Subject: COMMENTS TO CITY COUNCIL SESSION OF APRIL 15 2025-AGENDA ITEM 3 on CONSENT CALENDAR
PLEASE DISTRIBUTE TO THE CITY COUNCIL MEMBERS AND THE PUBLIC, AND ENTER INTO THE PUBLIC RECORD Re. Proposed Ordinance 2025-5 Amendment to NBMC Ordinances regarding Timelines for CompleƟon of ConstrucƟon
Honorable Mayor and Council Members:
I have just learned of the proposed Ordinance to Amend the City’s Municipal Codes relaƟng to , Timelines for CompleƟon of ConstrucƟon in Single and Two-Unit ResidenƟal zones.
This Ordinance proposes to open the door to Extensions to Timelines for up to 2 addiƟonal ( or more) Timeline extensions—all to be granted at the discreƟon of a single Building Official.
Ordinance No. 2019-8 adopted in 2019 was fundamentally a well constructed and generous ordinance, limiƟng CompleƟon Timelines to not more than three years ( increased from prior period of two years).
The excepƟonal “urgent type” ordinance extended during COVID ( 2022-8) should rightly sunset, as is suggested.
RestoraƟon and acƟvaƟon of the provision of Ordinance 2019-8 makes good sense. We recommend and request that the Council consider this approach,
rather than opening the door to more protracted construcƟon periods , subject only to the discreƟon of a “Building official”.
Introducing addiƟonal uncertainty into building Ɵmelines gives rise to more layering of mulƟple construcƟon projects in highly dense residenƟal zones. There are already safety issues associated with impairment of street/alley ingress and egress.
Our residenƟal communiƟes conƟnue to be increasingly burdened by all of the impacts associated with extensive construcƟon, parƟcularly as the City has allowed increasing intensificaƟon of development.
We respecƞully request that the City not approve the proposed new Amendment, and remand staff to a much simpler and well craŌed path established in Ordinance No. 2019-8.
Thank you for your consideraƟon.
