City Council Agenda Report
September 2, 2025
TO: Honorable City Council
FROM: Jesus M. Gomez, City Manager
BY: Glen W.C. Kau, P.E., Director of Public Services/City Engineer Jacqueline Koontz, P.E. Senior Civil Engineer
SUBJECT: RESOLUTION NO. 25-41 BUDGET AMENDMENT AND APPROVAL FOR

PUBLIC SERVICES UTILITIES DIVISION PROFESSIONAL ENGINEERING

STAFF AUGMENTATION SERVICES
Background:

The Public Services Department (Public Services) is responsible for the management, operations and maintenance (O&M) of the City’s water, sewer, and storm drain systems; street lights, traffic signals traffic signage and pavement striping/markings. In addition, Public Services also implements the City’s capital improvement program (CIP), which includes: roadways, traffic signals, underground utilities (water, sewer and storm drains), facilities (city and park) and associated projects. Included with the capital program are the necessary system master plans (water, sewer, storm drain); pavement management plan, facilities and other essential studies. These studies help staff evaluate needs and prioritize improvement projects.

Public Services is currently engaged with water main replacement projects, well rehabilitation projects, water treatment implementation projects, Supervisory Data and Acquisition (SCADA) system implementation, smart water meter projects, storm drain planning and catch basin modifications projects, sewer and manhole repair and replacement projects, and grant management.

Recently, Public Services has been experiencing increased demand for development activity reviews. Input from Public Services helps ensure proposed developments and their recommended improvements are compliant with applicable codes and compatible with current/future service delivery. This increased demand is in addition to the O&M and CIP workload from both current and planned future projects. At the current staffing levels, the quantity and quality of work is not sustainable. Additional contract services and resources are required to supplement project management, design, construction support, and O&M. Contract

services will provide the necessary expertise and knowledge to offer a wide variety of services to help meet the needs of our community.

In October 2022, staff solicited for on-call services from consulting firms and recommended a “qualified” list to City Council in February 2023 and May 2023. This established a “consultant pool” of qualified consultants based on their proposals for their areas of expertise, previous experience, resource availability, project work type; services offered and staff augmentation availability.

In mid July 2023, staff solicited the consultant pool with a request for proposals (RFP) for staff augmentation services. W. G. Zimmerman Engineering, Inc. (WGZE) was awarded a contract in September of 2023 for an initial contract term of three years with the option to extend for two one-year extensions. WGZE continues to be available to support the department’s needs.

Fiscal Impact:

The cost for staff augmentation services is estimated to be $80,000. Funding for these services was not included in the budget for fiscal year 2025/26.

SUBJECT: APPROVE PURCHASE OF HANDHELD RADIOS
Background:

As part of the Fiscal Year 2025/26 budget process, the Public Services Department budgeted for the purchase of handheld radios for the department. Effective communication is critical to daily operations, special events, and emergency response. Handheld radios provide staff with a reliable and immediate means of communication that is not dependent on cell phone networks, which may become overloaded or unavailable during high-demand situations. B&W Communications Inc. has successfully provided radios for other City departments under a cooperative purchasing agreement, ensuring compatibility and streamlined support across all divisions. Procuring these radios from the same vendor promotes consistency, reliability, and interoperability among departments, which is especially important during Citywide events and emergencies.

Fiscal Impact:

Funds for the purchase of handheld radios are included in the approved Fiscal Year 2025/26 budget.

SUBJECT: APPROVE PURCHASE OF BACKHOE LOADER
Background:

As part of the Fiscal Year 2025/26 budget process, the Public Services Department allocated funds to replace the backhoe loader for the Street Maintenance Division. The current unit was placed into service in 2013 and has reached the end of its service life. Furthermore, the unit experiences frequent breakdowns and part replacements are difficult to find.

The backhoe serves as critical infrastructure support equipment for Public Services, as it is utilized for carrying / transporting materials, street right-of-way clean-ups (i.e. emergency services to pick up streetlight knockdowns, remove fallen trees, clearing of debris.), road repairs, and various other departmental and interdepartmental projects (i.e. moving concrete picnic tables within City parks). Public Services staff in all sections are cross-trained to utilize the backhoe loader for these multiple purposes.

Staff have become aware of a cooperative purchasing agreement for construction equipment with Case Construction allowing the City to purchase the unit locally through Sonsray Machinery of Santa Fe Springs, California for a significant cost savings.

Fiscal Impact:

Funds for the purchase of a backhoe loader are included in the approved Fiscal Year 2025/26 budget.

SUBJECT: ORDINANCE OF THE CITY OF NORWALK AMENDING NORWALK MUNICIPAL CODE CHAPTERS 8.48 AND 8.5 RELATING TO SOLID WASTE

HANDLING AND RECYCLING AND ORGANIC WASTE DISPOSAL

REDUCTION
Background:

The City of Norwalk currently relies on a two-stream waste collection system in which businesses separate organics into one bin while placing all other materials, trash and recyclables, into a single mixed-waste bin. This mixed waste is transported to Material Recovery Facilities (MRFs), where recyclables are extracted from the trash stream through a combination of mechanical sorting equipment and manual labor. The remaining non-recyclable material is then disposed of in a landfill.

In the past, this process helped the City meet the State’s ‘high diversion’ requirements, but as of January 1, 2025, CalRecycle has raised the minimum recovery rate for High Diversion Organic Waste Processing Facilities from 50% to 75%. Meeting this higher threshold would require significant capital investments and lead to material increased rates for commercial customers.

As an alternative option used in a number of jurisdictions in California, Athens Services recommends transitioning to a three-container collection system, which offers a more cost- effective and sustainable path to compliance. The facilities used by Athens Services do not qualify under the new standards, and as a result, the City may be considered out of compliance with State mandates if they do not move into a three-stream collection system.

To address this regulatory shift, staff recommends updating Chapter 8.5 of the Norwalk Municipal Code (NMC) to transition commercial accounts to a three-stream collection system.

While organics are already collected separately, this update will also require recyclables to be separated at the source, alongside solid waste. This approach reduces reliance on MRF

performance by ensuring that cleaner, less contaminated materials enter recycling and composting facilities directly. In addition to ensuring regulatory compliance, source separation improves the quality and marketability of recovered materials, reduces contamination fees, and can lower long-term disposal costs. Amending the NMC now allows the City to establish the necessary framework, ensuring a smooth and enforceable transition before State deadlines take effect.

Cost to Businesses
Businesses may experience adjustments in service costs over the next few years as the new three-stream collection system is implemented. City staff, in coordination with the City’s franchise waste hauler, Athens Services, will work proactively to support businesses in meeting the new requirements. The focus will be on providing education, outreach, and technical assistance to achieve compliance well before the State mandates stricter enforcement measures, including the potential assessment of monetary penalties for non-compliance.

WHEREAS, the City of Norwalk’s commercial waste accounts currently utilize a mixed waste collection system, with materials processed at Material Recovery Facilities (MRFs) to extract recyclables; and
WHEREAS, the City currently meets CalRecycle’s high diversion facility standards; and
WHEREAS, CalRecycle’s diversion requirements are becoming increasingly stringent, resulting in most facilities in California no longer qualifying as high diversion facilities; and
WHEREAS, transitioning from mixed waste collection to source-separated collection is necessary to maintain compliance with State mandates, reduce reliance on MRF processing, and ensure the City’s waste management practices remain sustainable; and
WHEREAS, implementing source-separated collection supports more environmentally conscious waste management practices by improving the quality of recovered recyclables, reducing landfill disposal, and minimizing greenhouse gas emissions.

CHAPTER 8.48

SOLID WASTE HANDLING AND RECYCLING SERVICES
AND
CHAPTER 8.50

ORGANIC WASTE DISPOSAL REDUCTION
“Section 8.48.030 – Definitions.

Self-hauler" means a person, single family resident, or company who hauls their own organics, recyclables and waste to a facility operation, activity, or property that processes or recovers the waste, rather than using a collection service provided by another hauler. Self-hauler also includes a person who back-hauls waste, or as otherwise defined in 14 CCR Section 18982(a)(66). Back-haul means generating and transporting organic waste to a destination owned and operated by the generator using the generator's own employees and equipment, or as otherwise defined in 14 CCR Section 18982(a)(66)(A).

To qualify, the person, single family resident or company must haul only waste they generated themselves. They must also separate generated organic waste from non-organic waste on site and haul the organic waste to a solid waste facility operation, activity, or property that processes or recovers the waste. Businesses that self-haul their organic waste must keep a record of the amount of organic waste delivered to each solid waste facility or activity that recovers it.

Section 8.48.260 – Self-haul exclusion.

Self-haul/back-haul exclusions. In addition to the authority granted by Section 8.48.210, nothing in this chapter shall prevent a commercial/industrial business owner or residential householder from, on a regular basis, collecting and disposing of solid waste generated in or on their premises, in lieu of availing themselves of the services of the authorized collector. No residential householder or commercial/industrial business owner shall employ or engage any solid waste enterprise, other than the collector, to haul or transport such materials to a transfer station, material recovery facility, landfill, or other waste processing or disposal facility. Any residential householder or commercial/industrial business owner who pursuant to this section seeks to on a regular basis collect and dispose of solid waste generated in or on their premises, must first obtain a self-haul/back-haul permit from the City, and must comply with procedures for self-hauling/back-hauling established by the City.

Section 8.48.270 – General Requirement.

In all cases where the right to an exclusion pursuant to this chapter is exercised, disposal shall be made at a transfer station, material recovery facility, landfill, or other waste processing or disposal facility which meets all applicable regulatory requirements. Any such disposal by a person exempted under this chapter shall not relieve such person from any obligation or liability imposed by this chapter or any other City ordinance, resolution, rule or regulation for the payment of the solid waste and recyclables collection fees charged by the collector, or of payment of any other applicable rates or fees.

Notwithstanding the foregoing, the following shall be exempt from the payment of the solid waste collection rates imposed for use of the services provided by a collector: (A) any person with a valid self-haul/back-haul permit obtained pursuant to Section 8.48.260 who does not use the solid waste or recyclables collection services offered by a collector; and (B) any owner of vacant property who does not use the solid waste or recyclables collection services offered by a collector, for the period of time the property is vacant. For purposes of this Section 8.48.270, vacant property means any real property in the City which, for a period of 30 days or longer, shows no activity on the water meter.

Notwithstanding the foregoing, any person with a valid self-haul/back-haul permit who does not use the solid waste collection services offered by a collector, but who does use the recyclables collection services offered by a collector, must pay the applicable rates and charges for such recyclables collection services.

SUBJECT: HERMOSILLO PARK REHABILITATION, STORMWATER CAPTURE AND

INFILTRATION PROJECT UPDATE

Background:

The Hermosillo Park Master Plan project began with a vision to revitalize the park, making it serve as a community hub for the southeast portion of the city. The top priorities for a redesigned Hermosillo Park were to c onstruct a new state- of-the-art community center with a banquet hall capacity of 200 people . The community center will also serve as the center piece of an overall Hermosillo Park revitalization project that replaces and upgrade park amenities. In response to community input, two new soccer fields with a lighting system will be installed to provide recreation opportunities currently not available at other Norwalk parks.

Along with the City’s goals to provide active living opportunities, the City is also promoting sustainable environmental practices such as choosing green infrastructure and environmentally sensitive building methods. The Hermosillo Park Rehabilitation demonstrates this commitment to the environment with the building of the Stormwater Capture and Infiltration Project under the proposed soccer fields. This system diverts and captures storm water to infiltrate into the ground water to replenish the area’s vita l ground water resources rather than flowing out to the Pacific Ocean.

The Hermosillo Park Rehabilitation, Stormwater Capture and Infiltration Project will construct

11.8-acre-foot capacity sub -surface infiltration gallery with water reclaim abilities. Upon completion, the project will provide numerous community benefits and will serve to improve water quality in Coyote Creek and the San Gabriel River. Following concerted efforts by City leaders and City staff, the City applied and received approval for $20.1 million of Measure W funding for the Stormwater Capture and Infiltration Project in 2019.

The project encountered several technical and regulatory challenges during the design phase, and the completion of the design was delayed primarily due to the higher project cost compared to the original 2019 cost estimate. As part of the ongoing park project, staff carefully reviewed the scope of recreational amenities in comparison to the available budget. During this process, unforeseen expenses associated with site preparation, infrastructure requirements, and increased construction material costs arose, resulting in a substantial increase of $ 20 million in the overall project cost.

The City received an additional $9,900,000 from Measure W funds from the Watershed Area Steering Committee (WASC), which includes funding for the soccer fields, as Measure W allows for recreational amenities to be charged to the grant if they are incorpora ted into any water infiltration projects. The funding is now being brought for routine approval at the Los Angeles County Board of Supervisors meeting scheduled for November 2025. Including the additional Measure W funding, the project budget is still deficit of approximately $10 million.

Due to economic forces outside the control of the City , the project’s budget is not sufficient to include all the initially proposed recreational amenities. After evaluating options, staff prioritized essential safety and infrastructure elements to ensure the park remains functional, accessible, and welcoming to the community. As a result, certain recreational features such as the Splash Pad, Basketball Court, and Handball Courts are deferred to future park upgrade projects.

While these adjustments were necessary to keep the project within the approved budget, staff remain committed to identifying potential grant funding, sponsorship opportunities, or future budget allocations that may allow for the phased addition of these amenities at a later time. We recognize the importance of these recreational features to our community and will continue to explore opportunities to enhance the park as funding resources become available.

Stormwater Capture Infiltration System

Pursuant to the Transfer Agreement between the City and the Los Angeles Region Safe Clean Water Program, the scope of work for the Hermosillo Stormwater Capture and Infiltration project includes educational elements to educate the public on the local water supply and demand. The Hermosillo Park Project consists of a perimeter concrete pathway with signage and narratives to highlight the stages of the water cycle and how the park’s subsurface basins fit into the cycle. The educational signs will be placed adjacent to the peri meter pathway at appropriate locations and, where possible, call out project elements (e.g., storm drain diversion pipes, subsurface basin inlets, hydrodynamic separators, equalization pipes, overflows, and discharge pipes) in the vicinity of the signs. At the end of the pathway, educational signs will highlight the capture, treatment, and reuse of a portion of the captured stormwater for on-site landscape irrigation at the park.
