RESOLUTION NO. 26-37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK AUTHORIZING AN AMENDMENT TO THE FISCAL YEAR 2025/26
ADOPTED BUDGET TO TRANSFER FUNDS FOR AMERICAN RESCUE
PLAN ACT FUNDED PROJECTS
WHEREAS, the City Council previously appropriated and obligated American Rescue Plan Act (“ARPA”) funding towards Project Number 1.7C2219 Security Technology Upgrade with ConvergeOne Inc (“Original Contractor”); and WHEREAS, the Original Contractor has defaulted under the agreement and the City intends to terminate said agreement in accordance with applicable contract requirements; and
WHEREAS, as a result of the contractor default, a portion of the ARPA funds originally allocated to Project No. 1.7C2219 remain unexpended and available for reassignment or completion of eligible ARPA activities; WHEREAS, the U.S. Department of the Treasury permits replacement contracts and continued obligation of ARPA/SLFRF funds in cases involving contractor default, provided the project remains within the original eligible scope and applicable federal requirements are met; and
WHEREAS, the City Council desires to ensure full utilization of its ARPA allocation prior to federal expenditure deadlines and maintain compliance with all applicable requirements; and
WHEREAS, the City Council desires to transfer $300,000 of unspent funds from ARPA Project No. 1.7C2219 Security Technology Upgrade to ARPA Project No.
1.7C8219 to ensure expenditures by regulatory deadline.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NORWALK HEREBY DETERMINES, FINDS, AND RESOLVES AS FOLLOWS:
Section 1.The City Manager is authorized to make the following transfer and prepare the necessary budget amendment for the following account:

Section 2.The Mayor, or presiding officer, is hereby authorized to affix her signature to this Resolution signifying its adoption by the City Council of the City of Norwalk and the City Clerk, or her duly appointed assistant, is directed to attest thereto.
