Ms. Ung,

Thank you very much for your response today.

In regards to item #4 above:

Can you please provide the address of the City owned property in HO-1 you are referring to? The address is 1201 Dove Street in HO-1
Can you please tell me how many residential units are allocated to each City owned property? What type of units, single family, condo, townhouses? 179 units for 1201 Dove Street (HO-1); and 152 units for 868 & 870 Santa Barbara (HO-4). No development type is assigned.

However, these will most likely be rentals and/or for-sale condos, townhouses since the density range would be between 30 to 50 du/ac.

Also just to confirm, no action is being taken at the 6/10/2025 meeting in regards to the Snug Harbor Surf Farm project (Newport Beach Golf Course) or any zoning or residential overlays at the Newport Beach Golf Course, golf holes 3 - 8, correct? I do not believe so. However, please contact project planner, Joselyn Perez, for status of this project at 949-644-3312 or email:

Good afternoon Mr. Smith,
I have received your attached email, forwarding from City Clerk's Office regarding to the above item.

Please see below for my responses to your questions:

1. Where exactly are the areas please for HO-1 and HO-4? HO-1 is called Airport Area Environs Area and located near the John Wayne Airport area. HO-4 is called Newport Center Area and located mainly within the Newport Center/Fashion Island area. Below is an exhibit showing general locations of all overlay zoning districts, including HO-1 & HO-4.

1. What exactly are the Zoning Overlay areas about?

HO OVERLAY ZONING DISTRICTS
These areas were created to provide housing development opportunities, to ensure the city can meet its allocation of its fair share of Regional Housing Needs Assessment (RHNA). Here’s the link to City Council adopted Ordinance 2024-16, established the Housing Opportunity (HO) Overlay Zoning Districts in the City’s zoning code.

1. What are they currently zoned for?
There are no proposed zone changes to these areas for the City Council consideration at this meeting, so the existing zoning of these properties (office, commercial, retail, light industrial, etc.) are still in place.

1. What are they planned to be zoned for during the 6/10/2025 meeting? During this meeting, the City Council will be considering the noticed request: 1) allocating certain number of residential units to the 2 city-owned properties, one in HO- 1 and one in HO-4 and 2) adjusting height limits for certain properties within HO-4 Area to meet the intended prescribed density range for residential developments.

1. What action is planned to be taken by the City Council on 6/10/2025? Approving the proposed amendments as described in the public notice.

The staff report along with all attachments provide detailed information, analysis, and recommendations from staff. They may be reviewed at the City Clerk’s Office, 100 Civic Center Drive, Newport Beach, California, 92660 or at the City of Newport Beach website at www.newportbeachca.gov, prior to the public hearing.

Please let me know if you need any further.

Thank you and have a great day.

[EXTERNAL EMAIL] DO NOT CLICK links or attachments unless you recognize the sender and know the content is safe. Report phish using the Phish Alert Button above.

Dear Council Members Weber and Kleiman,
St. Michael’s Church is reaching out to request your assistance. It has come to our attention that inaccurate and negative information about our proposed residential project is circulating among members of the Harbor Day School community. We are addressing this letter to Council members Weber and Kleiman because we believe you may be able to help clarify to concerned community members what the City Council will be discussing and voting on Tuesday night and, the overall background of the Regional Housing Nee ds Assessment (RHNA) and state housing law that has resulted in current City of Newport Beach housing goals, policy and zoning related to both market rate and affordable housing.

For decades, St. Michael’s Church and Harbor Day School have enjoyed a positive and cooperative relationship, one that we deeply value and hope to preserve. We are asking for your help in clarifying and correcting the record regarding our proposed project.

Specifically, a recent post (attached) claims that St. Michael’s is seeking project approval before the Council this coming Tuesday, that we plan to tear down our existing gym, and that we are proposing a “low -income housing project” with a special height adjustment request. None of this information is accurate.

As outlined in the attached letter that we have sent to the Harbor Day School community (attached):
• There are no plans to demolish any existing facilities, including the gymnasium. • This is not a “low-income” or government-subsidized housing project. • There is no project approval before the Council on Tuesday. • We have not requested any special treatment; we are asking simply to be treated equally with other parcels within the designated Housing Opportunity Zone (HO-4).

What is before the Council on Tuesday is a proposed height adjustment applicable to many properties — approximately 30 parcels — within the HO -4 Zoning Overlay. The height adjustments will result in residential developments of superior design for livabilit y, safety access and community aesthetic.

Importantly, these new homes will provide units that contribute towards Newport Beach meeting the RHNA allocation for both market rate and affordable housing units as prescribed by state law. St. Michael’s is one of those parcels. Our request is straightforward: we respectfully ask not to be singled out or treated differently from the other properties within this zone, particularly because our project will serve the mission of the church by providing a small but mea ningful number of affordable senior and workforce housing units.

We are mindful that there are often concerns within communities about “low - income” or government-subsidized housing. However, we are not proposing such a development. Instead, we are planning to provide a limited number of affordable units — approximately 15 to 18 — in a local housing market that has become increasingly unaffordable for seniors and working families.

The Episcopal Diocese of Los Angeles requires that any residential project on church property include an affordable housing component, and we have carefully calibrated our plan to include the minimum affordability necessary to satisfy the Diocese’s requirements while keeping the project economically feasible.

Singling out St. Michael’s for exclusion from the height adjustments available to many properties in this zone would significantly harm the viability of the project and undermine our efforts to fulfill the church’s mission in a responsible and community-minded way.

We respectfully ask for your assistance in clarifying the facts and ensuring that St.

Michael’s Church is not prejudiced in this process. Our project is aligned with the goals of the City’s Housing Element, state housing law, the Planning Commission’s reco mmendations, and the broader community need for more diverse housing options.

Thank you very much for your time, attention, and consideration.

Sincerely,
The Rector &Vestry of St. Michaels All Angels Corona Del Mar

To Our Friends at Harbor Day School:

St. Michael’s Church is excited about the opportunity to develop a senior residential housing project on a portion of our parking lot. This project would generate financial resources to support the mission of our parish and the Diocese of Los Angeles, while also providing a limited number of affordable housing units (approximately 10–20%) to serve the broader Newport Beach community.

The City of Newport Beach has already designated our site in its Housing Element, and the Planning Commission has included it in the Height Adjustment element applicable to properties in the designated Housing Opportunity Zone (as shown on the attached map). Importantly, this project is being led by members of the St. Michael’s Vestry who are both real estate professionals and long-standing members of the local community. The project has the full support of the Episcopal Diocese of Los Angeles and is being developed under the leadership of the church itself — not by an outside developer. In addition, Farmers and Merchants Bank has expressed its financial support for the project.

It has come to our attention that there may be some misconceptions circulating within the Harbor Day School community, and I would like to take this opportunity to address them directly.

First, there appears to be a misunderstanding that "the owners of the St. Michael’s Gym will tear it down and build a low-income apartment building." This is not accurate. The property, including the gymnasium, is owned by the Diocese of Los Angeles, and there are no plans to demolish the gym. The current concept envisions locating the new senior housing project on the west end of the existing parking lot. Furthermore, while 10–20% of the units are anticipated to be affordable, it’s important to clarify that in Orange County, affordable housing is generally defined as housing for a family of four earning less than approximately $130,000 per year (subject to annual adjustments).

The goal is to provide a modest amount of affordable senior and/or workforce housing as an alternative to the high housing costs and rents currently prevalent in our community — benefiting seniors on fixed incomes and working families. This is not a government-subsidized low-income housing project.

Second, there is also confusion regarding the nature of the request before the City Council. St.

Michael’s is not making a special request for an increase in height limits. The property is zoned for housing and is included in Housing Opportunity Zone 4. The matter before the City Council is an amendment to the zoning code that makes residential building height adjustments for many properties in Housing Opportunity Zone 4. For our site, even with the adjustment, the proposed height limits are is still within the upper range that the planning commission could approve for developments in the zoning district. What we are asking is simply that St. Michael’s not be singled out or excluded from the amendment which includes many other properties in the city, particularly given our commitment to include a small affordable component that benefits the community.

Additionally, there is no vote on our specific project scheduled for Tuesday. The City Council is being asked to confirm the Planning Commission’s recommendation regarding height adjustments in Housing Opportunity Zone 4. Our request is that St. Michael’s be treated consistently with other properties in the zone.

We are proud of the longstanding positive relationship between the Harbor Day School community and St. Michael’s Church, and we are hopeful that this spirit of cooperation will continue. We sincerely ask for your support as we move forward with a project that will serve the needs of the community, and St. Michael’s.

Sincerely,

The Vestry of Saint Michael and All Angels

Dear Mayor and City Council Members,

I am writing to express my strong opposition to the proposed "special" height increase at St. Michael & All Angels Episcopal Parish Church on Pacific View Drive in Corona Del Mar.

The request for this increase is based upon the pretense that an increase from 32 / 37 feet for flat / sloping roofs to 50 / 55 will allow for "greater flexibility in designing a residential project", and that it would then be consistent with max height limits allowed in the Private Institutional Zoning District.

According to the City itself, the PI Zoning District is intended to provide for areas appropriate for privately owned facilities that serve the public, including places for assembly/meeting facilities (e.g., religious assembly), congregate care homes, cultural institutions, health care facilities, marinas, museums, private schools, yacht clubs, and comparable facilities.

While the current use of the site obviously meets this criteria as a church, a residential project does not align with the criteria above, and as such, there is no reason why a

residential project warrants an alignment with the maximum height limits under the PI Zoning District.

It would appear that the Church is using its current status as a privately owned facility that serves the public to effectuate a change in use that inherently negates this status given the proposed residential development.

I urge you to deny this request and preserve the scale and harmony of our community.

Thank you for your consideration.

Dear Mayor and City Council Members,

I am writing to express my strong opposition to the proposed “special” height increase at St. Michael & All Angels Episcopal Parish Church on Pacific View Drive in Corona Del Mar.

This “special” height increase is not compatible with the surrounding properties and would negatively impact the character and aesthetic of the area. Please keep the height at 32 feet in line with surrounding properties and don’t increase it to 50 feet(flat) or 55 feet (sloped). I urge you to deny this request and preserve the scale and harmony of our community.

Dear Mayor and Honorable Members of the City Council,

As both a member of the Newport/Mesa community and a parishioner at St. Michael & All Angels Episcopal Church, I would like to extend our sincere gratitude to the Planning Commission and City Council for including our property in the recent height adjustment under HO-4, alongside Newport Center and the Irvine Company.

This important adjustment provides us with the opportunity to thoughtfully design a multi- family housing project that not only complements the surrounding community but also includes a meaningful affordable housing component. The additional flexibility will allow us to better fulfill our mission of service, creating a project that addresses critical housing needs while continuing to support the broader goals of inclusivity, outreach, and stewardship that have long defined our presence in Newport Beach.

We are truly grateful for your leadership and vision in helping make this next chapter possible, and we look forward to working collaboratively with the City as we move forward.

Dear Mayor and City Council Members,

It has come to the community's attention that there is a proposed Housing Development Project to replace St. Michael and All Angels Episcopal Church in Corona Del Mar.

We are in opposition to this development for the following reasons:
- already existing apartments at corner of Marguerite and Pacific View Drive -traffic will greatly increase the already congested roads due to Harbor Day School, Lincoln Elementary School and Pacific View Mortuary and Memorial Park -daily use of St. Michael gymnasium for the students of the preschool and HDS students. These students rely on use of the gym for various activities including sports activities, Cub Scouts belonging to Scouts of America and Girl Scouts

Replacement of this staple organization would not only negatively impact the aesthetic of the area but more importantly displace the daily use of the space and create more traffic in an already congested area.

Please reconsider this decision and explore other options.

Thank you for your attention.

Sincerely,
Alina Hackett

I am writing to express my strong opposition to the proposed “special” height increase at St. Michael & All Angels Episcopal Parish Church on Pacific View Drive in Corona Del Mar.

This height increase is not compatible with the surrounding properties and would negatively impact the character and aesthetic of the area. I urge you to deny this request and preserve the scale and harmony of our community.

Thank you for your consideration.

The gym has been a safe place for the kids to play various sports and camps. It's also close proximity to the schools which makes it super convenient for the kids.

Thank you for your consideration.

Dear Mayor and Honorable Members of the City Council,
As a long-time member of the Newport Beach community and a parishioner at St. Michael & All Angels Episcopal Parish Church located on Pacific View Dr. in Corona del Mar, I would like to extend the Parish's sincere gratitude to the Planning Commission and City Council for including our property in the recent height adjustment approval under HO-4 applicable to the Newport Center area.

This important adjustment provides us with the opportunity to thoughtfully design a multi- family housing project that not only complements the surrounding community but also includes a meaningful affordable housing component. The additional flexibility will allow us to better fulfill our mission of service, creating a project that addresses critical housing needs while continuing to support our broader goals of inclusivity, outreach, and stewardship that have long defined our presence in Newport Beach.

We are truly grateful for your leadership and vision in helping make this next chapter possible for the community, and we look forward to working collaboratively with the City as we move forward with our project.

RE: Agenda Item No. 18 - Height Limit Adjustment of St. Michael and All Angels Episcopal Church’s Property as part of the Housing Opportunity Overlay Zoning and Coastal Zoning District Height Limit Adjustment Amendments (PA2024-0205)

Dear Mayor Stapleton and City Councilmembers:

The St. Michael and All Angels Episcopal Church (“Church”) formally requests that our property remain in the proposed amendment being considered by the City Council at their June 10, 2025, meeting to adjust the height for certain properties located within Newport Center Area (HO -4) Subarea of the Housing Opportunity (HO) Zoning District. Importantly, our project, which will include some units for low -income housing in addition to market rate units, is aligned with the goals of the City’s Housing Element, state housing law and RHNA, the Planning Commission’s recommendations from their January 23, 2025, meeting, and the broader community need for more diverse housing options.

The Church is located at 3233 Pacific View Drive in Corona del Mar and is identified by the City of Newport Beach as Housing Opportunity Site No. 147 in HO-4. The adjustment, recommended by the Planning Commission, would allow residential buildings to be up to a maximum of 50 feet for flat roofs and 55 feet for sloped roofs. This height is consistent with the maximum height limit allowed in the Private Institutional Zoning District by Newport Beach Municipal Code Section

20.30.060(C)(2)(d). Similar to other properties, the base height limit of 32 feet for a flat roof and 37 feet for a sloping roof impedes the design of a multi-unit residential project on the property given the required density levels. Our property size is approximately 3.59 acres and allows for a multi-unit residential development with a density range of 20 -50 dwelling units/acre. Due to the location and design of the existing Church (which we have no plans to alter at this time), a preliminary design has identified about 1.62 acres available for the residential development. The current base height limit restricts the available area to accommodate the prescribed range of units.

The adjustment in height limit would provide greater flexibility in design and result in a superior residential development project. Similar to the many other parcels included in the amendment, the ST . MICHAEL
& ALL ANGELS

3233 Pacific View Drive, Corona del Mar, CA 92625
www.stmikescdm.org • (949) 644-0463
height adjustment would reduce the footprint necessary to accommodate the residential structures and result in the following:

• Accommodate density range (including 10%-20% affordable units) • Allow for increased landscape areas
• Improve vehicular and pedestrian circulation
• Improve emergency vehicle ingress and egress
• Provide more area for shared open space
• Provide more area for private balconies and patios

Importantly, the height limit would only apply to the proposed residential development. Thank you for your consideration of our request and we look forward to working with the City of Newport Beach to design a high-quality residential development on our property in furtherance of the City’s housing goals and policies, state law and RHNA requirements.

Sincerely,

Mark Peterson, Senior Warden

Dear Mayor and members of City Council,

I wish to communicate my strong opposition to the proposed “special” height increase at St. Michael and All Angels Episcopal Church, or St Mike’s as we lovingly refer to it, on Pacific View Drive in Corona Del Mar.

Permission to increase the height would negatively impact the area, aesthetic, and integrity of that corner of our community. Passing a height change would directly impact the type of businesses allowed to occupy that space when it exchanges hands. That property is uniquely positioned within our community near elementary and preschools, and its gym and meeting rooms have served as a recreational bridge for our community.

I know you have no control over the transaction and potential buyers, however I would encourage you to consider how passing a special height increase would create a domino of disruption to the uses of that property within our community. I urge you to deny this request.

Thank you for your consideration.

Best,

Dear Mayor and Members of the Newport Beach City Council, As a long-time resident of Corona del Mar and a member of the Jasmine Creek community, I’m writing to express my strong support for the inclusion of St. Michael & All Angels Episcopal Church’s proposed senior housing development in the recent height amendment approved by the Planning Commission for Housing Opportunity Zone 4 (HO- 4).

This project—undertaken by St. Michael’s and the Episcopal Diocese of Los Angeles— represents a compassionate and much-needed repurposing of an underutilized parking lot to meet a growing need in our city. I am grateful the Planning Commission saw the value in this and included the parcel in the HO-4 designation.

This isn’t just a housing project. It’s a lifeline for seniors in our city—particularly those living on modest incomes. I feel passionately about this population because I spent over two years managing the City of Newport Beach’s Home Delivered Meals program (Meals on Wheels) at the OASIS Senior Center, following six months as a volunteer driver. What I witnessed during that time was eye-opening. These were residents of Newport Beach—

many living alone, with limited mobility, scarce financial resources, and little to no nearby family support. Often, our volunteers were the only human connection they had each week.

In a city of approximately 83,000 residents, nearly 29% are over the age of 65 (according to the City’s website). Yet Newport Beach has just 435 affordable rental units—and only 232 of those are designated for seniors. That is not nearly enough. Further, a single-person household earning $114,000 or less qualifies as “Moderate Income” in our city. Many seniors fall within that bracket or lower, and still struggle daily with housing and food insecurity.

The proposed project at St. Michael’s is aligned with existing local housing precedents.

Just a block away is Seaview Plaza, which provides 100 HUD-subsidized senior units.

Nearby Baywood Apartments offer 105 moderate-income units for qualifying residents.

The St. Michael’s project similarly proposes to include 10–20% affordable units, while creating a safe, senior-focused community close to OASIS, groceries, pharmacies, public transportation, parks, and medical care.

I urge the Council not to let misinformation or vocal opposition obscure the facts or derail a development that clearly supports the City’s housing goals and addresses a well- documented local need. Please support this project to the fullest extent—on behalf of our seniors today, and on behalf of each of us who may one day walk in their shoes.

Sincerely,

Dear Mayor and City Council Members,

I am writing to express my strong opposition to the proposed “special” height increase at St.

Michael & All Angels Episcopal Parish Church on Pacific View Drive in Corona Del Mar.

This height increase is not compatible with the surrounding properties and would negatively impact the character and aesthetic of the area. I urge you to deny this request and preserve the scale and harmony of our community.

Thank you for your consideration.

Lisa Hallock
