City Council Meeting
of April 14, 2026

RESOLUTION APPROVING THE CALCULATION OF THE MAXIMUM GARBAGE COLLECTION

RATES PER PRIOR CONTRACTUAL AGREEMENT
RECOMMENDATION:

It is recommended that City Council adopt Resolution No. 2026- , approving the calculation of the maximum garbage collection rates per prior contractual agreement. • BACKGROUND:

The City renewed its contract in April of 2010 with Bertolotti Disposal Incorporated to provide solid waste collection and curbside recycling services to Newman residents and businesses. According to the agreement, the City does not set the rates for collection services, but only calculates the maximum rate that Bertolotti can charge our residents and businesses for their services. This maximum rate recalculates every 2 years. The agreement also allows Bertolotti to contract with the City to include Bertolotti' s customer charges on our monthly utility bills; which they do. The City is paid a percentage of the amount billed each month for billing Bertolotti's customers for them. ,
ANALYSIS:

The agreement with Bertolotti automatically adjusts the maximum rates every other year. The formula is as follows:
80% of the current rate is adjusted by the 12-month average of the Consumer Price Index (CPI), and 20% of the current rate is adjusted by the Stanislaus County Waste to Energy and Fink Road Landfill Tipping Fees.

Since 2024 the change in the average CPI was an increase of 5.73%. In December of2024 the Fink Road Landfill Waste to Energy facility was shuttered. Since then, the Fink Road Landfill tipping fees increased by 25 .23 %. When calculating the new maximum rate for a standard 90 Gallon Trash Can Bertolotti's billing rate will increase by $2.60 per month. This rate change takes place on July 1, 2026.

FISCAL IMPACT:

The increase in rates will generate approximately a $34,000 increase to the City's General Fund.

CONCLUSION:

Staff recommends the approval of Resolution No. 2026-, approving the calculation of the maximum garbage collection rates per prior contractual agreement.

Honorable Mayor and Members City Council Meeting
of the Newman City Council of April 14, 2026

REPORT ON DOWNTOWN MARKET EVENTS AT THE DOWNTOWN PLAZA
RECOMMENDATION:

Staff recommends the City Council approve the Downtown Market events scheduled at the Downtown Plaza every Friday in June.

BACKGROUND:

The City of Newman and the Newman Chamber of Commerce have requested exclusive use of the Downtown Plaza and the 1300 block of Main Street every Friday in June 2026, from 3:00 p.m. to 9:00 p.m., to host the Downtown Market event. The event will feature amplified music throughout its duration, and no alcohol will be served or sold. Staff has confirmed that the proposed event dates do not conflict with other scheduled community events.

ANALYSIS:

As of the date and time of this staff report, the event organizer is in the early stages of planning this event. Any subsequent changes will be reported by staff during the presentation of this report.

The event organizer has made the following requests:
❖ Exclusive use of the Downtown Plaza and the 1300 block of Main Street. Street Closure of Main Street between Tulare and Fresno Streets.
❖ Waive Standards for Downtown Events in the areas of:
• Clean-up deposit. Downtown standards require a $1,000.00 deposit, refundable upon satisfactory cleaning of the affected area. The event organizer assures staff that they will thoroughly clean up. • Traffic/crowd control device costs. City-owned barricades could be utilized. • Restroom and electrical use fees. Current standards indicate a $25.00 fee for each.

All other Standards for Downtown events will apply.

Staff has prepared a configuration for the event, which has the West and East sides of the plaza closed to vehicular traffic. The plaza parking lots will not be open for public parking.

The Newman Chamber of Commerce is increasing its general liability insurance coverage from $1,000,000 to $2,000,000 per occurrence, with a $3,000,000 aggregate limit, for the Downtown Market events to comply with the City's Risk Management Authority (CSJVRMA) requirements. CSJVRMA determines insurance requirements based on the nature and level of risk associated with the event activities, rather than the size of the event or the City's relationship with the organizer. In addition to local insurance providers, event organizers may obtain coverage through multiple Special Event Brokers recommended by CSNRMA. The Risk Management Authority requires the City to transfer liability risk to event organizers, vendors, and contractors through adequate insurance coverage and strongly recommends against waiving these requirements under any circumstances. Failure to properly transfer this risk could significantly increase the City's financial exposure, including raising the City's retained limit from $10,000 to $50,000 per claim.

FISCAL IMPACT:

There will be no direct fiscal impact as a result of this event.

CONCLUSION:

This staff report is submitted for City Council consideration and action. Staff recommends the City Council approve the event as presented.

City Council Meeting
of April 14, 2026

APPROVE PURCHASE AND SALE AGREEMENT WITH NEWMAN CROWS LANDING UNIFIED

SCHOOL DISTRICT
RECOMMENDATION:

Adopt Resolution 2026- , approving a Purchase and Sale Agreement with Newman Crows Landing School District for 2.05 acres ( a portion of Stanislaus County APN 026-034-011 ), authorizing the City Manager to execute said agreement.

BACKGROUND:

As the Newman Crows Landing School District prepared to install upgrades to their varsity baseball field and to construct parking lot improvements between said field and the football stadium, they discovered that the City actually owns a portion of the land. To ensure compliance with applicable laws, the District approached the City regarding the potential sale of the property to the District so that they may move forward with their project.

Following some discussion, the City and District agreed to terms whereby the City would sell 2.05 acres from the City to the District.

ANALYSIS:

In accordance with the terms of the Bond Sale, the District is permitted to purchase land provided they determine and pay fair market value. To meet this requirement, the District paid a firm to calculate fair market value. The City has agreed to accept the amount as the purchase price. In addition to the agreed-upon price, the District agreed to install curb, gutter, and sidewalk along Park Avenue so fans could safely view tennis competition without being required to stand in the roadway, to cover closing and engineering costs, and to record an irrevocable joint use agreement for the parking lot area. The use agreement would allow the parking area to be utilized during events at Matteri Field.

FISCAL IMPACT:

There is a positive fiscal impact.

CONCLUSION:

The attached Purchase and Sale Agreement contains the terms governing the sale of 2.05 from the City to the District. Upon execution by the District, an escrow account will be opened, and the final sale will occur once all the contingencies have been completed. Staff recommends that the Council approve the Purchase and Sale Agreement and authorize the City Manager to execute said agreement.

ATTACHMENTS:
