STAFF REPORT
Date: March 25, 2022 Agenda Item:

2.C.

To: Honorable Mayor and City Council Members
Prepared By: Andy Okoro, City Manager
Department: Administration
SUBJECT:

Proclamation of Local Emergency Regarding Novel Coronavirus (COVID-19) 30-day review.

RECOMMENDATION:

That the City Council review Proclamation of Local Emergency Regarding Novel Coronavirus (COVID-19), continue Local Emergency and return to City Council in thirty days, or soon thereafter, for review until emergency is terminated.

SUMMARY:

The California Emergency Services Act (Government Code section 8550, et seq.), Government Code section 8630, and Norco Municipal Code Chapter 2.28 empower the Director of Emergency Services and the Norco City Council to proclaim a Local Emergency when the City Council is not in session when there exist conditions of disaster or of extreme peril to the safety of persons and property within the territorial limits of the City of Norco which are or are likely to be beyond the control of the services, personnel, equipment, and facilities of the City and require the combined forces of other political subdivisions to combat.

BACKGROUND:

On March 8, 2020, the Riverside County's Public Health Officer declared a local health emergency based on an imminent and proximate threat to public health from the introduction of a Novel Coronavirus (COVID-19) in Riverside County. On March 10, 2020, the County of Riverside proclaimed a local emergency. The Governor of California proclaimed a State of Emergency on March 4, 2020, pursuant to the authority vested in him, particularly, Government Code section 8625. On March 13, 2020, President Trump declared the Coronavirus Pandemic a National Emergency.

On Monday, March 16, 2020, the City of Norco declared a local emergency to increase its efforts to protect the public from COVID-19. The City of Norco proclamation of local emergency notes that “there exists conditions of a disaster or extreme peril to the safety

of persons or property within the territorial limits of the City of Norco that are beyond the control for the services, personnel, equipment and facilities of the City for the reason of COVID-19.”
The declaration of local emergency comes as local, state and federal governments are working in an attempt to control the spread of COVID-19 across the country, in order to reduce the potential of the virus to overwhelm the nation’s healthcare agencies.

On March 18, 2020, the City of Norco City Council ratified by unanimous vote the declaration of local emergency.

Per Chapter 2.28 of the Norco Municipal Code, ratification of the declaration by the City Council is required within seven (7) days of the declaration. If ratified, the declaration of local emergency must be reviewed every 30 days, or soon thereafter, until the local emergency is terminated. Although the Governor has outlined conditions that must be met in order to implement the various phases that will ultimately result in rescinding the Governor’s Order, most of these conditions have not be met. Consequently, the Governor’s Stay at Home Order still remains in place. Staff is recommending that the City Council approve the continuation of the City’s Declaration of Local Emergency.
