RESOLUTION NO. 23-57
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK
APPROVING A SUBSTANTIAL AMENDMENT TO THE FISCAL YEAR
2019/20 ANNUAL ACTION PLAN CORONAVIRUS AID, RELIEF, AND
ECONOMIC SECURITY ACT FUNDS
WHEREAS, the City Council of the City of Norwalk adopted the Fiscal Year (FY) 2019/20 Annual Action Plan on May 7, 2019 and a Substantial Amendment to the FY 2019/20 Annual Action Plan on May 19, 2020 and February 16, 2021; and WHEREAS, the Code of Federal Regulations require that the City must amend its approved Annual Action Plan whenever it (a) changes it allocation priorities or method of distribution of funds; (b) carries out an activity not previously described in the action plan; (c) allocates a substantial changes (by $35,000, except for planning and administration) in funds; or (d) changes the purpose, scope, location, or beneficiaries of an activity; and WHEREAS, through the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), the United States Department of Housing and Urban Development (HUD) granted the City $1,598,280 in Community Development Block Grant CARES Act (CDBG- CV) funds to prevent, prepare for, or respond to COVID-19; and WHEREAS, HUD granted the City waivers and suspensions to CDBG funds to maximize the availability of funds for COVID-19; and
WHEREAS, the City implemented a reasonable public notice and reduced the 30- day commenting period to 5-days for substantial amendments, pursuant to HUD regulations; and
WHEREAS, Notice of Public Hearing and public notice of the substantial amendments to the FY 2019/20 CDBG Annual Action Plan and Citizen Participation Plan was posted at the City’s official posting sites on September 14, 2023, and published in The Norwalk Patriot on September 15, 2023; and
WHEREAS, a public notice of the substantial amendments to the FY 2019/20 CDBG Annual Action Plan and Citizen Participation Plan was posted at the City’s official posting sites on November 22, 2023, and published in The Norwalk Patriot on November 24, 2023; and
WHEREAS, the City Council conducted a duly noticed public hearing on October 3, 2023 and a duly noticed continued public hearing on December 5, 2023.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NORWALK HEREBY DETERMINES, FINDS, AND RESOLVES AS FOLLOWS:
Section 1.The Fiscal Year 2019/20 Annual Action Plan shall be amended to reallocate $206,447.88 of unused CDBG-CV funds to Homeless Assistance.

Section 2. The City will be implementing waivers and suspensions to the CDBG-CV3 reallocated funds.
Section 3.The Mayor, or presiding officer, is hereby authorized to affix her signature to this Resolution signifying its adoption by the City Council of the City of Norwalk and the City Clerk, or her duly appointed assistant, is directed to attest thereto.
