IN THE CITY COUNCIL

OF THE CITY OF OAKDALE

STATE OF CALIFORNIA
Meeting Date: August 15, 2022
To: Mayor Bairos and Members of the Oakdale City Council From: Michael Renfrow, Senior Engineering Technician
Reviewed by: Jeff Gravel, Public Services Director
Subject: First Reading of the Ordinance of the Oakdale City Code, Amending Chapter 18, Section 18-11, Speed Limits Set by State Law
I. BACKGROUND
To establish intermediate speed limits and for the Oakdale Police Department to enforce those limits using radar, the California Vehicle Code (CVC) Section 22357 requires posted speed limits along collector and arterial roadways to be established and justified by formal Engineering and Traffic Surveys (speed surveys). Furthermore, per CVC Section 40802, in order for posted speed limits to be enforceable, each road segments speed survey needs to be updated every seven (7) years and can be extended to ten (10) years when a registered engineer determines that no significant changes in roadway or traffic conditions have occurred.

II. DISCUSSION
Selecting the Roadways:

The 2022 Engineering and Traffic Survey Roadways were selected by the City’s Traffic Issue Committee which is comprised of the City Manager, Chief of Police, Police Lieutenant, City Engineer, Public Services Director and Public Works Superintendent. The Committee considered comments from the public based upon information obtained from the City’s Traffic Issue Submittal Form and the Oakdale Police Department and their observations of traffic behavior and enforcement priority.

The Committee selected 24 priority locations within the Oakdale City Limits.

These locations are shown in Attachment A.

Assigning Speed Limits:

The Traffic Issue Committee reviewed the survey data along with potential visibility restrictions, and proximity to schools and parks to recommend adopting specific speed limits on the selected streets within the community. The Engineering and Traffic Survey was conducted in accordance with applicable provisions of the California Vehicle Code, following procedures outlined in the California Manual of the Uniform Traffic Control Devices (MUTCD).

AGENDA ITEM 10.1

CITY OF OAKDALE
City Council Ordinance (Continued)
SUBJECT: First Reading of the Ordinance Speed Limits Set by State Law (Oakdale City Code Chapter 18, Section 18-11)
MEETING DATE: August 15, 2022
Results of the Survey:

According to the California MUTCD, the posted speed limit must be set at the nearest 5 mph increment of the 85th percentile speed that was surveyed, with the City Engineer having the option of lowering it by an additional 5 mph to address traffic safety needs of the community.

For example, if the 85th percentile speed surveyed for a roadway is 37 mph, the posted speed limit will be set at 35 mph (the nearest 5 mph increment), with the City Engineer having the option of lowering it down to 30 mph. If the 85th percentile speed surveyed is 38 mph, the posted speed limit will be set at 40 mph (the nearest 5 mph increment), with the City Engineer having the option of lowering it down to 35 mph.

Staffs Recommended Speed Limits include 18 reductions of the 85th percentile for reasons supported by California Vehicle Code, such as, school zones, near playgrounds/parks, contiguous property dwelling houses, pedestrian and bicycle safety or physical conditions. Attachment A-2022 Engineering and Traffic Survey Executive Summary provides the detailed breakdown.

This allowable reduction of the 85th percentile resulted in just four increases to speed limits among the 24 surveyed roadways. Of the four increases, one was newly developed section of East D Street adjacent to the Rodeo Grounds and were speeds not established by a survey. Two more were the industrial area, HiTech Parkway and Armstrong way, which were also speeds not established by a survey. South Yosemite Avenue, between Greger Street/Wakefield Drive and Warnerville Road, is the only increase among the 24 surveyed roadways that were initially established by a formal Engineering and Traffic Survey.

Additional Traffic Safety Enhancements:

During the Engineering and Traffic Survey, the City received Traffic Issue Submittals by the public regarding issues between vehicle and pedestrian and their safety at certain intersections. The Traffic Issue Committee recommended new stop signs at these locations to mitigate the potential hazard. There were three locations in the community that could benefit from new stop sign installations.

CITY OF OAKDALE
City Council Ordinance (Continued)
SUBJECT: First Reading of the Ordinance Speed Limits Set by State Law (Oakdale City Code Chapter 18, Section 18-11)
MEETING DATE: August 15, 2022
Those locations are: East “E” Street/North 6th Avenue, East “A” Street/Melva Avenue, and East “C” Street/North 8th Avenue. City of Oakdale Municipal Code allows the Public Services Director to erect stop signs. It reads:
18-85.10, Stop signs. [Ord. No. 1193.] The director is authorized to erect and maintain stop signs at those locations where he or she deems such controls to be necessary in order to protect the public safety. When signs are erected giving notice thereof, drivers of vehicles shall stop at the entrance or entrances to such intersections.

Adoption of the Engineering and Traffic Survey:

Staff has initiated an ordinance amending Article I of Chapter 18, Motor Vehicles and Traffic, Section 18-11, Speed Limits Set by State Law, of the City of Oakdale Municipal Code (Attachment B) adopting speed limits on certain streets in the City. A Notice of Public Hearing of the proposed ordinance amendment was published in the Oakdale Leader on August 3, 2022.

If City ordinance is amended to adopt recommended speed limits, new speed limit signage will be placed at the subject locations.

III. FISCAL IMPACT
There will be a minimal cost in the posting of signs and will be paid from Fund 110-4140-427006 General Supplies.

IV. RECOMMENDATION
That the City Council introduce an Ordinance amending Chapter 18, Section 18- 11 and Repealing Section 18-11.1 of the Oakdale City Code. If introduced, a second reading would be held on September 6, 2022, and the ordinance would become effective on October 6, 2022.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OAKDALE, AMENDING THE OAKDALE MUNICIPAL CODE, CHAPTER 18, SECTION 18- 11, SPEED LIMITS SET BY STATE LAW
WHEREAS, to establish prima facie speed limits in the City of Oakdale, the California Vehicle Code (CVC) Section 22357 requires posted speed limits along collector and arterial roadways to be established and justified by formal Engineering and Traffic Surveys (speed surveys); and
WHEREAS, per CVC Section 40802, in order for posted speed limits to be enforceable by the Oakdale Police Department using radar, each road segments speed survey needs to be updated every seven (7) years and can be extended to ten (10) years when a registered engineer determines that no significant changes in roadway or traffic conditions have occurred; and
WHEREAS, the most recent City Council action on an Engineering and Traffic Survey took place in August, 2012, meaning that previously surveyed roadways in the City of Oakdale are set to expire and are not enforceable by radar except for individual radar surveys performed by the Oakdale Police Department.

This practice is not generally expedient as it would be required each and every time an officer enforces speed limit on a roadway; and
WHEREAS, the 2022 Engineering and Traffic Surve Roadways were selected by the City’s Traffic Issue Committee which is comprised of the City Manager, Chief of Police, Police Lieutenant, City Engineer, Public Services Director and Public Works Superintendent. The Committee considered comments from the public based upon information obtained from the City’s Traffic Issue Submittal Form and the Oakdale Police Department and their observations of traffic behavior and enforcement priority; and
WHEREAS, the Traffic Issue Committee reviewed the survey data along with potential visibility restrictions, and proximity to schools and parks to recommend adopting specific speed limits on the selected streets within the community. The Engineering and Traffic Survey was conducted in accordance with applicable provisions of the California Vehicle Code, following procedures outlined in the California Manual of the Uniform Traffic Control Devices (MUTCD); and

It is hereby declared that the prima facie speed limits hereinafter set forth are established according to law.
