NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:
Resolution No. 2026-
Section 1: The City Council does hereby adopt the modified SRFF, including all "FY26/27 Fee" amounts, as set forth in Exhibit 1, which is attached hereto and incorporated herein by reference.
Section 2: Except as provided by Section 3 through 5, the charges listed in the modified SRFF shall: remain the "FY 25/26 Fee" amounts through June 30, 2026; be set at the "FY 26/27 Fee" amounts effective July 1, 2026; and be adjusted for CPI in accordance with this resolution.
Section 3: For all charges, except building and development fees, that were the subject of the Cost Studies, the "FY 25/26 Fee" amounts shall remain in effect until June 30, 2026, the "FY 26/27 Fee" amounts shall be effective July 1, 2026, and the first annual automatic CPI adjustment shall occur on July 1, 2027, in accordance with this resolution.
Section 4: For building and development fees that were the subject of the Cost Studies, the "FY 25/26 Fee" amounts shall remain in effect until July 24, 2026, the "FY 26/27 Fee" amounts shall be effective July 25, 2026, and the first annual automatic CPI adjustment shall occur on July 1, 2027, in accordance with this resolution.
Section 5: For the Junior Lifeguard Program fees the "FY 25/26 Fee" amounts shall remain in effect until June 30, 2026, and the "FY 26/27 Fee" amounts shall be effective July 1, 2026. A six percent (6%) adjustment shall occur for the Junior Guard Participant Fee on July 1, 2027, and each year thereafter on July 1 until the full cost of service is reached. The underlying cost of service used to calculate the Junior Guard Participant Fee shall be adjusted annually by CPI beginning July 1, 2027. The Junior Guard Administrative Fee shall be adjusted by CPI beginning July 1, 2027, in accordance with this resolution. The phase-in schedule shall remain subject to adjustment if the fee is studied prior to completion of the phase-in period.
Section 6: The Fire Chief is authorized to waive the City's Emergency Medical Service fees, under the following circumstances:
a. Demonstrated financial hardship where the patient is uninsured or underinsured, and, after application of all available insurance benefits, is unable to pay the remaining balance;
b. Insufficient insurance coverage where insurance payments do not fully satisfy the cost of services, and recovery of the remaining balance would impose undue financial hardship;
Resolution No. 2026-
c. Charity care or hardship determination as may be evaluated and documented through the City's established billing review or administrative procedures; and/or
d. Other extraordinary circumstances, as determined by the Fire Chief where waiver or reduction of fees are warranted in the interest of fairness and consistent with the City's cost recovery policies.
Section 7: Direct pass through, actual, and statutory fees in the SRFF may be updated by the Administrative Services Director to reflect actual third-party costs or amounts established by statute without further action by the City Council.
Section 8: The City Council hereby reaffirms all CPI adjustments to the SRFF that have been implemented prior to the adoption of this resolution.
Section 9: Except as provided herein, all charges within the SRFF subject to automatic CPI adjustments shall be adjusted annually on July 1 of each year by the percentage change in the annual average CPI for the most recently completed calendar year for which data is published compared to the annual average CPI for the immediately preceding calendar year.
If a charge has been in effect for less than twelve (12) months as of the applicable July 1 adjustment date, the CPI adjustment shall be prorated to reflect the portion of the year the charge has been in effect. Proration shall be calculated by multiplying the annual CPI percentage change by a fraction, the numerator of which is the number of full months the charge has been in effect as of July 1, and the denominator of which is twelve (12). Any partial month of fifteen (15) days or more shall be counted as a full month.
CPI shall mean the Los Angeles-Long Beach-Anaheim, CA Area, All Urban Consumers, All Items, Base Period (1982-84=100) , or successor index, as published by the United States Department of Labor, Bureau of Labor Statistics. For purposes of this section, "annual average CPI" means the arithmetic average of the monthly index values for the applicable calendar year, as published by the Bureau of Labor Statistics.
Except where a separate resolution, ordinance, agreement, or applicable law provides for a different CPI adjustment method, timing (including adjustments other than July 1 ), measurement period, or duration, the automatic CPI adjustments to charges shall occur annually on July 1 of each year for three (3) consecutive years following the effective date Resolution No. 2026-
of the charge. After the third consecutive annual CPI adjustment, automatic CPI adjustments shall cease unless and until the charge is subsequently updated and readopted, at which time automatic CPI adjustments shall resume in accordance with this section. This adjustment shall not apply to any fee that is subject to Proposition 218 (California Constitution Articles XIIIC and XIID and California Government Code Section 53750).
Section 10: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution.
Section 11: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 12: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
Resolution No. 2026-
Section 13: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution except that any building and development impact fees shall take effect 60 calendar days after adoption of Ordinance No. 2026-_.
ADOPTED this 12th day of May, 2026.
