Agenda Item: 8.d.
City Council Meeting
of March 8, 2022
AUTHORIZE CITY MANAGER OR FIRE CHIEF TO APPLY FOR AND EXECUTE ANY FUTURE
AGREEMENT WITH SAN JOAQUIN VALLEY AIR POLLUTION CONTROL DISTRICT FOR
FUNDING THROUGH THE PUBLIC BENEFIT GRANTS PROGRAM
RECOMMENDATION:
Adopt Resolution No. 2022- , Authorizing the City Manager or Fire Chief to apply for and execute any future agreement with San Joaquin Valley Air Pollution Control District for funding through the public benefit grants program.
BACKGROUND:
The San Joaquin Valley Air Pollution Control District regularly provides grant funding for equipment and vehicles that will assist in providing a direct air quality benefit to Valley residents. The District is currently providing funding opportunities under several components of its Public Benefit Grants Program to local public agencies. The program was developed and designed to meet the needs and challenges faced by Valley public institutions by providing funds towards a wide variety of clean-air, public benefit projects. The District is currently accepting applications from public agencies requesting funding, up to $20,000 per vehicle, for the purchase of new alternative-fuel vehicles.
ANALYSIS:
The Fire Department currently uses two command vehicles on a daily basis to provide enforcement, emergency response, and investigative services. One of the command vehicles has reached its end of life cycle and will be replaced, if approved, by a new subsidized Ford Interceptor Utility HEY SUV. This existing vehicle is a 2000 Chevy Silverado pickup truck used by the On-Call Officer. Due to the age of the vehicle repairs and parts are exceeding the vehicle's value. The other command vehicle will be an addition to the fleet and will primarily be assigned to the 9perations Battalion Chief. This vehicle, if approved, will be exactly the same as the other. These two new vehicles will allow the Fire Department to continue providing efficient and effective rapid emergency response. These vehicles are listed on the Public Benefit Grants Program - New Alternative Fuel Vehicle Purchase On-Road Eligible Vehicle List under the subcategory of Hybrid Electric Vehicles - Law Enforcement Only.
FISCAL IMPACT:
Participation in the Public Benefit Grants Program would be to offset the purchase price of two (2) - Ford Interceptor Utility HEY SUV. The price per vehicle is estimated at $44,070.00 making the total project cost $88, 140.00. If approved the grant would cover $40,000.00. The new vehicles will be a part of the Fire Department FY 2022-2023 budget request. The project would also meet the shared cost agreement established with West Stanislaus County Fire Protection District. This agreement splits the cost of vehicles and equipment with the Fire District 50/50. This would ultimately reduce the City's project cost to $24,070.00 during fiscal year 22-23.
CONCLUSION:
The Fire Department has a need to replace existing command vehicles that provide enforcement, emergency response, and investigative services on a daily basis. The goal of the Fire Department is to efficiently and effectively provide service to the community and surrounding area.
Therefore, staff recommends that the City Council adopt Resolution 2022- , Authorizing the City Manager or Fire Chief to apply for and execute any future agreement with San Joaquin Valley Air Pollution Control District for funding through the public benefit grants program.

Per the requirements of AB 361, the attached Resolution would allow the legislative bodies of the City of Newman to continue hold teleconference meetings for the next 30 days.
RESOLUTION NO. 2022-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWMAN MAKING FINDINGS IN ACCORDANCE WITH AB 361 AND GOVERNMENT CODE SECTION 54953(e), AUTHORIZING REMOTE TELECONFERENCE MEETINGS FOR THE
LEGISLATIVE BODIES OF THE NEWMAN CITY COUNCIL
WHEREAS, on March 4, 2020 Governor Newsom declared a State of Emergency in the State of California pursuant to Government Code Section 8625 as a result of the threat of the Corona virus (COVID-19) pandemic; and
WHEREAS, subsequently, in March 2020, in response to the COVID-19 pandemic, Governor Newsom issued Executive Orders N-25-20 and N-29-20. These orders suspended certain elements of the Brown Act and specifically allowed for legislative bodies as defined by the Brown Act to hold their meetings entirely electronically with no physical meeting place. On June 11, 2021, Governor Newsom issued Executive Order N08-2 l, which provided that the provisions in Executive Order N-29-20 suspending certain elements of the Brown Act would continue to apply through September 30, 2021; and WHEREAS, on September 16, 2021 Governor Newsom signed AB 361, which added subsection (e) to Government Code section 54953 of the Brown Act, and makes provision for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and WHEREAS, a required condition of AB 361 is that a state of emergency is declared by the Governor pursuant to Government Code section 8625, proclaiming the existence of conditions of disaster or of extreme peril to the safety of persons and property within the State caused by conditions as described in Government Code section 8658; and
WHEREAS, there has been a significant increase in COVID-19 cases in Stanislaus County due primarily to the Omicron variant of SARS-CoV-2, the virus that causes COVID-19. Emerging evidence indicates that the Omicron variant is far more transmissible than prior variants of the virus, may cause severe illness, and can be spread even by fully vaccinated individuals; and WHEREAS, the City Council now desires to adopt a Resolution finding that the requisite conditions exist for the legislative bodies of the City of Newman, as defined in the Brown Act, to conduct remote teleconference meetings without compliance with paragraph (3) of subdivision (b) of Government Code section 54953.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newman as follows:
1. The above recitals are true, correct and are incorporated herein by this reference.
2. The City Council hereby determines that as a result of the proclaimed State of Emergency in California due to the COVID-19 pandemic, and its continued spread in Stanislaus County and the City of Newman through the Omicron variant of SARS-CoV-2, which is far more transmissible than prior variants of the virus, may cause severe illness, and that even fully vaccinated individuals can spread the virus to others, holding meetings in person would present imminent risks to the health or safety of attendees.
3. The Mayor and legislative bodies of the City ofNewman are hereby authorized to take all actions necessary to carry out the intent and purpose of this Resolution including, continuing to conduct open and public remote teleconferencing meetings in accordance with the requirements of Government Code section 54953(e) and other applicable provisions of the Brown Act.
4. This Resolution shall take effect immediately upon its adoption and shall be effective until the earlier of (i) thirty (30) days after teleconferencing for the first time pursuant to Government Code section 54953( e ), or such time that the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3) to extend the time during which the legislative bodies of the City of Newman may continue to teleconference without compliance with paragraph (3) of subdivision (b) of Government Code section 54953.
The foregoing resolution was introduced at a regular meeting of the City Council of the City of Newman held on the gth of March, 2022, by Council Member , who moved its adoption, which motion was duly seconded and it was upon roll call carried and the resolution adopted by the following roll call vote:

RECOMMENDATION:
1. Conduct Public Hearing
REPORT ON NUISANCE ABATEMENT
Agenda Item: 9.a.
City Council Meeting
of March 8, 2022
2. Adopt Resolution No. 2022- , Declaring The Existence Of A Public Nuisance Under Ordinance No. 95-4.
BACKGROUND:
On April 25, 1995, the Newman City Council adopted Ordinance No. 1995-4, amending Chapter 2 of Title 8 of the Newman City Code, now referred to as Chapter 8.02. The purpose and intent of Chapter 8.02 is as follows:
1. To define as public nuisances and violations of [the] Code those conditions which are considered harmful and/or deleterious to the public health, safety, and welfare of the citizens of the City;
2. To develop regulations which will promote the sound maintenance of property and the enhancement of the livability, the community appearance, and the social, economic, and environmental conditions of the community; and
3. To establish guidelines for the correction of property maintenance violations and nuisances which afford due process and procedural guarantees to affected property owners.
Per NCC §8.02.030, "It shall be unlawful for any responsible person to keep or maintain premises under his/her control, in a condition detrimental to the public health, safety, or general welfare" and "No responsible person owning, managing or having control or charge of occupancy of any building, lot or premises within the City shall permit public nuisances of any kind as defined in [Chapter 8.02] to remain upon said premises or upon or over public sidewalks, streets or alleys between said premises and the center line of any public street or alley".
ANALYSIS:
As required by NCC §8.02.060, Notice and hearing for abatement of nuisances, a notice informing property owner(s) of the existence of a nuisance, abatement deadline, nuisance abatement procedures, and their right to object at a public hearing was sent to the property owner(s). Historically, many property owners comply with abatement notices prior to the posted hearing date. A final compliance survey of the subject property(ies) will be completed on Monday, March 8, 2022. Properties that have satisfactorily abated their specific nuisance(s) will be removed from the Abatement List prior to the public hearing.
FISCAL IMPACT:
None, abatement costs shall be recompensed to the City via a property lien (as provided in NCC §8.02.090).
CONCLUSION:
Public nuisances and violations of City Code are considered harmful and/or deleterious to the public health, safety, and welfare of the citizens of the City of Newman. The abatement of said nuisances enhances the livability, community appearance and the social, economic, and environmental conditions of the City. Therefore, staff recommends that the City Council conduct the public hearing and adopt Resolution No. 2022-, Declaring The Existence Of A Public Nuisance Under Ordinance No. 95-4.

Honorable Mayor and Members
of the Newman City Council
Agenda Item: 10.b.
City Council Meeting
of March 8, 2022
AN ORDINANCE AMENDING TITLE 10; TRAFFIC REGULATIONS, AMENDING SECTION 10.04.030 TO
ESTABLISH PARKING RESTRICTIONS OF SEMI TRUCKS AND TRAILERS WITHIN CITY LIMITS RECOMMENDATION:
It is recommended that City Council introduce by title and waive first reading of Ordinance No. 2022- , amending Title 4 Building Regulations, Chapter 4.11 Floodplain Management Title 1 O; Traffic Regulations, Section 10.04.030 Parking Of Certain Size Vehicles, To Establish Parking Restrictions Of Semi Trucks And Trailers Within City Limits.
BACKGROUND:
The City currently permits semi-truck and trailer parking in the following areas: Merced Street between Eucalyptus Avenue and Hills Ferry Road, along the west shoulder of M Street between Kem Street and Merced Street, along the west shoulder of M Street between Merced Street and Inyo A venue, L Street from Merced Street to the south dead end, Stanislaus Street between M Street and L Street, Inyo Avenue between M Street and the eastern city limits, and all oflndustrial Way.
Since the inception of permitted semi-truck parking locations, the City has received complaints of unlawful semi-truck washing, obstructed views of the roadway as a result of parking, mechanical repairs, and semi-truck parking in unauthorized locations, including residential zones. Dating back to 2015, a brief search of the Newman Police Department database system located twenty documented complaints pertaining to these concerns. The aforementioned complaints have resulted in violations of state and local codes, presented traffic safety hazards, contributed to premature deterioration of roadways, and have been the cause of noise complaints in residential neighborhoods.
ANALYSIS:
Currently there is a gross of nearly 16,000 feet worth of permissible semi-truck and trailer parking within the City. It should be noted that private driveway accesses and intersections of cross streets are included within this total. There is "No Truck Parking" signage posted to pre-existing utility poles in other locations within the City and are posted approximately 300 feet apart. Recently, the number of semi-trucks and trailers parked in the permitted locations were counted at various times of day over the course of several weeks. It was found that an average of 23 semi-trucks utilize these parking locations. The greatest number of semi-trucks and/or trailers parked in these locations during this sample was found to be 30, and the fewest number of trucks was 18. The remainder of semi-trucks and trailers parked throughout the City are in violation of local code.
Rental space options are offered at various private commercial lands within the City at a cost of $100 per month.
These would provide parking options for semi-truck and trailers at a fee and would thereby not preclude any and all parking within the City. The lots are located nearby current authorized parking zones. It should be noted that this recommendation is only applicable to parking and does not limit or restrict pre-established semi-truck routes.
FISCAL IMPACT:
$5, 100.00 is the estimate for signage materials. This estimate does not include staff hours to erect the signs, which is estimated to be a week.
CONCLUSION:
There are currently several locations within the City in which semi-truck and trailer is permissible. Over the past several years the City has received complaints of unlawful parking of these vehicles in residential neighborhoods, illegal washing, and traffic safety hazards created by obstructed views. Therefore staff recommends City Council review the following options presented and provide direction:
1. Except upon the lands of private commercial property, prohibit any and all semi-truck and trailer parking within the city limits of the City of Newman with "No Truck Parking" signage posted at delineated increments in the formerly permitted parking zones. Violators would be subject to a daily administrative parking citation with the fine amount of $25.00.
Agenda Item: 10.b.
2. Leave the existing permitted semi-truck and trailer parking zones within the city limits of the City of Newman as is.
ATTACHMENTS:
1. Proposed Ordinance No. 2022- , Title 10, Chapter 4.
2. City of Newman map depicting current truck route and existing commercial vehicle parking.
