Supervisor Condit Thanked Mayor Graham For Their Recent Meeting And Mentioned He Was Always Willing To Meet With The Council Members, Staff, And Members Of The Community.

Condit Reported That The Newman Police Department Received A Grant From San Joaquin Valley Air Pollution Control District To Purchase Electric Patrol Motorcycles With Some Assistance From His Office. He Invited Everyone To The State Of The County Address Ceremony On Thursday, April 25th At 5:30 P.M. At The Stanislaus County Modesto Library.

Council Member McDonald Congratulated Supervisor Condit And Thanked Him For All His Hard Work On Behalf Of His Constituents.

Mayor Graham Stated That Supervisor Condit Has Been An Outstanding Supervisor And Appreciated His Support Of The Newman And The Westside.

12. Items From The City Manager And Staff.

City Manager Holland Reported That There Would Be A Planning Commission Meeting In May To Consider A Forty-Two Lot Phase Two Of The Mattos Ranch Project With A Commercial Center Component For The Third Phase Of Said Project. Holland Explained That The NEWS Project Was Progressing At A Rapid Pace And Indicated That Said Project Was Scheduled To Be Completed By The End Of The Summer. He Noted That The Nature Park Drawings Were Thirty Percent Completed And It Was Anticipated That The Bid For The Park Would Be Awarded In The Spring Of 2025.

Holland Pointed Out That It Was Estimated That The Construction Of The Nature Park Would Be Completed Late In 2026. He Concluded By Stating That The Last Component And Final Phase Of The Newman Community Conservation Area Project Would Be To Continue Working With The University Of California, Merced On Their Planned Outdoor Laboratory.

Mayor Graham Asked Staff To Include A Rendering Of The Completed Project When Compiling The Progress Pictures To Present To The Community.

City Manager Holland Thanked Supervisor Condit For His Diligent Representation Of The Westside.

Holland Informed Everyone That The Public Works Director Position Was Open And That The City Was Actively Recruiting To Fill Said Position.

Recreation Director/Community Liaison Mendoza Reported That The Recreation Department Was Accepting New Registrations For The Girls Youth Basketball Summer League, And Kajukenbo Classes. Mendoza Noted That New Registrations For The Fit Kids Summer Program, And Youth Soccer Would Begin On Monday, April 29th. She Stated That The Free City Summer Movie Nights Would Take Place On June 15th, July 20th, And August 3rd.

Sergeant Williams Thanked The Community For Their Support Of The K9 Crab Feed Event. Williams Thanked Supervisor Condit’s Office For Their Letter Of Support To Purchase The Department's Electric Motorcycles And Noted That The Said Motorcycles Should Arrive In Two To Three Weeks.

She Reported That May Is Bicycle Safety Month And There Would Be Additional Grant Funded Enforcement.

Finance Director Humphries Reported That City Staff Was Currently Working On Preparing The City Budget To Be Presented To The City Council In June.

Chief Bowen Reported That The Fire Department Would Be Participating In The Arbor Day Event At Pioneer Park. Bowen Mentioned That The Department Would Also Be Participating In The Day Of The Child Event On The Upcoming Friday At Pioneer Park. He Stated That The New Recruits Would Be Doing Live Fire Training In Patterson On The Upcoming Weekend. Bowen Concluded By Noting That There Would Be An Explorer Post Meeting In Crows Landing On Thursday, April 25th.

REPORT ON NEWMAN FALL FESTIVAL 2024
RECOMMENDATION:

Staff recommends the City Council approve the annual Fall Festival.

BACKGROUND:

Agenda Item: 10.a.

City Council Meeting
of May 14, 2024
The Fall Festival is a well established annual community event. Staff has been working with the Fall Festival Committee in assisting with the allocation of City assets and services for this year's event.

ANALYSIS:

As of the date and time of the preparation of this staff report, the organizing committee is in the beginning stages of planning this year's event. Any subsequent changes will be reported out by staff during the presentation of this report and future reports.

Routine street closures and parade street closures are as follows:
•!• "R" Street - Will be closed between Fresno and Tulare Streets from Wednesday, August 28th at 12P.M. to Monday, September 2nd at noon. The carnival will be set up on this street. •!• Fresno Street - Will be closed between "R" and "Q" Streets from Saturday, August 31st at 5A.M. to Monday, September 2nd at 12 A.M.
•!• Tulare Street - Will be closed between "R" and "Q" Streets Sunday, September 1st from 7 A.M. to 7P.M. •!• "Q" Street - Will be closed between Fresno and Tulare Streets from Friday, August 30th at 6 A.M. to Monday, September 2nd at 12 A.M.
•!• Fall Festival Parade Street Closures 9 A.M. to 2 P.M. on Sunday, September 1st - Mariposa Street will be closed from "T" to Main Street, Main Street from Mariposa to Fresno, Fresno Street from Main to "R" Street.

The road will re-open when the parade passes. Horse staging will be on the 1100 block of R Street. •!• Main Street - Will be closed between Tulare and Fresno Streets Saturday, August 31st from 6 A.M. to 11 A.M.

Additional side streets along the course route will be "soft" or "rolling" closures controlled with crossing guards. The roadways will progressively re-open as the last runner passes.

Scheduled events with a potential impact include:
• The "An Evening Under the Stars" event (Wine and Cheese) has been tentatively scheduled in the Downtown Plaza for Friday, August 30th 7 P.M. to 11 P.M.
• The carnival will open at 12 P.M. on Friday, August 30th. On-stage family entertainment will be held at the Pioneer Park gazebo from 6 P.M. to 10 P.M.
• Tunnel to Towers 5k run will be held on Saturday, August 3151, from 8 A.M. to 11 A.M. and will begin and conclude in the Downtown Plaza.

The Fall Festival Committee has asked that the following downtown standards be waived for the "Evening under the Stars" event:
• Day of operation. This is a Friday event. Per standards, Sunday is the preferred day. • Hours of operation. This event is scheduled until 11 P.M. Per standards, events are to end by 9 P.M. • Music hours of operation. Amplified music is scheduled until 11 P.M. Per standards, music to cease by 8 P.M. • Clean-up deposit. Downtown standards require a $1,000.00 deposit refundable upon satisfactory cleaning of the affected area. The Fall Festival Committee assures staff that they will thoroughly clean up. • Waive ordinance 09.01.021, Drinking in Public, for the event area and timeframe. • Waive electrical and restroom use fees.
• Waive glass cup and bottle usage standard.

All other Standards for Downtown events will apply.

Agenda Item: 10.a.

Event organizers will be submitting a site plan for the event. There will be screened security fencing around the upper level with one entrance/exit at the archway on Main Street and one entrance/exit near the restrooms. There will be three private security guards hired by the Fall Festival Committee. One will staff each entrance/exit and one will remain inside the venue. The Fall Festival Committee will acquire all the necessary permits from the Alcoholic Beverage Control. All parking lots, alleys, and sidewalks will remain open for traffic.

The Fall Festival Committee has secured the $3,000,000.00 total aggregate insurance and liability policy with the city named as an additional insured. The organizing committee is requesting city services, as has been provided in past years, and is aware that any costs not covered by City Council action will be the responsibility of the Fall Festival Committee. The committee will also work with the Public Works Superintendent on the required number of portable restrooms, trash receptacles, and barricades as well as other needs in the park. There are no changes in this area as well, as these are the same requests as were approved by the City Council last year.

Other requests by the Fall Festival Committees are:

1. Waive Business License fees for vendors in the park

2. Exclusive use of Pioneer Park, Densmore Park, Barrington Park and the L.J. Newman building.

3. Waive permit to have alcohol in Pioneer Park.

4. Authorize the use of the entire Pioneer Park as a Beer Garden. (This has been approved by ABC in previous years.)

5. Public Works assistance with park maintenance prior to the event.

All sworn police personnel have been required to staff the Fall Festival throughout the weekend and only Reserve Officers and the School Resource Officer's salary have been invoiced to the Fall Festival. Previous security issues for this event have involved intoxicated subjects and altercations involving juveniles and young adults. The Fall Festival Committee is currently inquiring about mutual aid from allied agencies as opposed to contracting with private security to supplement the presence of Newman Police Officers for evening hours on Saturday, August 31st and Sunday, September 1st. Pending the cost of mutual aid, the Committee could propose financial assistance in order to provide increased safety to festival attendees. The Fall Festival Committee will retain a private security firm to cover additional carnival security and overnight park security.

FISCAL IMPACT:

The Police Department will fully staff the park with all available police personnel. Staff recommends that any applicable costs of staffing, or necessary equipment, be invoiced to the Fall Festival Committee.

CONCLUSION:

This staff report is submitted for City Council consideration and action. Staff recommends the City Council approve the 2024 Fall Festival.

STANDARDS FOR DOWNTOWN EVENTS

1. DAYS:

One Day Event: Saturday or Sunday preferred.

Two Day Events: Saturday & Sunday or Sunday & Monday may be allowed on weekends.

2. HOURS:

Events should be scheduled during daylight hours. Events may not begin prior to 7:00 a.m. or end later than 9:00 p.m. unless approved by the Chief of Police.

3. STREET USAGE:

First time event:

Anticipated crowd size:

4. INSURANCE:

One block
500 or less - one block
500 to I 000 - two blocks
1000 or more - three blocks
Three Million dollar policy naming the City as an additional insured. This must be received by the City three weeks prior to the event.

5. SECURITY:

Total cost of security for the event will be the responsibility of the event organizer. One half of the anticipated cost of police services will be deposited with the City Finance Department two weeks prior to the event.

General event: 1 officer per 200 attendees or as deemed necessary by the Chief of Police.

Alcohol/Bands/Dances - 2 officers per 300 attendees or more if required by the Chief of Police.

6. MUSIC:

No amplified sound systems before 10 A.M. or after 8 P.M. unless approved by the Chief of Police.

7. ELECTRICAL:

If electrical power use is requested, an electrical use fee of $25.00 will be collected prior to the event date.

A diagram of the outlet locations to be used and a plan, consisting of what type of equipment will be used at each outlet location, will be submitted for approval prior to the event date. No more than 20 amps per circuit will be allowed. Extension cords shall be a minimum of 14-3 gauge wire and properly sized for intended use. The cords shall be protected from abrasions caused by foot traffic and shall be placed so as not to cause a tripping hazard.

8. EVENT PLAN:

The applicant is to complete a street closure plan for barricading the downtown streets and provide a site plan for the location of any portable stages, alcohol sales, and other semi-permanent structures. This must be submitted to the Chief of Police or his/her designee 60 days prior to the date of the event. Downtown plaza usage will also require a site plan.

9. CLEAN UP:

The event organizer will be responsible for cleaning the streets, sidewalks and other public areas used by the event. A $1,000.00 deposit will be required. The deposit will be refunded if all city property is cleaned to the satisfaction of the Director of Public Works or his/her designee.

10. APPROVAL OF AFFECTED BUSINESSES:

First Time Events: Provide written approval of at least 75 percent of any business affected by the proposed street closure in the blocks involved.

Yearly Events: Provide a flyer making the downtown business community aware of the type of event, date, time and streets to be used.

Notification must be completed at least 45 days prior to the City Council meeting and must be approved by the Chief of Police or his/her designee.

11. BUSINESS LICENSES:

All local and out of town vendors/businesses conducting sales of goods or services shall have a business license with the City of Newman prior to participating in the event.

12. HEAL TH PERMITS:

Food vendors shall obtain a Stanislaus County Health Permit prior to the sale of any food items.

13. CANOPIES OR OTHER TEMPORARY STRUCTURES:

All temporary structures including but not limited to stages, platforms and booth structures must be inspected by the City's Building Department on the day of the event. Any direct cost to the City for this service will be the responsibility of the fundraiser/organizer. Any use of canopies must be inspected and approved by a designee of the City on the day of the event. No canopies or temporary structures are to be tethered or anchored, to any tree, structure, or fixture.

14. BLEACHERS:

All bleachers must be inspected by the City's Building Department the day of the event. Any direct cost to the City for this service with be the responsibility of the fundraiser/organizer.

15. ADVERTISING:

The event organizer shall not advertise or promote the event until the event has been approved by the City Council

16. ALCOHOL:

The sale or providing of alcohol shall be done under the following conditions:

A. That it is the fundraiser/organizers responsibility to make sure vendors obtain an on sale one-day permit from the California Alcohol Beverage Control Board (commonly known as ABC). This must be done and received by the City two weeks prior to the event.

B. That alcohol is served in paper or plastic cups (no glass cups or bottles).

C. That no alcohol sold inside any establishment can be consumed in the street closure area or plaza.

D. That the City Council approves the use of the street closure, or plaza, for a beer garden and that they waive the city ordinance prohibiting consumption of alcohol on public streets.

17. TRAFFIC/CROWD CONTROL DEVICES:

The fundraiser/organizer will be responsible for the direct cost of barricades, no parking signs, and any other required devices.

18. STATEMENT OF FUNDS
The fundraiser/organizer will provide documentation and/or a list of who has or will financially benefit from the fundraiser for the current event and any previous events. It will also state how much was raised and the amount or percentage that will or has been donated to what community organization(s).

19. TRASH AND RECYCLING RECEPTACLES
The event coordinator shall provide trash and recycling receptacles for the event in an amount not less than one per fifty attendees.

20. PLAZA USAGE
The standards for downtown events will apply to the downtown plaza where applicable.

Additional plaza-specific standards include:

A. The East parking lot will remain open for event parking.

B. Any requests to close the West parking lot will be submitted in the event plan.

C. Any request to open the plaza restrooms for use will be submitted in the event plan and will be subject to a use fee of $25.00 collected prior to the event date.

D. No use of any kind in the planters and other vegetation areas of the plaza.

E. No anchoring to any trees, vegetation, or other stationary plaza structures.

F. Use of the stage shall be requested in the event plan.

21. ADMINISTRATIVE OPTION FOR "PLAZA ONLY" USE
For smaller events that are contained within the plaza, an administrative option can be utilized with the following conditions:

A. The event is being hosted by a non-profit group for public benefit.

B. The event is contained within the pedestrian areas of the plaza.

C. All parking lots remain open and accessible for vehicle parking.

D. The event is no longer than three hours in duration.

The administrative option for plaza use will require approval from the City Manager, Chief of Police, and Fire Chief. This option is designed to streamline the process for smaller events that meet the above criteria.

All other event standards will still apply, but waivers may be decided by the administrative group.

APPROVING THE ANNUAL REPORT FOR THE LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT FOR FISCAL YEAR 2024/25
RECOMMENDATION:

Adopt Resolution No. 2024-, approving the annual report concerning the levy of assessments as submitted by NBS for the fiscal year commencing July 1, 2024 and ending June 30, 2025.

BACKGROUND:

Pursuant to the Landscape and Lighting Act of 1972 the City ofNewman has a total of 15 zones within the Lighting and Landscape Maintenance District (District) in various locations throughout the City. These zones represent the general nature, location and extent of improvements to be maintained, with an estimate of the costs to maintain and service the improvements. Improvements provided within the District include, but are not limited to, the weekly operation, maintenance, and servicing of all public landscaping improvements consisting of trimming and pruning, weed abatement, sidewalks, plant materials, pathways, irrigation systems, lighting systems, and graffiti removal.

Pursuant to provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with Section 22500) (the "Act"), that provides for the levy and collection of assessments by the County of Stanislaus for the City of Newman to pay for the maintenance and services of all improvements and facilities related hereto, the City Council has retained NBS for the purpose of assisting with the proposed assessments and to prepare and file an Annual Report for the District with the City Clerk.

ANALYSIS:

As required by the Landscape and Lighting Act of 1972 a resolution Initiating Proceedings for The Levy and Collection of Assessments and ordering the preparation of an Annual Engineer's Report for the Lighting and Landscape Maintenance District for Fiscal Year 2024/25 was adopted by the resolution at the April 23, 2024 City Council Meeting. Adopting this resolution will approve the Annual Report for the Lighting and landscape Maintenance District for Fiscal Year 2024/25.

CONCLUSION:

Pursuant to the Landscape and Lighting Act of 1972 a resolution is presented to City Council for consideration to approve the Annual Report for the Lighting and landscape Maintenance Districts for Fiscal Year 2024/25. Therefore, staff recommends City Council adopt Resolution No. 2024-, approving the Annual Report for the Lighting and Landscape Maintenance District for Fiscal Year 2024/25.

WHEREAS, the City Council has, by previous resolution, ordered NBS to prepare and file such Annual Report; and
WHEREAS, NBS has prepared and filed such Annual Report with the City Clerk.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City ofNewman DOES HEREBY RESOLVE as follows:

1. Approval of Annual Report: The City Council hereby approves the Annual Report concerning the levy of assessments as submitted by NBS for the fiscal year commencing July 1, 2024 and ending June 30, 2025.

1. INTRODUCTION
WHEREAS, on October 27, 1987, by Resolution No. 87-83, the City Council of the City of Newman (the "City"), State of California, under the Landscaping and Lighting Act of 1972 (the "1972 Act") established the City of Newman Lighting and Landscape Maintenance District (the "District"); and WHEREAS, in 2010 the City Council, under the 1972 Act, Article XlllD of the Constitution of the State of California (the "Article XlllD") and the Proposition 218 Omnibus Implementation Act (the "Proposition 218"), (the 1972 Act, Article XlllD and Proposition 218 are collectively referred to as the "Assessment Law"), approved the commencement of Proposition 218 proceedings for the District so that property owners could consider an increase in assessments for the maintenance of improvements which provide special benefit to them; and
WHEREAS, on August 10, 2010, by Resolution No. 2010-62, the City Council, found that under said Assessment Law, no majority protest to the levy of assessments existed and the proposed assessments would go into effect for the District; and
WHEREAS, on April 23, 2024, the City Council, under said Assessment Law, adopted its Resolution Initiating Proceedings (the "Resolution") for the Annual Levy of Assessments and Ordering the Preparation of an Engineer's Report for the District; and
WHEREAS, the Resolution directed NBS to prepare and file a report describing the general nature, location, and extent of the improvements to be maintained; an estimate of the costs of the maintenance, operations, and servicing of the improvements for the District, and a diagram of the area and properties to be assessed; and
NOW THEREFORE, the assessments as detailed in this Engineer's Report and as summarized in the table below are made to cover the portion of the estimated costs of maintenance, operation, and servicing of the improvements to be paid by the assessable real property within the District in proportion to the special benefit received. The following table summarizes the proposed assessments for Fiscal Year 2024/25:

1 2. PLANS AND SPECIFICATIONS
The City Council of the City adopted Ordinance No. 85-13 on December 10, 1985, which required that as a condition of approval of any tentative sub-division map or parcel map, the City shall require the applicants to petition the City Council for the formation of an assessment or maintenance district pursuant to the provisions of the 1972 Act. The District was established in 1987 and new sub-divisions were annexed to the District as development occurred.

The District provides for the continued administration, maintenance, operations, and servicing of various improvements located within the public right-of-way, dedicated easements, and publicly owned parcels in each of the 15 Benefit Zones within the District. The improvements are described in the budget for each Benefit Zone. The engineering drawings for the improvements are on file in the office of the Director of Public Works and are incorporated herein by reference. The specifications for maintenance work to be performed under contract are contained in City contracts on file with the City Clerk and Director of Public Works and may be viewed during normal business hours.

2.1 Description of the Boundaries of the District
The District is located within the boundaries of the City. An Assessment Diagram has been prepared which shows each of the 15 Benefit Zones and the parcels to be assessed. A copy of the Assessment Diagram is included herein by reference and is on file in the office of the City Clerk. The lines and dimensions of each parcel or lot within the District are those lines and dimensions shown on the maps of the Assessor of the County of Stanislaus (the "County") for the year in which this report was prepared, and are incorporated herein by reference and made part of this report.

2.2 Description of Improvements and Services
The improvements that may be maintained and serviced are generally described as follows:
a) Street lighting and safety lighting consisting of poles, fixtures, bulbs, conduits, and equipment including guys, anchors, posts, and pedestals, metering devices, and appurtenant facilities required to provide lighting in public rights-of-way and public easements within each Benefit Zone. b) Landscaping includes plantings, shrubbery, turf, irrigation systems, entry monuments, hardscapes including curbs, gutters and sidewalks, walls and fencing, and appurtenant structures, including ornamental structures in public rights-of-way and on City owned parcels including parks, recreational facilities, and other publicly owned parcels within each Benefit Zone.

Maintenance as used herein means the furnishing of services and materials for the ordinary and usual operation and servicing of improvements and appurtenant facilities, including the repair, removal, or replacement of the facilities. Maintenance is further defined to include trash removal, debris removal, graffiti removal, insect abatement, weed abatement, removal or mitigation of health and safety hazards related to the facilities, cultivation, trimming, spraying, fertilizing, and treating for disease. Services include personnel, materials, contracting services, utilities, capital projects, and all necessary costs associated with the maintenance, replacement, and repair required to keep the improvements in operational and in a safe, healthy, vigorous, and satisfactory condition.

4 3.2 Reserve Fund
The City may establish and collect reserve funds for the District in order to pay for the maintenance and servicing of the improvements prior to December 10 of the fiscal year, or whenever the City expects to receive its apportionment of special assessments and tax collections from the County, whichever is later.

The fund may be allowed to accumulate in anticipation of any unforeseen expenses not included in the yearly maintenance costs.

4. METHOD OF ASSESSMENT

4.1 General
Pursuant to the 1972 Act and Article XlllD, all parcels that receive a special benefit as a result of the maintenance and operation of improvements and services shall be identified, and the proportionate special benefit derived by each identified parcel shall be determined in relationship to the entire costs of the maintenance and operation of improvements.

Section 22573 of the 1972 Act requires that maintenance assessments must be levied according to benefit rather than according to assessed value. This Section states:
"The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements."
'The determination of whether or not a lot or parcel will benefit from the improvements shall be made pursuant to the improvement Act of 1911 {Division 7 {commencing with Section SOOOj [of the Streets and Highways CodeJ State of California]."
The 1972 Act also permits the designation of zones of benefit within any individual assessment district if "by reason of variations in the nature, location, and extent of the improvements, the various areas will receive different degrees of benefit from the improvements" (Sec. 22574).

Section 4(a) of Article XlllD limits the amount of any assessment to the proportional special benefit conferred on the property. Article XlllD also provides that publicly owned properties must be assessed unless there is clear and convincing evidence that those properties receive no special benefit from the improvements. Exempted from the assessment would be the areas of public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, public easements and rights-of-ways, public greenbelts, and public parkways.

The net amount to be assessed may be apportioned by any formula or method that fairly distributes the net amount among all assessable lots or parcels. Proposition 218, approved by the voters in November 1996, requires the City to separate general benefit from special benefit and only special benefit is assessed.

4.2 Special Benefit
The City has required as a condition of approval of any tentative sub-division map or parcel map that enhanced lighting and landscaping be provided within new developments. These enhanced levels of lighting and landscaping have proven to benefit parcels within each development by enhancing the desirability of property and creating a sense of community identity and pride. The costs associated with those improvements are assessed to all assessable parcels that receive the localized benefit. Localized improvements include the construction, operation, servicing, and maintenance of landscaping, street lighting, and park improvements that only benefit the assessable parcels located within each Benefit Zone.

The special benefits received by parcels include:

Localized Street Lighting- Developable parcels that have street lighting within close proximity directly benefit from street lighting and are assessed for the costs of the street lighting. Benefits include:
• Mitigates crime (especially vandalism)
• Reduces traffic accidents and enhances pedestrian safety • Contributes to a visually pleasing nighttime image, and • Promotes social interaction during the hours of darkness.

Localized Landscaping - Developable parcels that have localized landscaping such as neighborhood parks, entryway landscaping, streetscape landscaping, etc. adjacent to or near their parcels directly benefit from the landscaping improvements and are assessed for the costs of the localized landscaping. Benefits include:
• Parks and landscaped areas help conserve land, energy, and resources, and Proper maintenance of landscaping and parks makes communities more livable and enhances the desirability of property.

These improvements are for the benefit of the properties within each Benefit Zone and as such confer a special and direct benefit to parcels within each Benefit Zone by:

Improving the livability, appearance, and desirability for properties within the boundaries of the Benefit Zone, and
• Ensuring that improvements do not reach a state of deterioration or disrepair so as to be materially detrimental to properties within the Benefit Zone.

Only properties within each Benefit Zone receive a special benefit from the localized improvements and are assessed for the maintenance and servicing of the improvements within the Benefit Zone.

4.3 General Benefit
None of the improvements funded by the levy of assessments provide a special or direct benefit to parcels outside of the Benefit Zone in which the assessment is levied. Parcels within the City, not within one of the Benefit Zones included in the District, receive a minimal standard of City funded landscape maintenance and street lighting. As a result, there is no general benefit to parcels not within one of the Benefit Zones.

The District does not fund the maintenance or servicing of street lights or traffic signals on arterial streets that would serve persons or traffic that may travel through the Benefit Zones.

4.4 Benefit Zones
Benefit Zones 1 through 15 were established as a condition of tentative sub-division map or parcel map approval to accurately track and assess the costs associated with the localized street lighting, and landscaping improvements such as neighborhood parks, entryway landscaping, streetscape landscaping, etc. for specific development sites. The costs of these improvements are only assessed to the parcels within the Benefit Zones that directly benefit from the improvements.

4.5 Method of Assessment Spread
Each of the parcels within a Benefit Zone is deemed to receive special benefit from the maintenance and operation of the improvements. Each parcel that has a special benefit conferred upon it as a result of the maintenance and operation of improvements is identified and the proportionate special benefit derived by each identified parcel is determined in relationship to the entire costs of the maintenance and operation of the improvements.

To assess special benefit appropriately, it is necessary to relate the different types of parcel land use to each other. The Benefit Unit (BU) method of apportionment uses the single-family parcel as the basic unit of assessment since this is the primary land use within each Benefit Zone.

Each of the subdivided parcels within Benefit Zones 1 through 15 is deemed to receive special benefit from the improvements.
• In Benefit Zones 1 through 13, and 15, each parcel is assigned one (1) BU since they are all singlefamily residential parcels and receive the same benefit from the improvements. The total annual cost for each Benefit Zone is divided by the total number of BUs within each Benefit Zone in order to determine the annual assessment rate for each unit.

In Benefit Zone 14, the parcels are categorized as either low density or high-density parcels. Each low-density parcel is assigned one (1) BU and each high density parcel is assigned one-half (0.5) BU.

The total annual cost per BU is calculated by dividing cost by the total number of BUs within the Benefit Zone. The assessment for each parcel is calculated by multiplying the number of BUs assigned to the parcel by the assessment rate per BU.

The latest County Assessor's Secured Roll shall be the basis for the property type determination and units/acreage assignments, unless better data is available to the City. In addition, if any parcel within the District is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, the property type and BU assignment shall be based on the correct parcel number and/or new parcel number(s), County use code, and subsequent property information. If a single parcel has changed to multiple parcels, the BU assignment and assessment amount applied to each of the new parcels will be recalculated rather than spread the proportionate share of the original assessment.

4.6 Cost of Living Inflater
Each fiscal year beginning Fiscal Year 2011/12, the maximum allowable assessment amount may be increased by the percentage change in the year ending February preceding the start of the fiscal year of the Consumer Price Index for all Urban Consumers (CPl-U), for the San Francisco-Oakland-HaywardJ CA area. If for any reason the percentage change is negative, the maximum allowable assessment will not be decreased by reason of such negative percentage change and will remain at the amount as computed on the previous fiscal year regardless of any CPI adjustment. The maximum assessments are being increased by 2.366% for Fiscal Year 2024/25. The annual assessment cannot exceed the actual costs to operate the District in any given year. If operating costs are such that the maximum assessment amount is not needed, the City will levy only what is needed for that fiscal year.

5. ASSESSMENT DIAGRAM
An Assessment Diagram for the District is on file in the Director of Public Works' office. The lines and dimensions of each lot or parcel within the District are those lines and dimensions shown on the maps of the County Assessor of the County, at the time this report was prepared, and are incorporated by reference herein and made part of this Engineer's Report.

6. ASSESSMENT ROLL
Assessor's parcel identification, for each lot or parcel within the District, shall be based on the County Assessor's secured roll data for the applicable year in which this Report is prepared and is incorporated herein by reference.

A listing of assessor's parcels assessed within the District for Fiscal Year 2024/25, along with the assessment amounts, is on file in the office of the City Clerk and incorporated herein by reference. Based on County Assessor's secured roll data, current assessor's parcels, including corrected and/or new assessor's parcels, will be submitted and/or resubmitted to the County Auditor/Controller. The annual assessment amount to be levied and collected for the resubmitted parcel(s) shall be determined in accordance with the method of apportionment and assessment rate approved in this Report. Therefore, if a single assessor's parcel has a status change in development, other land use change, or subdivides into multiple assessor's parcels, the assessment amounts applied to each of the new assessor's parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment amount.

ADOPT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWMAN, CALIFORNIA,

DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS FOR THE LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT FOR FISCAL YEAR 2024/25
RECOMMENDATION:

Adopt Resolution No. 2024- , declaring its intention to levy and collect assessments for the Lighting and Landscape Maintenance District for the fiscal year commencing July 1, 2024 and ending June 30, 2025.

BACKGROUND:

The City of Newman's Lighting and Landscape Maintenance District (District) is divided into 15 zones. These zones are located in various parts of the City. The District is responsible for the general nature, appearance and upkeep of the street lights and various landscape features located within each zone. Maintenance and improvements within the District include, but are not limited to, the servicing of all District landscapes and lighting; including trimming and pruning, weed abatement, sidewalks, plant materials, pathways, irrigation systems, lighting systems, storm drainage systems, and graffiti removal.

The provisions of the Landscaping and Lighting Act of 1972, provide for the levy and collection of assessments to pay for the maintenance and services of all improvements and facilities related hereto. The City Council has retained NBS for the purpose of assisting with the proposed assessments.

ANALYSIS:

A resolution Initiating Proceedings for The Levy and Collection of Assessments and Ordering the Preparation of an Annual Engineer's Report for the Lighting and Landscape Maintenance District for Fiscal Year 2024/25 was adopted by resolution at the April 23, 2024 City Council Meeting, as required by the Landscape and Lighting Act of 1972. Just prior to the adoption of this resolution, the City Council will have adopt that Engineer's Report that was ordered.

This resolution declares the Council's intention to levy and collect assessments for the Lighting and Landscape Maintenance District for Fiscal Year 2024/25 and establishes a date to conduct a Public Hearing for the proposed assessments, which is June 11, 2024.

FISCAL IMPACT:

There is no fiscal impact caused by adopting this resolution.

CONCLUSION:

Pursuant to the Landscape and Lighting Act of 1972 a resolution is presented to the City Council for consideration to declare the council's intention to levy and collect assessments within the District to pay the costs of the improvements for fiscal year 2024/25 and establishes a date to conduct a Public Hearing for the proposed assessments. Staff recommends the City Council adopt Resolution No. 2024- , declaring its intention to levy and collect assessments for the lighting and Landscape Maintenance District for the fiscal year commencing July 1, 2024 and ending June 30, 2025 and set the date for the Public Hearing as Tuesday, June 11, 2024 at the regularly scheduled council meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWMAN, CALIFORNIA,

DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS FOR THE LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT FOR FISCAL YEAR 2024/25 WHEREAS, the City Council of the City of Newman (the "City Council") previously completed its proceedings in accordance with and pursuant to the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with Section 22500) (the "Act") to establish the City's Lighting and Landscape Maintenance District (the "District"); and WHEREAS, the City Council has retained NBS for the purpose of assisting with the annual levy of the District, and to prepare and file an Annual Report for the District with the City Clerk in accordance with the requirements of the Act.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Newman DOES HEREBY RESOLVE as follows:

1. Intention: The City Council hereby declares its intention to levy and collect assessments within the District to pay the costs of the Improvements for the fiscal year commencing July 1, 2024 and ending June 30, 2025. The City Council finds that the public's best interest requires such action.

2. Improvements: The Improvements include, but are not limited to:
• Street lighting and safety lighting, consisting of poles, fixtures, bulbs, conduits and equipment including guys, anchors, posts, and pedestals, metering devices, and appurtenant facilities required to provide lighting in public rights-of-way and public easements within each Benefit Zone.
• Landscaping, including plantings, shrubbery, turf, irrigation systems, entry monuments, and hardscapes including curbs, gutters and sidewalks, walls and fencing, and appurtenant structures, including ornamental structures in public rights-of-way and on City owned parcels including parks, recreational facilities, and other publicly owned parcels within each Benefit Zone.
• Services provided include all necessary service, operations, administration, and maintenance required to keep the improvements in a healthy, vigorous, and satisfactory condition.

3. District Boundaries: The boundaries of the District are as shown by the assessment diagram filed in the offices of the City Clerk, which map is made a part hereof by reference.

4. Annual Report: Reference is made to the Annual Report prepared by NBS, on file with the City Clerk, for a full and detailed description of the improvements, the boundaries of the District and the zones therein, and the proposed assessments upon assessable lots and parcels of land within the District.

5. Notice of Public Hearing: The City Council hereby declares its intention to conduct a Public Hearing concerning the levy of assessments in accordance with Section 22629 of the Act. All objections to the assessment, if any, will be considered by the City Council. The Public Hearing will be held on Tuesday, June 11, 2024 at 7:00 pm or as soon thereafter as is feasible in the Council Chambers located at 938 Fresno Street, Newman, CA 95360. The City Council further orders the City Clerk to publish notice of this resolution in accordance with Section 22626 of the Act.

6. Increase of Assessment: The maximum assessment is not proposed to increase from the previous year above that previously approved by the property owners (as "increased assessment" is defined in Section 54954.6 of the Government Code).

The foregoing resolution was introduced at a regular meeting of the City Council held on the 14th day of May, 2024 by Council Member , who moved its adoption which motion duly seconded and was upon roll call carried and the resolution adopted by the following vote:
