Agenda Item No. 7
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

David A. Webb, Public Works Director - 949-644-3311, [email protected] PREPARED BY:

Kyle Brodowski Fleet and Facilities Superintendent - 949-718-3464, [email protected] TITLE:

Public Bathroom Gate Fabrication and Installation – Reject All Bids for Contract No. 9761-1 ABSTRACT:

The City of Newport Beach conducted a formal request for bids for the fabrication and installation of 34 automatically locking security gates at 12 public restroom buildings. The City received three bids. The lowest bidder was deemed non-responsive due to not possessing the necessary license, and the other two bids received were significantly higher than the engineer’s estimate. Staff recommends the City Council reject all bids and re-advertise to provide an opportunity for the City to receive more competitive bids.

RECOMMENDATIONS:
a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines, because this action will not result in a physical change to the environment, directly or indirectly; b) Reject all bids received for Contract No. 9761-1; and c) Direct staff to re-advertise the Public Bathroom Gate Fabrication and Installation project.

DISCUSSION:

In response to the City Council’s discussion at its September 26, 2023 Study Session, staff conducted a formal request for bids (RFB) to identify a contractor for the fabrication and installation of 34 automatically locking security gates at 12 selected public restroom buildings (see table on page 2). The City received three bids. The lowest bidder was deemed non-responsive due to lacking the required California State Contractor License. The other two bids exceeded the engineer’s estimate by more than 100%. Staff recommends the City Council reject all bids and re-advertise the project to provide an opportunity for the City to receive more competitive bids.

34 Staff issued RFB 9761-1 through the PlanetBids website on March 11, 2025. Following a pre-bid meeting and job walk to review the scope and answer questions, the City Clerk opened and read the following three bids on the April 1, 2025, due date:

BIDDER

TOTAL BID AMOUNT
Low
Pacific Coast Fabrication, Inc.*
$367,200.00
2nd
Gold Coast Fence, Inc.
$653,553.00
3rd
Harris Steel Fence Co., Inc.
$828,864.00
*Non- responsive Bid
The apparent low bidder, Pacific Coast Fabrication Inc., was deemed non-responsive due to not possessing the required California State Contractor’s License. The other two bids exceeded the engineer’s estimate of $300,000 by approximately 118% and 176%, respectively.

Given the nature of the bids received, staff recommends rejecting all bids and re-advertising in order to provide a better opportunity to receive complete and responsive bids. Prior to advertising for new bids, staff will be reviewing the bid documents and looking at ways to possibly reduce costs and increase clarity in an effort to receive more focused bids. Staff will also reach out to known potential contractors directly to make sure they are aware of the bidding opportunity.

FISCAL IMPACT:

There is no fiscal impact related to this item.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
