Agenda Item: 8.d.
City Council Meeting
of June 25, 2024
AUTHORIZE THE CITY OF NEWMAN FIRE DEPARTMENT TO ACCESS STATE AND FEDERALLEVEL SUMMARY CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT RECOMMENDATION:
Adopt resolution No. 2024- , authorizing the City of Newman Fire Department to access State and Federal-level summary criminal history information for employment.
BACKGROUND:
The City of Newman Fire Department is an all-risk agency that provides emergency medical services, fire protection, public education, fire prevention, and fire investigation services. The department's members must be of sound mind and good moral-ethical character. The pre-employment background satisfies two goals: 1) assuring compliance with all applicable minimum standards for appointment and 2) screening out candidates who, based on their past history or other relevant information, are found unsuitable for the position in question. In the past, the pre-employment background was obtained through a contracted agency, which is no longer available to the City of Newman Fire Department. Government Code § 1031 requires a pre-employment background investigation for peace officers. These requirements are the same recommended for firefighters.
ANALYSIS
The City of Newman Fire Department was informed by its contract agency that the pre-employment background check service would no longer be available. Therefore, the department must establish its own source for preemployment background checks. The Fire Department conferred with other City departments and determined it could handle this requirement locally. Approval from the Council is required to move forward.
FISCAL IMPACT:
A nominal service fee is charged to the City of Newman Fire Department. These fees will be included in the fiscal year budget. The current fee is estimated at $32.00 per new hire. The fire department, on average, has five new hires per year.
CONCLUSION:
It is recommended that the Newman City Council Adopt Resolution No. 2024- , authorizing the City of Newman Fire Department to access State and Federal-level summary criminal history information for employment.

RE: Letter of Support - 2024 Transit and Intercity Rail Capital Program (TIRCP) for the Stanislaus Regional Transit Authority
Dear Mr. Edison:
The City of Newman strongly supports the Stanislaus Regional Transit Authority (StanRTA) funding application requesting $25,000,000 for the construction of the Next Generation Zero-Emission Bus Operations and Maintenance Facility, also known as the Stanislaus Transportation Center (STC). The project includes the construction of a maintenance and operations facility to meet the growing demands of the regional public transportation system and to deploy zero emission bus fueling infrastructure. The new facility will provide an efficient and modem transportation center in Stanislaus County.
StanRTA is currently leasing a facility for its bus maintenance. The facility is undersized as it was originally designed for a smaller fleet of about 90 vehicles. StanRTA currently operates over 130 vehicles. There is no opportunity for fleet expansion within the current property area due to the site constraints on all sides of the facility. It also lacks the capacity to support the necessary infrastructure to transition to zero-emission buses. The new facility will provide the additional space required to accommodate the infrastructure needed for hydrogen fuel cell buses.
Upon the completion of the STC, StanRTA will have the capability to plan and build its Bus Rapid Transit (BRT) corridor featuring zero-emission buses. The BRT system will be an effective and affordable solution to address the growing demand for public transit and traffic congestion in Stanislaus County. The BRT route will connect key points of interest and provide fast, reliable, and comfortable transportation for commuters.
The STC will be designed to meet the growing demands of the regional public transportation system. It will provide a modem and efficient facility to support the zero emission bus operations and maintenance of the fleet, ensuring that vehicles are in excellent condition and ready to provide reliable service to the community. The STC will feature state-of-the-art equipment and technology to support the maintenance and repair of buses, including multiple vehicle maintenance bays, parts storage, wash bays, and fueling stations.
Several benefits will arise from the construction of the STC. This project will persist in its commitment to serving disadvantaged communities by reducing transportation disparities and providing increased access to opportunities for communities that have historically been underserved by traditional transportation options.
The City ofNewman concurs with the project and requests your review and approval of this grant application.

RECOMMENDATION:
1. Conduct Public Hearing
REPORT ON NUISANCE ABATEMENT
Agenda Item: 9.a.
City Council Meeting
of June 25, 2024
2. Adopt Resolution No. 2024- , Declaring The Existence Of A Public Nuisance Under Ordinance No. 95-4.
BACKGROUND:
On April 25, 1995, the Newman City Council adopted Ordinance No. 1995-4, amending Chapter 2 of Title 8 of the Newman City Code, now referred to as Chapter 8.02. The purpose and intent of Chapter 8.02 is as follows:
1. To define as public nuisances and violations of [the] Code those conditions which are considered harmful and/or deleterious to the public health, safety, and welfare of the citizens of the City;
2. To develop regulations which will promote the sound maintenance of property and the enhancement of the livability, the community appearance, and the social, economic, and environmental conditions of the community; and
3. To establish guidelines for the correction of property maintenance violations and nuisances which afford due process and procedural guarantees to affected property owners.
Per NCC §8.02.030, "It shall be unlawful for any responsible person to keep or maintain premises under his/her control, in a condition detrimental to the public health, safety, or general welfare" and "No responsible person owning, managing or having control or charge of occupancy of any building, lot or premises within the City shall permit public nuisances of any kind as defined in [Chapter 8.02] to remain upon said premises or upon or over public sidewalks, streets or alleys between said premises and the center line of any public street or alley".
ANALYSIS:
As required by NCC §8.02.060, Notice and hearing for abatement of nuisances, a notice informing property owner(s) of the existence of a nuisance, abatement deadline, nuisance abatement procedures, and their right to object at a public hearing was sent to the property owner. Historically, many property owners comply with abatement notices prior to the posted hearing date. A final compliance survey of the subject property will be completed on Monday, June 24, 2024. Properties that have satisfactorily abated their specific nuisance will be removed from the Abatement List prior to the public hearing.
FISCAL IMPACT:
None, abatement costs shall be recompensed to the City via a property lien (as provided in NCC §8.02.090).
CONCLUSION:
Public nuisances and violations of City Code are considered harmful and/or deleterious to the public health, safety, and welfare of the citizens of the City of Newman. The abatement of said nuisances enhances the livability, community appearance and the social, economic, and environmental conditions of the City. Therefore, staff recommends that the City Council conduct the public hearing and adopt Resolution No. 2024-, Declaring The Existence Of A Public Nuisance Under Ordinance No. 95-4.

AN ORDINANCE AMENDING TITLE 10, TRAFFIC REGULATIONS, SECTIONS 10.04.050 AND
10.04.060 TO PROHIBIT PARKING AT ANY TIME ALONG THE WEST CURB LINE OF HARDIN
ROAD BETWEEN PARK A VENUE AND ANGELINA DRIVE AND ESTABLISHING RELATED
FINES ASSOCIATED WITH THE VIOLATIONS
RECOMMENDATION:
Adopt Ordinance No. 2024- , Amending Title 10, Traffic Regulations, Amending Section 10.04.050 and Section
10.04.060 to Prohibit Parking Along the West Curb Line of Hardin Road Between Park Avenue and Angelina Drive and Establishing Related Fines Associated with the Violations, and direct staff to publish a summary of said ordinance.
BACKGROUND:
This Ordinance was introduced and a Public Hearing held at the June 11, 2024 City Council meeting where the Council waived the First reading except by Title. There was no public comment or opposition to the proposed ordinance during the Public Hearing.
The City currently prohibits parking along the west curb line of Hardin Road between Park A venue and Angelina Drive Monday through Friday from 7:00 am to 4:00 pm. Orestimba High School and a child development center are located along the west side of Hardin Road in the aforementioned area. There are several residential structures (primarily multi-family complexes) located along the east side of the roadway. Off-street parking options are available in all of these residential locations.
ANALYSIS:
According to Google Maps, the length of the roadway affected by the proposed parking ban on Hardin Road, between Park Avenue and Angelina Drive, is approximately 1,253 feet. The roadway is approximately 32 feet wide from the east curb line to the west curb line. When vehicles are parked on both sides of the roadway, roadway clearance for vehicular traffic is reduced to approximately 20 feet. The decreased width of the roadway is a cause of traffic congestion when vehicles are parked on both sides of the roadway, thereby endangering citizens and property.
Vehicles parking along the west curb line also reduces the visibility of pedestrians to vehicular traffic during special events. In addition, the narrowing of the roadway and traffic congestion pose challenges for emergency service vehicles, hindering their ability to navigate the road safely. Staff have met with representatives of the School District who are aware, and in support of, the proposed ordinance.
Residential structures are located along the east side of Hardin Road between Park Avenue and Angelina Drive.
While these properties include some off-street parking options, the least intrusive option would be to prohibit parking along the west curb line of Hardin Road between Park A venue and Angelina Drive.
FISCAL IMPACT:
Minimal fiscal impact in the form of replacing existing signage and the time required to install them.
CONCLUSION:
Therefore staff recommends City Council adopt Ordinance No. 2024- , Amending Title I 0, Traffic Regulations, Amending Section 10.04.050 and Section 10.04.060 to Prohibit Parking Along the West Curb Line of Hardin Road Between Park Avenue and Angelina Drive and Establishing Related Fines Associated with the Violations and direct staff to publish a summary of said ordinance.
