Agenda Item No. 8
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

Mark Vukojevic, Utilities Director - 949-644-3011, [email protected] PREPARED BY:

Joshua Rosenbaum, Sr. Management Analyst - 949-644-3057 [email protected] TITLE:

Amendment No. One to Service Agreement with EwasteDisposal, Inc., for Hazardous Disposal Services (Contract No. 7371-3) ABSTRACT:

The Utilities Department utilizes a certified hauler to perform as-needed disposal services for asbestos cement (AC) pipes and other hazardous items. The current agreement with EwasteDisposal, Inc., is set to expire on October 31, 2026. Staff requests City Council approval to amend the agreement with EwasteDisposal to increase the total contract compensation amount by $80,000 and extend the term to an additional two years to October 31, 2028.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Authorize the Mayor and City Clerk to execute Amendment No. One to On-Call Maintenance/Repair Services Agreement with EwasteDisposal Inc., for As-Needed Disposal Services for Asbestos Cement Pipe and Other Hazardous Items to increase the contract amount by $80,0000 for a total contract not-to-exceed amount of $200,000 and extend the contract an additional two years to a new expiration date of October 31, 2028.

DISCUSSION:

The Utilities Department utilizes a certified hauler to perform as-needed disposal services for AC pipe and other hazardous items. The services include providing sealed storage bins for the Utilities Department to properly store wrapped AC pipe prior to collection and disposal at a certified facility. In addition, the agreement includes services for the collection and disposal of other hazardous items, including electronics or e-waste, and other household waste items that crews may come across during course of routine field operations.

In October 2023, following a request for proposals (RFP) process, the City of Newport Beach awarded a three-year, $120,000 agreement to Newport Beach-based EwasteDisposal, Inc., for as-needed disposal of AC pipe and other hazardous materials.

For the first three years of the agreement, the Utilities Department has spent about $35,000 per year on as-needed disposal services. Staff have been satisfied with the performance of the company for the past several years and recommends City Council approval of an amendment to the agreement for a two-year extension and an increase of $80,000 to the authorized total compensation amount.

FISCAL IMPACT
The adopted budget includes sufficient funding for these services. Expenses will be primarily charged to the Water Enterprise Fund’s Yard and Project Materials account 7019052-841073. Expenses will also be charged to Facilities Maintenance account 851062 within the Storm Drain and Wastewater Divisions within the Utilities Department.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
