STAFF REPORT
Date: March 19, 2025 Agenda Item:

3.D.

To: Honorable Mayor and City Council Members
From: Chad Blais, Public Works Director
Prepared By: Chad Blais, Public Works Director
Department: Public Works
SUBJECT:

Amendment to Increase the Contract Amount for NCS Engineers for the Per- and Polyfluoroalkyl Substances (PFAS) and Fluoride Treatment Design Project RECOMMENDATION:

Approve an amendment to the contract for NCS Engineers (NCS) in the amount of $107,131 for additional design services related to the Per- and Polyfluoroalkyl Substances (PFAS) and Fluoride treatment system at the existing Bluff Groundwater Treatment Plant.

SUMMARY:

The City previously approved a design contract with NCS in the amount not to exceed $669,027. During the preliminary design process NCS was evaluating various treatment options for Fluoride and one option the City wants to explore further will require some additional bench testing and analysis work that was not previously anticipated or included in NCS original proposal. NCS has provided a scope of work for this additional work for a cost of $107,131. Public Works is requesting the City Council approve a change order in the amount of $107,131 for the contract with NCS Engineers for additional design services PFAS and Fluoride treatment system at the existing Bluff Groundwater Treatment Plant. If the change order is approved the new contract amount will be $833,736.

BACKGROUND:

On June 5, 2024, the City Council approved a contract with NCS for design services to add a Per- and Polyfluoroalkyl Substances (PFAS) treatment system to the existing Bluff Groundwater Treatment Plant and authorized the City Manager to issue a purchase order in the amount not to exceed $669,027. Previously, a change order in the amount of $57,578 was approved on September 4, 2024, for additional environmental work required as part of a State grant the City is pursuing.

Page 21 of 132 ends

While the main focus of NCS design services was for PFAS treatment, NCS was also tasked to investigate treatment options to reduce natural Fluoride levels in the City's groundwater to below the State maximum contaminant level of 2 parts per million (ppm).

In 1998 the State issued Norco a 30-year wavier to serve water that contained Fluoride at a level of no more than 3 ppm). However, the State recently informed Norco the existing Fluoride waiver would not be renewed when it expires in 2028. Therefore, Public Works sought NCS help to determine potential treatment options for removal of Fluoride and what the cost implications would be on the cost of producing drinking water from the City's groundwater wells.

As part of the Preliminary Design Review (PDR), NCS identified two treatment options to remove Fluoride but both had significant construction and annual operations and maintenance costs that make the cost of producing the groundwater cost prohibitive.

However, NCS also identified a potential solution that would involve adjustment or modification to the existing Bluff Treatment Plant to replace one of the existing chemicals used to remove Arsenic with an alternate chemical that may remove both Arsenic and Fluoride. This potential option will require some additional investigative analysis by NCS using jar testing and bench testing methods to determine if removal of Fluoride can be accomplished to meet State standards while also not impacting the City's existing treatment processes to remove Arsenic from the groundwater. NCS has provided a proposal to conduct the additional sampling and analysis work for Fluoride at a cost of $107,131 (see attached proposal).

FISCAL IMPACT:

The PFAS Groundwater Treatment Project is included as a Capital Improvement Project (CIP) in the Water Fund for Fiscal Year 2024-25 under general ledger account number 144.950.43210.30 and project code 4709.9. Total funds in the amount of $900,000 are allocated for the project and can cover the additional change order being requested.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Plan Goal No. 5 - Infrastructure & Asset Management: Ensure timely preservation, replacement, improvement and acquisition of infrastructure and capital assets.

NCS Engineers (NCS) is pleased to submit this Scope of Work and Cost Proposal to provide bench testing and full-scale testing support for the evaluation of fluoride treatment at the City of Norco’s (City’s) Bluff Street Water Treatment Plant (Bluff St. TP). The Project Team will evaluate the feasibility of utilizing different coagulants and chemical combinations to reduce the concentration of fluoride to below the regulatory level.

In addition to fluoride, the City’s source waters, namely water from Wells 12, 13, and 15, also have elevated arsenic, iron, and manganese. They are currently treated by a combination of oxidation, coagulation, and filtration processes at the Bluff St. TP. The proposal will evaluate the treatment efficacy of fluoride while maintaining the compliance of arsenic, iron, and manganese.

Coagulation filtration is a known process that can reduce fluoride from water using suitable coagulants. Some of the coagulants, such as alum and PAC (poly-aluminum chloride), can achieve both fluoride and arsenic removal. However, higher dosages or secondary chemicals may be needed to achieve fluoride reduction compared with the current ferric coagulant. The proposed bench testing will examine pre-selected coagulants that can achieve concurrent fluoride and arsenic removal and determine suitable treatment conditions (i.e., pH, coagulant/chlorine/flocculant dosages), followed by full-scale testing that will determine the filtration efficiency, backwash frequency, and sludge generation.

Presented herein is our proposal to provide testing services and support for the City. As needed, the scope of work can be adjusted to meet the City’s and State’s requirements.

2 BACKGROUND
The City of Norco (City) currently operates three groundwater wells as part of its drinking water sources, namely Well 12, Well 13, and Well 15. The wells have elevated levels of fluoride, arsenic, iron, and manganese, exceeding their respective regulatory limits. The City has a centralized water treatment facility, the Bluff Street Water Treatment Plant (Bluff St.

TP), that treats water from Well 13 and Well 15. The Bluff St. TP has an oxidation, coagulation, and filtration treatment process that can effectively treat arsenic, iron, and manganese. The City currently has a waiver for fluoride treatment from the State Water Resource Control Board (SWRCB) that is due to expire by 2030. To meet the fluoride regulation, the existing treatment process needs to be supplemented or modified to enable fluoride removal.

As part of a preliminary design report, several stand-alone fluoride treatment processes have been evaluated as treatment options that can be added to the existing treatment system without significant modification to the existing process. The processes include activated alumina (AA) adsorption processes, and a ceramic membrane-based coagulation filtration treatment process. All the above treatment options have significant limitations that prohibit their application. Specifically, the AA treatment system requires significant operation and maintenance costs, as well as a large volume of waste streams generated during the backwash and regeneration process that render the process challenging. The ceramic membrane-based coagulation filtration process has extremely high system cost and capital investment requirements.

Besides adding a stand-alone treatment process, another treatment option is to modify the existing treatment system to allow fluoride removal. Although not as efficient as standalone treatment systems, coagulation filtration is a known process that can reduce fluoride to a certain extent using suitable coagulants that can react with and precipitate fluoride. However, since the existing system is designed to treat arsenic, iron, and manganese, the feasibility of this approach needs to be evaluated.

The current system at the Bluff St. TP treats arsenic by oxidizing it with an added oxidant (sodium hypochlorite). Oxidation converts the As(III) species to the As(V) species that can be complexed with ferric chloride coagulant to form floc. The media then filter the floc and thus the complexed arsenic in the filtration vessels. Similarly, iron and manganese in the water are also oxidized, precipitated, and removed by the filter media.

The current ferric-based coagulant (ferric chloride) does not have the capability to remove fluoride. Aluminum-based coagulants, such as alum (aluminum sulfate) or PAC (polyaluminum chloride), could potentially remove both arsenic (in the form of As(V)) and fluoride.

However, a few key questions need to be confirmed to determine the feasibility of switching to a new coagulant, as discussed in more detail in Task 3 in the following sections.

To comprehensively evaluate the feasibility of modifying the existing system to reduce fluoride, arsenic, iron, and manganese, a series of bench tests and full-scale testsis proposed.

Page 25 of 132 ends

3 Below is a description of the proposed scope of work to support the City in planning and conducting the tests and evaluating the feasibility of the treatment options.

SCOPE OF SERVICES
The goal of this project is to evaluate the feasibility and determine the operation parameters of fluoride removal concurrently with arsenic, iron, and manganese removal using the existing system at the Bluff St. TP by switching the water treatment chemicals. The project team has developed the following tasks.

Task 1: Developing Bench Test Plan
Under this task, the Project Team will determine the types of coagulants that could potentially be used, as well as their application parameters such as pH and dosages. The Project Team will reach out to chemical suppliers to select 3 to 4 potential coagulant candidates to be used in the initial screening test. Based on the selected coagulants, the test plan will develop a set of testing matrixes that aim to:
1) Select one to two best-performing coagulants to be used in the full-scale testing. 2) Determine the suitable operating pH levels.
3) Determine the optimal dosages.
4) Determine if pre-oxidation (sodium hypochlorite) is compatible with new coagulant 5) Determine if flocculant is needed for fluoride filterability and their dosages.

The Bench Tests will be conducted in the form of mixing jar tests. The coagulant is added to a jar of water sample at pre-determined pH, dosages, mixing time, and chemical sequence (i.e., sodium hypochlorite and/or flocculants). After a pre-determined reaction time, the mixture is then separated via vacuum filtration. The filtrate sample is collected and analyzed of key parameters (i.e., arsenic and fluoride) to determine the removal efficacy.

Deliverables
• Draft Bench Test Plan will be provided electronically to the City for review and comment. • Final Bench Test Plan will be provided electronically to the City for inclusion in the Final Report.

Assumptions
• Water samples and the most recent water quality data from the source wells will be provided by the City if any preliminary testing is needed to develop the test plan. • One round of consolidated edits/comments provided by the City on the Draft Bench Test Plan will be reviewed and addressed by the Project Team prior to producing the Final version.

Page 26 of 132 ends

4 Task 2: Conducting Bench Test
After the Bench Test Plan has been finalized, the Project Team will carry out the bench test according to the plan. The Project Team will source the testing equipment and materials needed and collect well water samples in preparation for the test. After the equipment and materials are in place, the bench jar tests will be conducted. On-site reaction parameters such as pH will be analyzed by NCS, while water quality parameters such as fluoride and arsenic will be analyzed by the City using a third-party analytical lab.

After the Bench Test has been concluded and the test results have been collected, a Bench Test Report will be prepared. The Report will analyze the result data and provide conclusions and recommendations regarding the questions listed in Task 1. The Bench Testing results will serve as the basis for full-scale trial testing.

Deliverables
• Draft Bench Test Report will be provided electronically to the City for review and comment.
• Bench-scale chemicals and test equipment will be provided by the Project Team. • Final Bench Test Report will be provided electronically to the City for inclusion in the Final Report.

Assumptions
• Water samples from the source wells (5 to 10 gallons) will be provided by the City for Bench Testing.
• One round of consolidated edits/comments provided by the City on the Draft Bench Test Report will be reviewed and addressed by the Project Team prior to the Final version. • The Full-Scale Test will be conducted only if the Bench Test shows sufficient removal.

Task 3: Developing Full-Scale Test Plan
After the Bench Test is concluded, if the coagulants and testing conditions demonstrate an effective reduction of fluoride and arsenic, a Full-Scale Test Plan will be developed to evaluate the treatment process in a full-scale setting. The Full-Scale Test aims to determine the operational feasibility of filtration media and vesselsin combination with the new coagulation conditions. Specifically, the Full-Scale Test aims to determine:
1) Whether the filter media is effective in removing the flocs formed by the new aluminum-based coagulant.
2) If flocculant is needed to improve the removal.
3) How long is the new operation cycle with the new aluminum-based coagulant (backwashing frequency).
4) How much backwashing water and sludge is generated during treatment.

Page 27 of 132 ends

5 5) Whether the sludge can be settled and meet the disposal requirement. This test will be done by the City as a longer-term condition is needed to purge and collect sufficient backwash water.

The Full-Scale Test will be conducted using one of the existing filtration vessels at the Bluff St.

TP. The Project Team will review the P&ID and as-built drawings of the existing system to determine testing logistics, including adjusting the influent flow rate, changing the injected chemicals, and diverting and collecting testing effluent. The test will be conducted in continuous operation mode with the City’s operators. Samples will be collected in predetermined intervals and be analyzed of water quality parameters (i.e., arsenic, fluoride, iron, and manganese) by the City’s third-party analytical lab. A temporary chemical injection and/or tote-based chemical supply will be needed for this short-term trial as the current chemical tanks and pump may switch over to a new coagulant may not be feasible.

Deliverables
• Draft Full-Scale Test Plan will be provided electronically to the City for review and comment. • Final Full-Scale Test Plan will be provided electronically to the City for inclusion in the Final Report.

Assumptions
• One round of consolidated edits/comments provided by the City on the Draft Full-Scale Test Plan will be reviewed and addressed by the Project Team prior to the Final version. • The City will provide a detailed operation plan for the full-scale system.

Task 4: Supporting Full-Scale Test
After the Full-Scale Test Plan has been developed, the Project Team will source the necessary equipment and materials related to chemical injections needed to conduct the Full-Scale Test.

After the equipment and materials are ready, the Project Team will provide start-up and commissioning support and full-scale test support for up to one week (including travel). The City will provide a full-time operator to work with the Project Team during this period. The daily operation tasks will be carried out by the City’s operating staff. Necessary training can be provided by the Project Team if needed. The operation data will collect regular samples every few hours during this test, and other operating conditions can be transmitted and/or communicated to the Project Team on a regular basis. The test samples will be submitted to the analytical lab daily for a 24-hour turnaround time for key parameters (F, As, etc.) to adjust any test conditions. The Project Team will review the data and provide feedback for on-site or remote assistance if necessary.

After the Full-Scale Test has been concluded and the test results have been collected, a Final Test Report will be prepared. The Report will include the Test Plans and test results from both the Bench Tests and the Full-Scale Tests. The Final Report will provide the conclusion and

Page 28 of 132 ends

6 recommendation regarding the treatment option of using the existing system with new coagulants for concurrent fluoride removal with cost estimates for the City’s review prior to submission to the State for approval.

Deliverables
• Draft Final Test Report in will be provided electronically to the City for review and comment. • Final Test Report will be provided electronically to the City for submission to the State.

Assumptions
• The existing treatment system, including chemicals, storage tanks, injections systems, filter media and vessels, will be available to be used for Full-Scale Test. • Minor modification to the existing system, such as switching to a new coagulant chemical, and/or adjusting the chemical dosages, changing the flow rates, etc., is allowed and achievable by the City during the Full-Scale Test.
• If needed, minor modifications to the system, such as adding additional chemical injection points by the City staff, are allowed.
• After the initial start-up and commissioning are completed, the City’s operating staff will conduct the routine operation, daily sample collection and submission, etc. during the FullScale Testing. Operation and testing data will be communicated with the Project Team on a regular basis.
• Up to two test conditions (two coagulants, coagulant with polymer, etc.) may be tested in Full-Scale. Each test condition will require at least two or three operating cycles for confirmation.
• Depending on the backwash requirements (frequency, duration, etc.), a longer-term test by the City may be needed for sludge collection and characterization in the existing backwash tank.
• One round of consolidated edits/comments provided by the City on the Draft Test Report will be reviewed and addressed by the Project Team prior to producing the Final Test Report.

STAFF REPORT
Date: March 19, 2025 Agenda Item:

3.E.

To: Honorable Mayor and City Council Members
From: Chad Blais, Public Works Director
Prepared By: Chad Blais, Public Works Director
Department: Public Works
SUBJECT:

Acceptance of Bids and Award of Contract for the Woodward Ave Street Improvements RECOMMENDATION:

Accept bids and award a contract to Mendoza Engineering Company, Inc. for Woodward Avenue Street Improvements Project, in the amount of $255,330 and authorize the City Manager to approve contract change orders up to 10 percent of the total bid amount.

SUMMARY:

Bids for the Woodward Avenue Street mprovements Project were opened on January 30, 2025, with Mendoza Engineering Company, Inc. of Fontana, California being the lowest responsible bidder.

BACKGROUND:

Plans and specifications for the Woodward Avenue Street Improvements Project (Project) were advertised on December 12, 2024, with a bid opening date of January 30, 2025. A total of thirteen (13) bids were received with proposals ranging in value from $255,330 to $498,500. The bid summary analysis has been attached for Council’s review (See Bid Summary). The Project consist of cold milling of existing asphalt, pavement resurfacing, adjustments to manholes and valve covers, curb ramp improvements, signage and striping, and all appurtenant related work to the satisfaction of the City Engineer.

Staff has reviewed all the bids submitted and determined Mendoza Engineering Company, Inc. of Fontana, California as being the lowest responsible bidder in the amount of $255,330 (see Proposal included in Contract). Staff did determine there was a discrepancy in the total cost for Mendoza Engineering Company, Inc., between the online bid tabulation ($255,330) versus the hand written bid sheet ($255,665), submitted. The unit pricing is the same for both online and written bid sheets, but the

Page 33 of 132 ends

bidder erred on the hand written total cost on line items No. 9, 12, and 15. The online bid summary is correct and the bidder has crossed out the incorrect total bid amount and initialed the error. Staff has reviewed the references of the lowest bidder and bid documents submitted and determined the bid is responsive to all requirements. The contractor has the experience to complete the required construction activities for the Project.

Please note the Project is funded by Measure R with an original budget request of $1,100,000. However, due to the flatness of the roadway and lack of drainage options, the planned improvements for curb and gutter and planting of trees, was not included in this project. There are larger drainage issues that cannot be remedied at this time and thus the reason for the reduced cost of the project versus the budget requested.

FISCAL IMPACT:

The Woodward Avenue Street Improvements Project was approved as a Capital Improvement Project (CIP) in the Measure R Fund (132) for FY 2024-25 in the amount of $1,100,000, (Project No. 54900.19 - Account No. 132.930.43160 for construction and 132.930.43160.30 for design). Total costs incurred to date is $43,960 (Design). There is sufficient funding to cover the lowest bidder bid amount, the 10% contingency, and an estimated $15,000 for inspection services.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Direction #5 – Infrastructure and Asset Management: Ensure timely preservation, replacement, improvement and acquisition of infrastructure and capital assets.

At the option of the City Manager or his/her designee, either (i) the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects City, its officers, officials, employees and agents; or (ii) Contractor shall provide a financial guarantee, satisfactory to the City Manager or his/her designee in his/her sole discretion,

guaranteeing payment of losses and related investigations, claim administration and defense expenses. At no time shall City be responsible for the payment of any deductibles or self-insured retentions.

All policies of insurance required hereunder shall be endorsed to provide that the coverage shall not be cancelled, non-renewed, reduced in coverage or in limits except after 30 calendar day written notice has been given to City. Upon issuance by the insurer, broker, or agent of a notice of cancellation, non-renewal, or reduction in coverage or in limits, Contractor shall furnish City with a new certificate and applicable endorsements for such policy(ies). In the event any policy is due to expire during the work to be performed for City, Contractor shall provide a new certificate, and applicable endorsements, evidencing renewal of such policy not less than 15 calendar days prior to the expiration date of the expiring policy.

The General Liability and Automobile Liability insurance policies shall be written on an occurrence form. The Contractors Pollution Liability insurance policy shall be written on either an occurrence form, or a claims-made form. The General Liability (including ongoing operations and completed operations), Automobile Liability and Contractors Pollution Liability insurance policies shall name City, its officers, officials, employees and agents as an additional insured. All such policies of insurance shall be endorsed so Contractor’s insurance shall be primary and no contribution shall be required of City, its officers, officials, employees and agents. The Builders Risk (Course of Construction) insurance policy shall be endorsed to name the City as a loss payee. Any Workers’ Compensation insurance policy shall contain a waiver of subrogation as to City, its officers, officials, employees and agents. The coverage(s) shall contain no special limitations on the scope of protection afforded to City, its officers, officials, employees and agents. If Contractor maintains higher limits of liability than the minimums shown above, City requires and shall be entitled to coverage for the higher limits of liability maintained by Contractor.

Claims-Made Policies – If any coverage required is written on a claimsmade coverage form:
(i) The retroactive date must be shown, and must be before the effective date of the Contract or the commencement of work by Contractor. (ii) Insurance must be maintained and evidence of insurance must be provided for at least 5 years after completion of the work or termination of the Contract, whichever first occurs.
(iii) If coverage is canceled or non-renewed, and not replaced with another claims-made policy form with a retroactive date prior to the effective date of the Contract, or work commencement date, Contractor must purchase extended reporting period coverage for a minimum of 5 years after completion of the work or termination of the Contract, whichever first occurs.

Page 47 of 132 ends

CA-7
(iv) A copy of the claims reporting requirements must be submitted to City for review.
(v) These requirements shall survive expiration or termination of the Contract.

Contractor shall furnish City with all certificate(s) and applicable endorsements effecting coverage required hereunder. All certificates and applicable endorsements are to be received and approved by the City’s Risk Manager or his/her designee in his/her sole discretion prior to City’s execution of the Contract and before work commences. Upon request of City, Contractor shall immediately furnish City with a complete copy of any insurance policy required under this Contract, including all endorsements, with said copy certified by the underwriter to be a true and correct copy of the original policy. This requirement shall survive expiration or termination of this Contract.

If at any time during the life of the Contract or any extension, Contractor or any of its subcontractors fail to maintain any required insurance in full force and effect, all work under this Contract shall be discontinued immediately, and all payments due or that become due to Contractor shall be withheld until notice is received by City that the required insurance has been restored to full force and effect and that the premiums therefore have been paid for a period satisfactory to City. Any failure to maintain the required insurance shall be sufficient cause for City to terminate this Contract. No action taken by City hereunder shall in any way relieve Contractor of its responsibilities under this Contract.

The fact that insurance is obtained by Contractor shall not be deemed to release or diminish the liability of Contractor, including, without limitation, liability under the indemnity provisions of this Contract. The duty to indemnify City shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Contractor.

Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Contractor, its principals, officers, agents, employees, persons under the supervision of Contractor, vendors, suppliers, invitees, consultants, subconsultants, subcontractors, or anyone employed directly or indirectly by any of them.

In the event of a partial or total destruction by the perils insured against of any or all of the work and/or materials herein provided for at any time prior to the final completion of the Contract and the final acceptance by the City of the work or materials to be performed or supplied thereunder, the Contractor shall promptly reconstruct, repair, replace, or restore all work or materials so destroyed or injured at his/her sole cost and expense. Nothing herein provided for shall in any way excuse the Contractor or his/her insurance company from the obligation of furnishing all the required materials and completing the work in full compliance with the terms of the Contract.

If Contractor should subcontract all or any portion of the services to be performed under this Contract, Contractor shall require each subcontractor to provide

Page 48 of 132 ends

insurance protection in favor of City, its officers, officials, employees and agents in accordance with the terms of each of the preceding paragraphs, except that the subcontractors’ certificates and endorsements shall be on file with Contractor and City prior to the commencement of any work by the subcontractor.

3.2.10 Safety. Contractor shall execute and maintain its work so as to avoid injury or damage to any person or property. In constructing the Project, the Contractor shall at all times be in compliance with all applicable local, state and federal laws, rules and regulations, and shall exercise all necessary precautions for the safety of employees appropriate to the nature of the work and the conditions under which the work is to be performed. Safety precautions as applicable shall include, but shall not be limited to: (A) adequate life protection and lifesaving equipment and procedures; (B) instructions in accident prevention for all employees and subcontractors, such as safe walkways, scaffolds, fall protection ladders, bridges, gang planks, confined space procedures, trenching and shoring, equipment and other safety devices, equipment and wearing apparel as are necessary or lawfully required to prevent accidents or injuries; and (C) adequate facilities for the proper inspection and maintenance of all safety measures.

3.2.11 Bonds.

3.2.11.1 Performance Bond. Contractor shall execute and provide to City concurrently with this Agreement a Performance Bond in the amount of the total, not-toexceed compensation indicated in this Agreement, and in a form provided or approved by the City. If such bond is required, no payment will be made to Contractor until it has been received and approved by the City.

3.2.11.2 Payment Bond. Contractor shall execute and provide to City concurrently with this Agreement a Payment Bond in the amount of the total, not-to-exceed compensation indicated in this Agreement, and in a form provided or approved by the City.

If such bond is required, no payment will be made to Contractor until it has been received and approved by City.

3.2.11.3 Bond Provisions. Should, in City’s sole opinion, any bond become insufficient or any surety be found to be unsatisfactory, Contractor shall renew or replace the affected bond within 10 days of receiving notice from City. In the event the surety or Contractor intends to reduce or cancel any required bond, at least thirty (30) days prior written notice shall be given to the City, and Contractor shall post acceptable replacement bonds at least ten (10) days prior to expiration of the original bonds. No further payments shall be deemed due or will be made under this Agreement until any replacement bonds required by this section are accepted by the City. To the extent, if any, that the total compensation is increased in accordance with the Agreement, the Contractor shall, upon request of the City, cause the amount of the bonds to be increased accordingly and shall promptly deliver satisfactory evidence of such increase to the City. To the extent available, the bonds shall further provide that no change or alteration of the Agreement (including, without limitation, an increase in the total compensation, as referred to above), extensions of time, or modifications of the time, terms, or conditions of payment to the Contractor, will

release the surety. If the Contractor fails to furnish any required bond, the City may terminate this Agreement for cause.

3.2.11.4 Surety Qualifications. Only bonds executed by an admitted surety insurer, as defined in Code of Civil Procedure Section 995.120, shall be accepted.

The surety must be a California admitted surety with a current A.M. Best’s rating no less than A:VIII and satisfactory to the City. If a California admitted surety insurer issuing bonds does not meet these requirements, the insurer will be considered qualified if it is in conformance with Section 995.660 of the California Code of Civil Procedure, and proof of such is provided to the City.

3.3 Fees and Payments.

3.3.1 Compensation. Contractor shall receive compensation, including authorized reimbursements, for all construction services rendered under this Agreement at the rates set forth in Exhibit B attached hereto and incorporated herein by reference. Extra work may be authorized, as described below, and if authorized, will be compensated at the rates and manner set forth in this Agreement.

STAFF REPORT
Date: March 19, 2025 Agenda Item:

3.F.

To: Honorable Mayor and City Council Members
From: Lisette Free, City Manager
Prepared By: Alejandra Gonzalez, Superintendent
Department: Community Services
SUBJECT:

Agreement with the National Parks and Recreation Association for funds program for Fiscal Year 2024-25.

RECOMMENDATION:

Approve the contract for a $2,500 micro-grant awarded to the Community Services Department for the "How to Coach Kids" training program. This program is designed to equip staff and volunteer coaches in the Sports Division with the necessary skills and knowledge to support positive youth development.

SUMMARY:

The City of Norco Community Services Department was awarded a micro-grant in the amount of $2,500 to facilitate the "How to Coach Kids" training program. The grant is part of the National Recreation and Park Association's (NRPA) Million Coaches Challenge initiative, made possible through the support of Disney Worldwide Inc. The training aims to enhance the skills, competencies, and confidence of park and recreation staff and volunteer coaches, promoting social and emotional well-being within youth programming.

BACKGROUND:

The National Recreation and Park Association administers the Million Coaches Challenge, a program designed to provide high-quality, no-cost training to park and recreation agencies. This initiative focuses on two core areas social and emotional learning and to ensure that youth sports coaches, staff, and volunteers possess the skills necessary for fostering positive youth development and creating inclusive environments.

Training provided through this program is conducted by leading national training organizations. The "How to Coach Kids" training, co-founded by Nike and the U.S.

Olympic and Paralympic Committee, leverages expertise from the Aspen Institute’s

Page 97 of 132 ends

Project Play and youth sports experts to address key areas such as relationshipbuilding, cultural humility, and leadership.

In 2024, NRPA awarded micro-grants ranging from $2,000 to $5,000 to eligible agencies as part of an equity-based grantmaking model. The City of Norco Community Services Department received $2,500 grant to implement this training for the Sports Division, furthering its commitment to offering high-quality and engaging youth programming. This initiative ensures that all staff and volunteers working with youth have the skills and confidence to support social-emotional well-being, foster teamwork, and promote youth sports equity.

FISCAL IMPACT:

The awarded $2,500 micro-grant is funded through the Million Coaches Challenge initiative, managed by the National Recreation and Park Association and supported by Disney Worldwide Inc. The project has no direct fiscal impact on the City’s general fund as it is fully funded by the grant. This initiative is included as part of the FY 2024-2025 mid-year budget adjustments to facilitate the implementation of the training program.

RELATIONSHIP TO STRATEGIC PLAN:

This item closely aligns with Strategic Plan No. 3 - Economic Development and Financial Stability: Assure financial stability by expanding development efforts, diversifying revenue sources and continuing prudent financial management.

STAFF REPORT
Date: March 19, 2025 Agenda Item:

3.G.

To: Honorable Mayor and City Council Members
From: Chad Blais, Public Works Director
Prepared By: Chad Blais, Public Works Director
Department: Public Works
SUBJECT:

Streets, Trails, and Utilities Commission Review of Possible Exceptions for the Use of Pavers In the Trails
RECOMMENDATION:

Receive and file Streets, Trails, and Utilities Commission recommendation to the City Council to not amend Trail Standard 700 or allow any exceptions and/or waivers related to the installation of pavers in the trail system.

SUMMARY:

A Norco homeowner recently was cited by Code Enforcement for installing two feet of pavers in the trail adjacent to their existing driveway, which is not allowed under the City's current trail standard. The resident was ordered to remove the pavers and then elected to appeal their case to the City Council under the Public Comments portion of the City Council meeting on February 5, 2025. City Council has asked Streets, Trails and Utilities Commission (STUC) to review the issue to determine if the City should consider a process that allows for a review of exceptions and/or waivers for pavers in the public trail. STUC reviewed this item on March 3, 2025, and unanimously recommended the City Council to not amend Trail Standard 700 or allow exceptions and/or waivers related to the installation of pavers in the trail system.

BACKGROUND:

The City of Norco has over 100 miles of trails composed of decomposed granite and native soils that are maintained annually by an outside contractor. In 2007, the use of pavers was approved as an acceptable alternate material to be placed as part of residential driveways within trail segments and numerous homeowners took advantage of the opportunity to improve their respective driveways, but this use of pavers was eliminated by the City Council on June 15, 2011, due to some complaints about equestrian safety crossing over pavers (see attached Trail Standards). The primary

Page 102 of 132 ends

complaint being that decomposed granite on a smooth surface, such as pavers, creates a slipping hazard for pedestrians and horses.

Jumping forward to present day, requests for encroachment permits, for the use of pavers in residential trail-side driveways, are the number one request from the public.

Residents frequently express concerns that decomposed granite is being tracked from the trail onto their concrete driveways, resulting in a mess that extends into their garages. In addition, residents also express the use of pavers improves the aesthetics of their property. It should also be pointed out, that prior to the removal of pavers as an acceptable alternate driveway material, numerous driveway paver projects were completed by residents and staff has not been able to find any documentation regarding any accidents related to the pavers already in existence. Also note, pavers are still allowed for any commercial property that fronts a trail.

Over the past eight years, Public Works staff has been diligent about providing a consistent message when it comes to requests or individuals who mistakenly install pavers without a permit. Pavers are not allowed and there are currently no exceptions and/or variances available. In fact, there have been many Code Enforcement cases over the years that required residents to remove pavers installed in the horse trails.

Recently, a homeowner on Norco Dr. was issued a citation from Code Enforcement due to the installation of about two feet of pavers as an extension of the existing driveway (see attached photos). This work was done without a permit from Public Works or inspection by the City.

The property owner has indicated the trail was routinely eroded due to water runoff and the pavers solved that issue. The resident insisted it was a safety issue that the City had routinely ignored. However, a review of work requests does not show that the City was informed about any trail issues at this property and staff explained that pavers are not allowed under any circumstance. In addition, staff explained this type of trail slope and erosion is not unusual for Norco and the City has a contract trail maintenance company that can remediate the rutting of the trail when it occurs. It was explained to the resident they can easily submit a work request online or through the City app when they see an issue. The resident was still insistent it is a safety issue and then explained that pavers also help the neighbor whose property sits at a lower elevation by limiting the dirt that runs into the neighbor's property. Once again, staff explained there are no exceptions for adding pavers and the placement of sandbags in a diagonal direction, to push water and debris away from the private property towards the gutter, is the proper way to address this problem (see attached photo). The resident was instructed to move forward with the removal of the pavers within a two week period.

At the February 5, 2025, Council meeting, the resident elected to make a direct appeal to the City Council under the Public Comments portion of the meeting. City Council did not elect to take any action on the request at that time. However, at the February 19th Council meeting, the Council did ask the Public Works Director to review this issue with the Streets, Trails, and Utilities Commission (STUC) to see if exceptions and/or waivers should be considered in regard to the use of pavers.

Therefore, on March 3, 2025, staff brought this item to STUC for consideration and comments that can be submitted back to City Council. As part of the discussion, the Public Works Director highlighted staff's ability successfully and fairly, administer the trail standards by simply stating that pavers are not allowed. The trail standard is very

Page 103 of 132 ends

straight forward and does not enable staff to be influenced by location or status of persons involved. Staff does not support the creation of exceptions and/or waivers as it would create an unrealistic expectation of staff to determine what conditions warrant an exception or waiver, versus those that do not merit such a designation. The City has invested in ongoing trail maintenance services that have greatly improved the overall condition of the trails. In addition, the regular placement and removal of sandbags by the trail maintenance company provides a significant boost to pushing water off the trail and into the street, thus minimizing erosion. Therefore, staff does not recommend creating exceptions or variances to allow pavers.

The property owner was present at the meeting and provided direct input to the commissioner questions. STUC reviewed and thoughtfully discussed this item and unanimously recommended the City Council to not amend Trail Standard 700 and not allow exceptions and/or waivers related to the installation of pavers in the trail system.

FISCAL IMPACT:

Not applicable for this item.

SUMMARY:

The City of Norco has engaged Webb Municipal Finance, LLC, to provide assistance with the Annual Levy process for all five Landscape Maintenance Districts (LMDs), which includes the preparation and filing of Engineer's Report with the City Clerk and Riverside County Auditor-Controller. In order to continue the levy, the City Council must adopt the requisite resolutions, order the preparation of the Engineer's Report, approve the preliminary Engineer's Report and set the public hearing, conduct a public hearing, and levy assessments, with provisions for annual increases. The Engineer's Report must be prepared in accordance with the requirements of Proposition 218 and shall include, but not be limited to, a description of the proposed improvements, cost estimates, apportionment methods, and assessment rolls. It is the recommendation of staff that the City Council adopt the necessary resolutions and authorize Webb Municipal Finance, LLC, to prepare and file the required Engineer's Report for Fiscal Year 2025-26.

BACKGROUND:

Pursuant to the provisions of California Streets and Highways Code sections 22500- 22679 (the "Act"), the City of Norco has retained Webb Municipal Finance, LLC, for the second consecutive year to assist with the Annual Levy process for all five LMDs within the City. This engagement encompasses the preparation and filing of the Engineer's Report with the City Clerk, as well as the submission of the annual levy to the Riverside County Auditor-Controller for the purposes of assessment collection.

The Act authorizes the County of Riverside to levy and collect assessments on behalf of the City of Norco to fund the maintenance and servicing of improvements related to landscaping, parks, and recreational facilities. The assessments are applied to the following established Landscape Maintenance Districts:

1. Landscape Maintenance District No. 1 (Beazer)

2. Landscape Maintenance District No. 2 (Western Pacific)

3. Landscape Maintenance District No. 3 (Centex)

4. Landscape Maintenance District No. 4 (Norco Ridge Ranch)

5. Landscape Maintenance District No. 5 (Hawks Crest)
The funds generated through these assessments are dedicated to the installation, construction, and ongoing maintenance of the improvements within each district, ensuring the continued upkeep of the City’s landscape and recreational facilities.

Annual Assessment Process
In order to continue the levy of assessments for the aforementioned Landscape Maintenance Districts, the City Council must, in accordance with the Act and the Assessment Law, undertake the following proceedings each year:

1. Adopt resolutions initiating the preparation of the Engineer's Report;

2. Preparation of the Engineer's Report;

3. Adopt resolutions of intention approving the preliminary Engineer's Report and set the public hearing;

Page 116 of 132 ends

4. Hold the public hearing;

5. Adopt resolution levying the assessments.

The Landscape Maintenance Districts are established with provisions that permit annual increases in assessments. Furthermore, the Engineer's Report shall comply with the requirements of Article XIIID of the California Constitution, as enacted by Proposition 218, the "Right to Vote on Taxes Act" (approved by California voters on November 5, 1996).

Engineer’s Report Requirements
In compliance with the Act, an Engineer's Report will be prepared for each of the five districts. Each report shall include the following:

1. A description of the improvements or services to be financed;

2. An estimate of the cost associated with each improvement or service;

3. An assessment diagram depicting the boundaries of each district and the parcels within such boundaries;

4. A description of the methodology employed to apportion assessments to properties within each district;

5. An assessment roll listing the parcels to be assessed and the proposed assessment for each parcel.

6. The completed Engineer’s Reports will be presented to the City Council for review and approval in May.

It is hereby recommended that the City Council adopt the five resolutions necessary to initiate the proceedings for the preparation of the Engineer's Annual Levy Report for the fiscal year commencing July 1, 2025, and ending June 30, 2026. The City Council is further requested to authorize Webb Municipal Finance, LLC, to prepare and file the required Engineer's Report concerning the levy and collection of assessments for the five districts in accordance with Chapter 3, Section 22622 of the Act. A proposal outlining the scope of work to be performed by Webb Municipal Finance, LLC, is attached hereto for the Council’s consideration.

FISCAL IMPACT:

The cost of professional services required to initiate proceedings for the levy and collection of assessments for the Fiscal Year 2025-26 Districts' Annual Levy authorization, in the amount of $19,890, is allocated within the Fiscal Year 2024-25 budget for the administration of the Districts. This cost will be apportioned and paid by each individual District.

RE: Landscape Maintenance Districts Annual Administration Services Dear Ms. Hamilton:

Webb Municipal Finance, LLC (WMF) is grateful to have the opportunity to continue to work with the City of Norco (the “City”) providing annual administration of Landscape Maintenance District Nos. 1, 2, 3, 4, and 5 (“LMDs”).

We are confident that our project team has the technical expertise, resources, knowledge, relationships and most importantly, the commitment to complete your administration projects on time and within budget. We will tailor solutions to meet your needs.

Our Scope of Services for the LMDs’ annual administration is as shown below:

Kickoff Meeting: The purpose of this meeting is to coordinate with the City to gain an understanding of the specific goals, components and criteria to meet the City’s needs. To that end, WMF will meet with the City staff to confirm the schedule of events, procedural considerations and discuss the City’s preferred method of communication.

Budget Review and Preparation: WMF will review and prepare a budget for each LMD based on the cost estimates for maintenance of all improvements, landscaping, capital improvements and incidental costs, as well as operating and capital improvement reserves. For the LMDs where costs exceed the maximum allowable assessments, WMF will factor into the budget the necessary cuts to bring the expenses in line with the assessments.

Annual District Engineering and Engineer’s Report Preparation: Prior to the annual public hearing confirming the LMDs assessments, WMF will file the Engineer’s Reports with the City Clerk. The Engineer’s Reports will include the fiscal year’s budget information, the listing of improvements to be maintained by the collection of the special assessments, the benefit spread methodology, a copy of plans and specifications, estimates of the costs, assessment diagrams, and complete listings of parcels to be assessed and their total assessments. The reports will be prepared in accordance with California Code. WMF’s Engineer’s Reports will include a statement of engineer signed by a Professional Engineer verifying the accuracy of the report. The original copy of the Engineer’s Report will be provided to the City.

Preparation of Resolutions: WMF, in coordination with the City Attorney and City Staff, will assist in the preparation of all resolutions and staff reports needed for the annual administration process.

Meeting Attendance: For each item requiring City Council action, WMF will attend all City Council Meetings pertaining to the LMDs. WMF will provide a PowerPoint presentation for City Staff to present at the Council Meetings and be available to answer any questions posed by City Staff, City Council Members, or the public. As requested by City Staff, WMF will be available to attend all Property Owner Meetings regarding the LMDs’ annual assessments and answer questions.

Page 129 of 132 ends

Annual Special Assessment Submittal: WMF will calculate and submit the annual levy for the LMDsto the Riverside County Auditor-Controller. Included with the annual levy submittal is the preparation of direct invoices (handbills) to all public agencies whose properties are determined to receive a direct benefit from the public improvements.

WMF will submit the annual levies for the LMDs in the media format, and configuration acceptable for direct submission to the Riverside County Auditor-Controller’s Office prior to the statutory deadline and shall perform adjustments and corrections to the levies on the property tax rolls as necessary.

District Mapping: WMF will obtain the latest assessor’s parcel maps and secured tax roll information from the Riverside County Assessor’s Office for the parcels within the LMDsto identify parcel changes each year. Each year, WMF will provide updated GIS maps and audit maps for the City’s use.

Annual Special Assessment Calculation: As requested by the City, WMF will audit the assessment calculations which include (but are not limited to) the review of EDU computations, parcel acreage, development status, and the taxability status of each parcel.

Property Owner Letters: WMF will assist City Staff with the preparation of property owner letters for applicable LMDs. WMF will generate a mailing list for each applicable district to include current property owner names and mailing addresses using the latest assessor’s parcel maps and Riverside County Assessor’s data as well as our inhouse GIS platform.

Property Owner Services: WMF will serve as the initial and primary contact to City Staff, property owners, title companies, and other interested parties for inquiries regarding the LMDs administration and annual special assessment installments. A toll-free telephone number, of WMF designation, will appear on the regular property tax bill next to each LMD’s line item to facilitate contact with the public.

Roll Changes and Adjusted Property Tax Bills: If any changes to the secured tax roll necessitate corrections/revisions after the deadline are determined necessary, WMF will research, recalculate and, with City approval, rectify the issue. We notify the City of the assessor’s parcel numbers that were rejected by the County and therefore will not be assessed.
