RESOLUTION NO. 2026-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, LIMITING THE
PARKING OF VEHICLES ON CERTAIN CITY STREETS,
INCLUDING STREETS IN NEWPORT HEIGHTS AND
CLIFF HAVEN AND REPEALING RESOLUTIONS 2020-
42 AND 2026-13
WHEREAS, Section 200 of the City Charter, of the City of Newport Beach ("City"), vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the City Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges or procedures granted or prescribed by any law of the State of California;
WHEREAS, Section 12.44.010(8) (Parking Time Restrictions) of the Newport Beach Municipal Code ("NBMC") provides that when authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of time longer than two (2) hours upon such streets or portions thereof as the City Council shall designate by resolution; WHEREAS, Section 12.44.01 0(E) (Parking Time Restrictions) of the NBMC authorizes the City Council to vary the hours or days of parking restrictions when special parking or traffic conditions exist;
WHEREAS, the City Council adopted Resolutions No. 2020-42 and 2026-13 to establish a comprehensive set of parking regulations within the City pursuant to Sections
12.44.010(8) and (E) (Parking Time Restrictions);
WHEREAS, residents and property owners in the Newport Heights and Cliff Haven community have indicated that student parking has caused undue impacts on St.
James Road and Snug Harbor Road on school days; and
WHEREAS, the City Council now desires to repeal Resolutions No. 2020-42 and 2026-13 and amend the parking regulations based upon the special parking and traffic conditions that currently exist within the City.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:
Section 1: The City Council does hereby repeal Resolutions No. 2020-42 and 2026-13 and amends the parking regulations based upon the special parking and traffic conditions that currently exist within the City as follows:

Section 4: If any section,subsection, sentence, clause or phrase of this resolutionis,forany reason, held to be invalidor unconstitutional,such decision shall not affectthe validityor constitutionalityofthe remainingportionsof thisresolution.The City Council hereby declaresthat itwould have passed thisresolution and each section, subsection, sentence, clause or phrase hereof, irrespectiveof the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 5: The CityCouncilfindsthe adoption ofthisresolutionisnot subject to the CaliforniaEnvironmental QualityAct (“CEQA”) pursuant to Sections 15060(c)(2) (the activitywillnot resultina director reasonablyforeseeable indirectphysical change inthe environment) and 15060(c)(3)(theactivityisnot a projectas defined in Section 15378) Resolution No. 2026-
of the CEQA Guidelines, CaliforniaCode of Regulations, Title14, Division6, Chapter 3, because ithas no potentialforresultinginphysicalchange to the environment, directlyor indirectly.
This resolutionshalltake effectimmediately upon itsadoption by the CityCouncil,and the CityClerkshallcertifythevote adopting thisresolution.
