Agenda Item: 9. a
City Council Meeting
of March 25, 2025
DECLARE THE EXISTENCE OF A PUBLIC NUISANCE UNDER ORDINANCE NO. 281 MISTLETOE
ABATEMENT
RECOMMENDATION:
It is recommended that the Newman City Council adopt Resolution No. 2025- , a resolution declaring the existence of a public nuisance under Ordinance No. 281 Mistletoe Abatement.
BACKGROUND:
Broad leaf mistletoe is an evergreen parasitic plant that grows on a number of landscape tree species in California.
Mistletoe reduces growth in trees by utilizing the host mainly for water and mineral nutrients and may kill them with heavy infestations. These plants produce small, sticky, whitish berries if they are female, or pollen if they are male. The plant is typically spread to other trees from birds and it is important to remove mistletoe before it is spread to other limbs or trees. The most effective method for control is through complete removal of the branch by mechanical pruning. Mistletoe cannot be completely eradicated; however, it can be controlled through complete removal.
ANALYSIS:
Abatement notices for the removal of mistletoe were sent out on January 31, 2025 to 28 properties in accordance with City of Newman Municipal Code Chapter 9.06, Section 9.06.020 Notice to Abate. This notice informs property owners of all nuisance abatement procedures, options and their right to object at a public hearing. Several property owners removed the mistletoe. On March 7, 2025, the 14 properties remaining were served with certified letters to remove mistletoe and given a Public Hearing Notice. It is anticipated that additional property owners will comply with the abatement notices prior to the hearing date. A final compliance survey will be done on Tuesday, March 25, 2025. An updated list of properties that have not complied with the abatement notice will be read out loud at the council meeting prior to the public hearing. The final list will include the cost to the remaining property owners for the removal of mistletoe.
FISCAL IMP ACT:
None.
CONCLUSION:
Mistletoe is a parasitic plant afflicting a number of trees in the City. Abatement notices have been sent to the property owners of the infected trees in accordance with City Municipal Code Chapter 9 .06. Therefore, staff recommends City Council adopt Resolution 2025- , a resolution declaring the existence of a public nuisance under · Ordinance No. 281 Mistletoe Abatement.

Mistletoe is the English common name for most obligate hemiparasitic plants in the order Santalales. They are attached to their host tree by a structure called the haustorium, through which they extract water and nutrients from the host plant.

RECOMMENDATION:
Adopt Resolution No. 2025 -, accepting the Wastewater Treatment And Reclamation Facility (WWTRF) McPike 1 Reclamation Improvements Project as Complete, Authorizing the City Clerk to record a Notice of Completion, and Authorizing the City Manager to make final payment of retention funds to Steve P. Rados, Inc.
BACKGROUND:
The major work consists of installing a new reclamation pump station and approximately 5,000 linear feet of 18- inch force main to a hydraulic distribution structure, approximately 1,000 feet of 21-inch distribution pipe and 2,800 feet of 24-inch distribution pipe. The project also included 33 irrigation valves and headwalls and a tie-in to an existing City irrigation well. All improvements are at the City's wastewater treatment and reclamation facility.
The project was advertised On November 23rct, 30th, and December 7th 2022, and bids were opened at Newman City Hall on January 11, 2023. The work was combined and bid with the City funded Phase 1 Trunk Sewer Project to accommodate completing both projects on the same site at the same time.
ANALYSIS:
The City received a total of eight bids that were opened and read aloud at 10:00 a.m. on January 11, 2023, this being the advertised bid opening date and time. The low bid was submitted by Steve P. Rados, Inc. in the amount of $3,740,050.00 for the McPike 1 Reclamation Improvements only (excluding the Phase 1 Trunk Sewer portion of the bid, which is not yet completed). The McPike 1 Reclamation portion of the project cannot wait until completion of the Phase 1 Trunk Sewer project to meet grant requirements. The project was awarded to Steve P. Rados, Inc on January 26, 2023. Only McPike Reclamation accounting is presented below.
Contract Bid Amount $ 3,740,050.00

Change Order #3* (Add standpipe support) $ 10,343.41
Change Order #5* (Road improvements) $ 170,175.00
Total Construction Costs $ 4,007,174.43
*non-sequential change order numbers reflect change orders applied to the Phase 1 Trunk Sewer Project, built by the same contractor under the same contract, but who 's accounting will be presented separately. The Trunk Sewer Project is not yet complete.
The Contractor completed all the work within the time required on the Contract Documents. A final inspection has been performed and the work has been found to be in compliance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion filed with Stanislaus County. If no claims are filed within 35 days after recordation, the retention amounts should be paid to Steve P. Rados, Inc.
FISCAL IMPACT:
The project was funded using the Clean Water State Revolving Fund Grant, Agreement D2101035.
