RESOLUTION NO. 24-02

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK

SETTING FORTH ITS FINDINGS OF FACT AND DECISION OF
UPHOLDING THE PLANNING COMMISSION’S DECISION TO DENY
PRECISE DEVELOPMENT PLAN NO. 2023-02 AND CONDITIONAL
USE PERMIT NO. 2023-05
WHEREAS, the Planning Commission of the City of Norwalk (Planning Commission) received Precise Development Plan (PDP) No. 2023-02 and Conditional Use Permit (CUP) No. 2023-05, a request from David A. Storer on behalf of Quick Quack Car Wash Holdings, LLC to demolish an existing commercial building and construct a new 3,511 square foot automated carwash facility with self-service vacuums at 11642 Firestone Boulevard; and
WHEREAS, Section 17.02.240.C of the Norwalk Municipal Code (NMC) requires the Planning Commission to review PDP applications, and sets forth the required findings that the Planning Commission must make prior to approval of a PDP; and WHEREAS, the purpose and intent of requiring a conditional use permit is to ensure that compatibility is maintained between the proposed use and other land uses on surrounding properties; and
WHEREAS, Section 17.02.210.A of the NMC authorizes the Planning Commission to grant a CUP and impose such conditions as it deems necessary and reasonable to protect the best interests of the surrounding property or neighborhood and to ensure compliance with the Zoning Ordinance and the General Plan; and WHEREAS, PDP No. 2023-02 and CUP No. 2023-05 were reviewed by the Planning Commission on November 8, 2023, at which time oral and documentary evidence relative to the application was received and they adopted Resolution No. 23- 33 and Resolution No. 23-34 to deny the application with a 4 to 0 vote; and WHEREAS, on November 22, 2023, the applicant submitted an appeal of the Planning Commission’s action denying the project; and
WHEREAS, pursuant to Section 17.02.210.H.4 (Appeal Procedure) of the NMC, the action of the City Council shall be final; and
WHEREAS, PDP No. 2023-02 and CUP No. 2023-05 has been reviewed by the City Council on March 5, 2024, at which time oral and documentary evidence relative to the application was received.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NORWALK HEREBY DETERMINES, FINDS, AND RESOLVES AS FOLLOWS:

Resolution No. 24-02 Page 2 of 2
Section 1. The proposed use would be inconsistent with the character of the community and the establishment of a positive image for Norwalk. The potential impacts generated by the project will be incompatible with the nearby multifamily residential uses, considering the abundance of existing carwashes in the city. The project will be detrimental to the public health, safety, and welfare and adversely affect the development of the surrounding area by hindering potential housing and diverse commercial uses for the community.

Section 2. The City Council of the City of Norwalk does hereby deny Precise Development Plan No. 2023-02 and Conditional Use Permit No. 2023-05.

Section 3. The Mayor, or presiding officer, is hereby authorized to affix her signature to her Resolution signifying its adoption by the City Council of the City of Norwalk and the City Clerk, or her duly appointed assistant, is directed to attest thereto.

APPROVED AND ADOPTED this 5th day of March 2024.
