SUBJECT: RESOLUTION NO. 24-51 – BUDGET AMENDMENT FOR ANNUAL WATER

LOSS REPORTING
Background:

The California Department of Water Resources (DWR) requires urban retail water suppliers to submit an Annual Water Loss Report for every calendar year to be in compliance with Senate Bill (SB) 555 adopted in 2015. The annual water loss report provides a systematic approach to auditing and managing water loss in the water distribution system. The report’s results help increase water supplies and recover revenues by identifying the scale and cost of these losses.

Arcadis, Inc. (Arcadis) has been assisting the City in the preparation and validation of its water loss reports from calendar year (CY) 2016 to CY 2022. The last Annual Water Loss Report for CY 2021 was completed in September 2022. On February 14, 2024 under the City Manager’s authority, the City approved an agreement with Arcadis to update the CY 2022, CY 2023, and CY 2024 Annual Water Loss Reports over a three-year term. The professional services provided by Arcadis assists the City with DWR regulatory compliance requirements.

New and more complex reporting requirements from DWR have resulted in additional technical review to ensure the quality of data and documentation. To maintain compliance and ensure the City is reporting the most accurate data available, staff is recommending a review of past reports. The audit could result in improved scores for the City’s water distribution system and reduced compliance requirements in the future.

Staff requested a proposal from Arcadis to perform an audit review on Annual Water Loss Reports submitted for previous CYs. The work scope (major tasks) for Annual Water Loss

PROFESSIONAL SERVICES FOR WATER METER READING AND RELATED

SERVICES
Background:

The Utilities Division (Utilities) in the Public Services Department is currently engaged with the development, preparation, and implementation of several capital improvement projects (CIPs) and construction of new water treatment facilities. Utilities is also responsible for addressing regulatory compliance for each City owned system, oversees the management and development of technical studies and master plans (water, sewer, storm drain systems), and must also be responsive to the rise in development activity within the City.

Utilities engineers and crew members play a large role with all activities, as well as other Public Services Departmental duties and external departmental requests/needs. As workloads grow from current and future projects/programs, an increased involvement is required from both Utility engineers and crew member staff. Contract services provide the necessary expertise, knowledge and staff augmentation to offer services necessary to help meet the needs of our community.

The Norwalk Municipal Water System (NMWS) service area is comprised of portions within the Cities of Norwalk and Artesia, and a small, unincorporated portion of Los Angeles County. The City has been successful with upgrading nearly 1,000 of the over 5,350 manual-read water meters to advanced metering infrastructure (AMI) meters for the NMWS. City staff are currently working on upgrading 477 additional water meters for this fiscal year. For the Finance Department to prepare water billing, and the Utilities Division to track water consumption, meter reads are gathered by crew members every other month. Manually reading over 4,350 water meters throughout the City’s water service areas, and later re-reading them to correct errors,

requires a significant effort from crew member staff. Currently there are four, soon to be five, crew member staff to meet all City water, sewer, and storm drain system current and future needs.

To ease crew member workloads, staff solicited Request for Proposals (RFP) No. 25-760 for Water Meter Reading and Related Services on August 9, 2024. The main components of the scope of work for RFP No. 25-760 are:
•Bi-monthly reading of water meters within the NMWS service area •Re-reading water meters that were missed or had incorrect reads •Data collection and to generation of work orders for needed repairs (e.g. broken/obscured registers, meter replacements, broken meter box lids)
•Notification of public safety issues or suspected water leaks •Water service turn-ons and service turn offs
•One-time water service connections materials survey for regulatory compliance •Fire flow testing and cross connection tests, as requested •Additional services related to water meter reading, as needed Proposals were due August 26, 2024. Two companies submitted proposals that were reviewed internally by an evaluation panel of City staff.

Proposals Received & Evaluated
Company/Contractor Costs for Services
Stephen Doreck Equipment Rentals, Inc. $485,074
Big Ben Engineering Unknown
Estimated and budgeted costs for the approved Fiscal Year 2024/25 Budget are $112,000 for these services. Additional funding in the amount of $373,074 will be needed to complete the work. Due to proposals being significantly higher than estimated costs, and a missing rate sheet for one contractor, staff is recommending rejection of all proposals. Solicitation of new formal proposals will not be pursued. Staff will be investigating other, less expensive, options.

SUBJECT: AWARD PURCHASING AGREEMENTS FOR 2024-2026 TRAFFIC

SIGNAGE AND RELATED MATERIALS
Background:

The Utilities Division (Utilities) within the Public Services Department is responsible for maintaining, replacing, and installing the City’s traffic signage. Aging infrastructure, new regulatory requirements for sign replacements, automobile collisions, vandalism, and the need for traffic related materials has grown. Currently, the City owns and maintains approximately 28,000 signs citywide. The traffic crew members (field staff) successfully upgrade and/or replace hundreds of signs, and related components, each year.

To prequalify vendors and secure competitive rates, staff solicited an Invitation for Bids (IFB) No. 25-770 for 2024-2026 Traffic Signing and Related Materials was released on August 8, 2024. The key supplies, materials and equipment, and non-professional services for IFB No. 25-770 include:

Supplies, Materials, Equipment Approved 2024-25

Sign posts, mounting hardware, and other miscellaneous
related items such as traffic cones and delineators

To avoid potential material shortages that would delay maintenance of efforts, staff recommend establishing purchase agreements with multiple companies. This ensures City access to resources needed for compliance with State laws and to meet community needs. This procurement process is to establish agreements with the three top responsive companies for purchase of supplies and materials.

Amounts budgeted for traffic signage and related materials are estimated and vary by fiscal year and will depend on current City needs. Combined purchases made between the three companies selected will not exceed the total annual amounts budgeted and approved by City Council each fiscal year. The initial contract agreement will be for a three-year term, with the option to extend twice for two one-year periods. Establishing agreements with each of the three companies, and the issuance of purchase orders, will not guarantee any purchases will be made.

Bids were due August 26, 2024. Eight companies submitted bids that were reviewed internally by an evaluation panel of City staff. Bids were evaluated on bid completeness, supplies and materials offered, inventory availability and lead times, and rates.

Square Signs LLC dba Front Signs, Roadline Products, and Myers & Sons Hiway Safety, Inc., are recommended by staff due to their extensive inventories of signage related supplies and materials and competitive rates. BY: Alex Hamilton, Interim Director of Community Development Sandra Duran, Senior Management Analyst
SUBJECT: AGREEMENT AMENDMENT NO. 4 FOR ON-CALL COMMUNITY

DEVELOPMENT CONSULTANT SERVICES AND ADDITIONAL SERVICES Background:

On October 25, 2023, an administratively approved contract for building services in the amount of $37,900 with The Code Group, Inc. dba “VCA Code” (VCA) was fully executed by the City.

On November 7, 2023, City Council approved agreements with 27 firms to provide on-call Community Development Consultant and Additional Services intended to support Community Development and other City departments with staff augmentation services, priority projects, long-range planning projects, and technical review. VCA was one of the firms selected and the compensation increased annually not-to-exceed $150,000. The following services have been approved:
•Amendment No. 1 for on-call services extended and the maximum compensation amount for of the contract increased to $150,000 annually. The contract with VCA helped offset staff shortages in the Building and Planning Divisions. The Community Development Department (Department) has used the following services since the contract was executed: Building Inspection Services, Building Official Services, Senior Permit Technician Services, and Planning Manager Services. Currently, the contract services are for interim Director of Community Development since the recent retirement of the department’s director.
•On June 4, 2024, City Council approved Amendment No. 2 increasing the maximum compensation amount of the contract to $375,000 through October 25, 2024.

•On June 18, 2024, City Council approved Amendment No. 3 to add City Hall design services which included a project budget of $170,000 to the total contract compensation.

The City sent a letter Request for Proposals for plan check services for The Walk (“Project”) to seven (7) on-call firms: 4Leaf, Inc., CSG Consultants, Inc., RKA Consulting Group, Scott Fazekas & Associates, Inc., Transtech, TRB and Associates, Inc., and The Code Group, Inc. dba “VCA Code”. The plan check services are required for Project compliance of local ordinance, state and federal laws that apply to Building and Safety. Proposals were received from all seven firms. City staff reviewed the proposals based on understanding of the project, proposed scope of work, firm and personnel experience and past performance. The proposal submitted by VCA provided extensive experience assisting cities in achieving code compliance for similar large developments. The firm’s experience with International Code Council) (ICC) Norkus, Tompos & Associates, Inc. on their modular construction program along with code experts to achieve the project goals expeditiously will facilitate a quick review turnaround time for the project. VCA’s plan check services are performed by a skilled team that will prioritize the Project to achieve code compliance.

The Project is high priority for the community and requires a high level of service and urgency during the plan review process. There is a need for expedited plan review services for the compliance with the applicable model codes. The building, mechanical, electrical, plumbing, green building, storm water/NPDES, accessibility, grading, drainage and related plans submitted to the City by the developer will be reviewed by the firm. Plans must be checked for compliance with all local ordinances and state and federal laws that relate to Building & Safety, and for compliance with the adopted California Codes.

Fiscal Impact:

Plan check revenue is included in the Fiscal Year (FY) 2024/25 Adopted Budget and costs for the plan check services are directly paid from the fees collected for the project. Design services will be funded by the American Rescue Act Plan Act Fund for safety and security improvements to City Hall. Due to personnel cost savings from vacant Community Development positions, there is also funding for the on-call services available in the current FY 2024/25 Adopted Budget.

SUBJECT: RESOLUTION NO. 24-52 SUPPORTING PROPOSITION 36 Background:

Proposition 36, one of the ten propositions on the November 2024 ballot, aims to create tougher penalties for serial theft and smash-and-grabs, confront the fentanyl crisis in our communities, and incentivize drug and mental health treatment. It is supported by a coalition of Democrats, Independents, Republicans, small businesses, local elected leaders, law enforcement, social justice organizations, and crime victims’ and drug survivor advocates.

Since the passage of Prop 47 ten years ago, California has seen an increase in property crimes and homelessness. Prop 36 attempts to walk back some of these unintentional consequences.

It will allow felony charges for possessing certain drugs and for thefts under $950 with two prior drug or two prior theft convictions, as applications. For defendants who plead guilty to felony drug possession, they can be ordered to undergo a new treatment-focused court process.

Additionally, Prop 36 will ensure that fentanyl is treated similarly to heroin, cocaine, PCP and methamphetamines when offenders possess a firearm. Lastly, Prop 36 will require courts to warn individuals convicted of selling or providing certain drugs that they could be charged with murder if they sell or provide illegal drugs that kill someone, such as fentanyl. Prop 36 will strengthen laws to help reduce crime, and help provide greater safety for our communities.

Therefore, Resolution No. 24-52 has been prepared for City Council consideration to support Proposition 36.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK IN SUPPORT OF PROPOSITION 36, THE HOMELESSNESS, DRUG

ADDICTION, AND THEFT REDUCTION ACT
WHEREAS, while Prop 47 achieved notable success in making California’s criminal justice system more equitable, Prop 47 has also led to unintended consequences over the past decade; and
WHEREAS, Prop 47 has contributed to increases in repeat and often organized retail theft, the shuttering of local businesses, and difficulty convincing people to seek drug and mental health treatment; and
WHEREAS, these unintended consequences can only be corrected by the voters at the ballot box with modest amendments to Prop 47; and WHEREAS, Prop 36, the Homelessness, Drug Addiction, and Theft Reduction Act is a bi-partisan measure that provides common sense, targeted reforms to Prop 47 that, with the recently adopted legislative Retail Theft Package, provide more tools to increase safety in our communities; and
WHEREAS, spikes in retail theft, violent smash-and-grab robberies, fentanyl deaths and illicit drug use, as well as strained social services, are creating challenges beyond the capacity of local governments; and
WHEREAS, cities are partnering with the state to advance solutions that help reduce crime and provide more support to residents struggling with substance abuse, while avoiding a return to the days of mass incarceration; and WHEREAS, Prop 36, the Homelessness, Drug Addiction, and Theft Reduction Act will define fentanyl as a hard drug, hold individuals convicted of trafficking fentanyl accountable, and grant judges greater discretion in sentencing drug traffickers; and WHEREAS, Breaking the cycle of repeat offenders means addressing the many root causes of retail theft; and
WHEREAS, Prop 36, the Homelessness, Drug Addiction, and Theft Reduction Act allows critical behavioral health services, drug treatment, and job training within our justice system for people who are homeless and suffering from mental illness or struggling with substance abuse; and

WHEREAS, it’s time for meaningful and tailored reforms to our justice system to ensure the safety of our communities;
