The City Council closed session began at 4 p.m.
COUNCIL PRESENT: Mayor Susan Wernick, Mayor Pro Tem Mark Milberg, Councilmember Pat Eklund, Councilmember Rachel Farac and Councilmember Tim O’Connor.

C. CLOSED SESSION ITEM
C1. CONFERENCE WITH LEGAL COUNSEL — INITIATION OF LITIGATION (California Government Code Section 54956.9, subdivision (d)(4).) One potential case.
The City Council voted 4-1, with Councilmember Farac voting no, to provide direction to initiate litigation. The litigation, the defendants, and the other particulars shall, once formally commenced, be disclosed to any person upon inquiry, unless to do so would jeopardize the City’s ability to effectuate service of process on one or more unserved parties, or to do so would jeopardize the City’s ability to conclude existing settlement negotiations to its advantage C.2. PUBLIC EMPLOYEE ANNUAL PERFORMANCE EVALUATION
(California Government Code Section 54957.)
