The fact that insurance is obtained by Contractor shall not be deemed to release or diminish the liability of Contractor, including, without limitation, liability under the indemnity provisions of this Contract. The duty to indemnify City shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Contractor. Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Contractor, its principals, officers, agents, employees, persons under the supervision of Contractor, vendors, suppliers, invitees, consultants, sub-consultants, subcontractors, or anyone employed directly or indirectly by any of them.

To the extent available, the bonds shall further provide that no change or alteration of the Agreement (including, without limitation, an increase in the total compensation, as referred to above), extensions of time, or modifications of the time, terms, or conditions of payment to the Contractor, will release the surety. RE: Bid Protest: Bid Invitation #54111.9 - Moreno Arena Bleacher Support Pad Replacement Bid Date: August 12, 2024 @ 10:00 AM
Dear Amanda Hamilton,
This letter shall serve as Hamel Concrete, Inc.’s formal protest against the bid proposal submitted by Metrocell Construction, Inc. which bid on August 12, 2024. Hamel Concrete, Inc. is protesting the above referenced bid, in accordance with the provisions of the “Notice of Invite to Bid”, Metrocell Construction, Inc. failed to complete and provide the necessary information required in the bid documents (see attached NIB & ITB).

1. Metrocell Construction, Inc. failed to provide three references on P-6 of the bid documents.

Please refer to Exhibit 1.
a. Metrocell Construction, Inc. only listed two projects as references; LA-RICS and City of Chino Police Department. Metrocell failed to list 3 required projects and do not have the required job experience and/or ignored the three project requirement. b. By Metrocell Construction, Inc. not providing required information, this grants them an unfair advantage of allowing them to provide partial information.

2. Based on the electronic file provided by the City of Norco, it was undeterminable if Metrocell Construction, Inc. bid documents were stamped and sealed, refer to Exhibit 2. a. If in fact, Metrocell Construction, Inc. did not seal this document with their stamp, this would grant them additional time not afforded to other bidders.

3. Metrocell Construction, Inc. failed to provide the description of items with unit price written in words on P-10 and P-11 of the bid documents. Please refer to Exhibit 3 a. The note on P-12 states that “the unit price must be written in words and also shown in figures. The total price must be extended for each item of work and the total of all items must be inserted in the line provided”

4. Metrocell Construction, Inc. failed to comply with P-13 of the bid documents. Please refer to Exhibit 4.
a. Metrocell Construction, Inc. failed to include the names and titles of their forenamed principals as stated: “IN WITNESS WHEREOF, BIDDER executes and submits this proposal with the names, titles, hands, and seals of all forenamed principals this 12th day of August, 2024.”

STAFF REPORT
Date: September 18, 2024 Agenda Item:

3.G.

To: Honorable Mayor and City Council Members
From: Alma Robles, Community Development Director
Prepared By: Alma Robles, Community Development Director Department: Planning
SUBJECT:

A proposal to amend Chapter 5 (Architectural Style Standards) of the previously adopted Objective Development Standards to require the incorporation of architectural corrugated metal siding for all developments with 100 or more residential units.

RECOMMENDATION:

Adopt Resolution 2024-53, approving an amendment to the Objective Development Standards.

SUMMARY:

This request is to amend Chapter 5 (Architectural Style Standards) of Objective Development Standards (ODS) to require the incorporation of architectural corrugated metal siding (i.e. metal wall panel systems) for all housing developments with 100 or more units.

BACKGROUND:

PROJECT DESCRIPTION AND ANALYSIS: On March 16, 2022, the City Council adopted Objective Development Standards (ODS) to address changes in California State laws by placing an emphasis on standards that provide objective criteria as the basis for project approval or denial. These standards were adopted by the City Council to comply with California Senate Bill 35, and accordingly apply to the ministerial approval of proposals for new multifamily and mixed-use development within the City that qualify as an “SB35” project. Additionally, these Design Standards also serve as design guidelines for the discretionary review of multifamily and mixed-use development proposed within the City that does not qualify as an SB35 project and therefore does not qualify for ministerial review.

This amendment to the ODS will require the incorporation of architectural corrugated metal siding (i.e. metal wall panel systems) for at least 40% of a building’s exterior surface for all developments with 100 or more residential units (ref. attached Exhibit

Page 226 of 259 ends

"A"). The intent of this amendment is to promote high quality architecture and ensure the durability of building facades against the elements, particularly for large development projects.

IMPACT ANALYSIS PER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): In accordance with the California Environmental Quality Act (“CEQA”), the proposed amendment to the ODS has been deemed exempt from environmental review as there is no possibility that the proposed changes would have a significant impact on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). The amendment will not result in any increase in the intensity or density of any land use above what is currently allowed. Staff is recommending that a Notice of Exemption be prepared and filed in accordance with CEQA Guidelines.

CONCLUSON: Staff recommends that the City Council adopt the Resolution, adopting the requested amendment to the ODS.

FISCAL IMPACT:

There is no financial impact.

RELATIONSHIP TO STRATEGIC PLAN:

An amendment to the Objective Development Standards, is consistent with Strategic Direction #3 - Economic Development and Financial Stability: Assure financial stability by expanding development efforts, diversifying revenue sources and continuing prudent financial management.

STAFF REPORT
Date: September 18, 2024 Agenda Item:

5.A.

To: Honorable Mayor and City Council Members
From:

Prepared By: Colin Burns, City Attorney
Department: Administration
SUBJECT:

Consideration of a Resolution to Adopt a Salary Adjustment for the City Manager position
RECOMMENDATION:

Adopt Resolution No. 2024-54 adjusting the Salary of the City Manager retroactive to August 15, 2024.

SUMMARY:

The proposed Resolution is to update the compensation for the City Manager to account for the Interim City Manager position.

BACKGROUND:

On August 15, 2024, the City Council appointed Finance Director Lisette Free, as Interim City Manager. In light of the increased responsibilities of performing the duties of Interim City Manager, the City Council desired to increase Ms. Free’s pay to $112.7204 per hour.

California Code of Regulations Section 570.5 requires a publicly available pay schedule for every classification that is subject to CalPERS membership. Further, CalPERS desires Interim positions be paid at the same rate as full time positions. Therefore, to implement the increase to $112.7204 and comply with CalPERS’s desire that the Interim City Manager be paid at the rate of full time City Manager, proposed for City Council consideration is a Resolution adjusting the pay for Step 1 - City Manager to $112.7204 per hour, retroactive to August 15, 2024 (total annual salary $211,013).

FISCAL IMPACT:

The Fiscal Impact is a savings to the FY 24-25 Budget based on the rate since the former City Manager was in step 7: The salary and benefits savings are $75,980

Page 240 of 259 ends

($38,818 salary and $37,162 benefits). This calculation does not include severance paid to the former City Manager.

RELATIONSHIP TO STRATEGIC PLAN:

This action is consistent with Strategic Plan Direction No. 2 - Human Capital: Build a sustainable workforce to meet the needs of all stakeholders.

STAFF REPORT
Date: September 18, 2024 Agenda Item:

6.A.

To: Honorable Mayor and City Council Members
From: Alma Robles, Community Development Director
Prepared By: Vince Acuna, Senior Planner
Department: Planning
SUBJECT:

Tentative Parcel Map 38849 (Calland Engineering, Inc.): A request to subdivide an existing 1.72-acre lot into 3 lots located at the northeast corner of Mountain Avenue and Paddock Lane, within the A-1-20 Zone (APN: 126-060-001).

RECOMMENDATION:

Adopt Resolution 2024-52, approving Tentative Map 38849.

SUMMARY:

An existing, vacant 1.72-acre parcel within the A-1-20 Zone is proposed to be subdivided into 3 residential lots. No development is proposed with this application. On its regular meeting on August 14, 2024, the Planning Commission recommended that the City Council approve this project.

BACKGROUND:

PROPERTY DESCRIPTION: The project site is a rectangular shaped single parcel located at the northeast corner of Mountain Avenue and Paddock Lane (ref. Exhibit A – Location Map and Exhibit B – Aerial). The site has a frontage along Mountain Avenue and Paddock Lane of about 280 feet and 250 feet respectively (ref. Exhibit C – Tract Map).

No street dedications are required (already exist), however, street improvements are not present along Mountain Avenue, along the western boundary of the site. No horse trails are adjacent to the project site on both street frontages (Mountain or Paddock).

However, there is an existing horse trail easement running along the northern property lines of the private parcels east of the project site. The site is relatively flat and slopes gently from north to south. The table below summarizes the existing land uses, Zoning, and General Plan Designations of the subject parcel as well as the surrounding area.

* See Parcel Map for list of proposed sizes/dimensions for all lots.

No development is proposed with this project. A building plan check and grading plan will be required prior to the construction of any single-family residence on any of the 3 lots. As street improvements are currently incomplete along Mountain Avenue, the project is conditioned to construct half of the street improvements on the said street.

Additionally, the project is also conditioned to record a trail easement along the north property line, in order to extend the horse trail easement that already exists on the properties west of the project site through the project, and into Mountain Avenue.

IMPACT ANALYSIS PER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): Staff has determined that this project is exempt from CEQA review under CEQA Section 15332, Class 32 – In-fill Development Projects. The project occurs within city limits on a site of no more than five acres, substantially surrounded by urban uses.

PLANNING COMMISSION ACTION: On August 14, 2024, the Planning Commission adopted Resolution 2024-10 recommending that the City Council approve this project.

NOTICING: Notices were mailed to surrounding property owners within a 300-foot radius of the subject property. No written comments were received at the time this report was written.

CONCLUSION: Staff recommend that the City Council adopt the attached Resolution approving Tentative Map 38849.

FISCAL IMPACT:

Not applicable for this item.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Plan Direction No. 4. Communication and Stakeholder Experience: Enhance the stakeholder experience, engage the community, and build brand awareness through proactive, effective and consistent communication.
