Item D. 3.
DATE 03/27/2025
TO Honorable Mayor and City Council Members
FROM Cora Dino, Interim Human Resources Director
SUBJECT Adopt a resolution approving a Side Letter to the Memorandum of Understanding (MOU) between the City of Newark and the Newark Police Association (NPA) to amend Section XXIII. Special Assignment Pay
SUMMARY AND RECOMMENDATION
The Police Department is currently experiencing an extended absence in the Communications Unit. There is currently no authority to provide acting pay to a Public Safety Dispatcher who is qualified and available to temporarily fill the Public Safety Dispatch Supervisor role during a long-term absence. Staff recommends City Council adopt a resolution to approve a Side Letter with the Newark Police Association amending the MOU to apply acting pay to all members of the NPA.
BACKGROUND
All Memoranda of Understanding (MOU) and Compensation and Benefit Plans between the City of Newark and its employee groups contain a section covering the benefits of "Acting/Special Assignment Pay". With the exception of NPA, all classifications in each employee group are eligible for acting pay. The NPA MOU currently states that only Police Officers are eligible for acting pay as Police Sergeants when assigned by the Police Chief. There are 12 classifications included in NPA, including Public Safety Dispatcher and Public Safety Dispatch Supervisor. The Police Department Communications Unit currently has one Public Safety Dispatch Supervisor who performs the more complex police department communications unit functions. The essential duties of the Supervisor include supervising, directing, and evaluating other Communications Unit personnel; oversight of training or training of new employees; and managing schedules.
DISCUSSION/ANALYSIS
To provide continuous service and meet the needs of the Communications Unit in the Police Department, it is important that the duties of the Public Safety Dispatch Supervisor be completed on a regular basis. Managing schedules and supervising Public Safety Dispatchers are essential duties to ensuring 911 and non-emergency police calls are answered promptly and effectively 24/7. During extended absences or potential vacancies in the Public Safety Dispatch Supervisor position, experienced Public Safety Dispatchers may be available to temporarily perform the duties of the Supervisor role. This is a common practice in which acting pay is provided to staff as compensation for temporarily performing duties regularly performed by staff in a higher classification. In addition to ensuring coverage and service demands are met, temporarily filling a higher classification provides a professional development opportunity for employees to practice new skills and try out new roles that may be of personal interest. The City also gains from a succession planning perspective and increased organizational capacity.
The City and NPA have met and conferred regarding the change to MOU Section XXIII.
Special Assignment Pay, as it relates to acting pay. Attached is a Side Letter representing the agreement reached between the City and NPA.
FISCAL IMPACT
The anticipated cost for acting pay is approximately $3,000 to cover a 12-week absence beginning on February 22, 2025. There are no other known absences or vacancies in Fiscal Year 2025 or subsequent fiscal years. The expense can be absorbed by the FY 2025 Police Department personnel budget due to vacancy savings.
Should a similar extended absence arise in the future, corresponding costs would be addressed in subsequent budget updates.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWARK APPROVING A SIDE LETTER TO THE
MEMORANDUM OF UNDERSTANDING WITH THE CITY
OF NEWARK AND THE NEWARK POLICE ASSOCIATION.
WHEREAS, the City of Newark strives to provide the best possible service for its community, including the Communications Unit within the Police Department; and WHEREAS, in the event of a long-term absence or vacancy in the Public Safety Dispatch Supervisor position, Public Safety Dispatchers are not eligible for acting pay if asked to temporarily fill a substantial portion of the Supervisor duties; and WHEREAS, the Public Safety Dispatch Supervisor is a critical position which includes supervisory functions in addition to dispatch, training, and scheduling responsibilities; and WHEREAS, the current Memorandum of Understanding between the City and NPMA, effective July 1, 2019 through June 30, 2025, is currently in effect (the “MOU”); and WHEREAS, the City and NPA have met and conferred in good faith regarding changes to Section XXIII. Special Assignment Pay of the MOU related to acting pay; and WHEREAS, the City has considered and determined that the proposed side letter is proper and in the best interests of the City.
NOW THEREFORE, BE IT RESOLVED that the City Council hereby approves a side letter to the MOU, attached hereto and incorporated herein by reference effective February 22, 2025 and authorizes the City manager to execute the side letter and to take such further actions as may be necessary to implement the side letter to the MOU including any necessary nonsubstantive modifications.
City of Newark
City Manager’s Office
37101 Newark Boulevard
Newark, CA 94560
To: Newark Police Association (NPA) Executive Board
From: David Benoun, City Manager
Lenka Hovorka, Assistant City Manager
Date: March 13, 2025
This will serve as a side letter to the City of Newark (City) and the Newark Police Association (NPA) July 1, 2019 - June 30, 2025 Memorandum of Understanding (MOU). The purpose of this side letter is to address recent discussions between the City and NPA regarding acting pay for Public Safety Dispatchers. This side letter would be effective February 22, 2025 upon approval by the City Council.
Due to an identified need to temporarily fill the Public Safety Dispatch Supervisor position during an extended absence or vacancy, it would be beneficial for Public Safety Dispatchers to perform a significant portion of Public Safety Dispatch Supervisor duties and be eligible for acting pay.
The City and NPA agree to the following amendments to the MOU:
Section XXIII. of MOU:
B. Public Safety Dispatcher / Lead Public Safety Dispatcher Training Public Safety Dispatchers / Lead Public Safety Dispatchers formally assigned by the Police Chief to train Public Safety Dispatchers / Lead Public Safety Dispatchers as part of a formalized departmental training program shall receive a five percent (5%) salary increase during such assignment, which shall not affect the amount of holiday in lieu pay received while performing Public Safety Dispatcher / Lead Public Safety Dispatcher training duties. Public Safety Dispatchers and Lead Public Safety Dispatchers are not eligible for this salary increase when acting as Public Safety Dispatch Supervisor and receiving acting pay for that assignment.
C. Acting Pay
Employees assigned in writing by the Police Chief to perform the duties of a higher classification on an "acting" basis shall receive a five percent (5%) salary increase for hours worked from the first day of the acting assignment.
In the event an employee in an acting assignment is absent from work because of illness or injury, the City may terminate the acting assignment.
