Honorable Newport Beach City Council Members and District 1 Councilmember Stapleton, I'm requesting the council review the newly painted advertising banners visible upon entry of the Balboa Peninsula, on the exterior of the Lido Marina Village parking structure. They are an eyesore, possibly a distraction for approaching drivers and disruptive to the classic, coastal charm of the peninsula, Lido and Cannery Village aesthetic.
Could you please clarify if a permit was submitted for the installation of the painted exterior wall which seems equivalent to billboards for City of Hope, along with what is being referenced on their Instagram as a "walkable outdoor art gallery" throughout the parking garage and entryway area? Regarding the art gallery installation, their Instagram @lidomarinavillage also notes "Stay tuned --this is just the beginning." The outdoor art gallery, while an honorable concept to highlight Southern California artists, resembles graffitti. Has a variance been approved regarding wall sign ordinances to allow the City of Hope advertising? Additionally, has a review or approval of any permit taken place for their installation of the deeply saturated, bright, rainbow colored paintings on the west exterior facing wall of the structure adjacent to the parking garage entryway and throughout the garage?
While an effort to collaborate with a City of Hope charitable initiative may be admirable, it should still require a permit or some type of approval to install an outdoor art gallery in a historic waterfront district where great attention has been taken to preserve some original elements. Additionally, were local Newport Beach artists given a chance to submit for the work or did they engage LA artists? This isn't LA yet this seems to be an LA styled art installation.
Has any of this been approved? I have concerns Redwood West's newly established ownership interest in Lido Marina Village, just initiated in February 2026, may be resulting in missed steps to comply with the proper due diligence required via the City of Newport Beach and these changes along with "more to come" could negatively affect our neighborhood.

Good afternoon,
I am submitting my public comments for tomorrow's city council meeting. Please see the attached pdf documents and related links below as relevant information for my public comment.
My public comment below:
"Good evening. My name is Bjorn Hazelquist. I'm the founder of a local nonprofit based in Costa Mesa called Strength In Pain Foundation. We're are an organization dedicated to supporting survivors of brain injury and concussions. I'm also a local surfer. I was born and raised here in Newport and like many others I learned to surf at Blackies and have been surfing in this community for over 30 years. For my entire life Newport Beach has had blackball rules to protect swimmers. In essence what I'm proposing tonight is blackball for beginner surfers, or as experienced surfers affectionately refer to them, kooks.
I'm here tonight because Newport Beach has some of the most heavily surfed beaches in the world — and with that comes a real and growing safety problem that this Council has the power to address.
In 2022 and 2024,1 personally suffered two concussions and a major neck injury from two separate collisions in the water. On both occasions, the surfer who hit me lacked the experience and skill to safely navigate the conditions they paddled out into. They should not have been out there. I suffered personal injury and financial damages in the form of out of pocket medical expenses that exceeded $1 Ok. And yet, under current law, I had no legal recourse — because the harm was unintentional, courts typically rule that the injured party assumed the inherent risks of the sport, and the case is dismissed.
I believe the nature of this entire situation is fundamentally unfair. Just like all of us here would not be comfortable with a 12 year old child with no driving experience taking a car for a joyride on the 405 freeway at rush hour, most experienced surfers are not comfortable with absolute beginners paddling out at advanced surfing spots. Unnecessary collisions and injuries inevitably happen when there's no regulation over where beginners are allowed to surf.
At the local level, I'm asking this Council to take two practical steps:
First — post large, clearly visible informational signage at Newport Beach surfing spots, similar to what exists at Trestles in San Onofre. These signs map the breaks and specify the skill level and equipment required to surf safely as well as specify which spots are for experienced surfers only. They set clear expectations before anyone paddles out.
Second — I support citation authority for local enforcement when beginner surfers disregard posted guidelines and cause injury to others. Accountability at the local level is a reasonable and proportionate response to reckless behavior in the lineup.
I also want to be clear about what I am not asking for. I firmly oppose a state -mandated surfing license. Surfing is a free and open pursuit. Management of surf lineups belongs at the local level with this Council not with state agencies. And I also want to be clear. I do not support a local city -mandated surfing license either. It's been done in the past in the 1960's, and during that era it seemed to be more about control and collecting revenue for the city than anything else.
The Kook Patrol Initiative isn't just a name. It's a call to action to raise awareness for brain injuries and concussions as well as to build a culture of accountability in the water.
Thank you for allowing me to speak and thank you for your time. " Here are links to my nonprofit website as well as a relevant link to an article about a surfing community in Bali that recently instituted very similar regulations on beginner surfers. https://strengthinpainfoundation.or ,/

Small portable folding signs can be used on the

be beginner spots, but also turn into advanced
spots when waves get big. Examples of this
would be 28th street and Blackies in the winter
months. Small portable signs could potentially
read something like "Experienced to Advanced
Surfers Only".

rim
Strength In Pain Foundation supports practical,
common sense measures aimed at preventing
inexperienced surfers from injuring themselves
and others in the water.
One example we endorse is the
use of large, clearly posted
signage at surf spots — like the
board shown here at Trestle
that maps out the area and
specifies the skill level and
equipment required to surf that
break safely. These kinds of
informational tools help set clear

We also support local governments issuing citations to those who disregard postedguidelines and, as a result, cause inj
ury to other surfers.
Accountability at the local level is a reasonable and proportionate response to reckless behavior in the lineup.
STRENGTH IN PAIN
FOUNDATION
Strength In Pain Foundation supports
legislative reform that would allow injured
surfers to pursue legal action against
negligent surfers, even in cases of
accidental injury. Under current lave, most
legal professionals agree that personal
claims are only viable when harm was
caused with deliberate, malicious intent.
When an injury results from an unintentional accident, courts typically rule that the injured party assumed the inherent risks of the sport — and the case is dismissed.
We believe this standard is fundamentally unfair. Experienced surfers should not have to bear the consequences of being injured due to the recklessness or ignorance of an inexperienced surfer simply because the harm was unintentional. Negligence should be enough.
STRENGTH IN PAIN
FOUNDATION
Strength In Pain Foundation does not
support the implementation of a state -
mandated surfing license.
While there have been recent rumors of
such a proposal being considered in
California, we are firmly opposed to the
idea. We view this as government
that would place excessive regulation on
surfing and surf culture as a whole.
The image of armed law enforcement stopping
surfers at the beach and demanding to see
their credentials is, for obvious reasons,
deeply concerning. Surfing is a free and open
pursuit, and it should remain that way.
We believe that managing surf lineups and
beach conduct is best left to local
communities and loyal governments — not
state agencies. Regulation at that level is
both more appropriate and more effective
than atop-down licensing system,

As an owner of duplexes in Newport Beach and holder of a STRI, I support Newport Beach's goal of a safe and welcoming community during peak periods.
But I'm concerned the February 10 'Safety Enhancement' agenda item did not adequately inform the public about the scope of what was being adopted.
I urge the City Council to cure and correct the issue by rescinding the February 10 action and restarting the process from scratch, with clear public notice and meaningful community input — including from responsible STIR owners and managers — so we can work collaboratively toward effective, balanced safety solutions.
Thank you,
Jean and Craig Batley

While I generally supportNewport Beach's goal of maintaining safety in our community, I'm concerned that the February 10 "safety enhancement" enactment did not adequately inform the community about what was being adopted.
I am particularly concerned about the portions of the City Council's action that includes penalties for violations. While the penalties were ordinary residence seem reasonable, the impact on short term property owners for infractions as far from reasonable.. Losing a short term license for violations without adequate warning or opportunity for correction presents a long-term financial penalty for these property owners far in excess of the penalties of other residents. Potentially losing my income as a result of an infraction is disproportionally severe. I think greater opportunity for citizen input should have been made before and acting this measure. I urge the City Council to reconsider or, even better, resend this action and start over. There are too many flaws in what was enacted to let this go forward. The City Council needs greater community input with clear and adequate public notice - including from short- term property owners and managers - so we can work collaboratively toward effective balanced safety solutions.
I would also be interested in seeing data that shows how big a problem this actually is.
