Ordinance No. 2026-12: Approving a Zoning Code Amendment and Ordinance No 2026-13: Approving a Development Agreement for the 1300 Dove Street Townhome Project (PA2025-0170) ABSTRACT:
For the City Council’s consideration is the adoption of Ordinance Nos. 2026-12 and 2026-13, approving a zoning code amendment and development agreement for a 132-unit residential townhome project (1300 Dove Street Townhome Project). This ordinance was introduced and considered at the City Council meeting on July 28, 2026.
RECOMMENDATIONS:
Find Addendum to the Newport Beach General Plan Housing Implementation Program Final Program Environmental Impact Report SCH No. 2023060699 prepared for the 132-unit Residential Townhome Project located at 1200 Dove Street, 1300 Dove Street, and 4041 MacArthur Boulevard (PA2025-0170) in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and City Council Policy K-3, and adopted by the City Council on July 28, 2026, by Resolution No. 2026-57; Waive full reading of an Ordinance, read by title only, conduct a second reading and adopt Ordinance No. 2026-12, An Ordinance of the City Council of the City of Newport Beach, California, Approving a Zoning Code Amendment for a 132-Unit Residential Townhome Project Located at 1200 Dove Street, 1300 Dove Street, and 4041 MacArthur Boulevard (PA2025-0170); and Waive full reading of an Ordinance, read by title only, conduct a second reading and adopt Ordinance No. 2026-13, An Ordinance of the City Council of the City of Newport Beach, California, Approving a Development Agreement for a 132-Unit Residential Townhome Project Located at 1200 Dove Street, 1300 Dove Street, and 4041 MacArthur Boulevard (PA2025-0170).
DISCUSSION:
On July 28, 2026, the City Council conducted a noticed public hearing on the proposed 1300 Dove Street Townhome Project (Project). After taking public testimony, the City Council voted unanimously to take actions related to the California Environmental Quality Act (CEQA) and to approve the Project. The City Council introduced and passed to a second reading Ordinance No. 2026-12 approving a Zoning Code Amendment to Section 20.80.025 (Housing Opportunity Overlay Zoning Districts Maps) of the Newport Beach Municipal Code (NBMC) to include the Project Site in the Housing Opportunity Sites Overlay in the HO-1 Airport Area Environs Map and Ordinance No. 2026-13 that approves a development agreement between the City of Newport Beach (City) and the applicant related to development of the Project.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
An Addendum to the Newport Beach General Plan Housing Implementation Program Final Program Environmental Impact Report (SCH No. 2023060699) was prepared by EPD Solutions, Inc. dated May 2026 and peer reviewed by the City’s consultant Kimley-Horn, pursuant to Section 15162 (Subsequent EIRs and Negative Declarations) and 15164 (Addendum to an EIR or Negative Declaration) of the CEQA Guidelines.
The Addendum included an analysis of the proposed zoning code amendment and development agreement, in accordance with the implementing guidelines of CEQA, the State CEQA Guidelines, and the City Council Policy K-3. The City Council adopted the Addendum at the July 28, 2026, meeting by Resolution No. 2026-57.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
