Good day,
Could you please clarify for me, are the Ordinance provisions related to "SECTION 11.08.020 (USE OF SHADE COVERINGS)" to be specifically applicable "TO ADDRESS ILLEGAL ACTIVITY DURING HIGH-RISK PERIODS", or are they to be applicable year round? Thank you,
Adam L

Mayor, City Council Members, City Manager and City Attorney:
On behalf of the Newport Beach Short-Term Rental Association (NBSTRA), we write to express our support for the Brown Act “cure and correct” demand letter referenced on the City Council’s March 24, 2026 agenda. We understand the allegation relates to actions taken on February 10, 2026 under Agenda Item No. 3 and concerns whether the agenda description provided clear notice to the public regarding the scope and effect of what was considered and acted upon.
NBSTRA’s central concern has consistently been ensuring that policy changes affecting regulated communities, property owners, and the public are developed through a transparent process with clear notice and meaningful stakeholder input. To be clear, the Brown Act issue itself is related to portion of the new ordinance related to shade structures and is not the only — or even the primary — basis for the concerns NBSTRA has raised regarding the City’s recent approach to “Safety Enhancement” policies. However, correcting the alleged Brown Act violation presents an important opportunity for the City to reset the process in a way that strengthens public trust and improves the quality and durability of the final policy outcome.
Accordingly, NBSTRA urges the City to cure and correct any Brown Act deficiency by rescinding the prior action as necessary and restarting the process from the beginning with clear, accurate agenda notice and a robust public outreach plan. From NBSTRA’s perspective, that outreach should include intentional engagement with impacted stakeholders — including the Short-Term Lodging Permit (STLP) community — so that responsible owners and professional managers can contribute practical, operational input toward the shared goal we all support: a safe and welcoming Newport Beach, especially during high-activity holiday and peak-period weekends.
NBSTRA stands ready to participate constructively in that process. We would welcome the opportunity to meet with City staff and legal counsel, participate in workshops or working groups, and help ensure that affected permit holders and managers are aware of and engaged in any re- agendized proceedings. Our members have a strong interest in effective, enforceable rules that enhance safety while also being developed through a process that is transparent, collaborative, and legally sound.
Thank you for your attention to this matter and for your continued service to the Newport Beach community. Please feel free to contact us if we can be helpful as the City considers its next steps.
Sincerely,
Jeff Flint
