TITLE: Annual Appointments for Scheduled Board and Commission Vacancies and One Unscheduled Vacancy on the City Arts
Commission
The annual vacancies on the City of Newport Beach Boards and Commissions will occur on June 30, 2023. Additionally, there is currently one unscheduled vacancy on the City Arts Commission. The process to fill the vacancies is provided in City Council Policy A-2 (Board, Commission, and Committee Appointments). As part of this process, an Ad Hoc Committee of the City Council interviewed applicants and made nomination recommendations as provided below, with the exception of the upcoming vacancy on the Civil Service Board which, pursuant to City Charter 710, was made by a majority of the Civil Service Board. All vacancies were noticed according to the Maddy Act and City Council Policy A-2.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Should the City Council appoint Laird Hayes for a seat on the Parks, Beaches and Recreation Commission, waive a portion of City Council Policy A-2; c) Make appointments to the Boards and Commissions from the nominees listed below:

DISCUSSION:

The nominees listed in the above recommendations were confirmed by the City Council at the June 13, 2023 City Council meeting and selected from applications received and on file in the City Clerk's Office. Copies of all the nominees' applications are attached to this staff report.

Laird Hayes was appointed to fill an unscheduled vacancy on the Parks, Beaches and Recreation Commission on January 28, 2014, was reappointed on July 14, 2015 and June 25, 2019, and has served two full four-year terms. If the City Council desires to appoint him to serve again on the Parks, Beaches and Recreation Commission, it would be necessary to waive the portion of City Council Policy A-2 which states, "...no person shall be eligible for appointment to any one (1) City Board, Commission, or Committee for more than two (2) consecutive four (4) year terms..." 20-2

All new terms will be effective July 1, 2023 and have an expiration date of June 30, 2027, with the exception of the appointment to fill the remaining term of the unscheduled vacancy on the City Arts Commission, which expires June 30, 2025, but the incumbent will be eligible to reapply for the respective seat in 2025 to serve for a full four-year term.

Appointment Process
Appointments to the Boards and Commissions will take place in the following manner:

A. The City Council will vote on the appointments using a paper ballot and each member of the City Council will cast the appropriate number of votes for each Board and Commission on the paper ballot.

B. The City Clerk will tabulate and announce the results, including the vote tally. To be appointed, the applicant must receive at least four votes.

FISCAL IMPACT:

There is no fiscal impact related to this item.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).

(1) History of Newport Beach is assigned to the Arts Commission as part of our Newport Beach Charter:
• Little attention has been given to this, especially directed to students and newer residents • Education about art and history in Newport Beach, in my opinion, has been overlooked:

Docents, school exhibits, travel exhibits are just some ideas to implement by volunteers. • Prepare and integrate with institutions like Sherman Gardens, and the various existing history associations and review art and history as part of General Plan updates. (2) The art in these areas of our history:
• Film Festival (films made here)
• Artists (Tony DeLap, Rex Brandt, Braden Finch (artists I knew ... and there are many more) • Boats (Goodwill, Windward Passage), Wild Goose, and many other famous sail and power boats
• Yacht Clubs (Newport Harbor, Balboa Yacht Club) and at least several others. • Harbor: International regattas and races, surfing, lifesaving • Boat building industry (shipyards -WWII, Schock, Hobie, surfboards, and others originated here).
• Incredible culinary ideas or restaurants started in Newport And many other areas should be part of our Newport Arts Commission and included in our General Plan update.
(3) My family and I have been here since 1950, over 70 years. • Served on Education Board Coast District as elected Trustee 30+ years, and various education -related boards/committees

I was hesitant to apply to the Civil Service board because I did not go to college. I moved to Newport Beach from Lincoln City, Oregon when I was 18. That was in 2005, my dad was a Realtor in Oregon and my mom is in the escrow industry. So I threw myself into Real Estate right away, and chose to self educate. Reading books, watching documentaries and developing an emotional intelligence through life experience which has contributed to my current skill sets.

In 2007 1 started working with families in Newport Beach helping them find homes. My mission is to help everyone find their place in the world. I have grown to know the in's and out's of Newport Beach by street because of my 10+ years of Real Estate experience. I have developed so many meaningful relationships with families across the city and I love my job.

In 2015 1 wanted to go a little deeper into the community so I applied to be a volunteer at Make A Wish Foundation. There are many volunteer roles within the foundation. The hardest volunteer role to achieve is a Wish Granter. A Wish Granter is an individual that goes to a home of a child that has a life threatening illness and understands what that Childs heart felt wish is and then makes it happen! After working very hard, I was able to become a Wish Granter. I sometimes felt that the families are helping me more than I am helping them. They all were so strong, positive and are fighters. They fueled me to be more like them. I have granted too many wishes in OC to count! I was chosen out of everyone in the entire MAW foundation to present the 6000 wish at the Make A Wish Gala with the radio host Ellen K.

In 20151 decided that I wanted to become a member of the Newport Harbor Yacht Club because I had grown up sailing and it was such a positive experience for me as a young adult. Again, I wanted to go a little deeper into the Newport Beach culture from land now to sea! Most members of Newport Harbor Yacht Club have family members who were, I did not. So after many hours of volunteering, developing relationships to have 1 main sponsor and 5 additional sponsors over a two year period I was able to apply. It was a pretty vigorous process to say the least, multiple interviews with 3 different boards and then the last step they ask every member if they have any discrepancies with me joining. After all of that I was able to become a member and I continue to volunteer!
I have been a part of the community for so long now in many different capacities that I believe I would be a great candidate to fill the seat for the Civil Service Board. I bring a complex understanding of many of the residents to the table. My own personal passion for serving would be to gear the city towards being more localized. Most people don't have a true understanding of their Constitutional Rights or the Bill of Rights. I believe it's my responsibly to prepare the city of Newport Beach with systems for the road ahead.

I have boated on our special harbor for at least 29 of my 31 years living in Newport. I've owned boats from 13' to 31 % including Sabots, Whalers, rowing shell, and a Bertram. Kept a boat at Basin and on a mooring. My kids benefitted immensely from our special harbor -son was a rower at NAC and recruited as student athlete to the Ivy League, my daughter is a current college sailor in the Ivy League recruited from CDM Sailing Team. I've spent too many days as a Race Committee member for local regattas. I've witnessed our harbor tranform in the summer from relatively serenity to obnoxious raft ups akin to Havasu. Electric boat rentals v. dinghy sailors v. 60' rowing shells --there is room for all if managed correctly) I live near the Back Bay and weekly walk the bluffs. I have a real estate law background and a "special place" in my heart for the California Coastal Commission. I don't have an opinion on eel grass (yet).

I am seeking a second term on the Harbor Commissioner because I believe I can continue to provide meaningful input toward the Harbor's goals and objectives, I have enjoyed giving back to my community on what is certainly the City's most precious asset. "there area wide variety of agenda items that come before us and I have found that as a practicing civil engineer my knowledge is helpful to apply in many circumstances. 1 have been actively involved in many of the defined objectives including the revisions to H1 policy, extensive study of floats and lifts, review of harbor design standards, dredging, and Lower Castaways. I beleive there is much more work to be done and I would like to continue my service in the effort to meet additional Harbor Commission Objectives. do not have a conflict of interest because I do not live on the harbor, own a boat on the harbor, and have no business dealings related to the harbor. Having grown up in and around Newport Harbor, the well-being of the Harbor and its preservation will always be important to me. It is my goal in becoming active in the community to preserve Newport Harbor for the enjoyment of future generations.

My wife, and daughters, are avid boaters and spend nearly all our free time on the water. We are active members of Balboa Yacht Club and participate in various other community organizations throughout Newport Beach.

I am both a power and sail boater. I have owned over two dozen boats in my life and have extensive knowledge in boat and yacht handling, angling, sailing, and the shipwright trades. Along with this knowledge, I work in the insurance industry and have a lifelong background in risk assessment and conflict resolution that I believe would be beneficial in approaching the issues that come before the Harbor Commission.

In addition to my experience in the insurance and security sector, I also hold the position of Marine Director for Revel Republic, the production company that most recently put on the Newport Beath International Boat Show at Lid Marina Village. This position required my interaction and collaboration with the City of Newport Beach Planning department, Public Works, Harbor Department, California Coastal Commission, United States Army Corp of Engineers, and other various entities that work, or oversee, the operations of the harbor,
harbor commission meetings regularly, so I am familiar with the organization. Along with attending these meetings, I have long standing relationships with many past and present Harbor Commissioners and the past and present Harbor Master to better my familiarity with the position that I am hoping to fill.

The past nine years serving on Parks Beaches and Recreation Commission has been incredible. I have enjoyed working with current and past commissioners, all of whom are passionate about the City and its 66 parks, tens of thousands of trees, world class beaches, amazing recreational facilities and community based programs. Continuing to serve the City in this capacity would be an honor. I was not expecting serving beyond my term and was not seeking a waiver of the two term limit rule, however, when Councilmember Weigand reached out to me seeing if I would be interested in another term, my answer was a resounding "yes."
