Proclamation - Juneteenth

PROCLAMATION

JUNETEENTH FREEDOM DAY
WHEREAS, June 19th is declared as Juneteenth Freedom Day, a nationally recognized day which celebrates the rich culture, legacy, and heritage of Black and African American people; and WHEREAS, Juneteenth is the oldest known celebration commemorating the abolition of slavery in the United States, dating back to June 19, 1865, when Union soldiers led by Major General Gordon Granger arrived in Galveston, Texas with news that the war had ended, freeing the enslaved, two and a half years after President Abraham Lincoln’s Emancipation Proclamation; and WHEREAS, the U.S. Congress—between 1865 and 1870—would pass key amendments to the U.S.

Constitution, that upon ratification by each state, would profoundly change the legal status of those once enslaved. The thirteenth amendment abolished bonded servitude. The fourteenth amendment conferred citizenship upon those once enslaved. Finally, the fifteenth amendment enfranchised people once held in bondage; and
WHEREAS, recognizing Juneteenth as a state holiday acknowledges the importance of this historic day and honors the resilience, strength, and spirit of African Americans; it is a time for community gatherings, celebrations, and educational events that promote understanding, unity, and solidarity among all people; and WHEREAS, Juneteenth Freedom Day celebrates Black and African American people’s freedom and achievement, while encouraging continuous self-development and respect for all cultures, as it takes on a more national, symbolic and even global perspective, to ensure the events of 1865 are not forgotten.

NOW, THEREFORE, I, Michael K. Hannon, Mayor of the City of Newark, on behalf of the Newark City Council, do hereby proclaim June 19, 2025, as

JUNETEENTH FREEDOM DAY
in the City of Newark and call upon all residents to observe this day with reflection, celebration, and commitment to the ongoing pursuit of freedom, justice, and equality for all.

IN WITNESS THEREOF, I have hereunto set forth my hand and caused the Official Seal of the City of Newark to be affixed this Nineteenth Day of June, Two Thousand Twenty-five.

MICHAEL K. HANNON

Item  D. 3.

DATE 06/12/2025
TO Honorable Mayor and City Council Members
FROM Art Interiano, Deputy Community Development Director SUBJECT    Adopt a Resolution Authorizing the City Manager to Execute a Third Amendment to the Contractual Services Agreement with Good City Company for Professional Planning Services
SUMMARY AND RECOMMENDATION
Good City Company provides on-call planning services for high-level planning work, such as processing planning entitlements for large, complex planning projects and assisting with 2023-2031 Housing Element policy and program implementation tasks.

They assist the Community Development Department in achieving the capacity required to maintain customer service levels and complete priority policy and program tasks. To continue these services through the end of the calendar year, staff recommends that the City Council authorize the City Manager to execute the Third Amendment to the Good City Company CSA to increase the not-to-exceed amount from $359,250 to $674,250, an increase of $315,000.

BACKGROUND
The City has relied on professional consultants to provide services and experience that City staff are unable to provide, such as environmental review, technical or specialty planning type services and other additional services to supplement staff.  For example, the City has several CSAs with consultants for on-call professional city planning services, Public Works construction inspections, and civil engineering development plan review services. These CSAs allow the City to address service and experience needs while maintaining high customer service levels.

In September 2020, staff released a Request For Qualifications (RFQ) for planning firms to assist with staff augmentation, specialized studies, and other work.  In November 2020, the City Council approved CSAs with three firms, including Good City Company, that responded to the RFQ to provide specific on-call planning services. In March 2021, the City entered into a CSA with Good City Company for the not-to-exceed amount of $50,000 to provide professional planning services to perform critical customer service and plan review functions.

In February 2024, the City Council approved a First Amendment to the Good City Company CSA to increase the not-to-exceed amount to $150,000 due to the continued need for entry-level staff capacity to provide customer service, single-family design reviews, housing element support, and various building permit reviews.  A Second Amendment for the same general services was approved on October 10, 2024, which increased the not-to-exceed amount to $359,250. Good City Company has recently been involved with assisting the city with the implementation of various Housing Element programs. The State-certified Housing Element requires 40 programs to be completed by 2031.

DISCUSSION/ANALYSIS
The third amendment would extend Good City Company's existing scope of services through December 2025. The Community Development Department continues to need assistance with the current planning workload and various projects, such as implementing the 2023-2031 Housing Element. Implementation work includes preparing immediate and short-term Housing Element programs that are funded through the approved 2024-2026 Capital Improvement Program.

On-call planning services are also needed for planning work, such as processing entitlements for large, complex planning projects, and other related work. The current planning staff team is expected to remain above its capacity at least through the end of the 2025 calendar year. The on-call planning services requested will help achieve the service capacity required to maintain service levels and complete priority policy and program tasks.

FISCAL IMPACT
The Third Amendment to the Good City Company CSA increases the not-to-exceed contract amount by $315,000, from $359,250 to $674,250. Funding will be provided from two sources: the unencumbered balances of the Community Development Maintenance Fund (Fund 625) for housing policy program development and the Community Development Department’s Consultant and Professional Services Budget (120.50.052.520.6220) for planning services in Fiscal Years 2024–25 and 2025–26.

Sufficient budget is available in both accounts to support this contract amendment.

Item  D. 4.

DATE 06/12/2025
TO Honorable Mayor and City Council Members
FROM Michelle Villanueva, Senior Accountant
SUBJECT    Adopt a resolution establishing the Fiscal Year 2025-26 Tax Appropriations Limit
SUMMARY AND RECOMMENDATION
Staff recommends that the City Council, by resolution, establish a Tax Appropriations Limit and update the annual adjustment factors for Fiscal Year 2025-26.

In November 1979, California voters approved Proposition 4 (the Gann Initiative) that added Article XIIIB to the State Constitution. The State Legislature added Division 9 (commencing with Section 7900) to Title I of the Government Code to implement Article XIIIB as amended with Proposition 98 in 1988 and Proposition 111 in 1990.

The original legislation implementing the provisions of Article XIIIB became effective January 1, 1981. In accordance with that legislation, the governing body of each local jurisdiction in California must, by resolution, establish a Tax Appropriations Limit (also referred to as the GANN Limit) prior to the beginning of each fiscal year. The Tax Appropriations Limit is based on actual appropriations during the State of California Fiscal Year 1978-79 and adjusted each year using population and inflation adjustment factors.

BACKGROUND
California's voters approved Proposition 111 on June 5, 1990, amending Article XIIIB.

Proposition 111 allows local jurisdictions to choose among measures of inflation and population growth to compute the adjustment factor. The measures for inflation (price factors) include growth in California's per capita income or growth in the City’s gross assessed valuation due to new non-residential construction, while measures for population growth include population growth within the county or city.

In 2022, state policy required local agencies to report state subventions that would cause them to exceed local appropriations limits. The state would then count those that exceeded the local limits, at the state level instead. The state budget excluded certain local subventions from their limit, to avoid exceeding the Gann Limit. Local agencies must now include the state subventions within their appropriation limits.

DISCUSSION/ANALYSIS
On July 25, 2024, City Council adopted Resolution No. 11673 establishing the Fiscal Year 2024-25 Tax Appropriations Limit of $527,493,135. The City's Tax Appropriations Limit was calculated using the percentage change in California per capita income as the price factor adjustment since the local assessment roll data necessary to calculate the percentage change in the nonresidential assessed valuation is generally not available from the County Assessor's Office until well into the fiscal year. In the absence of final information on this important factor, it is recommended that the known California per capita personal income of 6.44 percent be adopted for Fiscal Year 2025-26. For the population adjustment factor, it is recommended that the City's percent change in population of 1.04 percent be adopted for Fiscal Year 2025-26 since the higher percentage change in population is most advantageous to the City.

In accordance with Proposition 111 guidelines, and based on the above information, the proposed Fiscal Year 2025-26 Tax Appropriations Limit is $567,302,915.

The 2025-26 biennial budget appropriations subject to the limit are estimated to be well below the proposed Tax Appropriations Limit.

FISCAL IMPACT
There is no fiscal impact associated with this administrative action. Establishing the annual appropriations limit does not modify existing revenue sources or expenditure levels. Rather, it ensures the City’s continued compliance with the constitutional requirements set forth in Article XIIIB of the California Constitution.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

NEWARK ESTABLISHING THE TAX APPROPRIATIONS

LIMIT AND UPDATING THE ANNUAL ADJUSTMENT
FACTORS FOR FISCAL YEAR 2025-26
WHEREAS, pursuant to Article XIIIB of the Constitution of the State of California, the City Council of the City of Newark has established a "Tax Appropriations Limit" for Fiscal Year 2025-26; and
WHEREAS, the provisions of Article XIIIB became effective January 1, 1981 requiring the governing body of each local jurisdiction in California to establish a Tax Appropriations Limit (also referred to as the GANN Limit) each fiscal year by resolution; and WHEREAS, Proposition 111 allows local jurisdictions to choose among measures of inflation and population growth to compute the adjustment factor. The measures for inflation (price factors) include growth in California per capita income or growth in the City's gross assessed valuation due to new non-residential construction; while measures for population growth include population growth within the county or city.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newark, in accordance with Proposition 111 guidelines, and based on the known adjustment factors of 6.44 percent change in California per capita income and a 1.04 percent change in the population growth for the City of Newark, hereby establishes the amount of $ 567,302,915 as the Tax Appropriations Limit for Fiscal Year 2025-26.

FROM Michael Carmen, Assistant Engineer
SUBJECT    Adopt a resolution approving the Road Repair and Accountability Act of 2017 (Senate Bill 1) Fiscal Year 2026 Project List SUMMARY AND RECOMMENDATION
In order to receive Road Maintenance and Rehabilitation Account (RMRA) funds from the California Transportation Commission (CTC), Senate Bill 1 requires that local agencies annually submit to CTC a list of streets to be preserved, treated, or rehabilitated using that fiscal year's RMRA funds.

Staff recommends that City Council, by resolution, approve the Road Repair and Accountability Act of 2017 (Senate Bill 1) Fiscal Year 2026 Street List, including the project locations listed below and in the attached resolution.

BACKGROUND
In April 2017, the State Legislature passed Senate Bill 1 (SB1), the Road Repair and Accountability Act of 2017.  SB1 established the Road Maintenance and Rehabilitation Program and provides a significant, stable, and ongoing increase in state transportation funding to address deferred maintenance on the state highway and local streets and roads systems.  Funds for the program are deposited into the State Transportation Fund, Road Maintenance and Rehabilitation Account (RMRA).  The funds come from gasoline excise taxes, diesel fuel sales taxes, and vehicle registration fees.

SB1 continues to generate over $5 billion annually for State and local transportation improvements.  Cities and counties are slated to receive approximately $1.5 billion per year for local street and road maintenance.  Allocations of funds to cities are based upon population.

The City of Newark is projected to receive approximately $1,285,134 of RMRA fiscal year 2026 funds.  This funding is in addition to the Highway Users Tax Account funds that the City receives annually (commonly known as "Gas Tax" funds).  RMRA funding is included as part of the City's 2024-2026 Biennial Budget and Capital Improvement Plan.

In order to receive RMRA funds from the State, SB1 requires cities and counties to submit to the California Transportation Commission each year a list of projects submit to the California Transportation Commission each year a list of projects proposed to be funded with RMRA funds.  RMRA funds are required to be used towards projects which include, but are not limited to:

Road maintenance and rehabilitation
Safety improvements
Railroad gate separations
Traffic control devices
Complete street components, which include active transportation elements, pedestrian and bicycle safety improvements, transit facilities, and drainage and stormwater capture measures in conjunction with other allowable projects

DISCUSSION/ANALYSIS
The City of Newark is projected to receive approximately $1,285,134 of RMRA fiscal year 2026 funds.  Staff recommends that City Council approve the following street list for RMRA Fiscal Year 2026:

Street Name and Limits of Treatment:

Aralia Drive - between Smith Avenue and Smith Avenue
Barnard Street - between Lafayette Avenue and Bellhaven Avenue Bellhaven Avenue - between Newark Boulevard and Christine Street Bellhaven Place - between Bellhaven Avenue and End
Bellflower Drive - between Smith Avenue and Birch Street Blackburn Drive - between Chapman Drive and Portsmouth Avenue Camass Court - between Starflower Street and End
Castleford Court - between Lake Boulevard and End
Chestnut Street - between Thornton Avenue and Juniper Street Cleremont Drive - between Orleans Drive and Orleans Drive Concord Street - between Fountaine Drive and Montcalm Avenue The RMRA street list is neither binding nor inclusive.  Including streets on this list does not obligate the City to complete the street nor does it limit the flexibility of the City to use RMRA funds toward streets not originally included on the list, so long as the project meets the eligibility criteria listed above.

FISCAL IMPACT
There is no net fiscal impact to the General Fund associated with this action. The $1,285,134 in RMRA funding will be programmed for eligible capital improvement projects as outlined in the adopted 2024-2026 Biennial Budget and Capital Improvement Plan.

YEAR 2026 PROJECT LIST
WHEREAS, Senate Bill 1 (SB1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB1 includes accountability and transparency provisions that will ensure the residents of the City are aware of the projects in our community that are proposed for SB1 funding and which projects are completed each fiscal year; and
WHEREAS, the City must adopt by resolution each year a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB1, with such list of projects including a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and
WHEREAS, the City will receive an estimated $1,285,134 in RMRA funding in Fiscal Year 2026 from SB1; and
WHEREAS, this is the ninth year in which the City is receiving SB1 funding and the funding will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, and increase access and mobility options for the traveling public that would not have otherwise been possible without SB1; and
WHEREAS, the City used the 2024-2026 Capital Improvement Plan to develop the SB1 project list to ensure public input into our community’s transportation priorities; and WHEREAS, the City uses a Pavement Management System to develop SB1 project lists to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the community’s priorities for transportation investment; and WHEREAS, the funding from SB1 will help the City maintain and rehabilitate multiple street segments and help add active transportation infrastructure throughout the City this year and into the future; and
WHEREAS, the 2024 California Statewide Local Streets and Roads Needs Assessment found that the City’s streets are in “good” condition and this revenue will help the City maintain the overall quality of the City’s road system over the next decade; and WHEREAS, the SB1 project list and overall investment in the City’s local streets and roads infrastructure with a focus on basic maintenance and safety and investing in complete streets infrastructure will have significant positive co-benefits statewide.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newark does hereby approve the following list of newly and previously proposed projects to be funded in part or solely with Fiscal Year 2026 Road Maintenance and Rehabilitation Account revenues:

DATE 06/12/2025
TO Honorable Mayor and City Council Members
FROM Tonya Connolly, Maintenance Superintendent
SUBJECT    Hearing to consider property owners' objections to the 2025 Weed Abatement Program and instruction to the Superintendent of Streets to abate the public nuisances
SUMMARY AND RECOMMENDATION
The City of Newark and Alameda County Fire Department (ACFD) Fire Prevention Bureau conduct an annual weed abatement program as a fire prevention measure.

Vacant properties with the potential for extensive weed growth are typically included in the program.  Owners of these properties have the option to either complete abatement work themselves or have the work completed by a City contractor through this program. If objections are received prior to or during the public hearing, the City Council should consider the objections, and then allow or overrule the objections by motion. Staff recommends that the City Council, by motion, act upon any objections by property owners to the 2025 Weed Abatement Program, and instruct the Superintendent of Streets to abate the public nuisances.

BACKGROUND
The City of Newark conducts an annual Weed Abatement Program to abate weeds on vacant properties that are not maintained by property owners to the satisfaction of the Alameda County Fire Department (ACFD) Fire Prevention Bureau.  The program is authorized by, and conducted pursuant to, Government Code Sections 39560, et seq.

The abatement work typically consists of tractor mowing, supplemented with manual labor to clear weeds abutting fences and to remove debris to facilitate tractor work.

Property owners have the option to make their own arrangements for weed and debris removal.  All properties on which the City performs abatement work would be assessed the full cost of that work, including administrative costs.  Administrative costs are 20% of the cost of the weed abatement services pursuant to the adopted Fiscal Year 2024-25 Master Fee Schedule.

At the May 8, 2025, City Council meeting, the City Council initiated the 2025 Weed Abatement Program and set June 12, 2025, as the date for a public hearing to hear any objections from property owners. Property owners were sent pre-paid postcards following the City Council's initiation of the 2025 Weed Abatement Program and were asked to return those postcards by June 9, 2025, to advise the City if they would abate the weeds themselves.

DISCUSSION/ANALYSIS
There are approximately 120 industrial, residential, and commercial parcels that have large areas of vacant ground with regular seasonal weed growth that could develop into a fire hazard if not properly maintained.  These parcels are located throughout the City and are listed on Schedule "A". Property owners choosing to complete weed and debris removal themselves must complete the work prior to June 16, 2025, the date the City's contractor is scheduled to perform the weed abatement work.

At the time of writing this staff report, no written objections to abating weeds on the identified parcels have been received.  If the weeds on these parcels are not abated in a timely manner, the City's contractor will start the work on June 16, 2025.  This provides property owners ample time to complete the abatement work.  If objections are received prior to or during the public hearing, the City Council should consider the objections, and then, by motion, allow or overrule the objections.  The City Council may then instruct the Superintendent of Streets to abate the public nuisance on the parcels remaining in the program.

FISCAL IMPACT
The 2024-2026 Biennial Budget and Capital Improvement Plan includes sufficient funding in the Maintenance Division's cost center (Fund 140.60.064.641.6221) to support the 2025 Weed Abatement Program.  Any necessary abatement efforts are anticipated to be funded within the existing allocation.  If additional funds are required, staff will return to the City Council with a budget amendment request.

DATE 06/12/2025
TO Honorable Mayor and City Council Members
FROM Michelle Villanueva, Senior Accountant
SUBJECT    Public Hearing to consider adoption of a resolution approving the Fiscal Year 2025-26 Master Fee Schedule and related fee adjustments
SUMMARY AND RECOMMENDATION
The proposed amendments to the City’s Master Fee Schedule (MFS) for Fiscal Year 2025-26 reflect the City’s annual review of service-related fees to ensure alignment with the actual cost of providing services and to support full or partial cost recovery where appropriate. The updated fee schedule incorporates input from all relevant City departments and includes adjustments to selected existing fees, the introduction of new fees, and technical updates to account codes.

If adopted, the amended MFS will take effect on July 1, 2025, except for certain development fees, which, in accordance with California Government Code Section 66017(a), will take effect 60 days after the date of City Council adoption.

Staff recommends that the City Council adopt, by resolution, the proposed amendments to the City’s Master Fee Schedule (MFS) for Fiscal Year 2025-26.

BACKGROUND
The City of Newark conducts an annual review of its Master Fee Schedule (MFS) to ensure fees are aligned with the actual cost of delivering services. Regular updates allow the City to more accurately recover costs and reduce reliance on the General Fund for programs that offer limited community-wide benefit, thereby supporting long-term financial sustainability. This review process is collaborative across departments and includes a comprehensive analysis of both direct and indirect costs.

In accordance with the Cost Recovery Policy adopted with the Fiscal Year 2024–25 MFS, the City seeks to balance financial responsibility with equitable access, ensuring that service costs are fairly shared between general taxpayers and individual fee-payers. This approach promotes fairness and strengthens the City’s overall fiscal health.

The last comprehensive update to the MFS occurred in November 2024, following a full cost-of-service analysis. For Fiscal Year 2025–26, due to the unavailability of finalized employee salary data amid ongoing labor negotiations, no across-the-board fee increases are proposed. Instead, the proposed MFS includes targeted adjustments to select fees, while others remain unchanged. This approach is consistent with the policy’s allowance for exceptions based on legal, labor, or market conditions.

DISCUSSION/ANALYSIS
The proposed Fiscal Year 2025–26 Master Fee Schedule reflects updated fees based on cost recovery principles and input from City departments.

A summary of the proposed changes is provided in Exhibit A and includes the following:

Adjustments to existing fees to meet cost recovery goals, including increases and decreases;
New staffing fees for recreation programs that require staff assistance or are governed by specific agreements;
Additions and revisions in Recreation Services, such as athletic field prep fees, updated rental terminology, and increased Aquatic Center rental fees to reflect facility enhancements;
Revisions to minimum rental hours for select facilities; Changes to Fire Services fees, including new state-mandated inspection fees and updates to Fire Code Operational Permits;
Removal or simplification of outdated administrative charges, such as physical Newark Municipal Code reproductions;
Updated account codes to improve financial tracking;
Decreases in various impact fees based on changes to the Engineering News Record Construction Cost Index.

These updates promote transparency, support fiscal sustainability, and ensure alignment with the City’s adopted financial and cost recovery policies.

FISCAL IMPACT
Revenue from the updated fees will help offset the cost of delivering City services and will be allocated to the appropriate budgeted accounts. These adjustments are essential to maintaining cost recovery targets and ensuring long-term service sustainability. The approved changes will take effect on July 1, 2025, except for development fees, which, per State law, will become effective 60 days following the adoption of the resolution.

SUMMARY OF PROPOSED CHANGES
GENERAL FUND – ADMINISTRATIVE SERVICES
• Removed Newark Municipal Code Reproductions being that the code is available online and downloadable/printable and staff no longer receives requests for physical copies.
• Expanded returned check fee now includes returned E-checks.

GENERAL FUND – POLICE SERVICES
• Updated account number for administrative accuracy.
• Updated Alarm User’s Permit Application to a flat fee.

GENERAL FUND – FIRE SERVICES
• Changed Fire Code Operational Permits to a one-time cost, rather than annual being that it is issued until revoked.
• Added fees for state mandated fire inspections.

RECREATION AND COMMUNITY SERVICES
• Staffing fees were standardized to ensure consistent charges across all programs that require staff assistance or are governed by specific agreements. • A fee was added for staff to perform athletic field preparations—such as chalking lines and dragging baseball and softball fields—when requested by the group users.
• Updated the minimum rental hours required for select rental areas. • Revised certain rental sections to incorporate more inclusive and general terminology for field rentals—for example, using “ball fields” instead of specifying “softball” or “soccer” fields.
• Increased the maximum rental fees for the Aquatic Center parties and rentals to align with recent enhancements, including upgraded amenities and cabana fixtures. The updates enable services to be bundled into party packages that include guest admission, food options, oversized games, and more while providing a private, reserved space on the pool deck.

CONSTRUCTION ENTERPRISE
• The proposed adjustments decrease the Park Impact, Capital Facilities, Community Service/Facilities, Transportation, and Housing Impact Fees by 0.9% based on the San Francisco Engineering News Record Construction Cost Index per Resolutions, 10,505, 10,633, 10,634, 10,635 and 10,184, respectively.
