SUBJECT: APPROVE PURCHASE OF A TRAILER-MOUNTED HIGH-PRESSURE SEWER

LINE JETTING UNIT
Background:

As part of the Fiscal Year 2023/24 budget process, the Public Services Department budgeted for the purchase of a trailer-mounted high-pressure jetting unit. The unit is used to clear out small sewer lines in buildings and at parks. Currently, the City does not have a jetting unit and must contract out the cleaning and clearing of sewer lines to a private contractor. With the purchase of the unit, staff will be able to perform this service in-house, reducing the need to contract for this service for small diameter sewer lines.

On July 26, 2023, staff released a Request for Quote for the unit and US Jetting provided the lowest price.

Company Amount US Jetting LLC $71,422.70 Technology International, Inc. $75,140.00 Municipal Maintenance Equipment Inc. $93,711.58 Fiscal Impact:

City Council Agenda Report
September 19, 2023
TO: Honorable City Council
FROM: Jesus M. Gomez, City Manager
BY: Levy Sun, Director of Communications & Public Affairs SUBJECT: RESOLUTION NO. 23-54 - AMENDING THE FISCAL YEAR 2023/24 ADOPTED

BUDGET TO APPROPRIATE FUNDS FOR CITY CRISIS COMMUNICATIONS

SUPPORT
Background:

In the rapid-fire changing world of digital communications, a government entity can lose control of a crisis faster and easier than ever before. News coverage is no longer limited to the traditional media of newspapers, radio, and television. One citizen with a smartphone can broadcast an emerging crisis quickly and broadly. This environment demands effective utilization of all available communication channels to get the City’s message out quickly.

Since August 5, 2020, the City has utilized The Merino Group dba TMG Strategies (formerly Merino, Barajas & Associates, Inc.) for crisis communication services. Since partnering with The Merino Group, the City has effectively worked with staff to monitor media, collect information from news reports, note issues being focused on by traditional and social media, highlight errors and misinformation that needs to be corrected, and establish important contact information. For example, The Merino Group has prepared numerous statements associated with the COVID-19 pandemic, added content to the City’s social media platforms, and Norwalk Now newsletter articles.

In the past six months, The Merino Group provided valued services that enhanced the operations of the City. For example, the Merino Group conducted research and coordinated outreach efforts with the Public Safety Department regarding Street Vendor Permits. The Merino Group also collaborated with University of Southern California (USC) graduate students to facilitate a public survey and focus group that provided insight to community policing programs.

The Merino Group also played a critical role in supporting the Communications and Public Affairs Department during crises. With their expertise in the media landscape, they assisted the City in

City Council September 19, 2023
Resolution No. 23-54 - Budget Amendment Page No. 2
5 8
8 multiple media interviews, such as construction issues on private properties that may negatively impact the City’s reputation. Recently, The Merino Group provided key support before, during, and after Tropical Storm Hilary. The agreement has been amended several times, last on December 30, 2022.

Through the term of the proposed contract that extends to June 2024, The Merino Group will monitor, evaluate, and respond to emerging crises associated with homelessness, crime, high- profile development projects, environmental disasters, and any forecasted crises. In addition, The Merino Group will work with the Public Safety and Communications and Public Affairs departments to support content and communications efforts regarding issues that impact the Norwalk community. Amendment No. 6 extends the agreement through June 30, 2024 with the option of a one-year extension.

Fiscal Impact:

The original allocation of the American Recovery Plan Act (ARPA) funding included in the FY 2023/24 budget is being released as The Merino Group’s services no longer qualify to utilize those funds. Therefore, a budget appropriation of $47,705 in general fund is necessary to fund this agreement through the end of this fiscal year. The amendment with The Merino Group is in an amount not to exceed $127,680.

PUBLIC SERVICES UTILITIES DIVISION PROFESSIONAL

ENGINEERING STAFF AUGMENTATION SERVICES
Background:

The Public Services Department (Public Services) is responsible for the management, operations and maintenance (O&M) of the City’s water, sewer, and storm drain systems; street lights, traffic signals traffic signage and pavement striping/markings. In addition, Public Services also implements the City’s capital improvement program (CIP), which includes: roadways, traffic signals, underground utilities (water, sewer and storm drains), facilities (city and park) and associated projects. Included with the capital program are the necessary system master plans (water, sewer, storm drain); pavement management plan, facilities and other essential studies. These studies help staff evaluate needs and prioritize improvement projects.

Public Services is currently engaged with water main replacement projects, well rehabilitation projects, water treatment implementation projects, Supervisory Data and Acquisition (SCADA) system implementation, smart water meter projects, storm drain planning and catch basin modifications projects, sewer and manhole repair and replacement projects, and grant management.

Recently, Public Services has been experiencing increased demand for development activity reviews. Input from Public Services helps ensure proposed developments and their recommended improvements are compliant with applicable codes and compatible with current/future service delivery. This increased demand is in addition to the O&M and CIP workload from both current and planned future projects. At the current staffing levels, the quantity and quality of work is not sustainable. Additional contract services and resources are required to supplement project management, design, construction support, and O&M. Contract

1 services will provide the necessary expertise and knowledge to offer a wide variety of services to help meet the needs of our community.

In October 2022, staff solicited for on-call services from consulting firms and recommended a “qualified” list to City Council in February 2023 and May 2023. This established a “consultant pool” of qualified consultants based on their proposals for their areas of expertise, previous experience, resource availability, project work type; services offered and staff augmentation availability.

In mid July 2023, staff solicited the consultant pool with a request for proposals (RFP) for staff augmentation services. In response, two proposals were submitted with resumes and their schedule of hourly rates and fees. The submitting firms were:
 W. G. Zimmerman Engineering, Inc. (WGZE)
 SA Associates, Inc.

Personnel recommended for staff augmentation services were evaluated for their knowledge of civil engineering principles and practices as applied/related to public works, and their ability to perform professional engineering work. WGZE’s proposal demonstrated their personnel meets or exceeds the City’s needs per the RFP and are available to support the department’s needs.

Fiscal Impact:

CIP project budgets are part of the approved FY 2023/24 budget process. Funds involved for the CIP projects are from various restricted funds such as qualified water and sewer projects under Water and Sewer Enterprise funds; storm water related projects/services under Measure W funds. Funds will be utilized as appropriate and applicable for each work order assigned to consulting personnel.

Funding is available across Public Services Water and Sewer Enterprise Funds and General Fund (See Table). Fiscal Year 2023/24 approved budget will be amended to account for professional engineering staff augmentation services for development reviews and O&M assistance. Funds will be programmed into future fiscal year budgets as needed.

Water Enterprise $ 32,500
Sewer Enterprise $ 32,500

SUBJECT: APPROVE PURCHASE OF A TRACTOR/BACKHOE
Background:

As part of the Fiscal Year 2023/24 budget process, the Public Safety Department budgeted for the purchase of a tractor/backhoe for HOPE Team Operations. The unit is used for site cleanups and would be available in the event of an emergency as a backup to Public Services. Currently, the HOPE team does not have a dedicated tractor and must schedule use of the equipment around other city projects. With the purchase of the unit, staff will be able to perform major cleanups immediately and much more quickly than they otherwise would when working without the equipment.

A cooperative purchasing agreement for construction equipment is in place with Case Construction allowing the city to purchase the unit locally through Sonsray Machinery of Santa Fe Springs, California.

SUBJECT: CONSIDERATION OF A LETTER OF PARTNERSHIP WITH THE LOS

ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY FOR THE 2028 OLYMPIC GAMES MOBILITY GRANT PROJECT
Background:

In 2021, the Infrastructure Investment and Jobs Act (IIJA) established the Federal Reconnecting Communities Pilot (RCP) grant program, a $1 billion discretionary grant program to reconnect communities divided by transportation infrastructure. In 2022, the Inflation Reduction Act (IRA) established the $3.2 billion Neighborhood Access and Equity Grant (NAE) Program to provide funds for projects that improve walkability, safety, and affordable transportation access and address existing transportation facilities that create barriers to community connectivity in disadvantaged or underserved communities.

Under the combined Federal Reconnecting Communities and Neighborhoods (RCN) grant program, the RCP and NAE grant programs share common goals including:
•Prioritizing disadvantaged or underserved communities
•Aiming to improve access to daily needs such as jobs, education, healthcare, food, and recreation
•Fostering equitable development and restoration
•Reconnecting communities by removing, retrofitting, or mitigating highways or other transportation facilities that create barriers to community connectivity, including mobility, access, or economic development.

Funds will be awarded on a competitive basis for projects that: advance community-centered connection transportation projects; benefit underserved communities; improve access to daily needs; foster equitable development and restoration; and reconnect communities.

7 In addition, the Los Angeles County Metropolitan Transportation Authority (Metro) has the responsibility to prepare the regional transportation system to accommodate the 2028 Olympic Games (Olympics). The Olympics will include multiple sports parks across Los Angeles County that will issue 10 to 15 million tickets across 700+ events. The Olympics are expected to be one of the largest peacetime gatherings in United States history.

Mobility considerations during the Olympics include:
•Olympics Network: Dedicated lanes for Olympic vehicles between venues. •Car-Free Games: No parking at the venues. All spectators will need to arrive to the venues using public transportation.
•Supplemental Bus System: Temporary bus system to meet spectator demand during the Olympics.

To address these needs, Metro convened a 2028 Games Task Force to collaborate with local and regional partners, develop a funding strategy, and advance project planning and delivery.

According to their needs assessment, 15 project areas have been identified within the region, including the Metro C-Line (formerly Green Line) station area and route to the Norwalk/Santa Fe Springs Metrolink Station. The grant application for this project may include eligible projects such as bus improvements (eg. enhanced bus shelters, increased service frequency, branding and other service enhancements) and first/last mile improvements intended to improve pedestrian and bicycle safety needs. At this time, specific funding estimates are not available.

Specific Norwalk projects will be further identified and City Council will receive future updates regarding how the funding is proposed for use. The program guidelines recommend that the grant request be accompanied by submittal of a letter of partnership from the City of Norwalk, which endorses the request.

INSERT DATE
Secretary Pete Buttigieg
U.S. Department of Transportation
Office of the Secretary of Transportation
1200 New Jersey Avenue, SE
Washington, D.C. 20590
Dear Secretary Buttigieg:

RE: Los Angeles County Metropolitan Transportation Authority Neighborhood Access & Equity Grant Application
On behalf of the City of Norwalk, I write to affirm our partnership with Los Angeles County Metropolitan Transportation Authority (Metro) in our application for the United States Department of Transportation’s (USDOT) Neighborhood Access & Equity (NAE) competitive grant program for Removing Barriers by Creating Legacy - A Multimodal Approach for Los Angeles County (Project).

This Project will ensure regional collaboration that will transform Los Angeles (LA) County through high-quality mobility options that will enable people to spend less time traveling while enhancing communities through improved mobility and access to opportunity. The Project will enhance and expand affordable, equitable, and safe multi-modal connections through investments into bus corridor improvements within the City of Norwalk. The proposed scope of work aligns with NAE’s goals for advancing community-centered transportation connection projects that primarily benefit disadvantaged communities and improve access to daily needs for communities by investing in equitable mobility mode options to redress historic inequities of investments into auto-centric focused transportation and design.

The City of Norwalk is home to over 102,000 residents. The Project is particularly important to our community because of the improved regional transit connectivity it will provide. Our city acknowledges the proposed project scope and our intent to carry out the scope within the right of way of our jurisdiction. Norwalk believes that the Project is vital to the prosperity of the residents we serve and is an excellent, cost-effective investment.

The Project is consistent with Norwalk’s current transportation plans, which were the result of planning, design and outreach efforts. This Project will transform the lives of residents of Norwalk through over 3 miles of bus corridor improvements (such as enhanced bus shelters and transit signal priority) on Imperial Boulevard, Hoxie Avenue and Studebaker Road between the Metro C-Line Station and Metrolink Norwalk/Santa Fe Springs Station. [City letterhead]
Metro and Norwalk have agreed to each contribute their staff/resources to complete the development of the Project at no cost to one another. If awarded the funds, Metro and Norwalk will proceed with the development and completion of the environmental, design and outreach phases of the Project. We appreciate Metro’s assistance in expediting Norwalk’s local priorities upon availability of funds to support the development of the Project.

The City of Norwalk would like to thank you for your consideration of this regionally significant project.

Sincerely,
Jesus Gomez

GRANT FUNDING AGREEMENT
Background:

The Safe Drinking Water Program (SDWP), previously known as the Water Replenishment District (WRD) Wellhead Treatment Program, is a grant funding program established by WRD in 1991. The program provides groundwater pumpers with funding, or financing opportunities, for treatment systems to remove specific groundwater contaminants (man-made Volatile Organic Carbons known as VOCs) from affected drinking water wells enabling water purveyors to meet State drinking water standards. This program was recently expanded to address localized groundwater quality issues beyond man-made VOCs. The expanded program now includes funding and financing for primary and secondary contaminants (other than VOCs) as identified by Title 22 of the California Code of Regulations.

As recent as October of 2021, the City’s Well No. 10 has exceeded the maximum levels the State allows for Benzene. Benzene has been on the Primary VOC contaminant list since 1989 and is natural and man-made. Examples of man-made benzene use is as a constituent in motor fuels, and in the manufacture of detergents, pharmaceuticals, and dyes. In order to meet State drinking water standards, the City will need to treat groundwater from Well No. 10 to remove Benzene by implementing a treatment system. Typical treatment systems for Benzene may also be capable of removing other contaminants which is an additional benefit to the City, if needed.

WRD’s SDWP has five options available for groundwater pumpers to address water quality issues. City staff confirmed that Well No. 10 is eligible and submitted a grant application to WRD for SDWP grant funding. WRD funding availability is dependent on the particular agency needs and the number of projects funded during their budgeting process. Maximum funding available for Well No. 10 is $2,000,000. Eligible expenses are for design and construction only; operations and maintenance expenses are not eligible. WRD accepted the City’s grant application in May

0 2023 and approved a grant funding agreement in the amount of $2,000,000 at their August 15, 2023 Board Meeting. The final step to receiving the grant is approval of the WRD grant funding agreement by City Council.

Fiscal Impact:

Estimated project costs for implementing treatment for groundwater from Well No. 10 to remove Benzene is $2,500,000 – $3,000,000. Funding from a grant award in the amount of $2,000,000 from the WRD will offset expenses to the City’s Water Enterprise Fund.

SUBJECT: PROPOSED NEW RESIDENTIAL REHABILITATION PROGRAM Background:

The United States Department of Housing and Urban Development (HUD) funds the Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME) and submittal of an Annual Action Plan (Plan) is required, which lists the specific activities that the City will undertake with the funds. The types of activities that the City may conduct are subject to federal rules and regulations, such as funding caps on program administration and social services, requirements for public-private partnerships, and compliance with National Objectives.

On May 2, 2023, City Council adopted the Fiscal Year (FY) 2023/24 CDBG and HOME Plan.

HUD granted the City $1,063,684 in CDBG and HOME funds. On July 18, 2023, staff presented to City Council a report to review the proposed changes to activities for the FY 2023/24 Plan and received direction for priorities of the proposed new Residential Rehabilitation Program. The purpose of this report is to provide an update regarding the proposed Residential Rehabilitation Program based on City Council’s feedback.

Funding and Proposed Activities for the Annual Action Plan The City is proposing to reallocate funds from the Residential Rehabilitation Program activity to a capital improvement project within census tracts 5526.01 and 5526.02. The Public Services Department has partially completed curb ramps, gutters, and street paving within the 5526.01 census tract. The City anticipates the CDBG Program to have $600,000 in unallocated funds, which were a combination of carryover funds from 2021 and 2022 and reallocation of $400,000 from FY 2023 Residential Rehabilitation activity funds.

The capital improvement project was not listed in the FY 2023/24 Plan adopted by City Council on May 2, 2023. Under the Citizen Participation Plan, allocating funding to a new activity triggers a substantial amendment to the Plan. After the Plan public review period ends, new activities cannot be added to the Plan without triggering another 30-day public review period and a

The program will help create safe and livable neighborhoods while supporting sustainability and climate resilience throughout the community. The new proposed residential rehabilitation services would include the following:

Eligibility requirements would include home ownership and 60 years of age and above. Grants will be administered on a first come first served basis.
•Residential Rehabilitation Services for Eligible Low and Moderate Income Homeowners Norwalk homeowners will be eligible for a grant to make necessary residential rehabilitation repairs. Grants will be administered on a first come first served basis.
•Home Safety Inspections
Contractors will conduct residential property inspections on behalf of the City to Norwalk residents in order to identify potential health and safety repairs needed for the property (e.g. faulty wiring, plumbing, and gas leaks, etc.). The homeowners would be able to apply for potential assistance to correct the safety items identified that are eligible as part of the program.
•Use of Funds
HUD requires that CDBG and HOME funds be allocated to projects that meet the National Objectives of decent housing, a suitable living environment and expanded economic opportunities. While HOME funds may only be used for housing related activities, CDBG funds may be used for a variety of community development activities, such as rehabilitation of housing and commercial buildings, infrastructure improvements, and certain services, such as counseling and job training. Funds may be used to directly benefit a household that meets the income limitations, such as repair of a specific home, or used for an area benefit, where the improvement is located in a census tract with at least 51% of the households being considered low to moderate income. In addition to meeting these general requirements, activities must comply with the regulations found in Chapter 24, Part 92 and 570 of the Code of Federal Regulations.
