City Council Meeting
of January 1 1, 2022
AUTHORIZATION OF FINANCE DIRECTOR TO SUBMIT LOCAL TRANSPORTATION FUND CLAIM FOR FISCAL YEAR 2021/22 OTHER PURPOSES
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution 2022-, approving the Local Transportation Fund Claim for FY 2021/22 Other Purposes; and
2. Authorize the Finance Director to execute the claim on behalf of the City of Newman.
BACKGROUND:
In accordance with the Transportation Development Act, the Stanislaus Council of Governments, acting as administrator, allocates an amount of Local Transportation Funds (L TF) to each City and County for qualified transportation projects. Cities must submit claims based on calculated eligible amounts and budgeted projects. To claim those funds we need to submit this 2021 /22 Claim. Once the Newman City Council approves the claim, it will be submitted to the StanCOG Policy Board for approval.
ANALYSIS:
In 2018, the City was informed that Stan COG would be reallocating our L TF monies to other projects since we would be receiving Measure L funds. We've now been notified that we are eligible to receive an allocation, albeit a much smaller one than previously received. The item before the Council is a request for approval to submit the Local Transportation Development Act (TOA) Claim to StanCOG. This process will obtain the City's allocation of Local Transportation Funding for Other Purposes. The claim for $21, 119 .51 is to provide for bicycle and pedestrian facilities, and sidewalk repairs at various locations throughout our City.
FISCAL IMPACT:
There is no cost in submitting the claim. The claim will provide the City with a total of $21, 119 .51 to offset costs.
CONCLUSION:
This staff report is submitted for City Council consideration and possible action.
ATTACHMENTS:
1. Resolution 2022- ,
2. StanCOG L TF Claim forms for Fiscal Year 2021/22 Other Purposes Respectfully submitted,

CAPITAL FACILITIES FEES

Fiscal Year
2020-2021
Introduction
Prepared By:
City of Newman Finance Department
January 1, 2022
This Capital Facilities Fees Annual Report for Fiscal Year 2020-2021 has been prepared as an annual requirement by the State of California in accordance with Section 66006 of the Government Code. The City of Newman collects Capital Facilities Fees (CFF) on new development to fund infrastructure improvements that are necessary to accommodate new growth.
State law requires that the City make the following information available to the public for each separate fund on an annual basis, and that the City Council review that information at a public meeting. The law requires the report to include the following information for each individual fund for the fiscal year:
• The beginning and ending balance of the fund; and
• The amount of the fees collected and interest earned; and • The amount of refunds made; and
• A description of each interfund transfer or loan made by the fund; and • Identification of each public improvement on which fees were expended and the amount expended on each improvement; and
• Current Fees
If the agency no longer needs the funds for the purposes collected, or if the agency fails to make required findings, or perform certain administrative tasks prescribed by AB 1600, the agency may be required to refund, on a prorated basis to owners of the properties upon which the fees for the improvement were imposed, the monies collected for that project and any interest earned on those funds.
Beginning and Ending Balance of Funds, Amount of Fees Collected and Interest Earned
Table 1 "Combining Statement of Revenues, Expenditures, and Changes in Fund Balances" outlines .the beginning and ending balance of each fund for Fiscal Year 2020- 2021. Detailed expenditures are shown under each fund description. Furthermore, since this is a pay-as-you-go program, the City must accrue enough revenue to construct a project. This results in an "accumulation" of fund balances. The accumulation occurs until enough revenue is generated to construct a project.

There were a total of zero CFF refunds this fiscal year. Table 2 details the refunds as they occurred throughout the year. Refunds are not uncommon and can occur for a variety of reasons such as a property owner deciding not to build a project, but the fees were paid or at times an overpayment was paid.

Revenues
Table 3 "Five Year Revenue History of CFF Funds" illustrates the revenue over a fiveyear period. These funds are based on new development. In FY 2020/21, we saw our lowest revenue totals in the last five years. The revenue has declined by 59% from the previous year. This can be attributed to a lack of new home lots. The highest revenue year, during the last 5 years, for all funds was fiscal year, 2018119.

Capital Facilities Fees mitigate the impacts caused by new development on certain public facilities. The Funds are defined as follows:

Fund 40 - Public Facility Fees

Fund 41 - Supplemental Impact Fees

Memorandum

Agenda Item: 8.f.
To: City of Newman City Council vf 0
From: Kathryn Reyes, Director of Public Works f!"f--
Subject: Agenda Item No. 8.f. - Adopt Resolution approving the application for California Department of Parks and Recreation, Rural Recreation and Tourism Program for the Newman Nature Park and Authorize the City Manager to execute all documents.
To address California's diverse recreational, cultural and historical resource needs grant programs are available to support the health and wellness of Californians. The Rural Recreation and Tourism Program competitive grants will create new recreation features in support of economic, tourism, and health related goals.
The City of Newman's applied for a Proposition 68 Grant to construct the Newman Nature Park and was not funded. The Rural Recreation and Tourism Program is another grant opportunity that we can apply for using the same community outreach and application information we used previously. This new grant program seems like a good fit for our Nature.Park and we would like to apply for this grant.
As part of the application process a Resolution is required authorizing the City Manager to submit the grant application and execute all documents.

Agenda Item: ~
Per the requirements of AB 361, the attached Resolution would allow the legislative bodies of the City of Newman to continue hold teleconference meetings for the next 30 days.
RESOLUTION NO. 2022-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWMAN MAKING FINDINGS IN ACCORDANCE WITH AB 361 AND GOVERNMENT CODE SECTION 54953(e), AUTHORIZING REMOTE TELECONFERENCE MEETINGS FOR THE
LEGISLATIVE BODIES OF THE NEWMAN CITY COUNCIL
WHEREAS, on March 4, 2020 Governor Newsom declared a State of Emergency in the State of California pursuant to Government Code Section 8625 as a result of the threat of the Coronavirus (COVID-19) pandemic; and
WHEREAS, subsequently, in March 2020, in response to the COVID-19 pandemic, Governor Newsom issued Executive Orders N-25-20 and N-29-20. These orders suspended certain elements of the Brown Act and specifically allowed for legislative bodies as defined by the Brown Act to hold their meetings entirely electronically with no physical meeting place. On June 11, 2021, Governor Newsom issued Executive Order N08-2 l , which provided that the provisions in Executive Order N-29-20 suspending certain elements of the Brown Act would continue to apply through September 30, 2021; and WHEREAS, on September 16, 2021 Governor Newsom signed AB 361, which added subsection (e) to Government Code section 54953 of the Brown Act, and makes provision for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and WHEREAS, a required condition of AB 361 is that a state of emergency is declared by the Governor pursuant to Government Code section 8625, proclaiming the existence of conditions of disaster or of extreme peril to the safety of persons and property within the State caused by conditions as described in Government Code section 8558; and
WHEREAS, there has been a significant increase in COVID-19 cases in Stanislaus County due primarily to the Omicron variant of SARS-Co V-2, the virus that causes COVID-19. Emerging evidence indicates that the Omicron variant is far more transmissible than prior variants of the virus, may cause severe illness, and can be spread even by fully vaccinated individuals; and WHEREAS, the City Council now desires to adopt a Resolution finding that the requisite conditions exist for the legislative bodies of the City of Newman, as defined in the Brown Act, to conduct remote teleconference meetings without compliance with paragraph (3) of subdivision (b) of Government Code section 54953.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newman as follows:
1. The above recitals are true, correct and are incorporated herein by this reference.
2. The City Council hereby determines that as a result of the proclaimed State of Emergency in California due to the COVID-19 pandemic, and its continued spread in Stanislaus County and the City of Newman through the Omicron variant of SARS-Co V-2, which is far more transmissible than prior variants of the virus, may cause severe illness, and that even fully vaccinated individuals can spread the virus to others, holding meetings in person would present imminent risks to the health or safety of attendees.
3. The Mayor and legislative bodies of the City of Newman are hereby authorized and directed to take all actions necessary to carry out the intent and purpose of this Resolution including, continuing to conduct open and public remote teleconferencing meetings in accordance with the requirements of Government Code section 54953(e) and other applicable provisions of the Brown Act.
4. This Resolution shall take effect immediately upon its adoption and shall be effective until the earlier of (i) thirty (30) days after teleconferencing for the first time pursuant to Government Code section 54953( e ), or such time that the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3) to extend the time during which the legislative bodies of the City of Newman may continue to teleconference without compliance with paragraph (3) of subdivision (b) of Government Code section 54953.
The foregoing resolution was introduced at a regular meeting of the City Council of the City of Newman held on the 11th of January, 2022, by Council Member , who moved its adoption, which motion was duly seconded and it was upon roll call carried and the resolution adopted by the following roll call vote:
