AMENDMENT NO. THREE TO
ON-CALL MAINTENANCE/REPAIR SERVICES AGREEMENT
WITH VERNE'S PLUMBING, INC. FOR
PLUMBING SERVICES
THIS AMENDMENT NO. THREE TO ON-CALL MAINTENANCE/REPAIR
SERVICES AGREEMENT ( Amendment No. Three ) is made and entered into as of this 13th day of October, 2026 , by and between the CITY OF NEWPORT BEACH, a California municipal corporation and charter city City ), and VERNE'S PLUMBING, INC., a California corporation Contractor whose address is 8561 Whitaker Street, Buena Park, CA 90621, and is made with reference to the following:
RECITALS
A. On January 24, 2023, City and Contractor entered into an On-Call Maintenance/Repair Services Agreement (Contract No. C-7140-3) to perform on-call plumbing maintenance and/or repair services for the City B. On June 18, 2024, City and Contractor entered into Amendment No. One to the update the Schedule of Billing Rates.
C. On August 20, 2025, City and Contractor entered into Amendment No. Two to the Two
January 23, 2028, increase the total compensation, and update the insurance requirements.
D. The parties desire to enter into this Amendment No. Three to increase the total compensation and update the Administration and Notices sections of the Agreement.
NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as follows:
1. COMPENSATION TO CONTRACTOR
Section 4.1 of the Agreement is amended in its entirety and replaced with the following: Contractor for the Services on a time and expense not-to-exceed basis in accordance with the provisions of this Section and the Letter Proposal and the Schedule of Billing Rates attached hereto as Exhibit B and incorporated herein by reference. Except as otherwise provided herein, no rate changes shall be made during compensation for all Services performed in accordance with this Agreement, including all reimbursable items and subconsultant fees, shall not exceed Three Hundred Fifty Thousand Dollars and 00/100 ($350,000.00), without prior written amendment to the Agreement

including all reimbursable items and subconsultant fees, in an amount not to exceed One Hundred Thousand Dollars and 00/100 ($100,000.00). 2. ADMINISTRATION Section 6 of the Agreement is amended in its entirety and replaced with the This Agreement will be administered by the Municipal Operations Department.
Facilities Superintendent or designee shall be the Project Administrator and shall have the authority to act for City under this Agreement. The Project Administrator shall represent City in all matters pertaining to the Services to be rendered pursuant to this Agreement.
3. NOTICES
Section 25.2 of the Agreement is amended in its entirety and replaced with the addressed to City at:

4. INTEGRATED CONTRACT
