To the City Clerk,
Please pass along this note to the city council.
I am in favor of the proposed ordinance prohibiting the use of public property by the homeless in the manner outlined in the ordinance.
I further would support the prohibition of daytime loitering on city sidewalks and the enforcement of ADA laws requiring clear pathways.
See photograph of a homeless encampment blocking the public right of way.

Thank you for all you hard work. This ordinance looks like you are headed in the right direction.
I just wanted to share the following from my personal experience and several businesses in CDM. I am a 20 year homeowner in CDM Village.
Begonia Park (6 months ago)- I witnessed a homeless man masturbating while watching children playing in the playground. One father confronted the homeless man only to have him run away.
The police eventually came and took a report.
Frank- Manager of Panini Cafe told me about several experiences with people living on the street.
Patti (homeless woman) use to eat at the restaurant as patrons would give her gift cards. A few months ago she had a psychotic break in the middle of the restaurant. Another man walked into the middle of the restaurant with a large can of Monster and poured the whole drink on the floor and then just walked out. Another homeless man became aggressive and threated Franks life on the patio. Frank said he use to call the Police but they don't respond to his calls anymore.
Alberto -Manager at Rubys said the homeless people go through his trash every night and make a mess and he has to clean up every morning. He said homeless people disrupt customers. He has called the police who have come and asked the homeless people to leave only to have them return.
He said it is really bad for business.
Golden Spoon- the bench out front had to be removed by the city as the homeless people use to lay on it. So unfortunate, customers of golden spoon use to sit there and enjoy their treats.
Thoughts and ideas:
$50,000/year seems like an exorbitant amount of money to house a homeless person in a shelter bed. Are we trying to reunite people with their family members? Why is it the city's responsibility to take care of someone? Could there be some kind of established work program (All rights no responsibility)? What about getting a roommate program for people who can't afford shelter?
Repurposing decommissioned military bases in the state and establishing some kind of structured treatment/rehab/work training program? The problem is not housing in my opinion, it is the lack of purpose, community, work ethic, ideals, mental illness and substance abuse. I think a goal might be "behavior change" as opposed to giving money and/or housing. Community members should be discouraged from giving things/money to people living on the street. If they want to donate, make it widely publicized they can donate to a NB "homeless fund", volunteer in a shelter or interact/converse with the homeless on the street.
Thank you for all you are doing.

Dear Honorable City of Newport Beach Council Members:
Thank you for your service to our Community. I fully support the Draft Ordinance, a resolution related to homelessness. The following are my thoughts for your consideration to address this escalating situation, which go above the Draft Ordinance.
The immediate solution is right in front of your eyes, the State-owned but closed FARVEIW DEVELOPMENT CENTER. Hire Alan Dershowitz, Esquire, and sue the State of California and the City of Costa Mesa for wasting valuable State resources.
Further, file a court action to demand the State of California require drug -addicted individuals and those with mental problems to either go into long-term treatment or be put in jail each time they break the law, which they do every day. The definition of homelessness has been changed by the Liberal mentality to include anyone that wants to be homeless because they do not have the fortitude to work. This presents a distorted picture of what homelessness really is today. The people hanging around the transportation center in tents and other areas in Newport Beach and Orange County are not interested in moving to a shelter with rules and regulations, learning to take care of their basic needs, or God forbid getting a job. The FARIVEIW DEVELOPMENT CENTER is set up to provide all these needs and education in a safe and park -like environment for individuals that want to change their life. There is even a medical facility on the site. They have a hospital, classrooms, and individual housing. How many of you have driven through and looked at this massive unused site? Not using this facility is not DEFENSIBLE by any standard you want to use. This facility was built and operating long before homes were built in this vicinity. The residents in this area that do not want such a facility should have thought of that before they moved next to it.
Terminate the CityNet Contract or at least amend it so that CityNet is paid on a performance basis. Why does Newport Beach even need this organization? The City
has a Homeless Coordinator, the Newport Beach Police Department dedicates resources to homelessness and the Department also has a Clinical Outreach Van.
There are numerous Governmental Agencies in Orange County that offer assistance to the homeless and a multitude of private charities that also offer assistance, yet the problem keeps growing. You need to understand why the problem is growing and tackle that first.
The headline from "The Wallstreet Journal" in-depth story, a month ago, "California Spent $17 Billion on Homelessness. It's Not Working". What more proof do you need that the laws must change? A fundamental bedrock of the American Constitution is that laws are applied equally to all citizens. However, that part of the United States Constitution has been thrown under the bus when it comes to the homeless. They can destroy private and Government property, litter, spread unsanitary conditions, block the ADA requirements regarding sidewalks and passage for individuals with disabilities, and threaten and harass law ability members of society but they are immune from arrest or prosecution. Why? Yes, being homeless is not a crime, but being homeless does not liberate them from being law-abiding citizens.
Homelessness has escalated out of control because "do good" organizations, which are funded by the likes of George Soros and others, use the courts to give these nonproductive individuals more rights than the productive individuals contributing to Society. It is time that productive Citizens and Cities take the same approach, and file lawsuits to protect the citizens from homelessness and their abuse and destruction of property and our right to enjoyment. While the lawsuits are going through the legal process, move all the homeless to the sidewalks in front of the homes of Judges that have allowed this situation to fester with their irrational rulings.
On May 25, 2023 1 sent a letter to the City Manager requesting since Newport Beach has engaged CityNet what has been the total amount paid to City Net? No reply.
The continued acceleration of homeless drug addicts and mentally ill individuals invading Newport Beach and the leaders refusing to seek a different path indicates that Newport Beach is following the course that ruined Los Angeles and San Francisco, with Santa Ana not far behind.
Respectfully,
Gerald Giannini

Honorable Mayor and Council Members,
Firstly, we wish to thank the Council Ad Hoc Committee members Blom, Grant and Kleinman for their work to provide recommendations .
There can be no doubt that it is necessary to take action to prevent interference with public access, unpermitted structures and certain conduct on public property with jeopardizes the safety and welfare of the entire public, including the homeless.
We believe that the Recommendations set forth in the staff report are responsive and meaningful, and request that the Council adopt such Recommendations, including Resolution no. 2023-41 and the proposed Ordinance amendments no. 2023-11,with one exception:
We believe that the proposed Ordinance should be modified to enable the progressive enforcement, prosecution of individuals who repeatedly threaten or assault individuals, and that individuals who are the victims of such violence be able to pursue protection from the Policy, and legal remedies.

As a resident and a co-owner of multiple properties and restaurants on the Peninsula, we see the impact of homelessness in our city. We are grateful for the entire city council taking action on this issue and especially members of the Ad Hoc Committee; Mayor Noah Blom and Council Members Robyn Grant and Lauren Kleiman.
We hope you will support this item because our community must do more than what it is currently doing. Among other things, we have witnessed people partaking in illegal drugs, constructing unpermitted structures and people passed out on public right-of-ways. By not acting on these common occurrences, we are not helping those experiencing homelessness.
The proposed resolution and ordinance are a great step in the right direction. Please support Item

Dear Mayor Blom and Members of the Newport Beach City Council, I am writing to express my deep concern over the escalating issue of homelessness in our beloved city of Newport Beach. As a long-term resident, homeowner and business owner, it saddens me to see the current homeless situation worsening. My family has been instrumental in revitalizing the McFadden Square area over the past 12 years. We have removed two liquor stores, re-concepted multiple businesses and renovated many dilapidated properties. This was all in an effort to make the area more family friendly for locals and visitors alike.
In the past few years we have seen more open drug use and public defecation than ever. The smell of marijuana smoke has been driving away local families from visiting the area. I have not only found a dead body underneath one of my dining tables, but multiple other dead bodies have been found in a one block radius! A few years ago, a homeless person was caught on video lighting my car on fire. Twenty - foot flames burnt the car to the ground. Luckily no one was hurt. Unfortunately, picking up human feces has become a regular occurrence along with having the same homeless people urinate on our doorsteps almost daily.
I understand that homelessness is a multifaceted issue with no quick fix. However, as elected representatives of our community, we rely on your ability to devise and implement strategic solutions to tackle this problem. I implore you to view this not only as a responsibility but also as an opportunity to demonstrate your commitment to our community's betterment and a more humane solution to the homeless
individuals that are living under these inhumane conditions. Lets not only add to enforcement but lets get them the proper help that they need.
Please do NOT allow our beautiful city to become synonymous with homelessness and drug abuse. The first responders need to be given the tools and direction to enforce what is able to be enforced...
Sincerely,
Mario Marovic

Dear City Council Members,
Thank you for your time and service to our community. I am writing to express my deep concern over the increase in people sleeping in public areas, panhandling, and conspicuous substance abuse in public areas.
I was recently with my children at a local restaurant and when we left to walk to our car, there was a sale of drugs happening on the sidewalk right outside the restaurant. I was forced to have a conversation with my children that I believe wasn't appropriate for their age and it shocks and saddens me that it happened right here in our own beloved community.
Even during the day, their bike ride to and from junior guards includes unnecessary risk and exposure to certain behavior and interactions that they shouldn't be seeing as a daily part of their life.
We need to drastically reduce the number of individuals living on our streets and improve the quality of life for all Newport Beach residents.
I understand this issue is multifaceted and affects many people in many different ways, but I sincerely hope my letter highlights for you at least one specific impact this issue is having and I hope it prompts your immediate action. Please do not allow our beautiful city to become synonymous with homelessness and drug abuse.
Sincerely,

Please support the proposed Resolution No. 2023-41 and Ordinance No. 2023-11. I am thrilled to see the council and especially the AdHoc Committee Members of Mayor Blom, Councilwoman Kleiman and Councilwoman Grant taking a thoughtful approach to address the problem. Currently, there are areas in Newport Beach that have become unsafe and not welcoming to visit or live. It is cruel to both the people experiencing homeless and the people/business who are impacted, for the city to look the other way.
The ordinance and resolution will protect the health and safety of all people within the Newport Beach city limits, ensure that access to public facilities is maintained and that unpermitted structures are not maintained on public property.

My husband and I have been residents of Newport Beach since 1980. 1 was in the 2nd graduating class at Corona Del Mar High School in 1968.
The homeless problem, since the closing of many state mental hospitals many years ago, has exploded. I have personally been harassed for money at many locations in our city by aggressive homeless individuals in shopping centers and gas stations. It is very unsafe and I am very concerned for my personal safety and security. I am also very concerned for the safety of my grandchildren, who also live in our city.
In addition, the filth and squalor caused by the homeless creates severe health problems/risks for all of us.
Homelessness has changed the character of our city as well as other cities.
I implore the City Council to enact the measures on Tuesday's Agenda as well as other items necessary to reclaim our city for all those who worked so hard to make it the place we used to be proud of.
Thank you for your consideration,
Linda Goodman

I have read the legal wording of the proposed action for the homeless issue.
If I can translate into plain english, the homeless are not allow to build structures on public land.
So what is the solution?
I do not see a solution to the problem. Where do they go? How does this attempt to solve the problem? Sherry pollack

Dear City Councilmembers,
We are full time residents of 2711 ocean Blvd in corona Del Mar. We work diligently to be good neighbors - keeping our very publicly located home as nicely as possible for all. In fact, we utilize our own personal resources to keep the public street area tidy and nicely landscaped for all to enjoy. We access our home from ocean boulevard - there are many occasions where people are sleeping and residing in cars directly In front of our home. As I am going about my daily routine I am often very uncomfortable - with the people who have camped out either on the lawn in front of my home or in their vehicles - I will walk around the block because I don't feel safe directly in front of my home or especially having people watch me walk into or out of my home. Please assist those of us who Value and treasure corona Del Mar and Newport Beach to maximize safety in and around our homes.
Sincerely,
Heather and Jon Kline

As a business and property owner in the City of Newport Beach for the last 40 years I am writing to express support for the above upcoming City Council agenda item for June 28, 2023 and Item #23:
resolution number 2023-41.
The homeless are living in temporary tents and tarps, which are unsafe, uninhabitable by the CA definition of Habitability, and unsanitary. They create a fire hazard and emit human waste and debris into the streets, thereby violating the City of Newport Beach's NPDES storm water permit. To allow their presence on public right of ways and parks creates a health and safety hazard for all and takes away the rights of other citizens to utilize the same public space.
It is time to relocate them either to temporary habitable shelter and/or require they obtain medical attention, but not allow them to claim exclusive rights to public property.
It is for these reasons we support the City's efforts to address these issues through Resolution Number 2023-41.
Regards,
Katherine J Johansen

I am unable to attend this meeting as I am out of town however I fully support the new ordinance proposal. We moved here a year ago from Sacramento where they did not respond early enough and it is now completely out of control and out of the city's control, Susan Hambly 42 Whitewater Dr

The homelessness situation in Newport Beach has reached a breaking point. We pay over $40,000 in property tax and am outraged.
We live in Shorecliffs and my wife was approached by a homeless man a few weeks ago asking her and screaming at her asking what type of sex she is having with our dogs. She was taking them in a walk in PCH.
I had to step over a homeless man last week coming out of the dentist office. He was sleeping on the sidewalk at 10am.
For what we pay in tax, if we can't come up with a solution we should sell City Hall and lay-off the entire City staff.

Dear Council Members and City Manager,
I am writing to you to voice my strong support for Ordinance 2023-11 and Resolution 2023-41. These measures, if properly enacted and enforced, are exactly the sort of measures the city needs to take if it is serious about halting the proliferation of the blight of homeless encampments in our city! Please, do not let our beautiful city become yet another California eden turned into a skid row, a la San Francisco, Santa Cruz, Santa Monica, etc. Please support the resolution and ordinance recommended by the Homeless Ad Hoc Committee!
Thank you for your consideration!
Respectfully,

Subject: Concerns Regarding Homelessness in Newport Beach Dear Newport Beach City Council Members,
I am writing to you as a concerned business owner and property owner in the beautiful city of Newport Beach. First and foremost, I would like to express my gratitude for your dedicated service to our community. I truly appreciate the tireless efforts you and the City Council put forth in maintaining the prosperity and safety of Newport Beach.
However, I would like to bring to your attention an issue that has been causing distress among residents and business owners alike: the growing problem of homelessness in our city. While I understand that homelessness is a complex issue, we must address its implications on public safety, sanitation, and quality of life for all residents.
In recent months, I have witnessed an alarming increase in unsafe areas, drug use, drug paraphernalia, and the presence of urine and feces on our streets. These circumstances not only pose significant health risks, but also create an environment that compromises the well-being of our community members, our children, visitors, and business patrons.
As a business and property owner, I am deeply concerned about the negative impact this situation has on local commerce. It is in the best interest of our city's economic growth and reputation to take immediate action in addressing these concerns. I would like to urge the City Council to consider the following steps:
1. Increase collaboration with regional organizations, nonprofits, and service providers to expand outreach efforts and connect homeless individuals with appropriate resources and support systems.
2. Enhance law enforcement presence in areas heavily impacted by homelessness to ensure public safety and deter criminal activity.
3. Establish and enforce stricter regulations on public drug use, sending a clear message that such behavior will not be tolerated.
By implementing these measures, we can work together to protect the well-being of our residents, promote a safe and clean community, and set the standard for tackling homelessness in the State of California.
Once again, I would like to express my gratitude for your dedication and commitment to our city. I understand the complexity of the issues at hand and the challenges faced by the City Council. However, I firmly believe that with your leadership and the support of the community, we can find effective solutions to alleviate the concerns surrounding homelessness.
Thank you for your attention to this matter, and I look forward to witnessing positive steps being taken toward addressing these pressing issues.
Sincerely,
Benjamin C. Gott

Dear Council Members:
Thank you for dedicating your time and our City resources to such an important issue. I wholeheartedly support this Ordinance and use of City funds to attempt to curtail this issue from further damage to our economy and citizens. As we have unfortunately witnessed within other California cities, complacency cannot be tolerated. We must be proactive to address this complex issue, and this Ordinance does so on multiple fronts. Please vote to pass this measure.

Mayor Blom and Members of the Newport Beach City Council, The homelessness crisis facing our state is a serious issue that has become exacerbated over the last few years in our community.
I am writing to you today to express my support for proposed Resolution No. 2023-41 and Ordinance No. 2023-11.
I want to thank Mayor Noah Blom and Council Members Robyn Grant and Lauren Kleiman for their work as part of the Newport Beach City Council Ad Hoc Committee on homelessness.
The proposed regulations and policies under consideration by the City Council strikes a thoughtful balance between the City's obligations to protect public health and safety while using a person -centered, compassionate approach to people experiencing homelessness. Along with these new regulations and policies, the City is also expanding the number of beds available at the City's Bridge Shelter and in the process expanding the services and opportunities offered to persons experiencing homelessness.
On behalf of myself, and my family, we ask you to adopt Resolution No. 2023-41 and Ordinance No. 2023-11.
Thank you,
Peter Zak
