Subject: Authorize by Minute Order Cancellation of the Regular City Council Meeting scheduled for Tuesday, January 3, 2023.

I. BACKGROUND

II. FISCAL IMPACTS
There is no fiscal impact associated with the cancellation of the January 3, 2023 City Council meeting.

Subject: Consideration of Tree Removal Request: 150 South Wood Avenue November 21, 2022
As noted above, the Subject Tree is located at 150 South Wood Avenue in the interior of the property, near the parking. The canopies extend over the adjacent apartment buildings and are about the 50 feet tall. See Attachment A – Tree Photographs.

II.DISCUSSION
Per the Tree Preservation Ordinance, significant trees (any tree with a diameter of 24 inches or greater at a height of 3 feet) must receive City Council approval in order to be removed.

Section 36-28(4)(D) of the City’s Tree Ordinance provides the criteria used the evaluate requests for tree removal. The removal of Significant Trees requires City Council approval prior to being removed.

The criteria in the Ordinance applicable to this request include:
(1) “The condition of the oak or significant tree with respect to its general health, status as a public nuisance, danger of falling, proximity to existing or proposed structures, interference with utility services, and its status as host for a plant, pest or disease endangering other species of trees or plants with infection or infestation.” The Subject Trees have root growth that are interfering with and damaging PG&E equipment. (2) “The number, species, size and location of existing trees in the area and the effect of the requested action on shade areas, air pollution, historic values, scenic beauty and the general welfare of the City as a whole.”
The Subject Trees do provide shade, but does not significantly affect the City’s historical values, scenic beauty, or general welfare due to its location. The Applicant has elected to replace the trees with two (2) twenty-two (22) foot tall Crepe Myrtle Trees.

III.RECOMMENDATION

I. BACKGROUND
On February 28, 2022, the City of Oakdale Administrative Hearing Officer approved Tentative Parcel Map No. 2022-07 located on existing lot of record (APN 064-044-035), property located at 811 Wakefield Drive. The Subject Parcel is currently 4.51 acres in size and is located within the southern portion of the City of Oakdale, its industrial district. Specifically, the Subject Parcel is located at the intersection Wakefield Drive and Delano Drive. The proposed Tentative Parcel Map consists of subdividing the 4.51-acre parcel into three separate parcels:

Parcel “A” 0.88 acres, Parcel “B” 0.88 acres, and Parcel “C” 2.75 acres.

Proposed Parcel “C” is occupied by the company Haeger Inc. and contains an existing building and site improvements. Proposed Parcels “A” and “B” are vacant and undeveloped.

The property is designated as an Industrial (IND) land use under the City’s General Plan and zoned Limited Industrial (L-M).

II. DISCUSSION
The Parcel Map has been prepared for city review and approval. The City of Oakdale Administrative Hearing Officer and City Engineer has examined the map and finds that it substantially conforms to the approved Tentative Parcel Map, the State Subdivision Map Act and the City of Oakdale Subdivision Ordinance and is satisfied it is technically correct.

This action is statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15268(b)(3) Ministerial Projects (approval of final subdivision maps), of Title 14 of the California Code of Regulations (State CEQA Guidelines). TABLE 1

MAXIMUM SPECIAL TAXES

Type of Property Maximum Special Tax
Fiscal Year 2007-08
Single Family Residential $414 per Unit
Multi-Family Residential $276 per Unit

2. Special Tax Increases
In January 2008, and each January thereafter, all figures shown in Table 1 above shall be adjusted by applying the Average Increase, if any, in the Indices. Each annual adjustment of the Maximum Special Tax shall become effective on the subsequent July 1.

SECTION D

METHOD OF LEVY
Each Fiscal Year, the Special Tax shall be levied on all Parcels of Developed Property according to the steps outlined below.

Step 1: Determine the Special Tax Requirement, as defined in Section A above, for the Fiscal Year in which the Special Tax will be collected;
Step 2: Calculate the total Special Tax revenues that could be collected from Developed Property within the CFD based on application of the Maximum Special Tax rates determined pursuant to Section C above;
Step 3: If the amount determined in Step 1 is greater than or equal to the amount calculated in Step 2, levy the Maximum Special Tax on all Parcels of Developed Property in the CFD.

Step 4: If the amount determined in Step 1 is less than the amount calculated in Step 2, levy the Special Tax Proportionately on each Assessor Parcel of Developed Property so the amount of the Special Tax levy equals the Special Tax Requirement for that Fiscal Year.

SECTION E

COLLECTION

A Special Tax shall continue to be levied and collected within the CFD to fund the annual Special Tax Requirement in perpetuity.

SECTION F

EXEMPTIONS
Notwithstanding any other provision of this Rate and Method, no Special Tax shall be levied on Public Property, except as otherwise provided in the Act.

SECTION G

FORMULA FOR THE PREPAYMENT OF THE SPECIAL TAX
The Special Tax may not be prepaid.

SECTION H

INTERPRETATION
The Administrator may interpret this Rate and Method as necessary to clarify any inconsistency, vagueness, or ambiguity.

SECTION I

APPEALS
Appeals of any claim of incorrect computation of Special Tax or application of this Rate and Method may be made by the owner of an Assessor Parcel or such owner’s duly-authorized representative by filing a written notice of appeal with the Administrator not later than on calendar year after having paid the disputed Special Tax. The Administrator shall promptly review the appeal and if necessary, meet with the property owner (or representative), consider written and oral evidence regarding the amount of the Special Tax, and decide the appeal. If the property owner disagrees with the Administrator’s decision, the owner may then file a written appeal with the Council, whose decision shall be final. If the decision of the Administrator or the Council requires the Special Tax to be modified or changed in favor of the property owner, no cash refund shall be made for prior years’ Special Tax levies, but an adjustment shall be made to the next Special Tax levy(ies) as appropriate. This procedure shall be exclusive and its exhaustion by any property owner shall be a condition precedent to filing any legal action by such owner

I. BACKGROUND:

In August 2015, the City established the City of Oakdale Community Facilities District No. 2015-01 (Maintenance Services) (CFD No. 2015-01), for the purpose of establishing a special tax, paid by new residential property owners, to help off-set the additional costs of providing services related to the maintenance of streets, street lights, drainage facilities, the treatment of storm water run-off, and landscaping to new residents.

II. DISCUSSION:

On May 16, 2022 the City Council adopted resolution 2022-044 approving Annexation No. 6 to Community Facilities District 2015-01 (Estates at Tesoro).

4. Operating small trucks and stock trailers used in transporting animals, equipment, and supplies;

5. Examining animals to determine age/sex, behavioral characteristics, and overall condition;

6. Maintaining inventory of food, tools, and other related supplies;

7. Performing other related duties as assigned
On October 03, 2022, the City Council approved a resolution authorizing the City Manager to enter into an Animal Control Services Agreement with the City of Escalon to provide Animal Control Services in the City of Escalon. Part of this agreement includes a costsharing, whereby the City of Riverbank (who we have already been providing animal control services to) and the City of Escalon is now shared amongst three agencies.

As noted in the October 03, 2022 Staff Report, in order to properly serve each of the three communities, staff believes that the staffing levels should be increased to three full-time animal control officers, one full-time animal shelter attendant and one part-time animal shelter attendant.

I. BACKGROUND
The Wastewater Treatment Plant is in need of an additional vehicle in order to perform its regular duties both at the WWTP and in the public. In an effort to improve the WWTP fleet, staff has been looking to purchase a used truck that can supplement the 1998 Chevrolet 3500 that was passed along to the Public Works Department. This vehicle was moved to Public Works due to the fact that the WWTP does not need a heavy-duty vehicle.

II. DISCUSSION
The WWTP staff researched several used vehicles as replacements:

1. 2 Win Auto Sales: 2017 Toyota Tacoma 106,755 Miles $24,772.04

2. Road Motors Imports: 2017 Toyota Tacoma* 85,816 Miles $19,995.00

3. Centennial Toyota: 2016 Toyota Tacoma 76,205 Miles $26,485.00 These prices do not reflect tax or registration. While the cost is less for the Road Motors vehicle, it has a Salvage Title due to being in a previous accident. Even though the vehicle from Centennial Toyota has less mileage, it is located in Las Vegas, NV. WWTP staff test drove and completed a thorough inspection on the vehicle from 2 Win Auto Sales, so staff feels that the best option for purchase is the 2017 Toyota Tacoma from 2 Win Auto Sales in Oakdale.

The City of Oakdale (City) is proposing the Stanislaus River Salmonid Habitat Restoration Project at Stanley Wakefield Wilderness Area (Project) in Stanislaus County, California (Figure 1). Historical land uses in the Stanislaus River watershed have led to major geomorphic alterations to the river, including reduction of channel complexity and isolated floodplains, leading to the loss of important salmonid rearing habitat. Through funding from the California Department of Fish and Wildlife (CDFW) Fisheries Restoration Grant Program (FRGP)(Phase I) and the U.S. Fish and Wildlife Service (USFWS) Central Valley Project Improvement Act (CVPIA)(Phase II), the Project aims to restore and enhance the Stanislaus River off-channel and riparian ecosystem processes critical for juvenile California Central Valley (CCV) steelhead (Oncorhynchus mykiss) populations, with anticipated ancillary benefits to California Central Valley (CV) Chinook salmon (O. tshawytscha) and other native fish, on the lower Stanislaus River.

1.1 Project Location
The Project is located in the Stanley Wakefield Wilderness Area (Wilderness Area), adjacent to Kerr Park, within the City of Oakdale (Figure 2). The Project encompasses an approximately 1,273-meters (m) (4,177-foot [ft]) segment of the Stanislaus River, a tributary to the San Joaquin River, approximately 68 river kilometers (rkm) upstream of the confluence with the San Joaquin River and approximately 24 rkm downstream of Goodwin Dam, between 37°47'24.22"N, 120°49'11.45"W (downstream limit) and 37°47'15.11"N, 120°48'33.39"W (upstream limit).

Elevations in the Project area range from approximately 90 ft to 150 ft NAVD88 and contain a variety of terrestrial and aquatic habitats. The Project area is characterized as having riparian woodland habitat of willows (Salix spp.), cottonwood (Populus spp.), and alders (Alnus spp.) where the Stanislaus River borders the Project area to the north. Valley oak woodland habitat dominates the rest of the Project area with a canopy of oak (Quercus spp.) and cottonwood with an understory of extensive stands of invasive Himalayan blackberry (Rubus armeniacus) and native elderberry (Sambucus spp.). The Stanislaus River flows west along the northern section of the Project area, connected to riparian wetland along the left bank and emergent wetland located in the center of the Project area.

Land use in the approximately 70-acre Project area is largely park and open space. Surrounding land uses include a mix of single-family residential development and agricultural lands in the unincorporated community of East Oakdale to the north. A private golf course borders the Project area to the south.

2.1 Project Background
The Stanislaus River corridor historically supported a diverse, dynamic riparian ecosystem complex of seasonal wetlands, oxbow lakes, extensive forested floodplains, and meandering side channels (Elias 1924). A diversity of microhabitats existed in these shallow-water areas characterized by dense overhanging vegetation, cool water temperatures, large woody debris, low water velocity, and ample prey production. Since at least the mid 1800’s the geomorphology of the Stanislaus River has been impacted from agriculture, gold and gravel mining, and flow and sediment regulation. Agricultural development in the corridor lead to alterations to local drainages and overbank habitats. As early as 1858 one of the first irrigation cooperatives on the Stanislaus River was formed by the Tulloch family, who built a diversion dam to supply water to farms in the area around Knight's Ferry. Levee construction in the lower river followed the Flood Control Act of 1944 and construction initiated in 1956 with various modifications made through the mid-1980’s. Gravel, gold, sand and gravel mining occurred in the river from approximately the 1920’s to the late 1960’s and is thought to have extracted a considerable amount of coarse and fine sediment relative to the natural watershed supply (Kondolf et al. 2001; Schneider et al. 2003). Several large dams were constructed in the upper watershed that have altered the flow regime and supply of sediment. While there are multiple dams that regulate the flow of the Stanislaus River, including the reach representing the upstream limit of anadromy, Goodwin Dam (operational since 1913) and New Melones Dam (operational since 1978) have had the largest impact on peak runoff in the river. New Melones Dam releases no more than 8,000 cubic feet per second (cfs), the designated 100-year flow downstream of the dam (FEMA 2008). Pre-dam, the river saw flows of 10,000 cfs occurring at least every 2 years and peak floods that exceeded 60,000 cfs. The U.S. Army Corps of Engineers (USACE) is also required to maintain an 8,000 cfs floodway from Goodwin Dam to the San Joaquin River. Because the reservoir releases much less than 8,000 cfs most of the time, even during flood season, agricultural encroachment into the floodplain has occurred and constrains the USACE from making large releases most of the time. Brown and Bauer (2009) showed that mean annual flow associated with full natural runoff has essentially been halved from 1979 to 2006, and that flows are generally reduced in the winter and spring and increased in the summer compared to pre-dam conditions.

Estimates of sediment supply reduction due to flow regulation are given by Kondolf et al. (2001). For the period from 1949 to 1999 an estimated 6,324,300 cubic yards (yd3) of sand and gravel were extracted from mining pits between Goodwin Dam and Oakdale with 84,700 yd3 of inputs from tributaries below Goodwin Dam (Kondolf et al., 2001). Sediment produced in the watershed above New Melones Dam was estimated to be 949,200 yd3, highlighting the magnitude of sediment extraction. Due to these impacts the number of salmonid spawning riffles, as well as overbank flooding, in the river has decreased over time. In addition to the impacts caused by the lack of spawning substrate supplied to the river, it has been hypothesized that moderate flows have been flushing fine sediments from mining pits that eventually infiltrate spawning riffles, causing further degradation. To offset the reduction to spawning habitat lost, there has been at least 34,000 yd3of gravel augmentation in the Stanislaus River since about 1994, primarily in the Goodwin Canyon reach.

The above alterations have reduced the amount of overbank habitat and degraded the quantity and quality of juvenile salmonid rearing habitat. Levees limit the lateral extent of flood releases from upstream dams, and flow regulation limits the magnitude of flood flows and sediment supply. As a Stanislaus River Salmonid Habitat Restoration Project at Stanley Wakefield Wilderness Area 5 result, the river has incised over time. For example, Kondolf et al. (2001) found incision on the river to be approximately 1.5 feet from 1980 to 1993 at the Highway 120 Bridge. The culmination of historical changes in the river limits overbank habitats needed for salmonids to rear and grow before emigrating to the delta and Pacific Ocean. The lack of suitable rearing habitat and migratory conditions are thought to be significant stressors to juvenile salmonids (Anchor QEA 2019). Other general stressors to salmonids in include temperature, predation, hatchery influences, entrainment in diversions, habitat limitations, and poor water quality.

The U.S. Fish & Wildlife Service (USFWS) and National Marine Fisheries Service (NMFS) have determined that improved Stanislaus River watershed management to restore and protect instream and riparian habitat, including restoring and replenishing spawning gravel, is a high priority (USFWS 2001; NMFS 2014). The CDFW has determined that the stretch of river between Goodwin Dam and the confluence with the San Joaquin River is of considerable importance for maintenance and restoration of Chinook salmon and CV steelhead (CDFG 1990).

2.2 Project Purpose and Objectives
The purpose of this Project is to design, implement, and monitor an off-channel habitat restoration that will improve rearing habitat for listed CCV steelhead, with anticipated ancillary benefits to Chinook salmon and other native fish, on the lower Stanislaus River. The term restoration, an accepted colloquial term, is used hereafter to refer to naturalization, enhancement and rehabilitation of rivers and streams.

Within an approximately 28-acre footprint, this Project will generate a restoration design that will regrade and rehabilitate a perched floodplain and emergent wetland. The Project aims to create a variety of terrestrial and aquatic habitats, including oak grassland, floodplain, and side channels that function under a variety of flow conditions present on the lower Stanislaus River.

The primary objective of the Project is to augment, rehabilitate, and enhance productive Stanislaus River juvenile salmonid rearing habitat by providing juveniles access to the historic floodplain.

Additionally, the Project may:
• Address goals of existing recovery plans and work synergistically with existing restoration efforts on the Stanislaus River, and
• Improve community opportunities to participate in, learn about, and support salmonid habitat restoration and the value of functional riverine ecosystems.

2.3 Project Design
The Project would meet the primary objective by expanding the existing emergent wetland and enhancing the connection to the Stanislaus River, and creating a side channel along both the eastern portion of the Project area and on the riverside terrace (Figure 3). The design will incorporate the use of large wood structures (i.e., trees with root wads) obtained from on-site excavations for floodplain and side channel habitat complexity. Excavation of the floodplain would extend approximately 1,900 linear ft (LF) from the upstream portion of the proposed eastern side channel north towards the enhanced wetland connection within the Project area. Three alcoves would be created to provide high quality rearing habitat for juvenile salmonids. The existing disconnected wetland within the center of the Stanislaus River Salmonid Habitat Restoration Project at Stanley Wakefield Wilderness Area 6 Figure 3. Map of the 100% design features.

Project area would be expanded, enhancing the connection between the wetland and the Stanislaus River for drainage and providing a salmonid rearing habitat complex. Excavation would also occur at the northwest portion of the Project area and extend approximately 505 LF to create a side channel on the riverside terrace (Figure 3). Approximately 54,800 yd3 of material would be excavated from the perched Stanislaus River floodplain and remnant side channels within the Project area. The constructed features will function under a variety of flow conditions present on the lower Stanislaus River and will support a variety of ecological services, including salmonid rearing habitats and improve water quality, including temperature and dissolved oxygen under low flow conditions.

Additional Project design features include the incorporation of large wood structures that would provide habitat complexity within both the wetland and side channels.

2.3.1 Project Construction
The Project will require the operation of construction equipment (e.g., rubber-tired front-end loaders, excavators, articulated haulers, dozers, etc.) within the Project area. Construction equipment shall be clean and use biodegradable, vegetable-based lubricants and hydraulic fluids. To minimize any potential negative effects on salmonids, any in-water work will occur from 15 June to 15 November when flows are typically and comparatively low (approximately 200 cfs or less) and active salmonid spawning is not occurring. However, there is no expectation or need for construction activities to occur within the Stanislaus River either directly or indirectly aside from the upstream and downstream channel connections Off-channel construction may occur throughout the year; mitigation measures to avoid impacts to special status species will be implemented.

2.3.1.1 Access and Staging
Staging areas will be restricted to existing roads and trails within and adjacent to the Project area that would avoid any significant impacts to sensitive natural resources, as required by Best Management Practices (BMPs) (see Section 2.3.2 below). Construction access to the Project area would likely be from the entrance to the Wilderness Area at the intersection of North Kerr Park Drive and North Stearns Road (Figure 2). During construction, the contractor would install signs and limit access to the Wilderness Area for safety purposes.

Implementation of the Project design will require frequent coordination with the City of Oakdale to ensure proper staging of the site as well as daily access due to the proximity to both Kerr Park to the west and the Stanislaus River to the north. Each of these locations experience active public recreation, particularly during the summer months.

Construction activities will be sequenced such that connections between the side channel entrance and exit and the main channel will occur near the end of the earthwork activities to limit water flowing through the site until construction is near completion. Apart from connection of the side channel, there is no expected need for construction activities to occur within the Stanislaus River.

2.3.1.2 Project Implementation Time Frame
Out of channel construction may occur year-round. Construction is anticipated to occur in 2023 and require only one year to complete. Site stabilization would occur immediately once construction activities are complete, and revegetation planting would commence at the beginning of the rainy season, which would presumably begin in late-November and continue through February. Construction activities would take place during normal working hours, 7:00 am to 5:00 pm, Monday through Friday.

2.3.1.3 Revegetation
A preliminary revegetation plan has been developed for areas impacted during excavation and grading to create the new features and fill placement areas. Mitigation tree planting will occur in areas suitable for upland and riparian species in locations outside the grading areas. The native grass seeding areas include hydroseeding using a combination of an erosion control seed mix and a pollinator seed mix as show on the design drawings. Tree species for the upland tree planting and riparian tree planting zones are based on direct replacement of native trees impacted by construction. The Project will undergo a Section 7 consultation with the USFWS to assess impacts to Valley Elderberry Longhorn Beetle (Desmocerus californicus dimorphus). It is anticipated that a Biological Opinion will be issued to address mitigation requirements for transplant and take of elderberry shrubs. A final revegetation plan will be developed after regulatory permitting coordination.

2.3.2 Best Management Practices
Project construction activities are expected to result in potential effects to sensitive natural resources.

The Project would implement appropriate measures to minimize adverse effects (i.e., Best Management Practices). Preliminary BMPs have been included into the 100% Design Plans and final measures will be developed after regulatory permitting coordination. These measures will be incorporated in construction documents prepared for the Proposed Action and will be contractually required of all construction contractors.

2.3.3 Project Operation and Maintenance
Following construction, post-project monitoring activities will take place to ensure the Project was built to design standards and specifications. After construction and revegetation are complete (see Section

2.3.1.3 above), the planted trees will require management during the initial establishment period following planting. There is no municipal water for irrigation at the site; therefore, watering will need to be undertaken using a hands-on methodology. Monthly watering will be required and could be accomplished using a watering truck and hoses, or temporary slow-release water tubes that slowly release water but require refilling every few weeks. The Project team and the City of Oakdale will coordinate to determine the most efficient approach for plant establishment and watering.

2.4 Required Permitting
Permits required for implementation are shown in Table 1. Permitting requirements may affect aspects of the design, especially impacts to trees and the required mitigation.

Table 1. Anticipated permits needed for implementation.

PATROL – ONGOING • On October 1st, officers were dispatched to the 400 block of East A Street for a report of a female who had attempted suicide in the rear parking lot. Upon arrival, officers located a female laying on the ground bleeding from her wrists and neck.

Officers applied tourniquets to her arms while another officer assisted in restraining the female who was being combative and resisting assistance. The female was stabilized and transported via ambulance to a local hospital. • On October 1st, officers conducted a traffic stop on a vehicle for possible DUI and driving without headlights in darkness. The driver was contacted and after further investigation was determined to be driving under the influence of alcohol. The passenger was arrested for public intoxication and resisting arrest. • On October 5th, officers responded to a report of a physical altercation at Ryderz between one female and two male subjects. Upon arrival, officers contacted the two male subjects and identified them as the aggressors through witness statements.

The female subject and victim were gone on arrival; therefore, officers were unable November 2022 Police Department Report for October
to obtain a statement. One male was found to have a confirmed warrant out of OPD and was subsequently booked into the county jail.
• On October 8th, officers responded to a report of a male and female in a physical altercation possibly fighting over a child. The female left prior to the officers’ arrival. It was determined the child was safe and in the custody of the father. A witness reported both parties driving recklessly up and down the street with the child in the car.
• On October 11th, officers responded to a 911 call reporting an unresponsive male on the sidewalk in front of the Battered Beaver. Officers arrived on scene and made contact with the male who was conscious and breathing. It was determined the male was intoxicated and was released to a family member.
• On October 11th, dispatch received a call about a suspicious person at Circle K. The caller described the subject as a male sitting on a motorcycle in the parking lot and looking into windows. Officers responded and upon arrival made contact with the subject who was found to be on probation. A probation search revealed methamphetamine and drug paraphernalia on his person. The subject was arrested and booked into the county jail.
• On October 12th, officers responded to a report of a vehicle vs a parked vehicle.

Officers located the suspect vehicle and driver and performed field sobriety testing which determined the driver to be under the influence. Officers located a large amount of Xanax, cash in multiple dominations, and other paraphernalia indicative of drug sales. The suspect was arrested on multiple charges and was booked in county jail.
• On October 12th, officers initiated a traffic stop for vehicle code violations. The driver was identified via Mexico driver’s license and was found to have a confirmed felony no bail warrant out of Santa Clara County. The subject was subsequently arrested and transported to county jail for positive identification and booked on his felony warrant.
• On October 13th, officers conducted a traffic stop for vehicle code violations. During the traffic stop officers located 29.7 grams of powder cocaine and 3.4 grams of crack cocaine. The driver and passenger were both arrested and booked into county jail on various drug charges.
• On October 14th, officers responded to Cottles Wood Park for a report of a subject unconscious and hanging out of a vehicle. Upon arrival, officers located the subject who appeared to be suffering from an opioid overdose. Officers administered Narcan and the subject was transported to the hospital via ambulance for further medical treatment.
• On October 15th, officers responded to Jerry’s Motel to investigate an assault with a deadly weapon that had just occurred. After further investigation, the suspect was positively identified and a Ramey warrant was issued for the suspect’s arrest.

Officers conducted surveillance and located the suspect’s vehicle in the driveway of a residence. Officers, along with assistance from deputies with the Stanislaus County Sheriff’s Office and their drone, conducted a surround and call out of the residence. The suspect exited the residence and was taken into custody by officers without incident. The weapon was recovered and the suspect subsequently November 2022 Police Department Report for October
confessed to the crime. The suspect was booked into county jail for assault with a deadly weapon and criminal threats.
• On October 19th, dispatch received a call reporting several males fighting. Officers responded and located an intoxicated male bleeding from the mouth. The male was intoxicated to the point he could not care for himself. It was later determined the male had his wisdom teeth removed earlier in the day. The male reported no crimes committed against him and neighbors reported he was the issue. The male was transported to a local hospital for medical clearance prior to being booked into county jail for disorderly conduct and resisting officers. The subject also made threats to officers during the process.
• On October 22nd, dispatch received a report of a traffic collision at West F Street and Wood Avenue. Officers arrived on the scene and located two involved vehicles.

It was determined the responsible was an 18-year-old female who was subsequently arrested for felony DUI. The driver and passenger of the other vehicle were both transported to a local hospital for non-life-threatening injuries. • On October 27th, dispatch received a call reporting a male subject riding a skateboard across the bridge with what appeared to be a rifle slung over his shoulder. Responding officers made contact with the subject on the bridge and determined the item to be a BB gun, not a rifle. The subject was arrested and issued a citation for being in possession of an imitation firearm. The BB gun was booked into evidence.
• On October 28th, 911 dispatch received a call of a subject rambling and then hung up on dispatchers. After further investigation, it was revealed this was the 56th documented incident this year in which the subject had called and/or texted 911, not in need of emergency assistance. A case number was pulled documenting the incidents and a Ramey warrant will be written for misuse of 911.

SUPPORT SERVICES • Detectives are currently investigating or assisting in the investigation of several active cases. 4 cases were closed/resolved for the month of October. • Detectives conducted follow-up on a missing juvenile case. Detectives were able to locate a photograph of the juvenile and distributed it to patrol for BOL (be on the lookout). November 2022 Police Department Report for October
ONGOING:

Staff received the graffiti report for the month of October from the city’s TAG (Team-up Against Graffiti) coordinator Mike Hancock. Mr. Hancock reported there were a total of five incidents for the month of October, which is up from September’s incident rate of three, but the best quarterly rate this year at 14 incidents. Reported graffiti incident locations this month included the frequently tagged Ash Street tunnel, and the South 6th Avenue electrical box. A couple of road construction signs were also tagged as was a railroad box on East F Street. There were no gang-related graffiti incidents reported for the month of October and TAG is not aware of any open graffiti incidents at the end of October. Please note, graffiti occurring at the Community Park is now being reported to either TAG or to PD for reporting and abatement by Public Works. The details are now incorporated into the reporting for a more inclusive city-wide view. A map showing graffiti incidents is attached (Attachment C)
