SUBJECT: PROJECT NO. 7235 – AWARD OF CONTRACTS - INTELLIGENT

TRANSPORTATION SYSTEMS IMPROVEMENT ALONG IMPERIAL

HIGHWAY FROM SAN GABRIEL RIVER TO SHOEMAKER AVENUE -
RESOLUTION NO. 25-06, BUDGET AMENDMENT
Background:

On February 5, 2024 staff issued an invitation for bids for the construction of Project No. 7235 – Intelligent Transportation Systems Improvement along Imperial Highway from San Gabriel River to Shoemaker Avenue. Work at the City Maintenance Yard and Traffic Operations Center (TOC) was added to this project.

The project along Imperial Highway includes traffic signal and ITS improvements, such as installing signal cabinets, service enclosures, conduit, traffic poles and mast arms, luminaires, vehicle and pedestrian signal heads, accessible push buttons, video detection systems, closed circuit television (CCTV) cameras, fiber optic cable, advanced controllers, malfunction monitoring units, and ethernet switches. Work at the City Maintenance Yard involves installing conduit, fiber optic cable, splice vaults, and a fiber distribution unit, and integrating the upgraded controller into the existing Centracs Advanced Traffic Management System (ATMS).

Additionally, Americans with Disabilities Act (ADA) ramps along the corridor are being reconstructed.

At Imperial Highway and Hoxie Avenue, improvements include constructing a 12' right turn bay in the westbound direction, reconstructing the ADA ramp, sidewalk, curb, gutter, catch basin, and asphalt concrete, and installing a new concrete collar to connect the catch basin to the existing pipe. The northwest pedestrian ramp is also being upgraded to ADA standards. Traffic signal modifications include new poles, pull boxes, and conduit, along with signing and striping updates.

SUBJECT: AMENDMENT NO. 7 TO THE AGREEMENT FOR BUS STOP MAINTENANCE

SERVICES
Background:

On March 31, 2008, the City entered into an agreement with Nationwide Environmental Services Inc. (NES), a Division of Joe’s Sweeping Inc. to perform bus stop maintenance services.

NES maintains 192 citywide bus stops and four canopies located at the Metrolink Transportation Center. Locations are categorized based on the amenities at the bus stops and cleaning frequencies range from daily to weekly, depending on high traffic locations and need. Cleaning includes removal of trash and replacement of trash liners, graffiti removal, deodorizing of shelters, and pressure washing of benches and hardscapes.

Several amendments to the agreement have previously been approved to extend the term, adjust compensation, etc. In February 2022, Amendment No. 6 was approved to increase the term to twelve (12) years with one-year automatic renewals effective July 1, 2022, and modify the provision regarding the annual Consumer Price Index (CPI) adjustment to remove the 5% cap.

NES has gone beyond the scope of the contract by maintaining a higher cleaning frequency without additional cost to the City. However, due to growing vandalism, it has become necessary to amend their contract to better address the following issues:

1.Increased Traffic and Public Usage: The City's bus stops have seen a significant rise in foot traffic, resulting in a quicker buildup of litter and requiring more frequent cleaning to maintain cleanliness and functionality.

2.Non-Transit Riders: Bus stops experience high usage by a variety of individuals, including those without stable housing. As a result, these locations require increased

maintenance efforts to ensure they remain clean, safe, and accessible for all members of the public.

3.Improper Trash Disposal: Individuals occasionally use the bus stop receptacles for household trash disposal, which overwhelms the bins' intended capacity.

4.Trash Spillage: In some cases, people digging through the trash spill its contents, leaving the area in disarray and creating additional cleaning needs.

Given these circumstances, City staff requested a quote from NES to help the City address these concerns. NES responded and proposed additional services with an increase in cleaning frequency as described in Exhibit A (attached), to address these growing challenges. The current monthly cost is $19,697. The increase in service frequency would cost an additional $8,300 (42%) per month, for a new monthly expenditure of $27,997 for the remaining five months of FY 2024/25. These services would commence March 1, 2025.

Additionally, NES is requesting to modify Section 2.3, Payment Adjustment, in which they would modify the CPI provision based on the CPI index for February of each year or 4%, whichever is greater. This modification would aid in the management of rising operational costs, including labor, insurance, fuel, and parts, ensuring the long-term sustainability of the contract.

Fiscal Impact:

Funds for increased service in the amount of $41,500 will be requested during the mid-year budget under the Prop C budget.

SUBJECT: ADVISORY BODY APPOINTMENTS
Background:

With the exception of the Planning Commission (which is commensurate with the appointing Councilmember’s term) and five members of the Art in Public Places Commission (which is established in the Norwalk Municipal Code), Advisory Body terms are for two years following a City election. Advisory Body terms are from January 1, of odd years to December 31, of even years.

As of December 31, 2024, all positions have expired. However, the Advisory Body resolution extends the terms for 90-days to allow for meetings to continue until City Council re-appoints or makes new appointments to all the Advisory Bodies. At the end of the 90 days, any positions that have not been filled through re-appointment or new appointment, will become vacant. The required notice has been posted which allows for City Council to make appointments beginning this evening.

There are vacancies on several Advisory Bodies: Art in Public Places (4), Community Promotion (2), Historical Heritage (5), International Friendship Commission (3), Public Safety (1), Social Services (2), and the Youth Commission (all 15). The Youth Commission does not have any members at this time. The age range for the Youth Commission is between 13 to 18 years of age. Each City Councilmember has three appointments.

Two of the vacancies on the Art in Public Places Committee are appointed based on Norwalk Municipal Code §15.44.060, and require consensus of the entire City Council. Any Councilmember may nominate an individual who falls into one of the two categories:

Business/Community College Representative and at-large Community Representative.

SUBJECT: PERSONNEL APPEALS BOARD CERTIFIED LIST
Background:

Norwalk Municipal Code (NMC) §2.24.110 provides that City Council shall establish a list of five people who may serve on a Personnel Appeals Board as needed. A Personnel Appeals Board is convened whenever necessary to hear an appeal pursuant to the grievance procedure established in the NMC. Whenever an appeal is filed, three members from the established list are selected by the Mayor to hear the appeal; the selections are subject to approval by the entire City Council. Each person on the list of potential Personnel Appeals Board members shall be selected based upon their experience in the area of personnel relations. The NMC also provides that each name on the list shall remain certified as a potential Board member until such person resigns or a majority of the City Council determines to remove such name. Periodically, the list is brought before City Council for review and/or if there is a vacancy.

Currently, there are three individuals who comprise the list: Kim Apodaca (Perez), Olga Avina (Rios), and Gloria Rodriguez (Ayala). Councilmembers Ramirez and Valencia have vacancies and staff is recommending that appointments be made in order to have a complete list of five individuals that could be called upon if there was a need to convene a Personnel Appeals Board to hear a matter.
