Aside from providing low hourly rates for their services, AGC also offered one of the lowest retainers for basic legal services in the region. Additionally, said agreement allowed for an automatic rate adjustment annually consistent with the adjustment to the Consumer Price Index (CPI). AGC has requested only one adjustment in their nearly six years of serving as City Attorney which was approved in 2022.
Recently a request was made by AGC to adjust their rates to make the retainer and hourly rates comparable with CPI adjustments allowed and consistent with other rates being charged by other law firms providing city attorney legal services. AGC is requesting the following rate adjustments to the monthly retainer in the amount of $18,750 for the first 75 hours of basic legal services at the rate of $250 per hour and $275 per hour for excess legal services provided each month. Special legal services (real estate, litigation, complex contract matters and labor/personnel matters) would be set at $295.00 for Partn ers, $290 for Senior Associates, $285.00 for Associates. These Retainer and Special Service rates are still substantially below hourly rates charged to the City by outside special counsel and by law firms providing similar services in neighboring cities as outlined in the attached correspondence.
Finally, the Agreement needs to be amended to define the Term of the AGC’s services to be continuous until terminated. This approach is identical to the term provided to the City’s previous law firm and consistent with the approach followed by most cities in the region.
By approving the attached First Amendment, the rates for City Attorney legal services with Alvarez-Glasman & Colvin would be adjusted accordingly effective July 1, 2025. With the
City Council July 15, 2025

exception of the new rates and the new definition of “Term,” all other terms of the original Agreement will remain the same.
Fiscal Impact:
The proposed rate adjustment is expected to result in a marginal increase in annual legal services expenditures. This increase was included within the City Attorney budget allocation for Fiscal Year 2025/26. The actual dollar amount will be determined upon the actual legal services required and requested by the City.

RE: Rate Adjustments for 2025
Dear Mr. Gomez:
As you know, Alvarez-Glasman & Colvin (AGC) has proudly provided City Attorney and related services to the City of Norwalk (City) for over five years. As a team of skilled and talented attorneys, AGC takes great pride in being more than just another City vendor, we become part of the City’s team and partner. AGC looks forward to many more years of quality legal services and continuing our strong relationship with the City.
When AGC was appointed City Attorney, aside from providing low hourly rates for our services, we also committed to maintain our hourly rates without adjustment for the first two years. In 2022, our firm requested and the City approved our only request for a CPI increase which has remained in place for three years. In April of last year, I communicated with Ms. Kabaklian- Slentz the need for an adjustment for fiscal year 2024-25. In order to be sensitive to maintaining the cost of legal services, AGC deferred implementing that rate increase throughout the first half of the fiscal year.
However, careful consideration, it is necessary to make adjustment consistent with CPI calculations and to bring the value of our legal services comparable to those being charged by your previous City Attorney law firm and those rates charged by attorneys serving other neighboring cities. At the time our firm started as City Attorney, we provided Norwalk an hourly rate in 2020 which was below what the City was being charged by the City’s prior firm back in 2015. When examining a rate increase by applying CPI to the rates being charged by your previous City attorney law firm in 2015, the current rate today for general law rates would be set at $258.26 and special advice and litigation rates should be set at $336.35. This is calculated by comparing the hourly rates charged by your prior law firm with a CPI adjustment Attachment No. 1

to current day rates. However, to be mindful of the goal of being sensitive to the cost of legal services, AGC is limiting our rates to $250.00 per hour for general legal services and $295.00 per hour for special services. Law Clerk rates will be set at $150 per hour.
When comparing our firm’s rates to other neighboring cities, school districts and other public agencies of comparable size and scope of legal needs, including rates charged by special counsel, AGC’s rates remain substantially lower than that of other cities. As an example, the City of Cerritos City Attorney fees are as follows:
General legal services $285 for Partners and $260 for Associates Special legal services $325 for Partners and $295 for Associates Litigation and Risk Management $325 for Partners and $295 for Associates
AGC hourly rates will be between $35.00 and $30.00 less per hour for services provided by our firm’s Partners for General and Special legal services.
As another example, the City of El Monte’s law firm has a monthly basic retainer amount of $67,000 per month as compared to AGC’s monthly basic services rate of $18,750 per month for the first 50 hours. Even factoring months when basic service hours exceed 50 hours per month, the City of Norwalk is saving over $500,000 annually in legal costs over a city like El Monte.
One final example of a comparable city is the City of Alhambra. Alhambra paid their law firm the hourly rate, as of March 1, 2024, the following rates:
City Attorney and Assistant $309 per hour
Partners 12 years or less $330 per hour
Partners 13-20 years $353 per hour
Partners 21+ years $380 per hour
Associates’ rates range from $317 to $253 per hour
(The above rates were subject to a CPI adjustment on March 1, 2025)
As can be seen, AGC’s rate have been significantly below market rate and even with our request rate adjustment would still be below those rates paid by other cities for their City Attorney services.
Finally, our last request is the Term of our agreement with the City needs to be renewed. Our request is that the definition of Term be consistent with our retainer agreements for our other public agency clients and consistent with the exact language found in the Amended and Restated Agreement for Legal Services between the City and your previous City Attorney firm.
Accordingly, the definition of TERM would read as follows:
Mr. Jesus Gomez
City of Norwalk
April 21, 2025
Northern California • Napa Valley/Yountville Southern California • City of Industry
TERM. The Term of this Agreement, which commenced on October 16, 2019, shall supersede the Term defined in that Agreement and shall continue until terminated as provided herein.
Over the past years, AGC has provided the City of Norwalk excellent legal services and has saved the City hundreds of thousands of dollars. AGC remains committed to providing the City with the highest quality and innovative legal services. AGC has demonstrated extraordinary results in providing day-to-day guidance and advice and has achieved success in numerous complex matters. On behalf of AGC, we appreciate the continued opportunity in serving the City of Norwalk. We look forward to having the attached First Amendment be considered by the City Council at the earliest possible date.
If you have any questions concerning this request, please feel free to contact me directly.
Very truly yours,

The Appeals Board conducted a public hearing on July 9, 2025 and recommended that City Council move to lien the listed properties, with the exception of those customers that have resolved their accounts by the July 31, 2025 deadline. Daily payments and/or adjustments will continue to be processed through July 31, 2025. If approved by City Council, action will be taken to submit the delinquent charges, including the $25 per account City administrative fee, to the Los Angeles County Tax Collector for placement on the 2025 property tax bill.

SUBJECT: ADVISORY BODY APPOINTMENTS
Background:
With the exception of the Planning Commission (which is commensurate with the appointing Councilmember’s term) and five members of the Art in Public Places Commission (which is established in the Norwalk Municipal Code), Advisory Body terms are for two years following a City election. Advisory Body terms are from January 1, of odd years to December 31, of even years.
There are vacancies on several Advisory Bodies: Art in Public Places (4), Community Promotion (1), Historical Heritage (5), International Friendship Commission (2), Parks & Recreation (1), Public Safety (1), and the Youth Commission (14). The Youth Commission has one member at this time. The age range for the Youth Commission is between 13 to 18 years of age. Each City Councilmember has three appointments.
Two of the vacancies on the Art in Public Places Committee are appointed based on Norwalk Municipal Code §15.44.060, and require consensus of the entire City Council. Any Councilmember may nominate an individual who falls into one of the two categories:

BY: Allan Perdomo, Director of Recreation and Park Services SUBJECT: RESOLUTION NO. 25-30 - SUPPORT OF AN APPLICATION FOR LAND AND
WATER CONSERVATION FUND GRANTS
Background:
Land and Water Conservation Fund (LWCF) grants provide funding for the acquisition or development of land to create new outdoor recreation opportunities for the health and wellness of Californians. Since 1965, over one thousand parks throughout California have been created or improved with LWCF assistance. The LWCF is a current competitive grant program for both local and state agencies under the California Department of Parks and Recreation (DPR).
The LWCF provides funding for acquisition projects or development projects. Examples of acquisitions may include the creation of a new park or the expansion of an existing park. Examples of development may include those for outdoor recreation, and may include, but not be limited to, features such as athletic courts, fields, dog parks, picnic areas, outdoor trails, and aquatic features. The deadline for the application is August 5, 2025. The local agency maximum grant request is $6 million with a match requirement of 50%.
The Recreation and Park Services Department will be applying for the LWCF grant program. The application process requires an approved resolution from the City of Norwalk City Council. If awarded, grant funds will go towards the Norwalk Park expansion project.

City Council Agenda Report
July 15, 2025
TO: Honorable City Council
FROM: Jesus M. Gomez, City Manager
BY: Alex Hamilton, Interim Director of Community Development Nancy Lee, Development Services Manager
SUBJECT: URGENCY ORDINANCE NO. 24-1753U - 10-DAY REPORT ON THE
MORATORIUM TO ESTABLISH, IMPLEMENT, OR OPERATE (TEMPORARILY
OR PERMANENTLY) CONVENIENCE STORES (LIQUOR STORES),
DISCOUNT STORES, PERSONAL USE - LAUNDROMATS,
VEHICLE/AUTOMOBILE - WASHING, PAYDAY LOAN ESTABLISHMENTS,
EMERGENCY SHELTERS, SINGLE-ROOM OCCUPANCY, SUPPORTIVE
HOUSING, AND TRANSITIONAL HOUSING CITYWIDE
Background:
On August 6, 2024, City Council adopted Urgency Ordinance No. 24-1752U, a 45-day moratorium to establish, implement, or operate (temporarily or permanently) convenience stores (liquor stores), discount stores, personal use – laundromat, vehicle/automobile washing, payday loan establishments, emergency shelters, single-room occupancy, supportive housing, and transitional housing city-wide (“Moratorium”). Urgency Ordinance No. 24-1752U included a waiver process for those requesting to establish the listed uses during the Moratorium.
After a 10-day report was received and filed by City Council on September 3, 2024, the Moratorium was extended on September 17, 2024 under Urgency Ordinance No. 24-1753U (see Attachment 1) for an additional 10 months and 15 days and is set to expire on August 5, 2025, unless extended for an additional year by City Council pursuant to Government Code Section 65858(a).
Prior to City Council consideration of the second (and final) extension of the Moratorium, City Council is required to issue a “10-day report”, which describes the measures taken to alleviate the condition in which led to the adoption of Urgency Ordinance No. 24-1753U. Per Government Code Section 65858(d), this action is required before any extension of an urgency ordinance.

Convenience stores (liquor stores), discount stores, personal use – laundromat, vehicle/automobile washing, and payday loan establishments - Prior to the adoption of the Moratorium, the establishment and operation of the aforementioned uses was a concern by virtue of their operational characteristics. Staff has researched to determine if these uses may have detrimental effects (i.e., maintenance, proliferation, security issues, loitering, noise, and economic impacts) on the community. To date, staff has completed the following research:
1. Reviewed City business license records to quantify the number of each type of use operating within the City to determine if there is a saturation of these uses;
2. Initiated studies of land use tables for surrounding cities for the same or similar uses to determine if the uses are permitted by right, not permitted or permitted with a discretionary review (such as a conditional use permit);
3. Studied surrounding cities’ development and operational standards for aforementioned uses; and
4. Researched various sources (i.e., American Planning Association, Urban Land Institute), publications and articles on the aforementioned uses.
Due to the various uses and issues studied, additional time is needed for the next steps, which would be for staff to initiate a zoning code text amendment(s) that will clarify definitions of the aforementioned uses and provide additional regulations which may include (but are not limited to) standards for the following:
1. Discretionary review requirements;
2. Distance requirements (i.e., from other uses, from sensitive uses, etc.);
3. Development standards (i.e., minimum lot size, standards for new developments to minimize the need for these uses (i.e., in-unit laundry hookups for new residential units)); and
4. Operational standards (i.e., property maintenance and security).
Emergency shelters, single-room occupancy, supportive housing, and transitional housing (“housing uses”) – During the COVID-19 pandemic, the County of Los Angeles (“County”) operated Project RoomKey at 12500 Firestone Boulevard without input from the community.
Upon closure of Project RoomKey in 2021, individuals who were housed were not provided with an exit plan.
Following the closure of Project RoomKey, the County received a $52 million encampment resolution grant, which included Norwalk. Due to the experience of the Project RoomKey in the City, Norwalk officials requested that Persons Experiencing Homelessness (“PEH”) not be located at 12500 Firestone Boulevard and alternative sites were provided.
Despite the request, the County selected 12500 Firestone Boulevard for a two-year transitional housing program without consideration of City and community interests and an exit plan at the conclusion of the housing program. Given the poor performance of Project RoomKey, City Council directed staff to draft an Urgency Ordinance pursuant to Government Code Section 65858. Since the adoption of the Moratorium, the City and the County have had productive City Council

discussions about utilizing the former Metro State Hospital located at 11401 Bloomfield Avenue for PEH instead of 12500 Firestone Boulevard.
As a result of the Moratorium on the housing uses, the California Department of Housing and Community Development (“HCD”) issued a Notice of Violation and Corrective Action Letter on September 16, 2024, and after discussions with City staff and HCD, HCD subsequently revoked the City’s 2021-2029 Housing Element Certification.
Following this action, the State of California filed a lawsuit against the City on the grounds of violation of state housing laws. While there has been discussion recently between HCD and City staff on next steps to obtain Housing Element recertification, the possibility of extending the Moratorium for an additional year without the housing uses may be considered by City Council.
A trial date for the pending litigation is scheduled for August 19, 2025. The City Attorney’s Office and the attorney from the California Attorney General’s Office have been engaged in discussions which may bring resolution to the litigation and may include the City taking steps to not extend the Moratorium as it relates to the emergency shelters, single-room occupancy, supportive housing, and transitional housing uses.
On August 5, 2025, staff will present at a noticed public hearing for City Council’s consideration of an additional year extension of the Moratorium.

SUBJECT: RESOLUTION NO. 25-31 APPROVING AN AGREEMENT FOR THE ELDERLY NUTRITION PROGRAM FOR FISCAL YEAR 2025/26
Background:
The Los Angeles County Aging and Disabilities Department (ADD) runs the Elderly Nutrition Program (ENP), which provides funding through grants and subawards for the congregate and home delivered meal program, also known as the Senior Nutrition Program, for the senior citizen population of the City. In Fiscal Year 2019/20 the City and ADD mutually agreed to collaborate though a direct agreement to achieve the City’s objective of effectively serving the senior community. This agreement allows the City to provide meals to both our congregate meal sites and to our 225 participants of home delivered meal program daily, Monday through Friday.
Totaling over 121,000 meals for the fiscal year.
In 2023, the City partnered with Trio Community Meals, LLC (TCM), for catering services. They are one of the several caterers the LA County permits the City to use. The cost for each individual meal is competitive with most LA County approved caterers. TCM are quick to respond to any questions or adjustments requested by staff. The quality of the meals has dramatically increased attendance for congregate meals and is regularly acknowledged by the patrons. It is in the best interest of the Senior Nutrition Program to renew TCM’s services for Fiscal Year 2025/26.
Fiscal Impact:
Operating funds for the Senior Nutrition Program are provided by the Los Angeles County Aging and Disabilities Department Grant, Elderly Nutrition Program 252606, and are included in the Fiscal Year 2025/26 budget.
