The City of Newman investment policy follows California Government Code §53600.3 the "Prudent Investor Rule". This "Rule" affords the City a broad spectrum of investment opportunities as long as the investment is deemed prudent and is allowable under current legislation of the State of California (G.C.

Section §53600 et. seq.).

Investments may be made in the following media;
• Securities of the US Government, or its agencies (Treasury Bills/Notes) • Small Business Administration Loans
• Certificates of Deposits
• Bankers Acceptances (Letter of Credit)
• Local Agency Investment Fund (LAIF) - State Pool
• Chandler Asset Management - CSJVRMA Pool
• Passbook Savings Account Demand Deposits
• Other products which are totally guaranteed and insured by the US Government Criteria for selecting investments and the order of priority are:

1. SAFETY: The safety and risk associated with an investment refers to the potential loss of principal, interest or a combination of these amounts. The City only operates in those investments that are considered very safe.

2. LIQUIDITY: This refers to the ability to "cash in" at any moment in time with a minimal chance of losing some portion of the principal or interest. Liquidity is an important investment quality especially when the need for unexpected funds occurs occasionally.

3. YIELD: Yield is the potential dollars earnings an investment can provide, and sometimes is described as the rate of return.

SAFEKEEPING: Securities purchased from brokers/dealers shall be held in third party safekeeping by the trust department of the local agency's bank or other designated third party trust, in local agency's name and control, whenever possible.

INVESTMENT OBJECTIVE: The cash management system of the City of Newman is designed to accurately monitor and forecast expenditures and revenues, thus insuring the investment of monies to the fullest extent as possible. The City attempts to obtain the highest interest yields possible as long as investments meet the criteria required for safety and liquidity.

CITY CONSTRAINTS: The City of Newman operates its pooled idle cash investments under the "Prudent Investor Rule". This affords a broad spectrum of investment opportunities so long as the investment is deemed prudent and is permissible under currently effective legislation of the State of California and other imposed legal restrictions.

The City strives to maintain the level of investment of all idle funds as near 100% as possible, through daily and projected cash flow determinations. Idle cash management and investment transactions are the responsibility of the City Finance Officer and City Treasurer.

The basic premise underlying is the City's investment philosophy is, and will continue to be, to insure that money is always safe, available when needed, and earning maximum interest yield on deposits.

City Council Meeting
of January 13, 2026

ADOPT A RESOLUTION AUTHORIZING THE APPROVAL OF THE
"LEASE AND SUBSCRIPTION CAPITALIZATION POLICY" FOR THE CITY OF NEWMAN RECOMMENDATION:

It is recommended that the Newman City Council approve Resolution No. 2026- , authorizing the approval of the "Lease and Subscription Capitalization Policy" for the City of Newman.

BACKGROUND:

GASB Statements 87 (Leases) and 96 (Subscriptions) requires the recognition of lease and subscription assets and liabilities on the balance sheets of the city. The city engages in leases and subscriptions in amounts that do not substantially affect our financials; because they are not a major focus of our operations. By establishing a "Lease and Subscription Capitalization Policy" the City can set a limit, that if exceeded, would cause the reporting of a material lease or subscription activity. By establishing this policy, the City's financials will reflect only those leases and subscriptions which are significant.

ANALYSIS:

Currently, the City does not have any leases or subscriptions that would be reported under the proposed policy.

FISCAL IMPACT:

Approving this resolution has no financial impact.

CONCLUSION:

Staff recommends the City approve Resolution No. 2026- authorizing the approval of the "Lease and Subscription Capitalization Policy" for the City of Newman.

CITY OF NEWMAN

LEASE AND SUBSCRIPTION CAPITALIZATION POLICY
PURPOSE:

The purpose of this policy is to establish the criteria and procedures for recognizing lease and subscription assets and liabilities on the balance sheet, as required by the Governmental Accounting Standards Board (GASB) Statements No. 87 and 96.

The policy applies to all lease and subscription agreements that contain lease or subscription components entered into by the City of Newman.

DEFINITION:

A lease is a contract, or part of a contract, that conveys the right to control the use of an identified asset (property, plant, or equipment) for a period in exchange for consideration. The lessee is the party that obtains the right to use the asset. The lessor is the party that owns the asset and makes it available for use by the lessee. GASB 87 is for capitalization of leases.

A subscription-based information technology arrangement (SBIT As) is a contract that gives the right to use another party's IT software for a set period of time. SBITAs is also known as GASB 96.

POLICY:

The City of Newman will adopt a capitalization threshold of $100,000 for leases and subscriptions with a term greater than 12 months. This means leases and subscriptions with an initial value of payments below $100,000 will not be recognize on the balance sheet. This threshold was based on the materiality of leases and subscriptions recommended by City of Newman auditors.

If a lease or subscription is capitalized, the City of Newman will recognize a right-of-use asset and a lease or subscription liability on the balance sheet at the commencement date of the contract or agreement. The right-of-use asset will be measured at the amount of the lease or subscription liability plus any initial direct costs incurred by the City of Newman. The lease or subscription liability will be measured at the present value of the payments that are not paid at that date, discounted using the interest rate implicit in the lease or, if that rate cannot be readily determined, the City of Newman incremental borrowing rate.

The City of Newman will amortize the right-of-use asset over the lease or subscription term on a straight-line basis unless another systematic basis is more representative of the pattern of benefit. The City of Newman will also recognize interest expense on the lease or subscription liability and reduce it by making payments.

The City of Newman will present right-of-use assets and lease and subscription liabilities separately from other assets and liabilities on the balance sheet. Finance leases and subscriptions will be presented within property, plant and equipment and debt. Operating leases and subscriptions will be presented as separate line items. The City of Newman will disclose information about its leases in the notes to the financial statements.

PROCEDURE:

The City of Newman will follow these steps to implement this policy:
• Identify all existing and new contracts that contain leases/subscriptions or potential leases/ subscriptions.
• Evaluate whether each contract meets the definition of a lease under GASB 87 and whether it contains any embedded leases. Does the contract convey control of the right to use another entity's underlying asset? Is the underlying asset controlled for a period of time in an exchange or exchange like transaction? Does the contract transfer ownership of the underlying asset to the lessee by the end of the contract? Does the contract contain termination options? Does the contract contain a fiscal funding or cancellation clause that is reasonably certain of being exercised? Is the contract period over 12 months?
• Evaluate whether each contract meets the definition of a subscription under GASB 96. Does the subscription convey the right to use another party's IT software? Does the contract convey the right to use another party's IT software alone, or in combination with an underlying tangible capital asset? Is the contract a licensing arrangement that provides a perpetual license to use vendors software? Is the software controlled for a period of time in an exchange or exchange like transaction? Is the contract period over 12 months? • Apply the criteria for capitalizing leases/subscription to each identified lease/subscription and determine whether it should be recognized on the balance sheet or not based on the capitalization threshold.
• Measure and record right of use assets and lease and subscriptions liabilities at inception and subsequent periods for capitalized leases and subscriptions. • Present and disclose leases in the financial statements according to GASB 87 for leases and GASB 96 for subscriptions requirements.

This policy will be reviewed periodically for changes in facts and circumstances that may affect its appropriateness.

ANNUAL REPORT
Fiscal Year
2024-2025
Introduction
Prepared By:

City of Newman Finance Department
January 5, 2026
This Capital Facilities Fees Annual Report for Fiscal Year 2024-2025 has been prepared as an annual requirement by the State of California in accordance with Section 66006 of the Government Code. The City of Newman collects Capital Facilities Fees (CFF) on new development to fund infrastructure improvements that are necessary to accommodate new growth.

State law requires that the City make the following information available to the public for each separate fund on an annual basis, and that the City Council review that information at a public meeting. The law requires the report to include the following information for each individual fund for the fiscal year:
• The beginning and ending balance of the fund; and
• The amount of the fees collected and interest earned; and • The amount of refunds made; and
• A description of each interfund transfer or loan made by the fund; and • Identification of each public improvement on which fees were expended and the amount expended on each improvement; and
• Current Fees
If the agency no longer needs the funds for the purposes collected, or if the agency fails to make required findings, or perform certain administrative tasks prescribed by AB 1600, the agency may be required to refund, on a prorated basis to owners of the properties upon which the fees for the improvement were imposed, the monies collected for that project and any interest earned on those funds.

Beginning and Ending Balance of Funds, Amount of Fees Collected and Interest Earned
Table 1 "Combining Statement of Revenues, Expenditures, and Changes in Fund Balances" outlines the beginning and ending balance of each fund for Fiscal Year 2024- 2025. Detailed expenditures are shown under each fund description. Furthermore, since this is a pay-as-you-go program, the City must accrue enough revenue to construct a project. This results in an "accumulation" of fund balances. The accumulation occurs until enough revenue is generated to construct a project.

Table 3 "Five Year Revenue History of CFF Funds" illustrates the revenue over a fiveyear period. These funds are based on new development. In FY 2024/25, our revenues dropped by 44%. Revenue still rose by 310% from fiscal year 2020/21 to 2024/25. The drop in revenues over last year can be attributed to higher interest rates which are just starting to decrease. The highest revenue year, during the last 5 years, for all funds was fiscal year, 2023/24.
