TITLE: Resolution Nos. 2023-44 and 2023-45: Collection of Certain Sewer and Recycling Fees and Charges Through the Property Tax Roll ABSTRACT:
There are approximately 5,300 accounts that are sewer and/or recycling only customers that do not currently receive a City of Newport Beach (City) utility bill. Section 5470 et seq., of the California Health and Safety code allows local agencies to collect certain annual fees and charges, including for sewer and recycling services, through the property tax roll. Enrolling these types of charges on the property tax roll is a common practice in California local agencies, particularly in instances where a customer is not receiving electric and/or water service from the billing agency. Because these customers do not receive a utility service from the City that can be disconnected for nonpayment, the delinquency rate can be significantly decreased through utilizing the property tax billing process. Such charges are billed as part of the normal property tax billing process as an add -on charge. FY 2023-24 will be the second year these charges are placed on the property tax roll.
RECOMMENDATIONS:
a) Conduct a public hearing;
b) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; c) Adopt Resolution No. 2023-44, A Resolution of the City Council of the City of Newport Beach, California, Confirming the Sewer Fee Report for Fiscal Year 2023-24 and Authorizing Collection of the Fee Through the Orange County Tax Roll; and d) Adopt Resolution No. 2023-45, A Resolution of the City Council of the City of Newport Beach, California, Confirming the Recycling Fee Report for Fiscal Year 2023-24 and Authorizing Collection of the Fee Through the Orange County Tax Roll. 13-1

DISCUSSION:
The City provides services including water, sewer and recycling to residents and businesses that are billed for via the City's utility billing process. While most of the City's residents and businesses are served by the City for all of these services, certain areas of the City are provided one or more of these services by other surrounding cities or special districts. The City also provides services to a limited number of customers that are located outside of, but immediately adjacent to, the City boundary. Currently, the charges related to each customer account are billed via a single bill that is sent to the customer. There are approximately 5,300 accounts that are sewer and/or recycling only customers; which can be broken down to 4,692 recycling only, and 606 sewer -only accounts. This is a small percentage of the City's total sewer accounts, approximately 23,300, and recycling accounts, approximately 22,600. To ensure the City receives timely payment for services rendered, staff proposes placing these bills on the County of Orange property tax bill.
Health and Safety Code Section 5470 et seq. authorizes the collection of sanitation and sewer system solid waste rates on the tax rolls, in the same manner and at the same time as its general taxes by causing a written report to be prepared each year and filed with the City Clerk, which identifies the parcels and the amount of the charge to each parcel for the year (Report). The Report, which is attached as an exhibit to each resolution, would result in sewer fees and recycling fees to be placed on the tax rolls for each parcel.
This is the second year the City would collect these fees in this manner and is required to publish and mail notice of the Report to new property owners and new parcels added to the Report at the address shown on said assessment. In this case, the City mailed notices of this hearing on July 7, and published notice of the hearing on July 8 and July 15.
At the hearing, the City Council is required to hear and consider all objections and protests, if any, to the Report. If the City Council does not find that protests are made by a majority of the separate parcels of property described in the Report, the City Council may adopt the Report based upon a supermajority vote. If adopted, the Report must be submitted to the Orange County Assessor's Office no later than August 10 in order for the sewer and recycling fees to be placed on tax rolls for Fiscal Year 2023-24.
Considerable staff time has been expended on collection efforts related to these bills. The frequency of issues increased significantly since Newport Coast began to be assessed the recycling fee in Fiscal Year 2021-22. Because the bills are small and infrequent, and because the bills are sent to the property address when the owner may reside elsewhere as their primary residence, collection rates have been significantly lower than for customers who are also billed for other City services. Continuing to assess these fees and charges on the property tax bill will also reduce the burden on these customers by eliminating an additional bill that must be paid on a semi-annual or bi-monthly basis. 13-2

FISCAL IMPACT:
The revenue from these customers is included in the City's budget. It is anticipated that as a result of implementing property tax billing for these accounts, the rate of collections will increase along with the corresponding revenue to the General Fund for recycling fees and the Sewer Fund for sewer service charges.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The sewer and recycling fees are already established. This action would simply allow for the collection of the fees through the tax rolls.
NOTICING:
Notice of this hearing was provided to the impacted property owners 14 days prior to today's hearing via mail and newspaper publishing. Additionally, this agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, CONFIRMING THE
SEWER FEE REPORT FOR FISCAL YEAR 2023-24 AND
AUTHORIZING THE COLLECTION OF THE FEE THROUGH
THE ORANGE COUNTY TAX ROLL
WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges, or procedures granted or prescribed by any law of the State of California;
WHEREAS, in 1992, the City of Newport Beach ("City") adopted a sewer use fee ("Sewer Fee") as set forth in Chapter 14.24 (Sewer Connection, Permits) of the Newport Beach Municipal Code ("NBMC") to cover the cost incurred in providing sewer services in the City;
WHEREAS, the Sewer Fee is adjusted from time to time in accordance with Article XIID, Section 6 of the California Constitution and California Government Code Section 53750 et seq. ("Proposition 218") including, most recently in 2017, via City Council Resolution No. 2017-61;
WHEREAS, California Health and Safety Code Section 5470 et seq. authorizes the City to collect sanitation and sewer system solid waste rates on the tax rolls, in the same manner and at the same time as its general taxes by causing a written report to be prepared each year and filed with the clerk, which identifies the parcels and the amount of the charge to each parcel identified for the year ("Sewer Fee Report"); WHEREAS, on July 26, 2022, the City Council adopted Resolution No. 2022-49 authorizing collection of the Sewer Fee through the Orange County Tax Roll in accordance with California Health and Safety Code Section 5473;
WHEREAS, adoption of this resolution authorizes collection of the Sewer Fee for Fiscal year 2023-24 on the Orange County Tax Roll;
WHEREAS, on July 7, 2023, the City mailed notices to any new record owner of any new parcel identified in the Sewer Fee Report and published notice of filing the report and the date and time of this public hearing in accordance with California Health and Safety Code Section 5473.1; and

WHEREAS, a duly noticed public hearing was held by the City Council on July 25, 2023, in the Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A notice of time, place and purpose of the public hearing was given in accordance with California Government Code Sections 6066 and 54950 et seq., and Health and Safety Code Section 5470 et seq. Evidence, both written and oral, was presented to, and considered by, the City Council at this public hearing including giving the responsible person and owner of the property an opportunity to raise objections or protest placement of the Sewer Fee on the tax rolls.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:
Section 1: The City Council has heard and considered all objections and protests to the Sewer Fee Report for Fiscal Year 2023-24 prepared pursuant to Section 5473 of the Health and Safety Code and finds that protests have not been made by a majority of owners of separate parcels of property described in the Sewer Fee Report. Therefore, the City Council has determined to adopt the Sewer Fee Report and collect said Sewer Fee for Fiscal Year 2023-24 on the Orange County Tax Roll through procedures established by the Orange County Assessor's Office.
Section 2: The City Clerk or her designee is directed to send a copy of Sewer Fee Report and this resolution authorizing collection of the Sewer Fee on the tax roll to the Orange County Assessor's Office on or before August 10, 2023, with a statement endorsed on the Sewer Fee Report under her signature that the report has been finally adopted by the City Council of Newport Beach, and take any other actions necessary to effectuate this resolution.
Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. 13-5

Section 5: The City Council finds adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA°) pursuant to Sections 15060(c)(2) (activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.

RESOLUTION NO. 2023-45
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, CONFIRMING THE
RECYCLING FEE REPORT FOR FISCAL YEAR 2023-24
AND AUTHORIZING THE COLLECTION OF THE FEE
THROUGH THE ORANGE COUNTY TAX ROLL
WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges, or procedures granted or prescribed by any law of the State of California;
WHEREAS, in 1990, the City of Newport Beach ("City") adopted a recycling service fee ("Recycling Fee") as set forth in Chapter 2.30 (Recycling Service Fee) of the Newport Beach Municipal Code ("NBMC") to cover the cost incurred by the City in complying with the California Integrated Waste Management Act of 1989 ("Act"); WHEREAS, the Recycling Fee is adjusted from time to time in accordance with Article XIID, Section 6 of the California Constitution and California Government Code Section 53750 et seq. ("Proposition 218") including, most recently in 2021, via City Council Resolution No. 2021-25;
WHEREAS, California Health and Safety Code Section 5470 etseq. authorizes the City to collect sanitation and sewer system solid waste rates on the tax rolls, in the same manner and at the same time as its general taxes by causing a written report to be prepared each year and filed with the clerk, which identifies the parcels and the amount of the charge to each parcel identified for the year ("Recycling Fee Report"); WHEREAS, on July 26, 2022, the City Council adopted Resolution No. 2022-50 authorizing collection of the Recycling Service Fee through the Orange County Tax Roll in accordance with California Health and Safety Code Section 5473; WHEREAS, adoption of this Resolution authorizes collection of the Recycling Fee for Fiscal Year 2023-24 on the Orange County Tax Roll;
WHEREAS, on July 7, 2023, the City mailed notices to any new record owner of any parcel identified in the Recycling Fee Report and published notice of filing the report and the date and time of this public hearing in accordance with California Health and Safety Code Section 5473.1; and

Resolution No. 2023-
WHEREAS, a duly noticed public hearing was held by the City Council on July 25, 2023, in the Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A notice of time, place and purpose of the public hearing was given in accordance with California Government Code Sections 6066 and 54950 et seq., and Health and Safety Code Section 5470 et seq. Evidence, both written and oral, was presented to, and considered by, the City Council at this public hearing including giving the responsible person and owner of the property an opportunity to raise objections or protest placement of the Recycling Fee on the tax roll.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:
Section 1: The City Council has heard and considered all objections and protests to the Recycling Fee Report for Fiscal Year 2023-24 prepared pursuant to Section 5473 of the Health and Safety Code and finds that protests have not been made by a majority of owners of separate parcels of property described in the Recycling Fee Report. Therefore, the City Council has determined to adopt the Recycling Fee Report and collect said Recycling Fee for Fiscal Year 2023-24 on the Orange County Tax Roll through procedures established by the Orange County Assessor's Office.
Section 2: The City Clerk or her designee is directed to send a copy of the Recycling Fee Report and this resolution authorizing collection of the Recycling Fee on the tax roll to the Orange County Assessor's Office on or before August 10, 2023, with a statement endorsed on the Recycling Fee Report under her signature that the report has been finally adopted by the City Council of Newport Beach, and take any other actions necessary to effectuate this resolution.
Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. 13-22

Section 5: The City Council finds adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
