City Council Meeting
March 26, 2024

APPOINTMENT TO FILL A VACANCY ON THE ARCHITECTURAL REVIEW COMMITTEE RECOMMENDATION:

Appoint a new Historical Society Member to the Architectural Review Committee.

BACKGROUND:

The City has one (1) vacancy on the Architectural Review Committee. The vacant seat is for the Newman Historical Society member on the Committee and said vacancy was created by the recent resignation of long-term Architectural Committee and Historical Society Member Sheldon Crow.

As per City Code Section 4.13.060.B., the Council should strive to include a member from each of the following groups for the five member Architectural Review Committee: one Planning Commissioner, one Newman Historical Society member, one City resident at-large, one member of the business community and/or Chamber of Commerce and one professional in one or more of the following disciplines: Architecture; Architectural History; Historical Remodeling or Reconstruction, Historic Archaeology, Historical Conservation or related discipline to the extent such professionals are available in the community of Newman.

The City Council through its appointments to the Architectural Review Committee, has continued to make every effort to comply with City Code Section 4.13.060.B. and the intended makeup of the Committee while also acknowledging the difficulty in filling all of the Architectural Review Committee vacancies and understanding that such professionals are not always available.

The City notified the Newman Historical Society of the Architectural Committee vacancy on February 29, 2024 and then published a public notice for said vacancy in the West Side Index on March 6, 2024.

ANALYSIS:

The City has received one (1) application for the Architectural Review Committee vacancy. Brian K. Thompson submitted an application for citizen service and a copy of said application is attached for your review.

Brian Thompson is a member of the Newman Historical Society's Board of Directors and now wishes to serve as the Newman Historical Society member on the Architectural Review Committee. Appointing Mr. Thompson would comply with City Code Section 4.13.060.B. and fill the vacant Newman Historical Society member seat on the Committee with a member of the Newman Historical Society's Board of Directors.

This appointment to the Architectural Review Committee would be for the remainder of Newman Historical Society member's term on the Committee; said appointment would be effective immediately and expire in April 2025.

Honorable Mayor and Members
of the Newman City Council

DECLARE THE EXISTENCE OF A PUBLIC NUISANCE
UNDER ORDINANCE NO. 281 MISTLETOE ABATEMENT
RECOMMENDATION:

Agenda Item: 9.a.

City Council Meeting
of March 26, 2024
It is recommended that the Newman City Council adopt Resolution No. 2024- , a resolution declaring the existence of a public nuisance under Ordinance No. 281 Mistletoe Abatement.

BACKGROUND:

Broadleaf mistletoe is an evergreen parasitic plant that grows on a number of landscape tree species in California.

Mistletoe reduces growth in trees by utilizing the host mainly for water and mineral nutrients, and may kill them with heavy infestations. These plants produce small, sticky, whitish berries if they are female or pollen if they are male. The plant is typically spread to other trees from birds, and it is important to remove mistletoe before it is spread to other limbs or trees. The most effective method for control is through complete removal of the branch by mechanical pruning. Mistletoe cannot be completely eradicated; however it can be controlled through complete removal.

ANALYSIS:

Abatement notices for the removal of mistletoe were sent out on February 2, 2024 to 31 properties and three more notifications on February 20, 2024, in accordance with City of Newman Municipal Code Chapter 9.06, Section

9.06.020 Notice to Abate. This notice informs property owners of all nuisance abatement procedures, options and their right to object at a public hearing. Several property owners removed the mistletoe. On March 11, 2024, the 14 properties remaining were served with certified letters to remove mistletoe and given a Public Hearing Notice. It is anticipated that additional property owners will comply with the abatement notices prior to the hearing date. A final compliance survey will be done on Tuesday, March 26, 2024. An updated list of properties that have not complied with the abatement notice will be read out loud at the council meeting prior to the public hearing. The final list will include the cost to the remaining property owners for the removal of mistletoe.

FISCAL IMPACT:

None
CONCLUSION:

Mistletoe is a parasitic plant afflicting a number of trees in the City. Abatement notices have been sent to the property owners of the infected trees in accordance with City Municipal Code Chapter 9.06. Therefore, staff recommends City Council adopt Resolution 2024- , a resolution declaring the existence of a public nuisance under Ordinance No. 281 Mistletoe Abatement.

Mistletoe is the English common name for most obligate hemiparasitic plants in the order Santalales. They are attached to their host tree by a structure called the haustorium, through which they extract water and nutrients from the host plant.

AUTHORIZATION TO LEASE NEWMAN PRESCHOOL FACILITY
RECOMMENDATION:

Authorize City Manager to execute lease agreement for the Newman Preschool facility located at 1147 R Street.

BACKGROUND:

The Newman Co-Op Nursery School (Co-Op) has leased the Old Orestimba School House (measuring 1,040 square feet) located at 1147 R Street, immediately north of the Library in Densmore Park, since November 2000.

Unfortunately, due to the retirement of the original directors/teachers and a reduction in the number of parents who were able to participate in the programming, the Co-Op officially closed their doors last spring.

ANALYSIS:

Over the past few months, the City has been in communication with Ana Corona, who currently operates the Primeros Pasos Preschool (Primeros) at 1017 N Street (Hwy 33). She indicated a desire to operate a preschool facility at the 1147 R Street location. Primeros has operated at the N Street location since they secured Use Permit 2013-01; permitting a preschool in the Professional Office district. Since Primeros opened for business, the City has not experienced any issues with them operating out of the N Street location.

In February and March, City staff met with Ana to discuss her proposal. She indicated her desire to relocate her business off Highway 33 and to the R Street location. The goal is to be operational by the beginning of the next school year. After additional conversation, staff and Ana believe that the R Street location would be beneficial to the operator and the families that utilize the facility. In addition, the proposed location provides a safer environment during the drop-off/pick-up periods.

To ensure that the facility meets State standards, the City has agreed to perform some improvements including repairing the steps into the building, removal of a drinking fountain, and the addition a working stove. The terms of a lease are identified in Attachment 1.

FISCAL IMPACT:

Positive. Starting in Year 1 and escalating thereafter, the City will receive $6,000 per year in rent.

CONCLUSION:

City staff has evaluated the proposal from Ana Corona (Primeros Pasos Preschool) and finds that it would be mutually beneficial for the facility to relocate from its Highway 33 location to 114 7 R Street (Old Orestimba School House). Therefore, staff recommends the Council authorize the City Manager to execute a lease agreement with Ana Corona to operate the Primeros Pasos Preschool at 1147 R Street, ATTACHMENTS:
