Honorable Mayor and Members
of the Newman City Council
Agenda Item: 8.d.

City Council Meeting
of August 9, 2022

APPROVE COMPENSATION RATES FOR THE FIRE DEPARTMENT STIPEND PROGRAM RECOMMENDATION:

It is recommended that the Newman City Council approve the compensation rates for the Fire Department stipend program.

BACKGROUND:

The Newman Fire Department is an all-risk volunteer-supported fire protection agency. The department has an agreement with West Stanislaus County Fire Protection District to share the cost of staff, apparatus, and equipment.

The Council approved the 22/23 fiscal year budget which includes the updated compensation rates for the fire department members. Per NCC 7.01.050 Compensation of Department members. The compensation of the members of the Fire Department, with the exception of the Fire Chief, shall be an amount recommended by the Fire Chief and approved by the City Council at the time the budget for each fiscal year is approved by the City Council.

ANALYSIS:

The compensation for a fire department member was previously based on a per-call basis. In years past, the members would receive $10.00 per call they responded to. The Fire Chief noticed a declin~ in the fire department participation and responses using this compensation rate and, therefore, conducted meetings with the membership.

The membership overwhelmingly addressed the inconsistencies and inability to leave work or home at a moment's notice. Their recommendation was to transition to a stipend program that would allow them to preschedule their shifts, which allowed them to pre-plan their participation. The recommendation also suggested that a per shift stipend be established to provide the members with nominal compensation for their dedication and service. The Fire Chief and members established the following recommendation for compensation per 24-hour shift/day:

1. On-Call Officer (OIC) - $225.00

2. Engine-Operator (ENOP) - $175.00

3. Firefighter II (FFII) - $125.00

4. Fire Prevention Officer (FPO) - $25 .00

5. Emergency Medical Technician (EMT) - $25.00 incentive

6. Call Back (CB) - $25.00 for significant incidents (Officer Approval Required) FISCAL IMPACT:

None. The compensation was approved in the 22/23 FY budget.

CONCLUSION:

The Newman Fire Department provides all-risk fire protection services while relying on a volunteer-supported membership. The volunteers provide a valuable service that saves the City of Newman at least a million dollars a year. The members have been challenged by the need to provide for themselves and their families while following their passion to protect their community. It is recommended the above compensation and participation model be implemented and effective as of July 1st, 2022 and the City retroactively compensate the members for any shift work. Staff recommends the Council approves this recommendation as required by NCC 7.01.050.

City Council Meeting
of August 9, 2022

VACATE THE SECTION OF STANISLAUS BETWEEN LAND M STREETS AND THE ADJACENT

ALLEYWAY IMMEDIATELY NORTH OF SAID SECTION
RECOMMENDATION:

Adopt Resolution No. 2022 - , vacating that section of Stanislaus Street between L and M Streets and the adjacent alleyway immediately north, measuring twenty feet wide by two hundred twenty-five feet long, between APNs 128- 018-004 and 010.

BACKGROUND:

In 2015, the City Council approved the vacation of Stanislaus Street from M Street to the railroad; directly across the street from the proposed abandonment. This action occurred as the railroad crossing at this location had become unsafe and impassable.

The City recently approved a purchase and sale agreement for that portion of Stanislaus Street between M and L Streets. Unfortunately, since that road was created prior to Newman becoming incorporated, the street was dedicated as an easement as opposed to fee title ownership the City now requires. Therefore, City staff is proposing the City vacate this section of Stanislaus Street.

ANALYSIS:

In reviewing the proposed segment of Stanislaus Street, staff found it to be in a state of underdevelopment. The street is unpaved and lacks curbs and gutters on the south side; for which the City does not have funding to correct.

In addition, the street receives very little traffic. The roadway does, however, contain a City waterline that services the property to the north. Based upon staff review, the water line can be accommodated through the placement of an easement prohibiting any permanent structures from be placed on top of it.

CA Streets and Highways Code §8324.b reads:

If the legislative body finds, from all the evidence submitted, that the street, highway or public service easement described in the notice of hearing or petition is unnecessary for present or prospective public use, the legislative body may adopt a resolution vacating the street, highway or public service easement. The resolution of vacation may provide that the vacation occurs only after conditions required by the legislative body have been satisfied and may instruct the clerk that the resolution of vacation not be recorded until the conditions have been satisfied.

In reviewing the 2030 General Plan, staff finds that Stanislaus Street is not classified as either a Collector or Arterial roadway nor does it provide a critical linkage between Collector and/or Arterial roadway(s). This specific section of Stanislaus Street is unnecessary for movement in the area, underdeveloped (not paved), and the City lacks funding to installed the necessary improvements.

In speaking with Public Works staffand reviewing the City's utilities map, it has been determined there are City utilities located within the portion of right-of-way that would be vacated. As a result, Staff recommends that an easement be placed over the utilities prior to recordation of the Resolution.

ENVIRONMENTAL: .

The proposed vacation proceedings are exempt from California Environmental Quality Act (CEQA).

FISCAL IMPACT:

None.

CONCLUSION:

After receiving a request from the adjacent property owner, staff has reviewed the possibility of vacating the portion of Stanislaus Street between L and M Street and the adjacent alleyway immediately north, measuring twenty feet wide by two hundred twenty-five feet long, between APNs 128-018-004 and 010. Staff has found that this portion of Stanislaus Street is not identified within the 2030 General Plan as necessary for future development nor is it necessary to implement the City's infrastructure master plans. As a result, staff recommends the Council approve the attached resolution.
