City Council

STAFF REPORT
Date: February 5, 2025 Agenda Item:

3.J.

To: Honorable Mayor and City Council Members
From: Chad Blais, Public Works Director
Prepared By: Chad Blais, Public Works Director
Department: Public Works
SUBJECT:

Resolution updating the City's restricted parking areas by adding "No Parking" along the easterly frontage of Valley View Avenue from Third Street to Fourth Street.

RECOMMENDATION:

Adopt Resolution 2025-03 to add "No Parking" along the easterly frontage of Valley View Avenue from Third Street to Fourth Street.

SUMMARY:

The City completed a pavement rehabilitation project on Valley View Avenue from Third Street to Fourth Street that resulted in the roadway being narrowed to accommodate new drainage system with curb and gutter. As a result, there is insufficient roadway width to allow street parking that was previously allowed when the curb and gutter was not present. Therefore, Public Works is seeking City Council approval to add "No Parking" along the easterly frontage of Valley View Avenue from Third Street to Fourth Street.

BACKGROUND:

The City recently completed a long-awaited street rehabilitation project on Valley View Avenue from Third Street to Fourth Street. This project also included some critical storm drain improvements, including adding curb and gutter, which was severely needed to reduce reoccurring flooding during rain events. However, the project also narrowed the roadway and eliminated the ability for vehicles to be parked safely on the easterly side of the roadway. Therefore, "No Parking" restrictions should be implemented on the easterly frontage of Valley View from Third Street to Fourth St. "No Parking" restrictions already existed on the westerly frontage of the roadway adjacent to the trail.

Chapter 10.06.110, "Posted Parking Zone Established", states "The City Council may from time to time by resolution or ordinance establish parking time limits on various streets in the city." Therefore, the Director is recommending the City Council approve

Page 443 of 514 ends

Resolution 2025-03 adding "No Parking" along the easterly frontage of Valley View Avenue from Third Street to Fourth Street. Staff has updated the parking restriction index and maps to reflect the requested changes as shown on map pages 10 and 13.

FISCAL IMPACT:

There is no financial impact with approving this parking restriction as the required "No Parking" signs along Valley View Avenue have already been completed by the Contractor for the project.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Direction #4 - Communication and Stakeholder Experience: Enhance the stakeholder experience, engage the community, and build brand awareness through proactive, effective and consistent communication.

City Council

STAFF REPORT
Date: February 5, 2025 Agenda Item:

5.A.

To: Honorable Mayor and City Council Members
From: Alma Robles, Community Development Director
Prepared By: Vince Acuna, Senior Planner
Department: Planning
SUBJECT:

Second Reading: Ordinance, Zone Code Amendment 2024-04 (City of Norco): A City initiated amendment to Title 18, Chapter 18.43 (Hearings and Appeals Therefrom), Chapter 18.68 (Accessory Building Use Permits), and Chapter 18.40 (Site Plan Review), increasing the public noticing radius requirements from 300 feet with a minimum number of 25 properties captured, to 600 feet with a minimum of 40 properties captured, and to require noticing for Site Plan Review applications.

RECOMMENDATION:

Adopt Second Reading: Ordinance No.1128, approving Zone Code Amendment 2024-

04. SUMMARY:

This Zone Code Amendment proposes to increase the city’s public noticing radius requirements from 300 feet with a minimum number of 25 properties captured, to 600 feet with a minimum of 40 properties captured, and to require noticing for Site Plan Review applications.

BACKGROUND:

CURRENT STANDARDS AND BACKGROUND: The purpose of public noticing is to inform surrounding property owners of any nearby development that could have the potential to affect their properties. The development code currently requires properties within a 300-foot radius of a project site involving a public hearing (i.e. Variances, Conditional Use Permits, Subdivision maps, etc.) to be notified, provided that there are at least 25 properties captured within the noticing radius. If there are less than 25 properties within the 300-foot radius, the radius size must be increased until at least 25 properties are captured. Additionally, Accessory Building Use Permits, which is an entitlement type reviewed by the Planning Commission as a discussion item also requires the same notification requirement as discussed above. A Site Plan Review is another entitlement type that is reviewed by the Planning Commission, but the

Page 469 of 514 ends

development code currently does not require any notification for Site Plan Review applications.

The City Council directed Planning staff to investigate increasing the city’s notification radius for entitlement applications that require public noticing, to appropriately notify all properties potentially affected by development, particularly when a development occurs in a street that is in, or leads to, a cul-de-sac.

On November 6, 2024, the City Council had a formal discussion regarding notification radius requirements. At that meeting, the City Council directed staff to bring forward a Zone Code Amendment changing the city’s requirements from 300 feet with a minimum number of 25 properties captured, to 600 feet with a minimum of 40 properties captured, and to also require noticing for Site Plan Review applications.

Zone Code Amendment 2024-04 was brought before the Planning Commission for consideration on December 11, 2024. During this meeting, the Planning Commission voted to recommend that the City Council approve the Zone Code Amendment.

ZONE CODE AMENDMENT 2024-04: Title 18 of Norco Municipal Code will be amended as follows (redlines show proposed changes):

18.43.06 Procedure for Hearings and Appeal Therefrom.
(3) The Community Development Director or designee shall cause notice of the public hearing to be published at least once in a newspaper of general circulation, published and circulated in the City, or, if there is none, it shall be posted in at least five public places within the City, not less than 10 calendar days before the date of said hearing. The Community Development Director or designee shall also cause said notice to be mailed, postage prepaid, not less than 10 calendar days before the date of said hearing to owners of real property within a minimum radius of 300 600 feet of the exterior boundaries of the property which is the subject of the application, or within the minimum radius that is required such that a minimum of 25 40 property owners will be notified, whichever is greater. However, public notice for a hearing for conditional use permit approval to authorize the reuse or redevelopment of any existing warehouse or industrial building with a gross floor area larger than 20,000 feet in the Heavy Commercial/Light Manufacturing (M-1) Zone and the Gateway Specific Plan Industrial District (I District) shall be mailed to all property owners within 1,000 feet of the exterior boundaries of the property which is the subject of the application. The names and addresses of property owners for mailing the notice of public hearing shall be taken from the last equalized assessment roll, or, alternatively, from such other records as contain more recent information in the opinion of the Planning Commission.

18.68.12 Public Noticing on Application for Accessory Building Use Permit.

Not less than 10 days prior to the decision date by the Planning Commission (or the City Council on appeal), the City shall mail notices of the proposed accessory building use to all property owners as shown on the last equalized assessment rolls within a 300-foot radius, or to the radius needed to reach 25 properties, of the property boundaries of the proposed accessory building site. minimum radius of 600 feet of the exterior boundaries of the property which is the subject of the application, or within the minimum radius that is required such that a minimum of 40

Page 470 of 514 ends

property owners will be notified, whichever is greater. Appeals on the accessory building use permit application shall be noticed similarly.

Add new Section to Chapter 18.40 Site Plan Review:

18.40.13 Public Noticing on Application for Site Plan Reviews Not less than 10 days prior to the decision date by the Planning Commission (or the City Council on appeal), the City shall mail notices of the proposed Site Plan Application to all property owners as shown on the last equalized assessment rolls within a minimum radius of 600 feet of the exterior boundaries of the property which is the subject of the application, or within the minimum radius that is required such that a minimum of 40 property owners will be notified, whichever is greater. Appeals on the Site Plan Review applications shall be noticed similarly.

IMPACT ANALYSIS PER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): In accordance with the California Environmental Quality Act (“CEQA”), the proposed Zone Code Amendment has been deemed exempt from environmental review as there is no possibility that the proposed changes would have a significant impact on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). It can be seen with certainty that there is no possibility that the adoption and implementation of the subject amendment will have a significant effect on the environment. Staff is recommending that a Notice of Exemption be prepared and be filed in accordance with CEQA Guidelines.

Relevant Experience (Briefly explain how your background, training, education and/or interests specifically qualify you as an applicant for the governmental body you are applying to serve on)
My 27 years in the real estate industry provide a strong foundation for understanding the key factors involved in land use, zoning, property types, development, and market trends. I am passionate about protecting and preserving Norco's uniqueness, and bring a commonsense approach to doing so. I attend (or watch online) city meetings and stay up-to-date on current events. I have been a resident of Norco for nearly 20 years, have actively volunteered in the community for 13-plus, and have been a part of the business community since 2012. I love Norco, its animalkeeping lifestyle, and its smalltown character. lt is very important to me to preserve and protect that lifestyle and character, and the planning commission is on the front line to do that. Whether the projects brought to the planning commission or small or large, the decisions made have the potential to shape the future character of the City. I would like to be a part of that process, to help ensure they benefit the uniqueness of Horsetown USA.

In your opinion, what are the goals and objectives of the Commission(s)/Committee(s)/Advisory Council(s) you are applying to serve on? The Planning Commission must strike a balance between the wants and needs of the residents, the need for economic development and the desire to position the city as a destination, and maintaining Norco's rural atmosphere and animal-keeping lifestyle. lt must focus on responsible development, be consistent in its decision-making, and support the City's Strategic Plan.

If appointed, how would you help achieve these goals and objectives? By approaching every project with an open mind, taking into consideration how it will impact the city as a whole and the specific business or residential area in which it is located. By working within and upholding city code, and by making recommendations for code changes when needed or asked to do so. By understanding that there are shades of grey, and that code cannot cover every situation, and

applying that to variances, conditional use permits, site plans, and design reviews. By working together with staff, City Council, other commissions, and the community.

If appointed to serve, do you see any potential for a conflict of interest claim based on personal interests?
No, I see zero potential for a conflict of interest.

My current role requires future forecasting and careful consideration of the impacts of everyday decisions to ensure continued success of programs, and the company at large.
