First Report. RE: City of Newman/ Vazquez, Domingo. Our file no.: FR 100841 Please consider this email as our First Report to the City.
Per our review, the claim filed by Domingo Vazquez on January 3, 2023 was timely and sufficient.
After further review, it would be our recommendation to consider the claim for rejection. If/when issued to the claimant, please provide us with a copy Form G.
According to the Claim Form, on January 16, 2023, the claimant drove through a flooded area at Driskel Avenue and Decoy Lane and damaged his tire and rim on an unsecured "sewer" cover. The claimant was seeking $1,353.83 in damages from the City for the tire and rim.
According to the information from the City (Perfecto), see below, the City was notified of the flooding at the aforementioned streets that same morning at 5:30 a.m. There were no prior complaints to the City. The City reacted immediately and switched the pumps from AUTO to Hand. The two pumps started pumping and the levels started to go down. Perfecto noticed on Driskell Avenue that three storm drain covers were pushed away from their rims. In his opinion, the storm lines were overwhelmed and the same water pushed the covers out of the rims. However, since the street was.flooded, no one would have and/or could have known that the covers were off.
Perfecto also added that they had a rain event on Sunday night, January 15, 2023 into early Monday, January 16, 2023 that delivered approximately 1.2 inches of rain. The storm system was overwhelmed during the rain event and possibly provoked a communication issue with the pumping station. The pumps were checked on Sunday morning, January 15, 2023 and they were fine. Perfecto also had never seen storm drain covers pushed out from heavy rains in his 22 years with Public Works.
Based upon our investigation, we found no evidence of negligence and/or liability on the part of the City of Newman because the City was not aware of the flooding and/or uncovered storm drain covers until the early morning of January 16, 2023. The storm drains could not handle the excessive amount of rain in such a short period of time. However, as soon as the City became aware of the situation they remedied it. There was no prior notice regarding the uncovered storm drains. There was nothing else the City could have done differently to have prevented this event and/or claim incident. Furthermore, the claimant chose to drive through a flooded street not knowing what he might be driving into.
The claimant assumed that risk.
Therefore, in addition to the City's rejection, should the City elect to reject the claim, it would be our recommendation that we (AIMS) provide the claimant with a denial letter. A copy of which would be provided to the City.
We have advanced our diary 120 days. Should any further correspondence be received in the interim, please advise.
Thank you,
Suzanne E. Johnson

City Council Meeting
of February 14, 2023
A RESOLUTION AUTHORIZING THE AUTOMATIC ANNUAL INFLATION ADJUSTMENT FOR CAPITAL FACILITY AND IMPACT FEES FOR THE PERIOD OF MARCH 1, 2023 THROUGH FEBRUARY 29, 2024
RECOMMENDATION:
1. Conduct a Public Hearing
2. Adopt Resolution No. 2023- authorizing the Automatic Annual Inflation Adjustment for Capital Facility and Impact Fees for the Period of March 1, 2023 through February 29, 2024.
BACKGROUND:
In April 2002, the City Council adopted Resolution No. 2002-22 approving the comprehensive update of Capital Facility and Impact Fees. The resolution provides for the automatic adjustment of the fees based on current construction indexes for the area. The following information is presented to the Council for review and approval.
ANALYSIS:
The City of Newman is considered a part of the Engineering News-Record's (ENR) San Francisco region. The 2022 ENR CCI inflation index for this region from Dec 2021 to Dec 2022 is a positive 5.3%; last year the CCI increased 8.0%. This increase has been applied to the Capital Facility and Impact Fees to originate new rates for the period of March 1, 2023 through February 29, 2024.
FISCAL IMPACT:
The adjusted rates will increase development fees due at time of development. For example, a vested single-family (Low Density) residential unit will go from $14,637.43 to $15,413.21 in impact fees. The adjusted fees apply to all development types; business park, commercial, industrial and residential.
CONCLUSION:
Staff recommends approval of Resolution No. 2023-, authorizing the Automatic Annual Inflation Adjustment for Capital Facility and Impact Fees for the period of March 1, 2023 through February 29, 2024. Upon approval, adjusted Fees will be initiated on March 1, 2023 and Notices will be forwarded to the BIA.

City Cost Index - San Francisco - As of December 2022
Share Share 116
The building and construction cost indexes for ENR's individual cities use the same components and weighting as those for the 20-city national indexes. The city indexes use local prices for portland cement and 2 X 4 lumber and the national average price for structural steel. The city's BCI uses local union wages, plus fringes, for carpenters, bricklayers and iron workers. The city's CCI uses the same union wages for laborers.

City Council Meeting

ADOPT MIDYEAR BUDGET CHANGES FOR FISCAL YEAR 2022-2023
RECOMMENDATION:
Review the budget adjustments as proposed in the report and adopt Resolution No. 2023- , adopting the midyear budget changes for fiscal year 2022-2023.
BACKGROUND:
It is customary for municipalities, midway through their fiscal year, to review their original budgeted revenue and expense projections. December 31st is the midway point of our fiscal year. Revenues and expenditures were analyzed for the 6-month period ending December 31, 2022.
ANALYSIS:
Exhibits A & B compare the budgeted revenues and expenditures to actual amounts received and spent through December 31, 2022 halfway through our fiscal year. Revenues and expenditures do not arrive in 1 /12 amounts each month. In Exhibit A, total General Fund Revenues collected are at 26.0% of budget, and revenues for all funds are at 25.0%. More revenues are typically collected in the second half of the year.
In Exhibit B, General Fund expenditures at December 31, 2022 are at 45.3% of budget and expenditures for all funds are at 33.5%.
To prepare the proposed adjustments, revenue and expenditure line items were analyzed and discussed with the City Manager, the various department heads, and their staff. Exhibits C & D contain the proposed revenue and expenditure budget adjustments by line item. The last column of Exhibit E shows the projected fund balances at June 30, 2023. It should be noted that the original budget, approved last June, only had estimated beginning fund balances; but, at this point, we have and use, actual/audited beginning fund balances to project our ending fund balances.
FISCAL IMPACT:
The City is requested the following changes to our staffing levels. The City Planner position will be eliminated and the Account Clerk I - Part Time and the Office Assistant I - Part Time positions will be changed to full-time. The Account Clerk I positon in the Finance Department will also assist the Recreation Department as their needs require.
The savings on the elimination of a management position will allow us to promote the two clerk level staffing positons to full time and save an estimated $76,000 per year. This will also provide us with more staff hours in positions that provide direct service to our residents.
Exhibit C shows no proposed budget changes to General Fund revenues at mid-year. Overall, General Fund revenues are projected to be 0.46% above our budget figures from the beginning of the year. Projected increases in Property Taxes, due to the newly negotiated agreement with Stanislaus County, and a grant for Animal Control services are projected to improve over earlier projections.
Exhibit D shows the detail of the expenditure budget adjustments totaling $126,400 in General Fund expenditures and $152,000 in other fund expenditures.
In our General Fund, at the beginning of the budget year, we projected expenditures to exceed revenues by $649,232. At this mid-year review, prior to any budget adjustements, we project an increase of $277,000. Staff desires to apply this surplus to several one time purchases that will still leave our General Fund with a surplus of $34,558.
CONCLUSION:
Exhibit Eis a projection of the ending fund balances of all funds. Funds typically should have a positive balance.
All of our funds are projected to have positive ending balances with the exception of Fund 20 - CDBG. The CDBG fund negative balance is due to a timing of project expenditures and grant receipts.
Agenda Item: 1 O.a.
The midyear budget review projects a General Fund ending balance of $4,140,278; an increase of $34,558 for the 2022-23 fiscal year. This will put us with a 68.8% General Fund reserve. The City has strong reserves and remains in good financial health.
