Agenda Item No. 15
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

David Miner, Chief of Police - 949-644-3701, [email protected] PREPARED BY:

Jennifer Manzella, Police Fiscal Services/Facilities Manager - 949-644-3655, [email protected] TITLE:

Agreement for Supplemental Law Enforcement Services between the County of Orange and the City of Newport Beach ABSTRACT:

The City of Newport Beach (City) contracts with the County of Orange for supplemental law enforcement services, which are primarily used for significant special events and deployments such as the Fourth of July holiday and the Orange County Marathon. The current agreement ends on June 30, 2026, and the Newport Beach Police Department (NBPD) is requesting City Council approval for a new five-year agreement. The agreement does not include a not-to-exceed amount. Either party may terminate the agreement without cause upon 20 days prior written notice.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve the Agreement Between the County of Orange and the City of Newport Beach for supplemental law enforcement services and authorize the Mayor and City Clerk to execute the agreement.

DISCUSSION:

For more than 30 years, the City has contracted with the County of Orange for supplemental law enforcement services from the Sheriff-Coroner’s Department. These services are an integral part of the NBPD’s planning and deployment for both routine annual events (such as the Fourth of July holiday) and unanticipated events (such as presidential visits).

The proposed agreement maintains the same terms and conditions as the current agreement. This same standardized contract language is used by law enforcement partners throughout Orange County and remains unchanged since it was approved by the Orange County Board of Supervisors in 1994. There is no listed not-to-exceed amount in the agreement. For reference, the current five-year agreement has resulted in a total of $281,139.32 in payments to the County of Orange.

FISCAL IMPACT:

The adopted budget includes sufficient funding for this agreement. Services related to the Fourth of July will be expensed to the Services, Professional & Technical NOC account in the NBPD Support Services Division, 01035352-811008. Services related to other events will be expensed to the Services, Professional & Technical NOC account in the NBPD Traffic Division, 01035354-811008.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
