City Council Meeting
of March 28, 2023
AUTHORIZATION OF FINANCE DIRECTOR TO SUBMIT LOCAL TRANSPORTATION FUND CLAIM FOR FISCAL YEAR 2022/23 OTHER PURPOSES
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution 2023- , approving the Local Transportation Fund Claim for FY 2022/23 Other Purposes; and
2. Authorize the Finance Director to execute the claim on behalf of the City of Newman.
BACKGROUND:
In accordance with the Transportation Development Act, the Stanislaus Council of Governments, acting as administrator, allocates an amount of Local Transportation Funds (LTF) to each City and County for qualified transportation projects. Cities must submit claims based on calculated eligible amounts and budgeted projects. To claim those funds we need to submit this 2022/23 Claim. Once the Newman City Council approves the claim, it will be submitted to the StanCOG Policy Board for approval.
ANALYSIS:
In 2018, the City was informed that StanCOG would be reallocating our L TF monies to other projects since we would be receiving Measure L funds. We've now been notified that we are eligible to receive an allocation, albeit a much smaller one than previously received. The item before the Council is a request for approval to submit the Local Transportation Development Act (TOA) Claim to StanCOG. This process will obtain the City's allocation of Local Transportation Funding for Other Purposes. The claim for $16,157.00 is to provide for bicycle and pedestrian facilities, and sidewalk repairs at various locations throughout our City.
FISCAL IMPACT:
There is no cost in submitting the claim. The claim will provide the City with a total of $16, 157 to offset costs.
CONCLUSION:
This staff report is submitted for City Council consideration and possible action.
ATTACHMENTS:
1. Resolution 2023-
2. StanCOG LTF Claim forms for F.iscal Year 2022/23 Other Purposes Respectfully submitted,

Pursuant to the Health and Safety Code Section 40600.5, appointments to the District Governing Board will be made by the San Joaquin Valley Special City Selection Committee. Rosa Escutia-Braaton Candidate Application (2 pages)
2 February 24, 2023
To: San Joaquin Valley Air Pollution Control District
Attached please find my application for consideration to the San Joaquin Valley Air Pollution Control District Board. I believe my status as a Councilmember for District 1 of the City of Modesto (population 220,000) meets with the entrance requirements necessary for this opportunity.
Much of my work as Councilmember for the City of Modesto supports the District's vision of seeking to have healthful air that meets or exceeds air quality standards for all Valley residents. Some of these works include but are not limited to the following:
• As a Board Member for the Stanislaus County of Governments I actively seek to improve air quality in the region by coordinating with other organizations with common values and mission, including but not limited to:
o Collaborating with SJVAPCD, other MPOs, and the Environmental Protection Agency to resolve air quality issues to meet state and federal regulations; o Analyzing air quality impacts from mobile sources (ie cars, and trucks) emissions and inform member agencies about air quality programs and Federal air quality regulations, and o Monitoring and responding to the air quality conformity regulations for the region, including State and Federal Clean Air Acts.
• As a previous member of the Stanislaus County Waste to Energy Joint Power Authority. o I addressed critical issues that impacted air quality in our region; and o heard public testimony regarding negative impacts to disadvantage communities due to landfills, waste treatment plants and other environmental contributors.
Growing up the youngest in a farming family the environmental impacts of air quality were highly visible to me and my family:
• While my mother and father worked in the fields harvesting the fruit/vegetable product they were directly exposed to chemicals and pesticides (from the air and ground); • My home and neighborhood play-grounds where directly across from a tomato cannery which filled the air with huge clouds of smoke from its refining plants; • Combined with the emissions from the dozens of trucks that drove in and around our neighborhood was so frequent that the dense and poignant smell of the air in my neighborhood was what I grew up thinking was normal.
In addition to my professional and personal experience referenced above, I bring the following experience that I believe may add value to the Board: I have served as a Planning Commissioner for the City of Modesto for seven years; and, have over 25 years of public policy experience in both private and public sectors, including serving a Gubernatorial Appointee to both Governor Davis and Governor Schwarzenegger.
Outside my professional endeavors I enjoy serving on non profit organizations such as American Heart Association, Latino Community Roundtable, and Stanislaus Medical Society Alliance.
Sincerely,
Rosa Escutia-Braaton

Agenda Item: 8.f.
Subject: Item No. 8.e. -Adopt Resolution No. 2023- , Opposing Initiative No. 21-0042Al On Jan. 4, 2022, the California Business Roundtable filed the "Taxpayer Protection and Government Accountability Act" or AG# 21-0042Al. On Feb. 1, 2023, the measure qualified for the November 2024 ballot.
The League of California Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly opposes this initiative.
Local government revenue-raising authority is currently substantially restricted by state statute and constitutional provisions, including the voter approved provisions of Proposition 13 of 1978, Proposition 218 of 1996, and Proposition 26 of 2010. The Taxpayer Protection and Government Accountability Act adds and expands restrictions on voters and local government tax and fee authority.
The Taxpayer Protection and Government Accountability Act would amend the California Constitution with provisions that limit voters' authority and input, adopts new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and penalties for violation of state and local laws. The measure significantly limits local government from collecting fees that are necessary to maintain core public services.
Therefore, staff recommends the Council adopt Resolution No. 2023- , Opposing Initiative No. 21-0042Al, the Taxpayer Protection and Government Accountability Act.
RESOLUTION NO. 2023-
RESOLUTION OPPOSING INITIATIVE 21-0042Al
WHEREAS, an association representing California's wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2024 statewide ballot; and WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and
WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure and our environment; and
WHEREAS, the measure may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and
WHEREAS, the measure puts billions of dollars currently dedicated to local services at risk and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and NOW, THEREFORE, BE IT RESOLVED THAT, the City of Newman hereby opposes Initiative 21- 0042Al.

DECLARE THE EXISTENCE OF A PUBLIC NUISANCE
UNDER ORDINANCE NO. 281 MISTLETOE ABATEMENT
RECOMMENDATION:
Agenda Item: 9.a.
City Council Meeting
of March 28, 2023
It is recommended that the Newman City Council adopt Resolution No. 2023-, a resolution declaring the existence of a public nuisance under Ordinance No. 281 Mistletoe Abatement.
BACKGROUND:
Broad leaf mistletoe is an evergreen parasitic plant that grows on a number of landscape tree species in California.
Mistletoe reduces growth in trees by utilizing the host mainly for water and mineral nutrients, and may kill them with heavy infestations. These plants produce small, sticky, whitish berries if they are female or pollen if they are male. The plant is typically spread to other trees from birds, and it is important to remove mistletoe before it is spread to other limbs or trees. The most effective method for control is through complete removal of the branch by mechanical pruning. Mistletoe cannot be completely eradicated; however it can be controlled through complete removal.
ANALYSIS:
Abatement notices for the removal of mistletoe were sent out on January 27, 2023 to 48 properties in accordance with City of Newman Municipal Code Chapter 9.06, Section 9.06.020 Notice to Abate. This notice informs property owners of all nuisance abatement procedures, options and their right to object at a public hearing. Several property owners removed the mistletoe. On March 2, 2023, the 15 properties remaining were served with certified letters to remove mistletoe and given a Public Hearing Notice. It is anticipated that additional property owners will comply with the abatement notices prior to the hearing date. A final compliance survey will be done on Tuesday, March 28, 2023. An updated list of properties that have not complied with the abatement notice will be read out loud at the council meeting prior to the public hearing. The final list will include the cost to the remaining property owners for the removal of mistletoe.
FISCAL IMPACT:
None
CONCLUSION:
Mistletoe is a parasitic plant afflicting a number of trees in the City. Abatement notices have been sent to the property owners of the infected trees in accordance with City Municipal Code Chapter 9.06. Therefore, staff recommends City Council adopt Resolution 2023- , a resolution declaring the existence of a public nuisance under Ordinance No. 281 Mistletoe Abatement.
