Agenda Item No. 9
TO:

HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM:

Zachary Gentry, Municipal Operations Director - 949-644-3055, [email protected] PREPARED BY:

Kyle Brodowski Fleet / Facilities Superintendent - 949-718-3464 [email protected] TITLE:

Amendment No. Three to On-Call Plumbing Maintenance and Repairs Services with Verne’s Plumbing Inc.

ABSTRACT:

Staff requests City Council approval to increase Verne’s Plumbing, Inc.’s agreement by $100,000, from $250,000 to $350,000, to ensure uninterrupted plumbing services at City of Newport Beach (City) facilities and to terminate Pacific Plumbing of Southern California’s agreement due to its failure to respond to service requests or provide quotes.

RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Approve Amendment No. Three to the On-Call Maintenance / Repair Services Agreement with Verne's Plumbing, Inc., for Plumbing Services, for a new total not-to-exceed amount of $350,000, and authorize the Mayor and City Clerk to execute the amendment; and c) Authorize the termination of the On-Call Maintenance and Repair Services Agreement with Pacific Plumbing of Southern California (dba Pacific Plumbing of Santa Ana.).

DISCUSSION:

On January 24, 2023, the City Council approved three On-Call Plumbing Maintenance and Repair Services Agreements with Verne’s Plumbing, Inc., Pacific Plumbing of Southern California, and ACCO Engineered Systems, Inc. Each agreement had a three-year term, with a not-to-exceed (NTE) amount of $200,000.

The agreements support plumbing maintenance and repairs for multiple City departments, including Municipal Operations, Fire, Utilities, Police and Recreation & Senior Services. Annual expenditures were projected at approximately $200,000.

On August 20, 2025, the city manager approved Amendment No. Two to each agreement, increasing the NTE amount from $200,000 to $250,000. Verne’s demonstrated expertise in underground plumbing, competitive pricing, and a willingness to provide aggressive quotes positioned the firm to support upcoming projects, including plumbing fixture replacements at the OASIS Senior Center, the Central Library, and Central Library, main-line piping repairs at Balboa Yacht Basin, and outdoor shower for renovations at Corona del Mar State Beach. Because the current $250,000 NTE amount is insufficient to sustain services throughout the remainder of the term, staff recommends increasing Verne’s agreement by $100,000, for a revised NTE amount of $350,000.

Pacific Plumbing has not consistently responded to service requests or provided quotes when requested, limiting the agreement’s effectiveness. Staff therefore recommends formally terminating the agreement in accordance with its termination provisions. The ACCO agreement, currently authorized at $250,000, will remain unchanged.

FISCAL IMPACT:

The adopted budget includes sufficient funding for this amended agreement. It will be expensed to the Maintenance and Building Repair account in the Municipal Operations Department, 0108541-851016, and to the respective maintenance accounts of other departments requesting plumbing services from these contractors.

ENVIRONMENTAL REVIEW:

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

NOTICING:

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
