Agenda Item No. 8
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

David Miner, Chief of Police - 949-644-3701, [email protected] PREPARED BY:

Katie Eing, Emergency Services Coordinator - 949-644-3670, [email protected] TITLE:

Resolution No. 2025-29: Emergency Management Performance Grant Authorization ABSTRACT:

In order for the City of Newport Beach to receive future expenditures from the Emergency Management Performance Grant (EMPG), it must re-identify and re-authorize agents of the City to execute all grant-related documents as required by the California Office of Emergency Services and the Federal Emergency Management Agency (FEMA) every year.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and Adopt Resolution No. 2025-, A Resolution of the City Council of the City of Newport Beach, California, Authorizing Persons Holding Certain Designated Positions to Execute Emergency Management and Homeland Security Grant Documents for and on Behalf of the City of Newport Beach for the Purpose of Obtaining Certain Federal Financial Assistance and/or State Financial Assistance.

DISCUSSION:

The City’s Emergency Management Program is managed by the Police Department and includes several key components: education, training, planning and multi-agency coordination. The City is served by the Orange County Sherriff’s Department Emergency Management Bureau, which is the lead agency of the Orange County Operational Area (OA). The OA is the countywide advisory body responsible for preparing for, responding to, and mitigating local emergencies. A primary function of this group is the coordination of state and federal grants.

The EMPG program provides grants to states to support state, local, tribal and territorial governments in preparing for all hazards, as authorized by the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.).

Title VI of the Stafford Act authorizes FEMA to make grants for the purpose of providing a system of emergency preparedness for the protection of life and property in the United States from hazards and to vest responsibility for emergency preparedness jointly in the federal government, states and their political subdivisions. The purpose of EMPG is to sustain and improve comprehensive emergency management programs at the state, tribal, territorial governments and local levels from all man-made and natural disasters through the prevention, mitigation, response and recovery for all hazard events.

The City has received EMPG funds since 1998 and previously used the funding to purchase equipment for its Emergency Operations Center to conduct citywide disaster exercises and train City staff on the National Incident Management System, as well as the Disaster Service Worker program.

FISCAL IMPACT:

The Emergency Management Performance Grant is projected to provide approximately $12,300 in revenue this year to support the City’s Emergency Management Program activities. However, since the grant requires 100% matching funds, which will be provided through existing maintenance and operating budgets, staff is required to get City Council approval, per City Council Policies F-3 and F-25.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
