Consideration and Adoption of Resolution No. 2026-07 Authorizing the Appropriation of Forty-Four Thousand Dollars ($44,000) for Drainage Improvements at the City of Norco Animal Shelter
RECOMMENDATION:

Adopt Resolution No. 2026-07 Authorizing the Appropriation of Forty-Four Thousand Dollars ($44,000) for Drainage Improvements at the City of Norco Animal Shelter.

SUMMARY:

The City of Norco Animal Shelter’s 20 small dog kennels lack proper drainage, causing flooding that compromises animal health and staff safety. The Animal Services Superintendent has deemed this an urgent infrastructure deficiency. Three bids were obtained; the lowest, $38,287, was submitted by G Squared Development. The Measure R Citizens’ Oversight Committee recommends City Council approval to authorize the appropriation of funds. With this authorization, the City Manager, or designee, will be granted authority to execute the work as specified.

BACKGROUND:

The City of Norco Animal Shelter is a vital community resource dedicated to animal welfare. It provides essential services such as pet adoption, stray animal care, and reuniting lost pets with their owners. The shelter houses a diverse range of animals, including dogs, cats, birds, livestock, and other species.

Currently, the shelter maintains twenty (20) small dog kennels located adjacent to the shelter office. When these kennels were originally constructed, interior drainage was not installed in the central walkway between the two rows of kennels. This design flaw has resulted in chronic flooding during routine cleaning operations, leaving standing water

Page 13 of 61 ends

that poses a significant risk to animal health and renders the kennels unsuitable for occupancy.

The Animal Services Superintendent has determined that this constitutes as an urgent infrastructure deficiency requiring immediate remediation to ensure compliance with animal welfare standards and operational best practices.

The lack of proper drainage has led to prolonged wet surfaces and operational inefficiencies, creating conditions that compromise animal health and safety. In addition to the risk to animals, standing water creates a significant slip hazard for staff during cleaning and daily operations, increasing the potential for workplace injuries.

To address this issue, staff obtained three competitive bids from duly licensed and verified contractors for the proposed work. The bids range from $38,287 to $48,500, with the lowest bid of $38,287 submitted by G Squared Development. Copies of all bids are attached to the staff report for Council review. The scope of work includes the installation of approximately 44 linear feet of drainage, saw-cutting and removing existing concrete, hauling away materials, leveling drainage, and importing sand to meet grade and tie into the existing system. This drainage system will connect to the catch basin and then flow into the clarifier. The contractor will then pour new concrete and install stainless steel trench drains.

On January 28, 2026, the Measure R Citizens' Oversight Committee reviewed and recommended City Council approval to address this critical infrastructure deficiency at the City of Norco Animal Shelter.

By approving this appropriation, the City Council will grant the City Manager, or designee, the authority to expend and administer the appropriation consistent with the purposes specified. Furthermore, any unexpended funds upon completion of the drainage improvements shall revert back to the Measure R Capital Improvement Program Reserve Fund.

FISCAL IMPACT:

Approval of the resolution will authorize the appropriation of $44,000 from the Measure R Capital Improvement Program Reserve Fund for the drainage improvements. Any unexpended funds upon project completion shall revert back to the Reserve Fund. This expenditure will be funded from the Measure R Capital Improvement Program Reserve Fund for Fiscal Year 2025-26, which has an estimated fund balance of $2,681,019— sufficient to cover the additional appropriation.

RELATIONSHIP TO STRATEGIC PLAN:

This item closely relates to Strategic Direction No. 5, "Infrastructure and Asset Management."

STAFF REPORT
Date: February 18, 2026 Agenda Item:

3.E.

To: Honorable Mayor and City Council Members
From: Lisette Free, City Manager
Prepared By: Kelli Anderson, Communications Manager
Department: Administration
SUBJECT:

Consideration of the City of Norco's 2026 Legislative Platform RECOMMENDATION:

Adopt Resolution No. 2026-08 to approve the 2026 Legislative Platform for the City of Norco and authorize actions in support of the platform.

SUMMARY:

The City of Norco’s Legislative Platform serves as the guiding document for advocacy efforts at the State and Federal levels. By adopting this platform, the City establishes its official positions on key issues and priorities, ensuring that legislative engagement is consistent, strategic, and aligned with the City's long-term goals. Organized around the 2022 Strategic Plan Directions, the platform reinforces local control as a fundamental principle of municipal authority. Reviewed annually in February, the 2026 Legislative Platform remains substantively unchanged from previous years, providing continuity in the City’s legislative priorities.

BACKGROUND:

Each year, the City of Norco engages with State and Federal legislators and agencies on issues that affect local governance, municipal operations, and the overall quality of life for residents. To provide clear guidance for these efforts, the 2026 Legislative Platform (Exhibit A) has been prepared for City Council consideration. Organized around the 2022 Strategic Plan Directions, the platform reflects the City’s mission and adopted Core Values, while reinforcing local control as a fundamental principle of municipal authority.

The platform outlines the City’s priorities and positions on legislative and regulatory proposals anticipated during the year. Once adopted, it authorizes the Mayor, City Manager, and designated representatives to advocate on behalf of the City through letters, emails, calls, meetings, and other communications. These actions ensure that

Page 27 of 61 ends

the City’s priorities are effectively communicated to decision-makers and stakeholders.

The City Manager, or their designee, will maintain records of advocacy activities and provide regular updates to the City Council, including copies of all correspondence signed by the Mayor.

The City Council previously adopted a Legislative Platform in 2023 and 2024. The 2026 Legislative Platform remains substantively unchanged from prior years—no items have been added or removed, however the platform now references the City's recently adopted Core Values. The platform continues to provide a flexible, overarching guide that may be refined in the future to address emerging challenges and opportunities. The platform will be presented to the City Council annually in February to ensure alignment with evolving City priorities.

FISCAL IMPACT:

This agenda item will not result in a fiscal impact.

From: Amanda Hamilton, Deputy City Manager /
Community Operations Director
Prepared By: Amanda Hamilton, Deputy City Manager /

Department: Community Operations
SUBJECT:

Acceptance of the City Hall Lobby and Security Upgrade Project (Project No. 54303.2) as Complete
RECOMMENDATION:

Accept the City Hall Lobby and Security Upgrade Project (Project No. 54303.2) as Complete, and Authorize the City Clerk to file a Notice of Completion with the County of Riverside.

SUMMARY:

The City Hall Lobby and Security Upgrade Project is complete. The work included security enhancements, ADA-compliant features, and aesthetic improvements. The original contract of $297,801 was adjusted to $289,070 after $22,769 in approved change orders and offset by $31,500 in liquidated damages for 63 days of delay. All work has been inspected and meets contractual and regulatory requirements.

BACKGROUND:

On October 15, 2024, the City Council duly awarded a public works contract for the City Hall Lobby and Security Upgrade Project (Project No. 54303.2) to Estate Design and Construction in the amount of Two Hundred Ninety-Seven Thousand Eight Hundred One Dollars ($297,801). Pursuant to Council action, the City Manager was authorized to approve change orders not to exceed ten percent (10%) of the original contract amount.

The approved scope of work encompassed security enhancements at the primary entrances of City Hall, together with accessibility and aesthetic improvements.

Specifically, the project included installation of new veneer cabinetry and counters, security glass, new flooring, full-length doors, additional security doors, and ADAcompliant countertops to ensure conformity with federal accessibility standards. These

Page 33 of 61 ends

improvements were deemed necessary to provide a secure, accessible, and professional environment for members of the public and City personnel.

Construction began in November 2024 under a contractual performance period of one hundred twenty (120) working days, with provisions for extensions through approved change orders. However, the contractor failed to perform within the agreed timeframe, resulting in significant delays caused by inadequate labor resources, poor material procurement planning, and repeated corrective work required to meet contractual specifications.

The work was completed in October 2025, within two hundred thirteen (213) working days, inclusive of approved extensions. In accordance with the contract, liquidated damages were assessed at a rate of Five Hundred Dollars ($500) per calendar day for sixty-three (63) days of delay, resulting in a credit to the City in the amount of ThirtyOne Thousand Five Hundred Dollars ($31,500). Approved change orders for additional electrical work, upgraded cabinetry, and expanded security glass totaled Twenty-Two Thousand Seven Hundred Sixty-Nine Dollars ($22,769).

Accordingly, the final contract amount is Two Hundred Eighty-Nine Thousand Seventy Dollars ($289,070), which reflects a reduction of Eight Thousand Seven Hundred ThirtyOne Dollars ($8,731) from the original contract amount after application of liquidated damages. While the duration of the project exceeded the original performance period, the completed improvements satisfy the intended objectives of enhanced security, ADA compliance, and improved public accessibility.

Further, the completed work has been inspected by the City of Norco Facilities Superintendent and has been determined to be in full compliance with the approved plans, specifications, and all applicable contractual requirements.

FISCAL IMPACT:

Following the application of liquidated damages and approved change orders, the final contract amount is $289,070, which represents a reduction of $8,731 from the original award of $297,801. The resulting savings will be returned to the Measure R Fund for future eligible projects.

STAFF REPORT
Date: February 18, 2026 Agenda Item:

3.G.

To: Honorable Mayor and City Council Members
From: Joshua Calhoun, Finance Director
Prepared By: Joshua Calhoun, Finance Director
Department: Finance
SUBJECT:

Approve Master Repayment Agreement Between City of Norco and Balboa Management Group ("Balboa")
RECOMMENDATION:

Adopt Resolution No. 2026-09 approving a Master Repayment Agreement between the City of Norco ("City") and Balboa Management Group ("Balboa") which replaces the prior Memorandum of Understanding between parties regarding reimbursement repayment schedule dated January 20, 2016 as amended, to establish a revised repayment schedule for reimbursable costs related to City owned facilities at SilverLakes.

SUMMARY:

In 2011, the City entered into multiple agreements with Balboa concerning the SilverLakes property. Under those agreements, Balboa constructed certain City owned facilities subject to reimbursement by the City.

In 2016, the City and Balboa entered into a Memorandum of Understanding establishing a repayment schedule for the reimbursable amount. During COVID, activities at SilverLakes were limited resulting in reduced revenue and the inability to make payments in accordance with the prior repayment schedule.

The proposed Agreement replaces the prior repayment schedule and sets forth the parties’ agreed upon calculation of all amounts due as of the Agreement’s Effective Date. The Agreement further establishes revised repayment terms, provides for an escrow account, and is intended to re-establish an enforceable repayment structure going forward.

BACKGROUND:

Page 40 of 61 ends

In 2011, the City entered into a series of agreements with Balboa related to the lease, development, construction, and operation of approximately 122 acres of City owned land commonly known as “SilverLakes.” Under those agreements, Balboa is required to reimburse the City for the costs associated with those facilities.

In 2016, the City and Balboa entered into a Memorandum of Understanding (“MOU”) establishing a repayment schedule for the reimbursable amount. During the COVID-19 public health emergency, operations at SilverLakes were significantly disrupted resulting in reduced revenue. As a result, payments under the prior repayment schedule were not made as originally anticipated.

As of the effective date of the proposed Agreement, a portion of the reimbursable amount remains unpaid. The proposed Agreement replaces the repayment schedule set forth in the Prior MOU, establishes updated repayment terms, provides for an escrow arrangement in lieu of a surety bond, clarifies the treatment of existing late fees and audit related matters.

The Agreement does not create new reimbursement obligations and does not modify the underlying Ground Lease, Development Agreement, Funding, Construction and Acquisition Agreement, or parking lot and ground leases, except as expressly provided with respect to repayment terms.

ALTERNATIVES:

Alternative No. 1: Adopt the Resolution and Approve the Master Repayment Agreement between City and Balboa.

Alternative No. 2: Do not adopt the Resolution and do not approve the Master Repayment Agreement.

FISCAL IMPACT:

Approval of the Agreement does not create new obligations beyond what was previously authorized. The Agreement confirms the parties’ agreed upon calculation of amounts due as of the effective date and establishes a revised repayment schedule and escrow security for repayment. Fiscal impacts are limited to receipt of payments as provided under the revised repayment schedule.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Direction No. 3 - "Economic Development and Financial Stability."

SECTION 3. ESCROW IN LIEU OF SURETY BOND

3.1 Instead of a surety bond, Balboa will fund an interest-bearing escrow (“Escrow Account”). The Escrow Account will be established at US Bank.

5.3 If an audit report is delayed due to unforeseen circumstances, Balboa will promptly notify the City Manager and Director of Finance in writing of the reason for the delay and the anticipated delivery date. Any extension of the deadline shall only be permitted with the City’s prior written approval.

5.4 If Balboa does not provide a required audit report or agreed upon procedures report on time, City will give written notice to Balboa. If the report is still not provided within thirty (30) days after that notice, that failure will be considered a default under this Agreement.

SECTION 6. DEFAULTS

6.1 Any one of the following will be an “Event of Default” under this Agreement:
(a) Balboa fails to make a Monthly Payment or any other payment under this Agreement when due, and does not cure that failure within ten (10) days after City’s written notice;

(c) Balboa fails to provide a required audit as required under Section 5, and does not cure that failure within thirty (30) days after City’s written notice; (d) Balboa is in uncured default under the Ground Lease, Development Lease or Funding Agreement, after notice and cure periods under those Agreements have run.

6.2 If an event of default occurs and is not cured within required period, City may declare immediately due and payable the outstanding principal balance of the Total Repayment Amount, all accrued but unpaid interest and the Existing Late Fees, and
