TITLE: Newport Boulevard Landscape Improvements (Industrial Way to Pacific Coast Highway) and West Coast Highway Landscaping Improvements (West City Limits to Highland St.) — Notice of Completion for Contract No. 9226-1 (231-01)
ABSTRACT:
On January 9, 2024, the City Council awarded Contract No. 9226-1 for the Newport Boulevard Landscape Improvements (Industrial Way to Pacific Coast Highway) and West Coast Highway Landscaping Improvements (West City Limits to Highland St.) project to Marina Landscape Inc. The project improved the landscaping and irrigation along the northern city limit slopes and median of Newport Boulevard and near the western city limit of West Coast Highway. The work is now complete and staff requests the City Council accept the work and close out the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project.

The contracted work has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows:

The final total contract amount was $1,061,193.86, which was approximately 3.42% higher than the original bid amount. This cost increase was primarily due to change order requests from City of Newport Beach staff for additional planting south of Hospital Road and installing improved irrigation boxes, and dealing with unanticipated conditions during construction, such as discovering asphalt underneath the soil in both areas of the project and fixing vandalized irrigation boxes.

Actual Substantial Construction Completion Date July 23, 2024 Due to rain impacts in the spring, the start of the construction was delayed, and additional days were added due to increased grow/kill time and for the landscape work that was added south of Hospital Road. The beginning of the maintenance period marks the start of the substantially complete date, which was still ahead of the contract completion date.
FISCAL IMPACT:
The Newport Boulevard Landscape Improvements (Industrial Way to Pacific Coast Highway) and West Coast Highway Landscaping Improvements (West City Limits to Highland St.) project was included within the FY 2023-24 Capital Improvement Program (CIP) Budget. Funds for the construction contract were expended from the following accounts:

ENVIRONMENTAL REVIEW:
On January 9, 2024, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (h) (maintenance of existing landscaping) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
