Resolution No. 2026-93: A Resolution of the City Council of the City of Newport Beach, California, Ratifying the Proclamation of a Local Emergency Issued on October 9, 2026 ABSTRACT:
On October 9, 2026, City Manager Seimone Jurjis, serving in his capacity as director of emergency services for the City of Newport Beach (City), signed a proclamation of local emergency in response to coastal flooding caused by Tropical Storm Rachel.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2026-93: A Resolution of the City Council of the City of Newport Beach, California, (i) Ratifying the Proclamation of a Local Emergency Issued on October 9, 2026, by City Manager Seimone Jurjis, the Director of Emergency Services of the City of Newport Beach, and Approving and Authorizing Certain Actions Related Thereto.
DISCUSSION:
On October 9, 2026, the city manager signed a proclamation of local emergency to aid the City in its response to the coastal flooding, elevated ocean water levels, high surf, and other storm-related conditions caused by Tropical Storm Rachel.
The emergency conditions began along the Balboa Peninsula on or about October 8. The affected or potentially affected areas include low-lying portions of Newport Beach, including but not limited to, the Wedge, Corona del Mar Main Beach parking lot, Corona del Mar Main Beach, Breakers Drive, the Balboa Pier parking lot, Seashore Drive between 44th and 60th Streets, 50th and 51st Streets, and 6th through 17th Streets.
As of the writing of this staff report on October 9, the City has undertaken emergency protective measures, including rebuilding protective beach berms, opening tide valves, operating pumping systems, and responding to flooding incidents. City staff, including personnel from the Municipal Operations, Utilities, Public Works, Newport Beach Fire, Newport Beach Police Department and City Manager’s Office will continue to monitor surf conditions and ocean and water levels and respond as needed to help protect the coastal areas of the community.
Staff recommends the City Council adopt the resolution thus confirming and ratifying the October 9 proclamation of local emergency and orders. If approved, the proclamation and orders will remain in effect until the local emergency is terminated by proclamation of the City Council, at the earliest possible date that conditions warrant. Pursuant to Section 2.20.065 of the Newport Beach Municipal Code, City staff will update the City Council at least every sixty (60) days regarding the status of the local emergency until the City Council terminates the local emergency.
FISCAL IMPACT:
The City has and will continue to expend resources on its response to the flooding. The ratification of the proclamation of local emergency will allow the City to continue to procure services and goods in an expedited manner.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this ratification of the proclamation of local emergency is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
