TITLE: American Legion Bulkhead Wall Repair — Notice of Completion of Contract No. 7659-1 (16H11)

On May 24, 2022, the City Council awarded Contract No. 7659-1, American Legion Bulkhead Wall Repair, to Applied Restoration, Inc. of El Cajon, California. The project consisted of installing a new external steel wale beam along the length of the existing bulkhead, new tie rods and repairing the bulkhead cap to provide needed structural stability and to increase its useful life. The work is now complete and staff requests City Council acceptance and closeout of the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a project Notice of Completion;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.

The work necessary for the completion of this contract consisted of repairing minor concrete spalling along the existing bulkhead cap, installing a steel wale beam along the exterior of the bulkhead, installing tiebacks through the steel wale beam into the soil, and adjusting the interior marina headwalk to accommodate the protrusion of the new steel wale beam along the exterior of the wall.

The contract has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows:

The project incurred eight change orders. An additional tieback was added to reduce the span between two tiebacks near the outdoor patio area. Unforeseen obstructions were encountered when installing tiebacks 40-feet underground. This resulted in additional core drilling as well as extensive parking lot saw -cutting and excavation to facilitate obstruction removal. The material encountered while installing the tiebacks presented additional challenges. Also, the installation angles of two tiebacks were adjusted during construction resulting in the refabrication of a wale beam component. Lastly, the as-builts were deducted from the bid item because this task was completed by the City of Newport Beach's engineering consultant.

On May 24, 2022, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1 (Existing Facilities — maintenance of existing public facilities involving negligible or no expansion of use) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it had no potential to have a significant effect on the environment. 5-2
