Agenda Item No. 17
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

Melissa Hartson, Library Services Director - 949-717-3801, [email protected] PREPARED BY:

Rebecca Lightfoot, Library Services Manager - 949-717-3819, [email protected] TITLE:

Budget Amendment to Allocate Funds from the Restricted Programs Fund to the Newport Beach Arts Foundation Programming Budget ABSTRACT:

The Balboa Performing Arts Theater Foundation distributed its remaining assets to the Newport Beach Arts Foundation in 2015 with the stipulation that the money be used to fund performing arts in the City of Newport Beach, with preference given to Balboa Village, as requested through the City Arts Commission. The City placed the funding in a restricted reserve account. Staff is seeking approval of a budget amendment to move $11,480 from the restricted fund reserve and allocate it to the Newport Beach Arts Foundation Programming budget to present a concert at Marina Park in October 2026.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and
b) Approve Budget Amendment No. 27-004 and appropriate funds from the Restricted Programs Fund Reserves in Fund 180 to increase expenditures in the Newport Beach Arts Foundation FY 2026-27 Programming budget 1800013-841004.

DISCUSSION:

In 2015, the Balboa Performing Arts Theater Foundation was dissolved and its remaining assets of $175,000 were distributed to the Newport Beach Arts Foundation to be used for performing arts in the city as requested through the City Arts Commission (Commission), with preference given to projects in Balboa Village. The Newport Beach Arts Foundation turned those funds over to the City in May 2015 and the funds were placed in a special restricted account.

The Commission is presenting a Concert at Marina Park on October 11, 2026, at 4 p.m., featuring the band Diego’s Garage. Staff is seeking City Council approval a budget amendment to move $11,480 from the restricted fund reserve and allocate it to the Newport Beach Arts Foundation Programming budget to cover the cost of the concert.

A breakdown of the costs is as follows:

Diego's Garage
$3,250
DJE Sound & Lighting
$6,770
Children's Activities
$625
Janitorial
$135
Photographer
$700
TOTAL
$11,480
FISCAL IMPACT:

The Budget Amendment appropriates $11,480 in increased expenditure appropriations from the Balboa Performing Arts Theater Foundation Fund unappropriated fund balance.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
