August 25, 2026, Public Facilities Corp. Agenda Comments The following comments on items on the Newport Beach Public Facilities Corp. agenda are submitted by:
Jim Mosher ( [email protected] ), 2210 Private Road, Newport Beach 92660 (949-548-6229) Item III. ELECTION OF OFFICERS
Does anyone actually pay attention to the actions of the City Council acting as the PFC board of directors?
As indicated in Item 1 (Minutes of the August 26, 2025), in an action continued from the previous year, at its meeting last year the board unanimously approved amendments to the corporation’s by-laws. The approved amendments to Section 4.02 eliminated the annual election of officers and permanently designated the Mayor of Newport Beach as the Chairperson and the Mayor Pro Tem as the Vice Chairperson. Similarly, amendments to Article III permanently designated the City Council members as the Directors.
The significance of the present agenda Item III is unclear, since the Board no longer has the power to elect a Chair or Vice Chair or to designate what persons should be Directors.
PUBLIC COMMENTS
Additionally, the placement of “PUBLIC COMMENTS” after “ELECTION OF OFFICERS” is inconsistent with California open meeting laws. Government Code Section 54954.3 requires the public be given a chance to comment “before or during the legislative body’s consideration of” each item, not after.
PFC Information Deleted from City Website?
As a non-agenda comment, my previous years’ comments contained a link to the Public Facilities Corporation webpage on the City website. According to the Internet Archive’s Wayback Machine, that page continued to exist as recently as February 7, 2026, and provide the public with useful information about the corporation, including its by-laws (although it did not provide any clear links to the bond activity overseen by the corporation, and the copy of the by-laws found by the Internet Archive’s web crawler on December 15, 2025, did not show the revisions made last year). The link now returns a “page not found” error, and entering “Public Facilities Corporation” in the City website’s search box comes up blank. Similarly, searching the City website for “Certificates of Participation” yields only a link under the “Long-Term Obligations” section of the Financial Information page, and that link returns a “page not found” message (again, the Wayback Machine shows it existed as recently as March 11, 2026).
Has information about the Corporation been moved to a new website? If so, even Google seems unable to find it.
